REPORTS/DISCUSSION
Revised portion of minutes:
The Mayor stated that attorneys Shute, Mihaly & Weinberger
advised the City the probability of success in litigation, is
unlikely in court against the FAA over jet noise because of the
holding in a Ninth Circuit case in April of 1992. The Mayor
indicated the citizens have been previously advised of this.
Further, the Mayor stated this did not rule out other types of
administrative litigation. Shute, Mihaly & Weinberger
recommended a public relations approach through the
administrative agencies.
Pursuant to authority from the Council, Mayor Cory reported that
he had requested The Rockey Company, a public relations firm, to
recommend a PR approach to the jet noise problem. The Rockey
Company has proposed guidelines to follow which are set forth in
a letter dated February 8, 1993.
The Council agreed that The Rockey Company should proceed ahead
with the guidelines and tha The Rockey Company has up to $5,000
to spend in this first phase for its time. It was also agreed
that the Rocky Company has the latitude to call Shute, Mihaly &
Weinberger, but before any significant services are requested
from Shute, Mihaley & Weinberger, the expense should be cleared
through the Mayor and the Mayor should discuss it with the City
Manager.
The City Manager was concerned that more than $5,000 might be
spent by The Rockey Company by incurring expenses through Shute,
Mihaly & Weinberger. The City Manager was advised that $40,000
had been allocated on the jet noise problem of which only S26,000
has been spent and that if some additional funds were spent with
Shute, Mihaley & Weinberger, it would be acceptable.
Hull made a motion that the above portion of February 8th minutes
be accepted as revised, seconded by Kelly, passed.

CALL TO ORDER: The regular meeting of the Medina City Council
was called to order at 7:00 PM by Mayor Cory.
The meeting was tape recorded.
ROLL CALL: Present: Councilmembers Guyton, Hull, Kelly,
Scholl, Potts, Zubko and Mayor Cory
City Staff Present: City Manager Papke,
City Clerk Davis, Police Chief Race, Public
Works Supt. Weigle and City Attorney Wines
MINUTES OF PREVIOUS MEETINGS:
Hull moved to approve the minutes of January 11, 1993, seconded
by Zubko, passed.
REPORTS/DISCUSSION
Puget Sound Regional Council Interlocal Agreement
Kelly moved to authorize the City Manager to sign the Interlocal
Agreement with Puget Sound Regional Council. Seconded by Zubko,
passed.
Zubko gave some background on the history of Puget Sound Regional
Council.
Drug Free Zone
City Attorney Wines stated the City does not have to take any
action on this in order to enforce the state statute, but does
have the option of adopting a map by ordinance which sets forth
where these areas are. He recommended the City adopt such a map.
He stated it would send a message to the residents that Medina is
concerned about drugs. In addition to this, Wines stated that
"Drug Free Zone" signs can also be posted.
Scholl moved that the City prepare a map and also budget money to
place signs at the perimeter of the city that Medina is a Drug
Free Zone. Seconded by Kelly.
Discussion followed.
The consensus of the Council was to prepare a resolution and map
for a future meeting.
The previous motion and second were withdrawn.
Financial Reports & Claims
Scholl moved to approve December claims warrants #6065-6085
totalling $24,075.81. January claims warrants #6086-6142
totalling $62,253.07 and payroll warrants #12721-12765 totalling
$53, 463. 35, seconded by Zubko, passed.
Committee Reports
Public Works Committee
Hull and Kelly reported having a meeting with the City Engineers
Jauhola and Hill. Jauhola prepared a report on the Comprehensive
Storm Water Management Plan which was forwarded to the Council.
Weigle reported that Jauhola stated that adopting the Storm Water
Management Plan means the City has a plan, but is not bound to
the funding options.
Intergovernmental
Kelly stated one item of importance discussed at the Mayors'
meeting was affordable housing:

The City Manager gave more background on the number of buildable
lots in Medina and encouraged the Council to attend future
meetings relative to the implementation of the county -wide
planning policies.
Lengthy discussion followed.
Police Report
Accepted as submitted.
_ Chief Race stated the Department had their first D. A. R. E.
graduation.
Margie Danz, 2420 77th Ave NE, stated Bellevue High School
parents had invited Chief Race and Chief Wehmeye-r to speak to
them to inform them how they would handle alcohol and drug
problems at the teenage level.
She, on behalf of the parents, wanted to thank them both for
attending the meeting and felt they left a favorable impression,
which will be passed on to the students.
City Manager Report/Public Works Report
City Manager Papke and Public Works Supt. Weigle reported on the
major storm cleanup and the efforts of the community coming
together as a team.
The Council congratulated the City Manager, staff and crew for a
job well-done. They also recommended a letter of thanks be sent
to Bill Gates and Doug Bonn for their assistance following the
storm.
ORDINANCES/RESOLUTIONS - Final Action
Ordinance No. 563 - Amending Medina Municipal Code 12.24.010,
Rules applying to all Public Parks, to prohibit littering and to
prohibit animals other than domesticated animals.
Hull moved to adopt Ordinance No. 563, seconded by Kelly, passed.
ORDINANCES/RESOLUTIONS._- First Reading
Ordinance No. 567 - An Ordinance pertaining to the wearing of
bicycle helmets while operating or riding on a bicycle or cycle
not powered by motor on public roadways, bicycle paths, rights -
of -way or publicly owned properties.
Discussion followed. Revisions will be made before the next
reading.
Executive Session - Litigation/Personnel
The regular meeting adjourned to executive session at 8:30 PM.
Executive session returned to the regular meeting at 9:25 PM.
PUBLIC MEETING
Mayor Cory stated that attorneys Shute, Mihaly $ Weinberger
advised the City they would not expect to win a lawsuit over jet
noise against the FAA. The Council has therefore agreed not to
pursue litigation at this time.
Councilmembe-r Scholl reiterated that we do not have a legal stand
in this matter. Shute, Mihaley & Weinberger's presentation some
months back made it clear that the city's chances of remedy
through litigation were greatly diminished due to a decision in
an April '92 suit.
Mayor Cory reported that he had contacted the Rockey Company, a
public relations firm, about an alternative approach to finding a
solution to the jet noise problem. The Rockey Company has
proposed a short.term program which is described in a letter
dated February '6, 1993.

volunteered to write this article.
