Road -------------------------------------------------------------------------------- CALL TO ORDER: The regular meeting of Medina City Council was called to order at 8:00 PM by Mayor Pro Tem Dietrich. The meeting was tape recorded. ROLL CALL: Present: Mayor Pro Tem Dietrich, Councilmembers Goldstein, Messmer, Vall-Spinosa and Yoler. Absent: Mayor King and Councilmember Reagan Staff Present: City Manager Dodge, City Clerk Davis, Director of Public Safety Anglin, Public Works Supervisor Hammerquist, and City Attorney Wines MINUTES OF PREVIOUS MEETING: Val]-Spinosa moved to approve the minutes as pre- sented, seconded by Goldstein, passed unanimously. PUBLIC HEARING Ordinance No. 457 - Regulating tree removal and maintenance in the City right-of-way. The City Manager was asked to review the background on the Ordinance. He stated the ordinance was prepared to establish a policy giving the City authority to require maintenance of trees and shrubs in the right-of-way. He felt the main issue is whether we would allow the process for a resident to get permission to remove or trim a tree on the neighbor's right-of-way. The other issue is who is responsible for maintaining the City right-of-way. This ordinance would repeal all previous tree ordinances. City Attorney Wines presented the Council with a draft copy of the Tree Ordinance. This ordinance prohibits topping of trees except for emergen- cies and by utility companies. It excludes private lanes and anything other than actual street rights -of -way that belong to the City. Wines stated that the City Manager preferred to adopt the National Arbor- ist standards which try to preserve the natural shape of the tree. Discussion followed on what specific plantings would be allowed in the City right-of-way. The Public Hearing was opened to the audience for their comments. Herb Lyon, 8645 NE 7th asked if there would be a public hearing before adopting this ordinance. He also felt it should be published in the News- letter along with a statement of policy so the residents would be informed. Mayor Pro Tem Dietrich agreed we should have some guidelines and a list of trees that would be recommended. Fred Gerber, 418 Overlake Dr., asked the definition of the City right-of-way. The City Manager explained it is property owned by the public for street and accessory use. Ann McKay, 853 83rd Ave. NE, asked a question on height of hedges in the City right-of-way. The City Manager recommended nothing be planted on the right-of-way other than grass or gravel for the first 8 feet. Medina City Council Minutes, September 14, 1987 Page 2 The City Manager summarized the requests of the Council. 1. A list of trees recommended for planting. 2. An introductory paragraph as to the policy of intent. 3. Conditions for landscaping the right-of-way without a permit. DISCUSSION The audience was encouraged to discuss any particular issue not on the agenda. There was no participation. ACTION Ordinance No. 456 - An ordinance declaring a portion of NE 8th Street and 83rd Ave. NE to be one way streets. The City Manager explained that speed humps are longer than speed bumps and they are legal on public streets where speed bumps are not. He contacted Mercer Island's Engineer regarding speed humps. He was advised that the main use of speed humps is to divert traffic to another route. There is some problems with installing speed humps, drivers do not like them and tends to cause bad driving behavior like honking of horns or going around the humps and causing damage to properties. They are only recommended on streets that are flat. The City Manager and Director of Public Safety recommended 83rd Ave. NE be made a one way street. Mayor Pro Tem Dietrich made mention of the two letters received from Anne and Don McKay, 853 83rd Ave. NE, asking the Council to consider an alterna- tive plan to making 83rd Ave. NE a one way street. Discussion followed. Messmer moved to adopt Ordinance No. 456 with a request that the City Manager place the subject on the agenda for review in six months, seconded by Vall- Spinosa. Yoler and Goldstein opposed. Dietrich voted yes. The record shows there were 3 ayes and 2 nayes. Val]-Spinosa moved item 5 on the agenda be moved to item 2, passed. Ordinance No. 432 - An ordinance granting Puget Power and Light a rranchise greement. Ken Meek, Puget Power representative summarized the ordinance and answered questions. Mr. Meek was asked if the City could require lines to be placed underground. He explained that the Public Utility Commission has ruled that the cost of converting lines has to be paid by the benefiting property owners or the City. They can not charge that expense to other rate payers. It was also explained that Puget Power is asking for a 25 year franchise. Messmer moved to adopt Ordinance No. 432, seconded by Yoler, passed unani- mously. Ordinance No. 453 - Repealing Ordinance No. 118 and No. 210 establishing block and neighborhood density exceptions to minimum lot sizes. Vall-Spinosa moved the adoption of Ordinance 453, seconded by Messmer, passed unanimously. Ordinance No. 454 - Changing zoning regulations for recreational facilities. Goldstein asked if the lighting was subject to retroactive regulations. The answer was no. Medina City Council Minutes, September 14, 1987 Page 3 Vall-Spinosa moved the adoption of Ordinance No. 454, seconded by Yoler, passed unanimously. Ordinance No. 455 - Changing zoning regulations for conditional & special use permits. Vall-Spinosa moved the adoption of Ordinance No. 455 as corrected, page 2, paragraph 5-8.12, fourth line [recreational] should be [reefeat4ena4l. Seconded by Goldstein, passed unanimously. REPORTS City Manager's Report The City Hall plans for remodeling are ready for review. Bids will be ready for next month's Council meeting. Hopefully within a week or two of that date, they will start construction with a completion date of 3 months. During construction, we will hold the Council meetings either at Medina Elementary School or at St. Thomas Church. The City Manager recommended a Council retreat on October 10, 1987. October 8th at 6:00 PM was tentatively agreed on. He also discussed the budget cal- endar. October 28th was the date set for delivery of the preliminary 1988 Budget to the Council. The first hearing at the regular November 9th Council meeting. Final hearing and adoption of the 1988 Budget at a Special Council meeting on December 3, 1987. The City Manager asked the Council's approval to close down City Hall to clean out files and transfer to new filing cabinets on Thursday, September 24, 1987. The Council approved. Director of Public Safetv's Report - Anglin Accepted as presented. Financial Report Accepted as presented. Messmer commended the City for having the August report ready for the September meeting. OTHER BUSINESS Claims Warrant Goldstein moved Claims Warrant 3348 - 3496 be approved as paid, Vall-Spinosa seconded, passed unanimously. Medina Park Improvements The Council was very pleased with the park improvements that have been made. NEW BUSINESS Mayor King appointed Gary Eilers to fill the Park Board position vacated by Frank Pattison, with an expiration date of June 1, 1991. Gary Eiler is a long time resident of Medina and was highly recommended by Councilmember Goldstein. The City Council endorsed his appointment.
