Rd. --------------------------------------------------------------------------------- CALL TO ORDER: The regular meeting of the Medina City Council was called to order by Mayor King. The meeting was tape recorded. ROLL CALL: Present: Councilmembers Goldstein, Messmer, Reagan, Yoler, Dietrich, and Mayor King. Absent: Vall-Spinosa. Messmer excused at 10:47 p.m. Staff Present: City Manager Dodge, City Attorney Wines, Planner Burke, and City Clerk Wyatt MINUTES OF PREVIOUS MEETING: The June 9, 1986 minutes were approved on a motion by Messmer, seconded by Dietrich and carried. Dietrich moved to accept the minutes as written for April 14 which includes the paragraph previously discussed. Reagan seconded, motion carried. PUBLIC HEARINGS Planned Residential Unit Development_ Reagan moved to continue the Public Hearing to the August 11 meeting. Messmer seconded, motion carried. Medina Heights Study - Recommendations of the Planning Commission Mayor King gave a brief history of the Medina Heights Study. City Manager Dodge reviewed the recommendations of the Planning Commission. Planning Consultant Burke defined the original study area and described the initial recommendations of the Planning Commission. Anne Hamilton, 8431 Ridge Rd., representing the Study Group, read a letter. (Attachment 1) Mrs. Omar Mithun, 8425 Ridge Rd., read a letter. (Attachment 2) Paul Saad, 7644 N.E. 8th, spoke -- no view, agreed with recommendations of the Planning Commission as stated. Ken Pyle, 8416 Midland Rd., referred to a letter written by Mrs. Glass. He felt that the petitions represent an overwhelming desire to limit development. Robert Pare, Architect representing several clients, asked for more flexibility. Bob Lund, 8611 N.E. 7th, referred to an original plat of Medina Heights. Stated a substantial number are opposed to the 25 foot height provision. Didn't sign petition. Elora Erickson, 8439 Ridge Rd., urged rejection of Planning Commission proposal and adoption of Medina Heights proposal. (Attachment 3) Andy Taylor, 826 Evergreen Pt. Rd., is not in Medina Heights, no view. Wanted 2 ordinances on height. Earl Johnson, 8711 Ridge Rd., suggested that the Medina Heights Committee take another look at what they call Medina Heights. Dave Heinlin, Architect, objected to the restrictions -- wanted creative ways to preserve views. Brian Lund, 7648 N.E. 8th, endorsed the recommendation for 25% coverage -- no view. Carol Rainey, 518 Upland Rd., objected to procedures of Planning Commission. 25 feet is a reasonable compromise. Wants Council to look at Clyde Hill's ordinance. Mayor King summarized a letter from Margaret Glass. She made 2 points: 1) regarding Appearance of Fairness, and 2) could not support a 28 foot height limit. Margaret Glass identified herself and said she is in favor of compromise. She liked Messmer's proposal of 26 feet on the flat and 20/26 on the slope. Objected to 28 foot height. City Council Minutes, July 14, 1986 Page 2 Herb Lyon, 8645 N.E. 7th, member of the Planning Commission, 1) Wanted to clarify that the 2 separate hearings would have been held under any circumstances so this is not a re -hearing, 2) Medina Heights is a unique area and another look should be taken at the boundaries, and 3) Another survey should be made so that severe restrictions are not put on property to which they do not apply. Julie Gerrard, 405 84th Ave. N.E., former member of the City Council, felt that a compromise could be worked out as was done on the Conditional Use Permit 10 yrs. ago. Judy Hansen, 443 86th Ave. N.E. voiced some concerns of her husband, Dick, who was not present: 1) He felt proposal not restrictive enough -- should be 20 feet; 2) Wanted Council to look at Mr. Perry's drawings; 3) Concerned about attempts to crowd back against neighbors to gain for solar energy, light, and air; 4) While sorry for effect on new residents what about long-time residents?; 5) Concern about coverage. Mayor King closed the hearing to public comment. Council reviewed the history of the Medina Heights Study Committee and the history of Ordinances No. 425 and No. 426. Further discussion followed. The Mayor declared the Public Hearing closed and recessed the meeting for 5 minutes. ACTION Appointment to the Board of Adjustment Mayor King informed the Council that he wanted to appoint Reed Langenbach to another term on the Board of Adjustment in accordance with the provisions of Ordinance No. 408. Messmer moved to approve the appointment, Dietrich seconded, motion carried. DISCUSSION Ordinance No. 432 - Puget Sound Power and Light Co. Franchise City Attorney Wines informed the Council that he has rewritten the franchise for Puget Power with provisions similar to the Washington Natural Gas franchise. City Manager's Report Dodge reported on discussions with the Bellevue Planning Department on street classifications. Police Chief's Report Anglin was present to give his report. Treasurer's Report Accepted as presented. OTHER BUSINESS Claims Warrants On a moti.on by Goldstein Claims Warrants #4214 through #4325 were approved. Motion seconded by Yoler, motion carried. New Business Responsibility for cutting limbs and branches which obstruct vision was discussed. Parking from the Park and Ride Lot spilling over along Fairweather Park roadway will be curbed. Upon request fora volunteer, Yoler offered to be an ex-officio member of the Park Board representing the City Council.
