Road CALL TO ORDER: The regular meeting of the Medina City Council was called to order at 8:00 p.m. by Mayor King. The meeting was tape recorded. ROLL CALL: Present: Councilpersons Dietrich, Goldstein, Messmer, Reagan, Vall-Spinosa, Yoler and Mayor King. Staff present: City Manager Dodge, City Clerk Davis, Director of Public Safety Anglin and City Attorney Wines. MINUTES OF PREVIOUS MEETING: Amendment to Executive Session. Mayor King excused himself from the Executive Session. Vall-Spinosa moved to adopt the February 9, 1987 minutes with the amendment, seconded by Goldstein, passed. Director of Public Safety Anglin introduced Lt. Merle Wilson to the Council. ACTION ORDINANCE NO. 445 - AMENDING PARKING CODE Kirk Wines, City Attorney, explained the purpose of this ordinance is to raise the parking fines to $35.00. The fines had been set for $16 and the filing fees in District Court for $19. The City is losing $3 each time we file a parking ticket. The other thing it does is to make failure to appear to pay the fine, or failure to appear for a trial date a misdemeanor, otherwise there is no way of tracking these things on minor violations. In the case of failure to appear for speeding violations, the State will not renew your driver's license unless you have appeared or paid your fines for all offenses. Messmer made a motion to adopt Ordinance No. 445, seconded by Yoler, passed unanimously. ORDINANCE NO. 446 - HARBOR CODE VIOLATIONS Anglin explained a typical harbor violation is speeding too close to shore, docks, negligent boating, etc. If this ordinance is adopted, the Court issues a warrant of arrest for the violator at the minimum fee of $250 which is set by the State. There is then a warrant on file. If that person is stopped in an automobile or boat, when the officer runs a record check, the warrant will show up and an arrest will be made, then we have a way to collect our money. Dietrich moved to adopt Ordinance No. 446, seconded by Reagan, passed unanimously. DISCUSSION BLOCK/NEIGHBORHOOD DENSITY EXCEPTIONS Bob Burke, City Planning Consultant, was present on behalf of his report. He reviewed the ordinance as it is now. Based upon the fact that the density exception had not been used extensively over the past 7 - 8 years and they are not consistent with the objectives of the updated Comprehensive Plan, he recommended the City consider amending the zoning code text to delete these provisions. He suggested this question be referred to the Planning Commission for their consideration. Mayor King recommended referring this to the Planning Commission for consideration and return to the Council with their recommendation. John Runkel, 8810 N.E. 2nd P1., and Earl Johnson 8711 Ridge Road, spoke in favor of reviewing block and neighborhood density exception. Medina City Council Minutes, February 9, 1987 Page Two REPORT ON PARK & RIDE City Manager Dodge gave some background on the Park & Ride. On May 17, 1961, Bellevue School District deeded the Park & Ride property to the State of Washington. The agreement, which was signed by the previous City Manager Ed Pefferman, has the provision the City would maintain it. The agreement also has a provision that the State has to notify the City, 60 days notice, if they intend to close the lot, but does not give the City the option of having it closed. Before going further, he felt we should generate more data. A few things that should be done is to document some of the issues and problems associated with it so our State Representative would have some ammunition to go to the Department of Transportation. Dodge recommended the Police Department survey the license plates in the Park & Ride once a week for a month, document all problems associated with the lot such as speeding, litter, etc. The number of alternate Park & Ride lots in the area, and other pertinent information. Wilma Edmonds, 7721 N.E. 24th, Roger Barbee, 2895 Evergreen Pt. Road, Susie Marglin, 2623 Evergreen Pt. Road and Dave Mortin, 3205 Evergreen Pt. Road were present and had some input on the Park & Ride. More discussion followed. In summing up the discussion, Mayor King requested the City Manager add to the research some procedural happenings, where our strength is, and review it with the City Attorney. CREATING AN ENGINEERING TECHNICIAN POSITION Dodge reviewed his report. In having an Engineering Technician full time employed by the City would save a considerable amount of money and get more work accomplished. He said we do need the services of Gray & Osborne but not on day-to-day engineering problems. Gray & Osborne concurred with this. The Council would like more data on the Engineering Technician such as job descrip- tion and engineering costs for their review to justify this position. GRAY & OSBORNE DRAINAGE PROPOSAL Dodge referred to the proposal from Gray & Osborne on a storm drainage analysis and inventory for the City of Medina. Since Mike Jahoula, City Engineer, was not present for comment, it was postponed until next month's meeting. FIRE CONTRACT Dietrich brought the Council up-to-date on the Fire Contract. He noted a change to be made on page 2, second paragraph. The language is a little vague on how the future increases were to be portioned out and what those increases were going to be applied to. Dodge said the contract was submitted so as to give the Mayor permission to sign it once they receive the amended contract. Dietrich moved to give the Mayor authorization to sign the contract once it has been corrected, Yoler seconded, carried unanimously. The Council applauded Dietrich and Dodge for a job well done. Dodge wanted to give recognition to the former Mayor of Clyde Hill. He did an excellent job negotiating the contract and put a lot of work into this. Mayor King requested the City Manager write a letter for his signature thanking Dwane Richards for his leadership of the Fire Contract Committee, also thanks to the Clyde Hill Council. Medina City Council Minutes, February 9, 1987 Page Three REPORTS CITY MANAGER'S REPORT - TRAFFIC ANALYSES He did not receive the report from the Traffic Engineer from Tacoma who spent one day with him reviewing the City's concerns. He would submit his report and the Engineer's report to the Council as soon as he receives it. Dodge spoke a little on the City Hall remodeling and had the preliminary plans displayed for their review after the meeting. DIRECTOR OF PUBLIC SAFETY Accepted as presented. Council congratulated the Police Dept. for an excellent year. Anglin gave a short report on the progress of the parking permits. They should be available in two weeks. The size is 2" wide and 2-1/4" high and will be placed in the lower left hand side of the rear window. The street signs are on order. FINANCIAL REPORT - Accepted as submitted. FIREWORKS ORDINANCE Anglin submitted a report on "compiled Fireworks Statistics" which ninety-six fire departments responded. After reviewing available fireworks ordinances supplied by the Association of Washington Cities, he recommended an ordinance on fireworks limiting fireworks between 9:00 a.m. and 10:00 p.m. on July 4th. No aerial fire- works such as skyrockets, roman candles, etc. Margie Suskind, 3667 Fairweather Lane, was present and was not in favor of any fireworks. After some discussion, the consensus of the Council was to have an ordinance as an item for public hearing for next month's meeting. REPORT ON RECREATIONAL VEHICLE AND BOAT PARKING After reviewing a number of ordinances from other jurisdictions, Anglin recommended an ordinance which he felt would be best suited for our community. "No major recreational vehicle shall be parked or stored on any lot except in a side yard, backyard, or behind a building nearest the street provided it be screened from view from the street and adjacent property owners." Mayor King referred to a letter received from Tony Caruso, 2235 79th Ave. N.E. as wanting to go on record. He stated that parking a boat or R.V. is a right that a property owner should have but felt the area should be kept as clean as possible. After more discussion on the subject, Mayor King asked Messmer and Reagan to work with Anglin on preparing an ordinance on R.V. and parking. OTHER BUSINESS NEW BUSINESS Tree trimming in right of way was discussed. Dodge reviewed the ordinance regulating the trees. Messmer asked to be put on the agenda for next month's meeting and he will make a report on the maple trees in question on 7th St. and the cost of trimming. It was moved and seconded to adjourn the Executive Session. Regular meeting resumed at 11:01 p.m. Dietrich moved to adjourn the meeting, Messmer seconded, carried unanimously.
