Rd. ------------------------------------------------------------------------------- CALL TO ORDER: The regular meeting of the Medina City Council was called to order by Mayor Pro Tem Dietrich. The meeting was tape recorded. ROLL CALL: Present: Councilmembers Goldstein, Messmer, Reagan, Vall-Spinosa, Yoler, and Mayor•_;Pro Tem Dietrich. Absent: Mayor King Staff Present: City Manager Dodge, City Attorney Wines, City Police Chief Anglin, City Clerk Wyatt, and Planning Consultant Burke. MINUTES OF PREVIOUS MEETING: Messmer moved adoption of the May minutes subject to the correction suggested by Dietrich and subject to the correc- tion on Page 3, Vall-Spinosa seconded, motion carried. ACTION Agreement for Purchase of Easement, AT&T Communications - City Manager Dodge reviewed the provisions of the easement. After a discussion Reagan moved to approve the easement agreement with the deletion of the words "and 3" from the last paragraph immediately after the words "item 2", Messmer seconded, motion carried. Resolution No. 176, Adopting Six Year Transportation Improvement Program - PUBLIC HEARING The City Manager presented the 6 year street plan. The only addition is the Evergreen Pt. Rd. project. The State has recognized it as an arterial street and, in their opinion it is substandard which would make it possible to get UAB funds. The other projects have been carried forward from previous years and will be reviewed. The Public Hearing was declared open and public input invited. Fred Pneuman, 2616 79th Ave. N.E.; Margaret Maxwell (no address given); Herbert Lyon, 8645 N.E. 7th St.; had questions and comments. There were no more requests to comment and Mayor Pro Tem Dietrich declared the Public Hearing closed. Messmer moved the adoption of Resolution No. 176, Yoler seconded, motion carried. Resolution No. 177, Authorizing Changing the Name of Puget Sound Cities Interlocal Insurance Authority to Washington Cities Insurance Association. Reagan moved to accept Resolution No. 177, Messmer seconded, motion carried. Planned Residential Unit Development City Planner Bob Burke gave an overview of the PRUD recommendations from the Planning Commission. Mayor Pro Tem Dietrich declared the Public Hearing open and stated the Council would hear comments for 1 - 11 hours tonight. PUBLIC HEARING Herbert Lyon, Member of the Planning Commission said he believes that setting an arbitrary limit for density tends to defeat the purpose of having a PRUD. Herb Stevenson, 309 Overlake Dr., inquired about condominium type housing and asked the Council not to close the door on smaller houses for the elderly. There followed a discussion on the percentage of density. Burke explained that the Planning Commission recommendations would, basicly,sustain what we have now. The changes in procedure make it possible for the applicants to get a preliminary approval before they have to go to the expense of more detailed drawings. They insure that the Planning Commission and the City Council are both involved. Burke continued that there are times it would be desirable for the City to have this procedure, depending on the configuration of the property. City Council Minutes, June 9, 1986 Puge 2 Whether it is necessary to have a PRUD Ordinance was discussed and, if so, giving it a little more flexibility. Jane Seeley, Evergreen Point Rd., expressed concern about the size of the lots. More discussion followed on the percentage of coverage. Herbert Lyon spoke regarding setting an upper limit for density. He was concerned that once the upper limit was granted to someone, it would be viewed as a right. Fred Pneuman spoke again about people reeding small homes. In the following discussion the point was made that common area does not mean that you have more units per acre. Burke commented on the Council's concern about the process. He explained the difficulty in trying to apply the current ordinance. It says nothing about what someone submits. In putting together an application the applicant incurs considerable expense not knowing what number of lots might be permitted. With a preliminary process, the first decision is probably the most critical. The Planning Commission can tell the applicants what they can do. It is an incremental type of procedure. Neil Thorlaksen felt that a flexible approach is needed. He spoke of clustered housing with areas in common. Bob Lund asked whether it would be legal to restrict such homes to long-time residents of Medina. He was informed that the City Attorney had advised the Planning Commission that he did not think it was legal. Restriction according to age was discussed. City Attorney Wines counseled that it could be done if the City were underwriting a project, but he had never seen a court decision where you could restrict a project by age. The City Planner was asked to check the surrounding communities to see what ordinances they have regarding PLUD'S. Mayor Pro Tem Dietrich closed the Public Hearing and continued it to the next regular meeting. DISCUSSION Reserve Officers - Police Chief Anglin introduced Jackie Bartl,. Dave DeVore, and David Ethridge who are new recruits for Reserve Officers. COUNCIL RETREAT - Council agreed to meet June 28th at Battelle Institute for a one day retreat. Confirmation of Reappointment of Barbara Milam to Civil Service Commission by City Manager Messmer moved to approve the reappointment of Barbara Milam to the Civil Service Commission, Yoler seconded, motion carried. Ordinance No. 429 - Sign Ordinance - Council discussed limiting the size and height of real estate signs, and that they should not be placed on public property. Placing of a sign on public right-of-way was considered if done with permission of the abutting property owner. A question was raised whether a sign ordinance is needed or whether references should be left scattered throughout other ordinances which are effected. The majority favored a separate sign ordinance with footnotes on effected ordinances The discussion will be continued at the July meeting. �— Legal Opinion on Appearance of Fairness - Messmer requested a written opinion from the City Attorney on whether he should participate in decisions regarding Medina Heights. Herbert Lyon also requested an opinion on behalf of himself as well as several other Planning Commissioners and asked that it appear in the newsletter. Police Chief's Report - Chief Anglin was present on behalf of his report (on file with the City Clerk). He discussed the parking problem caused bthe Park and Ride Lot overflow. y City Council Minutes, June 9, 1986 Page 3 City Manager - The delay on 82nd Ave. is due to sale of the paving canpany. He will visit the Metro site and get a schedule of completion. 7th St. rockery -- we have received no bids. He will make further, inquiries to locate a contractor. Treasurer's Report - Accepted as presented. Fire Contract - Dietrich had nothing to report other than they are still meeting. Traffic on 84th - Vall-Spinosa said there are plans to build a hotel on N.E. 8th and Bellevue Way. The City Manager has written a letter to the City of Bellevue regarding the traffic generated which will insure that we will participate in the impact statement. Claims Warrants - Claims Warrants #4115 through #4213 were accepted as presented on a motion by Goldstein, seconded by Vall-Spinosa, motion carried.
