REGULAR MEETING
MINUTES
July 8, 1991 Medina City Hall

EXECUTIVE SESSION: 6:30 PM - Labor Relations
CALL TO ORDER: The regular meeting of the Medina City Council
was called to order at 7:00 PM by Mayor Messmer.
The meeting was tape recorded.
ROLL CALL: Present: Councilmembers Anderson, Hull,
Goldstein, Langenbach, Mathewson, Mayor Pro
Tem Cory and Mayor Messmer
City Staff Present: City Manager Dodge, City
Clerk Davis, Chief of Police Race,
and City Attorney Wines
MINUTES OF PREVIOUS MEETINGS:
Hull moved to approve the minutes of June 10, 1991 meeting,
seconded by Langenbach, passed.
The minutes of June 10, 1991 meeting were approved as submitted.
AUDIENCE PARTICIPATION
Art Dietrich, 707 Overlake Drive E., addressed the reduction of
utility taxes.
Steve Marglin, 2623 Evergreen Point Rd., addressed the policy of
advertising in the City Newsletter supporting church affiliated
activities.
Discussion followed.
SPECIAL PRESENTATION
Bob Rudolph, President of Eastside Citizens Against Airplane
Noise, made a presentation on the proposal to deal with airplane
noise. A slide presentation followed.
Dr. Rudolph stated there is now 150 jets a day flying over Medina
and unless something is done to change this process, this will
increase to 250 flights a day. The impact of this will
continually increase in the future with a further significant
decrease in the quality of life . He stated that ECAAN asks the
support of the Council in this endeavor.
Discussion followed.
Dr. Rudolph stated he will have a legal proposal to present for
the August Council meeting.

REPORTS/DISCUSSION
License for a Fence in the City Right -of -Way - Rueb - 1200
Evergreen Point Rd.
The City Manager gave a brief background on the request.
Dave Rueb was present and stated a fence is needed for privacy of
the back deck and rear yard and would have no affect on the
traffic sight distances.
Discussion followed.
Langenbach moved that the application be approved conditioned on:
1. The fence be no closer to the east edge of the sidewalk than 3
1/2 feet.
2. The fence be set back from 12th at the southern end,
sufficient to comply with all relevant legal requirements for
sight line distances.
3. That the street right-of-way between the sidewalk and the
fence be landscaped consistent with the City's Comprehensive Plan
and to the satisfaction of the City's landscape architect.
Cory seconded the motion, passed. The fence right-of-way license
was approved.
ADOPTION OF SIX -YEAR TRANSPORTATION PLAN
The City Manager reviewed on the resolution for the Six -Year
Transportation Plan and recommended its adoption.
Discussion followed.
Mayor Messmer entertained a motion to adopt Resolution 205 with
the understanding that the attachment would be the same plan
adopted last year. He also authorized the City Manager to add
an additional year's worth of projects, with the understanding
that by approximately October 1, this item will be reviewed by
the public works committee.
Hull moved to adopt Resolution No. 205 with the Mayor's
recommendation, Langenbach seconded, passed.
RECOMMENDATION FROM PARK BOARD
The Park Board recommended the City Council pass an ordinance
requiring dog owners to pick up and dispose of dog waste from
City rights -of -way.
The City Attorney was asked to come back with an ordinance on
disposing of dog waste for the next meeting.
FINANCIAL REPORTS & CLAIMS
The City Manager reviewed the budget report on financial and
budgetary projections that was included in their packets.
Goldstein reported on the warrants.
Goldstein moved to accept as paid claims warrant #4447-4547, 99-
4418, 99-4490 and payroll warrants #11690-11742, seconded by
Cory, passed.

PUBLIC WORKS REPORT - US WEST COMMUNICATIONS EASEMENTS
Langenbach and Anderson reported on the committee's meeting with
US West Communication and their tour of the proposed
construction. The construction of the ditch starts at Rambling
Lane and runs to Fairweather Park on the eastside of the street
in the grass strip between the sidewalk and the street.
Langenbach recommended that all residents on Evergreen Point Road
receive a notice indicating the approximate dates of starting the
project and the approximate date of completion.
Rankhna
The City Manager stated the backhoe is completely worn out and
needs replacement. He asked the Council for authorization to
purchase a backhoe which was in the budget.
Cory moved to authorize the City Manager, after conferring with
the Public Works Committee, to spend up to $30,000, Hull
seconded, passed.
OTHER REPORTS
The Mayor reported on his meeting on the Library Services and
Fire contract.
Goldstein and Mathewson reported on the workshop they attended at
the 1991 AWC Conference. They encouraged the Council to attend
the conference in Bellevue next year.
The City Manager commended the Chief of Police for putting
together a training program for Animal Control Officers. The
class was certified by the state.
The Chief stated this is the first Animal Control Academy in the
State of Washington. The first session is a 48 hr. course,
Monday -Saturday, in August at the Bellevue Community College. It
is sponsored by Medina, BCC and the Humane Society.
Police Report
Accepted as submitted.
ORDINANCE/RESOLUTION
Ord. No. 540 - An Ordinance Requiring Compliance with the Uniform
Fire Code for Residences Constructed on Private Lanes.
The City Manager gave some background on this ordinance.
Discussion followed.
Ord. No. 540, including amendments, was tabled to next month's
meeting.
ORDINANCE/RESOLUTION - FIRST REVIEW
Ord. No. 541 - An Ordinance Regulating Structures in Unimproved
Portions of Public Rights -of -way.
Ord. No. 542 - An Ordinance Amending Medina Municipal Code
Section 12.08.010A to Reference the Medina Comprehensive Plan.

OTHER BUSINESS
Langenbach referred to his letter included in the packet. He
stated the intent of the change in language is to allow the City
Manager to provide some flexibility to the sign setback
requirement.
The City Attorney was asked to prepare an ordinance in final form
for next month's council meeting.
Executive Session - City Manager's Compensation
The regular meeting was adjourned to executive session at 10:40
PM.
The executive session was adjourned to the regular meeting at
11:20 PM.
ADJOURNMENT
