MINUTES
November 13, 1989

CALL TO ORDER: The regular meeting of the Medinna City Council
was called to order at 7 3OPM by
Pro
Tem Messmer. The meeting was tape recorded.
ROLL CALL: Present: Councilmembers Goldstein, King,
Mathewson, Messmer and Langenbach
Absent: Reagan and Mayor Vail-Spinosa
City Staff Present: City Manager Dodge, City
Clerk Davis, Chief of Police Race, Public Works
Supervisor Hammerquist, Planning Consultant
Burke and City Attorney Wines
MINUTES OF PREVIOUS MEETINGS:
The minutes were amended as followed: 2nd paragraph from bottom,
first line, insert "of" between definition and voice. After
under, add "voice". 2nd line after animal is, insert "within 25
ft. of the responsible person". Last sentence of the same
paragraph after damage change "or" to read "when". 3rd page,
under City Managers Report, 2nd line, after increased, insert "to
the equivalent of,, fifty cents, etc. 4th page, under City
Manager Compensation, 1st line after Goldstein and, change
"himself" to read "he". 'i Idi'hI
Langenbach moved the minutes1be approved as amended, seconded by
Goldstein, passed.
Mayor Pro Tem Messmer asked the City Manager to explain the
schedule of the budget process for the audience.
The City Manager stated the Budget was given to
theCouncil
tonight, a workshop date needs to be set up within a
week will be opened to the public. The final hearing on the budget is
November 27th at 7:30 PM at a Special Council Meeting at the City
Hall where final action will be taken, ordinances adopting the
budget and levying taxes would also be presented.
AUDIENCE PARTICIPATION
Bob Metzer, 1035 88th Ave. NE, asked the City to consider
installing large compost bin for the residents to deposit their
leaves.
ACTION
Ord. No. 489 - An Ordinance amending Section 1(h) of Ordinance
N0.--JPT8 Relating to Pets in Public Parks.
Discussion followed.
Langenbach moved to adopt Ordinance No. 489 as amended, Mathewson
seconded, carried.

Ordinance_ No. 490 - Ordinance Amending Chapter 2.40 of the Medina
Municipal~Code Governing the Board of Park Commissioners and
Repealing Chapter 2.36 Governing the Design Commission
The City Manager reviewed the background clarifying the role of
the Park Board and to eliminate the overlap of the responsibili-
ties with the Design Commission.
King moved the adoption of Ord. No. 490 with one change in
paragraph B on page 2, 2nd line, insert "prior" consent....
Mathewson seconded.
After some discussion, King withdrew his motion, Mathewson
withdrew his second. Ord. No. 490 was tabled for the Dec.
meeting.
Ordinance No. 491 - Ordinance Amending Medina Code Section
12.0$.O6-i _TB'j Concerning Longitudinal Cuts.
Langenbach moved to adopt Ord. No 491, seconded by Mathewson.
Discussion followed.
Langenbach moved to amend the present motion to provide that the
City Manager be the only one allowed to waive the requirements
with the consent of the Council, and the waiver must be in
writing. King seconded, passed as amended.
Ordinance_ No. 481 - An Ordinance Establishing a Bicycle Lane in
the City of Medina on 84th Ave. NE between NE 12th and NE 24th.
The City Attorney reviewed the proposed ordinance.
_ King moved to adopt Ordinance No. 481, with the correction of
"westerly" boundary NE and change dates in two places to 1989.
Goldstein seconded.
Discussion followed.
Messmer stated when the City moved forward with this interim
striping, we discussed the fact that it would be a bike lane and
that it is adequate in terms of width and striping. "His
recommendation was to approve the ordinance. Messmer moved to
amend Section 2, changing "Path" to "Lane", line 1, after person
insert "other than public transit operators".
Messmer explained to the audience that the plan between Medina
and Clyde Hill which had been agreed upon, but was not
implemented, had the bike lane on the east Clyde Hill side. One
lane of traffic going southbound on Medina side, and one lane
northbound between 12th and 24th.
King moved to adopt Ordinance No. 481 as amended, Goldstein
seconded, passed. Langenbach voting naye.
Revision of Permit Processing Fees
The City Planner was present and reviewed his report on the
permit Fee Structure.
Discussion followed.
The Council concurred to increase the Tree Trimming/ROW fee from
$20 to $50.

The City Planner was requested to come back next month with a
definition of when specific consultant costs would be charged.
DISCUSSION
Clarification _of_Provisions of _Sign _Ordinance
The City Planner reviewed the reason for their clarification is
_ the Chevron Service Station has be-" pur_ch-, d by BP (British
Petroleum) and the Chevron sign was removed and the new sign will
replace it.
Jerry Kirk, 841 NE 12th, owner of the station, and Joe Cordell
representative from PB were present to answer any questions the
council may have.
The two faced sign being requested is 4 ft. wide and 8 ft. tall.
The City Planner felt the size of the sign requested is a little
too large for that particular area. His interpretation of the
Ordinance is the station is allowed 2 signs, 24 sq. ft. each.
If they put on a 2-sided sign at that corner, facing both ways,
it would be considered as 2 signs.
Discussion followed.
1. The council had no consensus on how to interpret the
provisions of the ordinance.
2. It was noted that the sign request would go to the Planning
Commission at its Nov. meeting.

3. Any recommendations to4the ordinance by the PC would go back
to the Council.
Real Estate Signs
Mayor Pro Tem Messmer stated there was a provision in the Sign
Ordinance outlawing temporary sandwich board type real estate
signs. He made reference to a letter from Seattle -King county
Association of Realtors asking the Council to reconsider that.
David Crowell, Seattle -King County Association of Realtors, 2810
Eastlake Ave. E., Seattle, WA 98122, spoke on behalf of his
letter.
Several realtors and residents were present and spoke on this
issue.
The consensus of the Council was to consider a small for sale
sign used only for private lanes as a second sign, but no change
in A -frame signs.
The City Attorney was requested to draft a proposed amendment to
the ordinance for the next meeting.
Key Boxes
David Crowell stated that the Realtors Association converted to
new key boxes about a year and a half ago. The new key boxes
have a recording device, each realtor has a special code to get
into the key box. That code # is recorded on a foil strip inside
the key box each time it is used. Each realtor has his/her own
code.

The Chief was asked his feelings on key boxes on homes. He
stated from basic knowledge and experience, if a person wants to
break into a house he would do it with or without a key box.
Read moved to approve the ordinance to permit key boxes,
Goldstein seconded.
Read moved to repeal the ordinance in so far as it prohibits lock
boxes seconded by Goldstein, passed. Mathewson opposed.
The City Attorney will have a revised ordinance for the next
meeting.
REPORTS
City Manager's Report
Clear Vision Ordinance
The City Manager asked if this was an issue for the Joint Land
and Tree Review Committee to consider.
The City Manager was requested to take an inventory of the number
of properties that are affected by obstruction at intersections
and come back with a report for the council at the next meeting.
Solid Waste
The City Manager stated that the Solid Waste Coordinator will
have a report bringing the Council up to date on our recycling
program.
The City Manager made reference to the public having access to
ordinances. He stated that some cities have two readings of
_ ordinances, basically they would not be officially acted upon at
the first meeting, unless it was an emergency, which means the
ordinance will be on the agenda twice before they were adopted.
That left a 30 day period after it was on the agenda before it
was formally adopted so that any resident can come down to get a
copy of the ordinance.
Police Chiefs Report
Accepted as presented.
Public Works Report
Hammerquist's Public Works Status Report was accepted as
submitted.
The Council thanked Mrs. Valerie Holland for her assistance in
the plastic receptacles for dog droppings.
Treasurer's Report
Accepted as submitted.
NEW ,BUSINESS
—.essmer introduced and welcomed Tom Hull and Michael Anderson,
the two new councilpersons elect, who were in the audience.
Tuesday, November 21st at 7:00 PM was set for the Council
Workshop.
Monday, November 27th at 7:30 PM was set for the final Budget
Hearing.

Claims Warrant
Goldstein moved Claims Warrant # 2568-2661 and Payroll Warrant #
10673-10744 be accepted as paid, seconded by Langenbach, passed.
Adjournment
The meeting was adjourned at 11:20 PM.
