CALL TO ORDER: The regular meeting of the Medina City Council was called to order at 7:00 PM by Mayor Dewey Taylor. The meeting was tape recorded. ROLL CALL: Present: Councilmembers Guyton, Koelemay, Potts, Ross, Scholl and Mayor Taylor Absent: Cory City Staff Present: City Manager Papke, Public Works Superintendent Weigle, Police Chief Race and City Attorney Wines MINUTES OF PREVIOUS MEETING: Scholl moved to approve the minutes of the October 10, 1994 meeting. Potts seconded the motion, passed unanimously. ANNOUNCEMENTS Staff City Manager Papke gave a brief update on the status of the annual Washington State Audit that is currently underway in Medina. Papke stated that after reviewing the minutes, the auditor wanted the Council to be reminded that whether a councilmember chooses to vote aye, nay or they choose to abstain, the individual vote must be made clear so it can become part of the official record of the meeting. Also, the auditor wanted it reiterated that all public hearings must be officially opened for public testimony and when it is decided that public testimony will no longer be accepted, the public hearing portion of the meeting must be officially closed. PUBLIC HEARING Street Vacation - Gates - 1835 73rd Ave. NE To allow the vacation of the northerly portion, approx. 45 ft., of 73rd Ave. NE. Mayor Dewey Taylor opened the public hearing. Bruce Anderson, of James Cutler Architects, was present on behalf of the applicant to review his client's petition to vacate a portion of 73rd Ave. NE. Mr. Anderson noted that the only other owner, other than Gates, that abuts a corner of the portion of 73rd Ave. NE sought to be vacated, is Audrey House. He noted that she has submitted a letter to the City of Medina supporting the petition. Discussion followed on the reasons for the vacation as outlined in the petition submitted by Konrad Liegel, Attorney, Preston Gates & Ellis. City Council Minutes November 14, 1994 Page Two The following residents spoke regarding this issue: Norman Cutter, 602 Upland Rd. Marianne Denman, 1851 Evergreen Point Rd. Lynne Swoope, 7319 NE 18th City Attorney Wines reviewed the procedures and appropriate conditions that the Council may wish to impose by motion should the street vacation be granted. Wines also noted that a street vacation may not be granted unless public benefits are identified. Mayor Dewey Taylor closed the public hearing portion of the meeting. Scholl moved that the street vacation be granted conditioned upon: 1) Payment of one half of the assessed value of the street being vacated, based upon the assessed value on a square footage basis, of the adjacent real property. 2) Payment of all consulting costs incurred by the City. 3) Construction of an adequate turnaround in accordance with a plan approved by the City Engineer. 4) Identify and reserve easements for existing utilities. 5) The City reserves the right to grant future easements for public utilities and services. Discussion followed regarding the conditions of the approval and on the process of notification for Mrs. Audrey House regarding the turnaround. Scholl amended his motion to add: 1) Payment of all costs associated with the construction of any turnaround that is required. Koelemay seconded the motion, passed unanimously. The City Attorney stated that he would draft an ordinance approving the street vacation with the imposed conditions for review at the regular Council meeting in December. PUBLIC HEARING (Continued) Ordinance No. 575 - An ordinance relating to view and sun obstruction and providing a mechanism for preserving and enhancing views and access to sunlight. City Attorney Wines reviewed the revisions to draft Ordinance No. 575 as outlined in a memo dated 11/3/94. Mayor Taylor opened the public hearing. The following residents were present to speak regarding this issue: Ted Tanase, 3611 Evergreen Point Rd. Dorothy Jonson, 1015 84th Ave. NE Norman Cutter, 602 Upland Rd. andy Harris, 3607 Evergreen Point Rd. Chuck Madison, 8414 Overlake Dr. W. Marianne Denman, 1851 Evergreen Point Rd. Gail Swihart, 3615 Evergreen Point Rd. Mayor Taylor closed the public hearing portion of the meeting. Discussion followed regarding the "Tiburon Ordinance" and of modifying Ord. No. 575 to include some of the language contained in the ordinance. City Council Minutes November 14, 1994 Page Three It was the decided that further review was needed, so the public hearing regarding this issue was continued. REPORTS/DISCUSSION SR 520 Expansion Proposal Update City Manager Papke gave an update on the meetings with the Mayors of the Points Communities regarding the SR 520 expansion proposal. She stated that as a result of their discussions, the consensus was to send a joint letter to Rhonda Brooks, Program Manager of the Public/Private Initiative, listing their mutual concerns. Discussion followed. It was decided that Mayor Dewey Taylor would sign the joint letter on behalf of the City of Medina. REPORTS/DISCUSSION Financial Reports & Claims Scholl moved to approve the October claim warrants #7826-7900 totalling $101,484.36 and payroll warrants #13747-13793 totalling $61,445.08. Potts seconded the motion, passed unanimously. Guyton moved to approve claim warrant #7729 totalling $0, which was inadvertently left off of the August Warrant Register. Potts seconded motion, passed unanimously. Police Report Accepted as submitted. Public Works Report No Public Works Report. ORDINANCES/RESOLUTIONS Ordinance No. 594 - An ordinance establishing the terms and conditions of a franchise for water distribution and waste water collection. Discussion followed. Guyton moved to approve Ord. No. 594. Ross seconded the motion, passed unanimously. Adjournment The meeting was adjourned at 10:25 PM. LyTin Bktchelor,- -
