REGULAR MEETING
MINUTES
April 13, 1987

CALL TO ORDER: The regular meeting of Medina City Council was called
to order at 8:00 p.-m. by Dietrich, Mayor pro-tem. The
meeting was tape recorded.
ROLL CALL: Present: Councilpersons Dietrich, Messmer, Reagan, Vall-
Spinosa, and Yoler.
Absent: Goldstein and King.
Staff Present: City Manager Dodge, City Clerk Davis,
and City Attorney Wines.
MINUTES OF PREVIOUS
MEETING: Amendment to page 4, second line under heading "Drainage
Study","Caculator and", should read "calculations of drain-
age basins." Page 1, last line of paragraph 3, "resolutions"
should read "Ordinance".
Val]-Spinosa moved to adopt the March 9, 1987 minutes as
amended, seconded by Dietrich, passed.
City Manager Dodge introduced newly hired secretary, Marcy
Tarabochia.
Dodge also noted for the record that Councilperson Goldstein
would not be at the meeting tonight.
PUBLIC HEARINGS
ANNEXATION OF PROPERTIES ON NE 11 AND 88TH AVE. NE
City Attorney, Kirk Wines, gave a brief background on the annexation of the above
properties.

Messmer moved the adoption of Ordinance No. 447 - Annexation of properties on
N.E. 11 and 88th Ave- N.E. Yoler seconded, passed unanimously.
Meeting was opened to the public. R.L. Metzler - 1035 88th Ave. N.E. spoke.
He stated at the time the petition for annexation was made, they did not have
the presence of all the property owners and asked if the City had heard from
them and were there any objections. City Manager said there were none.
RESOLUTION SUPPORTING SR520 BRIDGE FOUNTAINS
City Manager said the proposal was generated at the Park Board. Some members
felt the fountains were an attractive addition to the bridge and they wanted
the State to consider reactivating the fountains. The City was contacted by
a State Senator that said he would support our request if we had a resolution.
Therefore, the Park Board has submitted the Resolution.
Vall-Spinosa moved to adopt Resolution No. 183, seconded by Messmer. Passed
unanimously.
It was requested that the City send copies of the Resolution to the neighboring
town and cities.
RIGHT OF WAY LICENSE REQUEST - UNOPENED PORTION OF 77 N.E.
This Right of Way request was tabled from the March meeting.
City Manager gave a short report.

The applicant, Reed Cahill, 9105 N.E. 1st, was present on behalf of his
request. fie was open to whatever direction the Council could give him.
Messmer asked the City Attorney, assuming we did grant the applicant
a license, does the City retain the right to improve the street or what-
ever needs to be done? Wines explained that right of way licenses are
revocable and temporary and the City would retain the right to come
through and improve that street. Before approving the license, you could
have the owner of Lot 2, provide a drive and a turnaround that would also
service Lot 3 so there wouldn't be two fire turnarounds on the same drive-
way.
City Engineer, Mike Jauhola, was present. He said Bellevue Fire Department
has specific standards. The Fire Marshall's office reviews all turnarounds
individually in the City of Medina. He will accept less than the 60' re-
quirement depending on circumstances. Sometimes the turnarounds encom-
passes a portion of the driveway on private properties. He will evaluate
property lines individually and requirements aren't as stringent as in the
standard codes. He will make allowances for the slope and topography on
the property.
After more discussion, it was determined that the license be tabled to the
May meeting.
RIGHT OF WAY LICENSE - GROAT PT. DRIVE
Mike Drobot, applicant, was present and gave some background for his request
to reconstruct the existing cul-de-sac in front of his home.
The main purpose for this request is privacy and security. The traffic has
increased each day. Mr. Drobot said if he were granted this license, he will
develop and maintain it at his expense.
Reagan moved to approve the license. He then withdrew his motion temporarily
for further discussion by the Council.
Vassos Demetriou, owner of Lot 1, was supportive of Drobot's request.
Jauhola brought up the issue of the turnaround, catch basins, drainage, etc.
Mr. Drobot does have written approval from the Fire Marshall for the turn-
around.
Reagan moved that the Right -of -Way request be approved as indicated by Scheme
B (on file) providing that he provides the City Manager with written approval
of the Fire Marshall and that the changes and alterations be approved by the
City Engineer and City Manager with respect to utilities, etc., and that
construction be paid for by Mr. Drobot as he indicated.
Vall-Spinosa seconded, carried unanimously.
The Right -of -Way License was granted with the entire scope of the work being
paid for by Mike Drobot, the applicant.
FIREWORKS ORDINANCE NO. 448
Fireworks Ordinance was tabled at the last meeting pending a State Legislative
decision. Wines said the bill never came out of the Committee so it will not
be passed in this session.
There are conflicting opinions as to whether or not a local municipality may
pass an ordinance which is more restrictive than state law. There is nothing
preventing us to go ahead and pass the restrictions that were discussed by the
Council at the previous meeting which is to limit fireworks between 9:00 a.m.
and 10:00 p.m. on the 4th of July and to prohibit fireworks which discharge
more than 8 ft. above the ground from anywhere within 200 ft. of any building
or residence or wooded area and not allowing any ignition on City streets,
right of way or parks, etc.

Henry Ovens, 2200 87th N.E., spoke in favor of the ordinance. After lengthy
discussion by the Council, Messmer moved to adopt Ordinance No. 448 with the
following changes:
1) Section 2, change the permissible times to read 8:00 a.m. to 12:00
p.m. on the 4th of July.
2) Changing the printed language of Section 4 to delete the reference to
skyrockets, to change 200 ft. to 100 ft. At the end of that sentence,
change period to comma and add the phrase "or in any other area where
such fireworks cannot be safely ignited,' and delete the last sentence.
Vall-Spinosa seconded, carried unanimously.

R/V PARKING REGULATIONS - MESSMER, REAGAN
Messmer clarified the language of what an R/V was. They should not be parked
in the City right of way or within the 30 ft. yard setback. They should be
screened from view of the street and should not be used as living, sleeping
or housekeeping purposes except to the extent provided in Ordinance No. 65.
Reagan concurred with Messmer.
The R/V Ordinance will be a discussion item for the May meeting.
MAPLE TREES ON N.E. 7TH - MESSMER
Preservation of the maple trees on N.E. 7th is his main concern. There is still
some investigating that needs to be done on whether the trees can be saved and
the expense of that project. Messmer will report back later.
AWC CONFERENCE
Dodge encouraged the Council to attend this conference - June 17, 18 and 19th.
He felt it would be very beneficial.
BOND ISSUANCE
City Manager reviewed his report as submitted to the Council.
$154,000 - Bond Anticipation Note repayment

$100,000 - Pond renovation and retention
$200,000 - City Hall remodel
$ 86,000 - Miscellaneous storm improvements

Discussion followed. This will be an action item in May.
Construction project at 801 Evergreen Pt. Rd. was discussed.

LIBRARY SERVICE
City Manager gave a brief run aown on the library issue. He is now waiting
for a reply from the Director of the Library system on questions that were
brought up at their last meeting.
City Manager discussed a letter received from Norton Clapp, Evergreen Pt. Rd.,
on a few hazards in the city relating to jogger and motor vehicles not having
a clear view at the intersections which are accentuated by plantings on cor-
ners and power poles.

OTHER BUSINESS
Vall-Spinosa made a motion to adopt Claim Warrants 5253-5300 and 2701-2788,
Messmer seconded, carried.
Vall Spinosa moved to adjourn the meeting at 10:40 p.m., seconded by
Messmer, carried unanimously.
