REGULAR MEETING
MINUTES
June 10, 1991 Medina City Hall
7:00 PM 501 Evergreen Point Rd.
CALL TO ORDER: The regular meeting of the Medina City Council
was called to order at 7:00 PM by Mayor Messmer.
The meeting was tape recorded.
ROLL CALL: Present: Councilmembers Anderson, Hull,
Goldstein, Langenbach, Mathewson, and Mayor
Messmer
Absent: Mayor Pro Tem Cory
City Staff Present: City Manager Dodge, City
Clerk Davis, Chief of Police Race, Public
Works Superintendent Hammerquist and City
Attorney Wines
MINUTES OF PREVIOUS MEETINGS:
Anderson moved to adopt the minutes of the May 13, 1991, seconded
by Anderson.
Langenbach moved to add the following paragraph to the right-of-
way license on page 1.
"The Council found that the goals of the Comprehensive Plan were
best served if the application were granted. The unique
topography of the site (steep, slope and extensive natural
landscaping) would require a larger structure than if the slight
encroachment were permitted.
Mayor Messmer moved to delete the last paragraph on page 1, "Ord.
No. 533, etc."
The minutes of May 13, 1991 were approved as amended.
Langenbach moved to adopt the minutes of May 30, 1991, seconded
by Hull.
Langenbach moved to add after the bid price "based on unit price
per ton, etc."
The minutes of May 30, 1991 were approved as amended.
SPECIAL PRESENTATION
Steve Thompson - Community Relations Coordinator, gave a
presentation on the King County Executive's recommendations to
build a suburban Regional Justice Center.
Discussion followed.
AUDIENCE PARTICIPATION
There was none at this time.

ORDINANCES/RESOLUTIONS - FINAL ACTION
Ordinance No. 533 - An Ordinance amending Medina Municipal Code
Section 17.80.060 C 2 to allow temporary commercial real estate
signs to be placed on city rights -of -way.
Discussion followed.
Anderson moved to adopt Ordinance No. 533 as amended, seconded by
Hull.
Langenbach moved to amend the effective date to 1135 days after
its publication." Seconded by Hull, passed.
Ordinance No. 533 passed as amended.
Langenbach stated he would draft a variance procedure for the
next meeting covering the sign requirements.
The Mayor recommended sending a copy of the ordinance to the
different real estate offices along with a letter that they
comply with this ordinance.
Ordinance No. 538 - Establishing general cable franchising
conditions.
Ordinance No. 539 - Granting non-exclusive franchise to TCI
Cablevision.
Anderson moved to adopt Ordinance Nos. 538 and 539, seconded by
Hull, passed.
REPORTS & DISCUSSION
Ordinance changes regarding structures in the public rights -of -
way_
Langenbach reviewed the Land & Tree Committee's recommendations
regarding structures in public rights -of -way.
Discussion followed.
The City Attorney was asked to prepare an ordinance on the
changes regarding structures in the city rights -of -way.
Easement Request by U S West Communications
Public Works Superintendent Hammerquist stated that U S West
Communications was requesting a right-of-way permit and
permission to replace the underground cable from NE 12th to NE
32nd. They also requested the City grant them a 10' by 30'
easement in the southwest corner of Fairweather Park to install a
switching box.
Hammerquist stated that U S West Comm. would be making a
presentation on the scope of the proposed project to staff and
the public works committee on Wednesday, June 12th at 3 PM and
invited any interested councilmembers to attend.
Discussion followed.
The City Attorney recommended US West Comm. get a survey of the
property and have it incorporated in the easement.
The City Manager recommended the Council give the Public Works
Committee authority to approve this request at the meeting.

The Council gave the Committee authority to approve this request
subject to the restrictions.
The Public Works Superintendent gave a review on the progress of
other projects in the city.
The City Manager stated that all the bids received for
landscaping and planting five corners at Medina Park were way
over the amount budgeted. He decided not to award the bid at
this time. The City Manager anticipated this project would be
redesigned and bid again next Fall.
AWC Conference
The Mayor recommended the Councilmembers attending the conference
give a brief report for the next meeting.
Financial Report
Goldstein and Hull reviewed the warrants.
Goldstein moved to accept as paid Claims Warrant #1350, 4350-
4446, 50791, 9-50791, 99-1350 and Payroll Warrants #11642-11689,
seconded by Hull, passed.
Police Chief's Report
Accepted as submitted.
The Chief stated a new police officer, Rick Whitmore, was hired
with a starting date of July 1, 1991.
City Manager's Report
Previously covered.
ORDINANCE/RESOLUTION - FIRST REVIEW
Ordinance No. 540 - Requiring residences constructed on private
lanes to comply with the Uniform Fire Code.
Other Business
New Business
Hull stated there is a house on 24th near the Indian Trail which
is being remodeled and has come to a stop. He feels it is a
hazard and something should be done before an accident occurs.
The City Manager stated he would look into the situation and
report back to the Council.
The City Manager stated a notice was sent to the residents
regarding the regrading of the Indian Trail and plantings.
Executive Session
Labor Relations, Dump Truck - legal position and City Manager's
annual evaluation
Mathewson moved to adjourn to Executive Session at 10:05 PM,
seconded by Hull, passed.
Executive Session returned to the regular meeting at 11:30 PM.
