Road -------------------------------------------------------------------------- CALL TO ORDER: The regular meeting of the Medina City Council was called to order at 8:00 PM by Mayor King. The meeting was tape recorded. ROLL CALL: Present: Councilmembers Dietrich, Messmer, Val]-Spinosa, Yoler and Mayor King. Absent: Goldstein and Reagan Staff Present: City Manager Dodge, City Clerk Davis, Lt. Wilson, Public Works Superintendent Hammerquist, City Attorney Wines and Building Official Erickson. MINUTES OF PREVIOUS MEETING: Val]-Spinosa moved to approve the minutes as presented, seconded by Dietrich, passed. DISCUSSION Mayor King called for audience participation. Tom McGrath, 8315 Overlake Dr. W., spoke in reference to a variance that was applied for by the neighbors to the north. He also displayed an exhibit de- picting what is being proposed for the redevelopment of the lot next door to him. The neighboring homes are sited much farther from the water than what the applicant proposes, and are built on a much more moderate scale. The applicants propose a 34 foot high house, Mr. McGrath's home is 21 feet high and the adjacent portion of the house to the south is 19 feet. At 35 feet, the proposed house would be 27 feet above the McGrath's kitchen and living room deck. The ordinance which now exists on the City's books permits this lot to be developed with the building 30 feet from the water and 36 feet high. Mr. McGrath asked the City Council to amend the ordinance so this would not happen in the future. Mayor King said it was an appropriate time to look at our ordinance and also asked the Council to suggest to our Planning Consultant to review Medina's regu- lation compared to other waterfront communities and advise the Council if our regulations are adequate. The Council suggested expanding this study to any property not just view property. After lengthy discussion, Mayor King asked Building Official Erickson where the property line is determined on waterfront property. Erickson stated as the ordinance reads it is 30 feet from the original line of the bulkhead. It is not necessarily the property line as it was surveyed. It would have been the prop- erty line after the lake was lowered. The Council would like the Planning Consultant to look at this as it relates to that particular property being discussed, and other situations where a building is proposed considerably out of line with views and give the Council an evaluation. ACTION ITEMS Ordinance No. 457 - Regulating tree removal and maintenance in the City right-of- way. Ordinance No. 458 - Pertaininq to Nuisances. Ordinance No. 459 - Adopting sight visibility standards for street intersections. Vall-Spinosa moved adoption of Ordinance Nos. 457, 458, 459. Dietrich seconded. After a lengthy discussion on Ordinance No. 457, Mayor King recommended amending Section 9-7.12. Landscaping Requirements: Sub section B to read: Only grass gravel, mulching median, or ground cover or other low growing foliage under 18" in average height is installed in the area within 8' from the edge of any improved road, land, path or sidewalk. Yoler seconded. Medina City Council Minutes, October 12, 1987 Page Two Discussion of planting in the City rights -of -way followed. City Manager Dodge clarified that the City always has required a permit to do anything in the right- of-way, and that the City Manager is authorized to issue a permit for planting in the rights -of -way. The City Council has to issue a right-of-way license to build structures. This ordinance allows residents to apply for a permit at no cost to them, and allows the City to review what residents are doing in the rights -of -way. Mayor King amended his amendment to place a period after the word "road" at the end of paragraph B, and also at the end of the word "road" at the end of para- graph C. Seconded by Yoler, passed with Messmer voting "no". Mayor King asked for audience participation. Dick Willard, 8404 Midland Road questioned Section 9-7.10 and 9-7.14. The City Manager explained that if one property owner wanted a tree removed on another property owner's abutting right-of-way, he would have to have that person's permission. That is a major change from our present ordinance. Mr. Willard is quite concerned about trees growing to a height that would block views. Vall-Spinosa withdrew his motion for approval of all 3 ordinances. Dietrich with- drew his second to the motion. Vall-Spinosa then moved to adopt Ordinances Nos. 458 and 459 and table Ordinance No. 457 to next month's meeting. Dietrich seconded. Messmer moved to amend Section 1 of Ordinance No. 458, 10-9.04 Type of Nuisances: Section B, 2nd line, insert after destroy "or to substantially" impair, etc. Motion carried, Dietrich opposed. Val]-Spinosa and Messmer volunteered to work with the City Manager in the rewording and condensing the tree ordinance to a more concise form and easier reading for the next Council meeting. Award for City Hall Remodel Lowell Erickson, Architect for the City Hall remodeling, was present. He stated that bids were postponed one week to allow the bidders sufficient time to research and bid the project. Mr. Erickson explained the scope of the remodel project and emphasized that substantially more structural work, specifically shear wall work and extra footing work beyond that anticipated by the preliminary plans and esti- mates. The configuration and appearance of the finished space was reviewed for the Council, particularly the main council room where beams will now break up the ceiling into coffered sections and posts will be detailed into the wall and center of the room for support of the mezzanine office expansion. The preliminary color scheme was described to the Council with the carpet selected. Objections were registered by some councilmembers to the plastic laminate colors selected. It was reiterated that these were preliminary colors and that final selection would be made after award of contract. The Council expressed a desire to maintain the period feel of the building and use true divided lights for any replacement sash on the main floor. N.E. loth Street Project Vall-Spinosa moved to accept the N.E. loth Street project, seconded by Messmer, passed unanimously. City Manager's Report Authorization for the City Manager to sign "Agreement For Community Development Block Grant Funds." Vall-Spinosa moved to authorize the City Manager to execute the Agreement with King County for HUD grant funds as presented, seconded by Dietrich, passed un- animously. Special Council Meeting Messmer moved to set a special meeting for 5:00 PM Tuesday, October 20, 1987 at Medina City Council Minutes, October 12, 1987 Page Three City Hall to consider acceptance of bids on the City Hall remodel. Dietrich seconded, passed unanimously. Director of Public Safety's Report - Lt. Wilson - Accepted as presented. Financial Report - Accepted as presented. Claims Warrant Vall-Spinosa moved to adopt Claims Warrant 3497 to 3611, seconded by Yoler, carried. The Council complimented the City Manager on the Medina Park Project.
