REGULAR MEETING
MINUTES
March 9, 1987 Medina City Hall

CALL TO ORDER: The regular meeting of Medina City Council was
called to order at 8:00 p.m. by Mayor King. The
meeting was tape recorded.
ROLL CALL: Present: Councilpersons Dietrich, Goldstein,
Messmer, Val]-Spinosa, Yoler, and Mayor King.
Absent: Reagan. Staff present: City Manager
Dodge, City Clerk Davis, Director of Public
Safety Anglin, and City Attorney Wines.
MINUTES OF PREVIOUS
MEETING: Amendment to the second page 2, 3rd paragraph,
second line: Dave "Mortin" should read Dave
"Martin"; 4th paragraph, second line: Procedural
"happenings" should read procedural "alternatives".
Messmer moved to adopt the March 9, 1987, minutes
with those two amendments, seconded by Dietrich,
passed.
PUBLIC HEARINGS
Mayor King made mention of one of the goals City Council set this year
was to get together with our neighbors and have an informal joint Council
meeting with members of Clyde Hill Town Council. Everyone is invited,
audience as well as Council members.
ANNEXATION OF PROPERTIES ON N.E. llth AND 87th AVENUE N.E.
City Manager Dodge said the City had received a petition signed by the
majority of the residents indicating they wished to be annexed into the
City of Medina. He asked City Attorney Wines to review the procedures
and what needs to be done.
Wines said we are proceeding under what is known as the direct petition
method. He said we received a notice of intent from the property owners
saying they would like to annex to the City of Medina. At this meeting
we should decide 1) whether they will be required to assume all or any
portion of the City's outstanding indebtedness as of the time of annexation,
and 2) whether the City wants to propose any special zoning for that area,
or whether the City wants to take it in under current R-20 zoning. The
Council needs to make a decision on those two items which needs to be
recorded in the minutes and the decision will be incorporated into the
4,L/ formal petition of annexation so that the owners of the property involved
will know what the ground rules are. If 75% of the owners sign the formal
N petition, and if Council approves it by resolution, it will become effective.
The City Manager gave a little background on the financial situation. We do
not have any outstanding bonded indebtedness. The only indebtedness that we
do have at this point in time is some bond anticipation notes that we have
set aside our regular property tax revenue to cover. There is no additional
indebtedness other than our normal day to day obligations.
Director of Public Safety Anglin also gave some background on this area.
He said the County could not respond to this area in a timely manner so they
asked the City to service this area without compensation. As a policy, the
police department serviced the area and provided crime prevention service.

Mayor King added that he had spoken to Councilman Bill Reams. This area
falls in his district and he supports annexation of that area to Medina
and that it would be to their advantage.
Discussion followed. Mayor King informed these residents that they would
be welcomed as residents to the City of Medina.
Public Hearing was then closed.
_ Vall-Spinosa moved to resolve to commence annexation proceeding of those
properties contained in the proposed area of annexation that is described
in the notice of intent. They are required to assume all City indebtedness
upon annexation. Yoler seconded. Carried.
Wines reviewed the issue of zoning.
Messmer moved that at such time as this property is annexed into the City
it be designated to be within the R-16 zone. Yoler seconded.
Wines indicated changing the zoning would delay the annexation.
Lloyd Reed, 8703 N.E. 11th, resident of the annexation, asked for a clari-
fication of R-16 and R-20 zoning. Mayor King explained the difference.
Messmer withdrew his motion with no objection from Yoler.
Dietrich motioned that we bring in the proposed property annexation under
the normal zoning ordinance that we have in the City of Medina, which is
20,000 square feet. Seconded by Val]-Spinosa.
Messmer wanted to indicate for the record that the residents should be
aware that once they are annexed they can make a request for a change in
that zoning.
Motion carried unanimously.
Wines said he would like the Council to approve the form of petition, which
is before you, and suggested they appoint Pat Dodge as the Council repre-
sentative to receive this petition and to approve it pursuant to statutory
guidelines which are set forth for verification of signatures and ownership.
Also authorize him to schedule a public hearing on the petition after it has
been received and approved.

FIREWORKS REGULATIONS
Anglin spoke on the Fireworks Ordinance. There is a bill pending in the
Senate which will require all cities to strictly follow the state regulations
and the City Attorney suggested we wait until the Senate makes their decision.
We still have sufficient time to do so.
Wines stated that the bill in the Senate will probably reduce the City's
power to restrict fireworks.
Mayor King opened the meeting to the public. No response.
Vall-Spinosa moved to table the Fireworks Ordinance to a later date based on
what happens at the State level. Messmer seconded, carried unanimously.

ACTION
RIGHT-OF-WAY LICENSE
David Cahill requested a right-of-way license to construct a driveway on
the unopened portion of 77th Avenue.
The City Manager gave some background on the Indian Trail and adjoining
properties. Discussion followed.
Messmer asked Wines what obligation does the City have to grant access to
lots that butt onto unopened streets.
His answer was that the person who buys on an unopened street has a right
of access, under our codes as they are now, unless that person acquires a
license from the Council, the person's option is to put in a road to City's
specifications.
More discussion.
David Cahill explained his position. He has tied this lot up on earnest
money, and is considering building a house. Part of his process is to
determine whether he can afford to put a house on the property. He would
like to know what the City's approach is so he can make a decision.
The Council would like Cahill to work with Dodge and his neighbors and
come up with a more concrete plan before a license can be granted.
ENGINEERING TECHNICIAN POSITION
The City Manager gave his report on the new position and goals we will be
striving for.
Mike Jauhola, City Engineer, was present and asked for his thoughts on the
position. He said he supports Dodge wholeheartedly and the position would
be cost effective. Many times he or someone from his staff comes out on a
job when they really need not be there. We are large enough now to support
an individual. He could handle many of the permits for the City without
having to call on Gray & Osborne.
Qualifications for this position were discussed, also Jauhola brought up
the subject of catch basins all over the City that need to be inventoried.
Messmer moved to authorize the City Manager to hire a person to fill the
Engineering Tech position described on the job description. Yoler seconded.
Passed.
Messmer moved to amend the pending motion to indicate that the base salary
offered would not exceed $30,000 a year. Goldstein seconded. Passed.
Dietrich opposed.
PARK AND RIDE
Anglin gave his report on the Park & Ride as requested by the Council.
Dodge also added that they had posted some areas and there has been a
noticeable improvement.
Mayor King read a letter from E.S. Freer who strongly opposes closing the
Park & Ride.
Barry Scott, 7626 N.E. 8th, Ben Pelly, 1619 Evergreen Point Road, Kifn
Jaderholm, 7814 N.E. 8th, and Richard Malm, 911 - 87th Avenue N.E., also
spoke in opposition to closing the Park & Ride.

More discussion followed.
Bob Caldwell, State Department of Transportation, was present to address
this topic.
He had monitored the traffic and also felt that there are things that can
be done to solve some of the problems. He understood that there were two
problems. One was overflow parking and excess traffic throughout the area
created by the lot. One of his suggestions is recommending allowing access
to 520 at night, close lot at top and install an automatic power gate on a
time clock. There are about ten spaces that are not being used by DOT
maintenance vehicles, that can be stripped and used for additional parking
to accommodate the overflow parking.
DOT would work with the City of Medina. They do not want to see the lot
closed.
Anglin stated that Metro and off -duty King County Police officers had
asked for our assistance to patrol Metro lots because they were having a
fair amount of crime. They do not have the force to do an effective job.
Yoler would like to go on record saying she would not appreciate that lot
becoming any larger.
Question on the liability of the lot was discussed.
City Manager was asked for his recommendations and the effect the permits
have had on traffic in that area.
DRAINAGE STUDY
City Manager had asked Gray & Osborne to submit a proposal on doing a
drainage analysis. It would involve caculator and drainage basins,
potential flow and what size pipes we would need to handle certain storm
events. They would also have to map our drainage systems. If we have our
own engineering tech our cost will be greatly reduced because he could do
much of the leg work.
He also discussed the issuance of bonds this year to include some additional
money for drainage problems. The worst problems and their solution need to
be identified and included in our proposal so they can be taken care of this
summer. We need to get started immediately. Since the money had already
been allocated in the budget, the Council told him to go ahead with the
project.
DISCUSSION
84th AVENUE N.E. TRAFFIC REPORT
City Manager Dodge submitted his report to the Council. The proposal was to
make 84th Avenue N.E. one lane on Medina's side going South and two lanes
going North with the very right bound lane of traffic going on 520 only. That
leaves the left lane towards the center for Medina and Hunts Point residents
who want to go on through. Discussion followed.
Vall-Spinosa was designated to represent Medina on the traffic issue.

LIBRARY SERVICE
Mayor King gave the background on discontinuing the library services to
the audience. Messmer suggested something should be put in the newsletter
informing the residents on this issue. Discussion followed.
City Manager will negotiate with the Director of the Library system.
It will definitely be considered in next year's budget.
City Manager encouraged the Council to review the additional information
placed before them on the bonds to be taken care of in the next month or so.
REPORTS
FINANCIAL REPORT - Accepted as submitted.
DIRECTOR OF PUBLIC SAFETY'S REPORT - Accepted as submitted. Anglin passed
around the permit sticker for the Council's review.
OTHER BUSINESS
CLAIM WARRANTS
Goldstein moved Claim Warrants 5131-5252 be approved as submitted, Vall-
Spinosa seconded, carried.
Vall-Spinosa made a motion to adjourn the meeting to executive session at
12:00 am.
EXECUTIVE SESSION
Council came out of Executive Session at 12:45 pm.
The Meeting was adjourned at 12:45 pm.
