Road -----•-------------------------------------------------------------------------------- CALL TO ORDER: The regular meeting of Medina City Council was called to order at 8:00 p.m. by Mayor King. The meeting was tape recorded. ROLL CALL: Present: Councilpersons Goldstein, Messmer, Reagan, Vall- Spinosa, Yoler, and Mayor King. Absent: Dietrich Staff Present: City Manager Dodge, City Clerk Davis, and City Attorney Wines. MINUTES OF PREVIOUS MEETING: Amendment to minutes were as follows: First page, second para- graph "Messmer moved" becomes third paragraph. Paragraph three "Meeting was opened" becomes second paragraph. Top of third page, item 2) delete comma after "skyrockets", add "&In�_ to change". Second paragraph under "Discussion". Line starting with "The R/V Ordinance will be discussion" should be "action" item. Vall-Spinosa made a motion to approve the minutes as amended, seconded by Messmer, carried unanimously. PUBLIC MEETING Ordinance on Bond Issue City Manager explained the Bond Issue is to retire the Bond Anticipation Notes and to finance the following: 1) Medina Park Pond drainage improvement. It involves draining and dredging ponds. Included will be storm drainage detention. 2) Storm drain line, 88th Avenue N.E. to Lake Washington 3) Storm drain line, 80th Avenue N.E. to Medina Park Ponds 4) Storm drain line, Overlake Drive to Lake Washington 5) City Hall project He said he compared the rates from 3 financial institutions and Peoples Bank had the best rates. They provided the funding on the Bond Anticipation Notes and Tax Anticipation Notes. He recommended Peoples Bank to the Council. City Manager also mentioned there was a Purchase Contract that the Council needs to approve allowing the Mayor to sign that agreement along with the Bond Ordinance. A few minor changes were made on the Ordinance before being approved. They were as follows: Page 5, sub paragraph (ii), second line, "88th Avenue Northwest" should read "80th Avenue Northeast". Sub -paragraph (iii) second line, "80th Avenue Northwest" should read "Northeast". Reagan made a motion to adopt Ordinance No. 451 as corrected, and allowing the Mayor to sign the Purchase Contract. Goldstein seconded, passed unanimously. Discussion followed. Jim Greenfield, Bond Counsel, and David Sitterson, Assistant Vice President of Public Finance for Peoples Bank were present to answer any questions. Medina City Council Minutes, May 11, 1987 R/V Parking Ordinance Page 2 Anglin, Director of Public Safety, gave some background on how he, Councilmembers Reagan and Messmer studied various ordinances from different cities and determined the wording for this ordinance. They also discussed the definition of a recrea- tional vehicle. Vall-Spinosa made a motion to adopt Ordinance 449, Messmer seconded. Discussion followed as to what vehicles would be considered as a recreational vehicle. Anglin received many calls asking exactly what a recreational vehicle was, which made him feel the ordinance was not clear. Storage and screening were also a concern. The following residents were present with objections to the ordinance and felt it was an infringement on their rights as a homeowner. Henry Ovens, 2200 78th N.E. Tim Johnson, 8060 N.E. 8th Fred Folden, 8105 N.E. 8th After a lengthy discussion from both Council and audience, it was agreed that more research on how other cities in the country dealt with recreational vehicle parking. The City Manager added that the International City Managers Association has a research library on different ordinances and he could request some material to see how other cities across the nation deal with some of the issues that were raised tonight. Reagan moved to table the ordinance until more information could be obtained, Yoler seconded, passed unanimously. Annexation - Ordinance No. 450 Wines, City Attorney, gave his report on the Ordinance. The King County Boundary Review Board wants the City to submit a resolution of intent to annex. The Board wants to do their review and determine it is exempt from their review before the ordinance is passed. Wines explained this procedure rescinding the prior ordinance of annexation passes a resolution setting forth the intent to annex this property. Reagan made a motion to pass Ordinance No. 450, Vall-Spinosa seconded, passed unanimously. Resolution No. 184 Intent to annex certain real property to the City of Medina pursuant to the petition method. Vall-Spinosa moved to adopt Resolution No. 184, Reagan seconded, passed unanimously. Right -of -Way License - 77th Avenue N.E. The City Manager said he received a letter from the Bellevue Fire Department that outlines what is required by Mr. Cahill and a turn -around for a fire truck is not required. City Manager called the Assistant Fire Marshall to confirm that and why they came to that decision. They felt that the Fire Department could back up the fire truck on a 16 foot lane. Discussion followed. Harvey Molitor, 2615 78th N.E. stated he had no objections but recommended they should stay to the 16 foot lane. Bridgette Kershen, Lot 6, wanted to know whose responsibility it was to maintain that right of way once a house was built. Dennis Reilly, 2750 Evergreen Pt. Rd. was not in favor of improving the jogging trail. Medina City Council Minutes, May 11, 1987 Page 3 Messmer made a motion to approve the granting of a right-of-way license subject to the conditions that were set forth in the City Manager's memo to the Council dated March 26, 1987, with the exception that the driveway width be 12 feet instead of 16 feet. Messmer restated those conditions: 1. The drive be designed so it can be easily extended to provide access to the adjacent property immediately to the south and that they be willing to incorporate a fire vehicle turn around by Bellevue Fire Department, if needed. 2. There be crushed rock jogging trail with a wooden border. 3. There be adequate drainage plans. 4. That the City Manager would have the final review of the plans before it was built. Reagan seconded, passed unanimously. Maple Trees on N.E. 7th - Dean Messmer Messmer distributed his report to the Council plus a list of trees and their status. He contacted the Aboretum Foundation and was referred to Brian Mulligan, who works with them and does some private consulting. Mr. Mulligan came out and viewed the trees with Messmer on April 28th. His basic conclusion was that, although the trees are older and do have some weaknesses, with some care there isn't any reason why they couldn't be around for another 20 to 25 years. There are some dead limbs in most of the trees which should be removed. Mr. Mulligan recommended the work be done by an established company with experience caring for large trees and also recommended Davey Tree and Washington Tree Service as two good candidates. Messmer called them both and requested bids for the work to be done. Assuming there is an agreement that trimming work need s to be done, several issues are presented. Who should pay for the cost of the work, and is a permit needed under our tree -trimming ordinance and what procedure should be followed. Discussion followed. City Manager said he would like some clear policy direction before anything is settled. If a policy decision is made, we need to decide if the City is going to take responsibility for any tree that comes to our attention that is dangerous. In the case of these maple trees, would we just trim out the dead branches? Many more questions were brought up. Reference was made to a letter received from Carol A. Rivkin, 8452 N.E. 7th, showing her concern about the maple trees that line both sides of N.E. 7th and she is par- ticularly concerned about the tree located on the east side of the right of way at the above address. Council felt the Tree Ordinance should be studied further. City Manager's Report Hazardous Waste City Manager reported that the State has a law that requires the City to have a hazardous material plan that identifies all hazardous material. A training/procedure manual for employees and postings in all locations where we have hazardous material is also required, along with a data sheet displayed where the poison centers are, tele- phone numbers and different anecdotes. The City Manager stated he wants a consultant to prepare the plan. Messmer moved to endorse the City Manager's proposal. Goldstein seconded, passed unanimously. SR520 Evergreen Bridge Fountains The City Manager informed the Council that Clyde Hill passed a resolution supporting SR520 fountains. Medina City Council Minutes, May 11, 1987 Library Service Page 4 City Manager gave a brief report. Mayor King also gave a report on the formula the library uses to compute Medina's fee. There wasn't any encouragement in getting a new formula. King suggested a reimbursement program for the residents who have paid $50 for a library card. City Manager was requested to put an article in the newsletter informing the residents to submit a copy of their receipt of $50 from the library to the City for reimbursement. The City Manager will be talking to the library director to negotiate next year's contract. Messmer made a motion to authorize the City Manager to reimburse residents for one library card in the amount of $50 per household up to a maximum expenditure of $10,000. Reagan seconded, passed. Director of Public Safety's Report - Accepted as submitted. Financial Report - Accepted as submitted. OTHER BUSINESS Goldstein moved to accept as payment Claims Warrant No. 2789 - 2847, Yoler seconded, passed unanimously.
