CALL TO ORDER: The regular meeting of the Medina City Council was called to order at 7:00 PM by Mayor Dewey Taylor. The meeting was tape recorded. ROLL CALL: Present: Councilmembers, Cory, Guyton, Koelemay, Potts, Scholl and Mayor Taylor Absent: Ross City Staff Present: City Manager Papke, City Clerk Batchelor, Public Works Supt. Weigle, Police Chief Race, Planning Consultant Largen and City Attorney Wines MINUTES OF PREVIOUS MEETING: Potts moved to approve the minutes of the September 12, 1994 meeting. Scholl seconded the motion, passed unanimously. ANNOUNCEMENTS Council Councilmember Koelemay announced that as one of the members of the Medina Days Committee she wanted to share the tally of the financial summary of the 1994 Medina Days Celebration. Koelemay reviewed the financial information and reported that Medina Days is in a good financial position, as the amount of $5,495.82 is being carried over for use in 1995. AUDIENCE PARTICIPATION Kirkland Performance Center Steve Larian, Executive Director of the Kirkland Performance Center, was present to give a brief review of the proposed theater planned for the Kirkland Performance Center. He stated that the Kirkland Performance Center is a community -based, non- profit corporation dedicated to constructing and operating a high quality, 400+ seat theater as well as dance and professional musical performances for local and regional audiences. Anyone who is interested in obtaining more information on how to make the center a reality has been asked to contact him. PUBLIC HEARING (Continued) Ordinance No. 575 - An ordinance relating to view and sun obstruction and providing a mechanism for preserving and enhancing views and access to sunlight. City Attorney Wines was present to review the most recent, dated 9/27/94, revised version of Ord. No. 575. City Attorney Wines shared some of the comments he had received from the City Landscape Consultants, Margaret Harrison and Linnea Ferrell regarding suggested changes to the ordinance. He reported City Council Minutes October 10, 1994 Page Two that they were unable to come up with a better definition of "substantial deprivation of sunlight". They did, however, want to point out that eliminating shade could destroy some of the lush vegetation that grows in shade. Mayor Taylor opened the public hearing. The following residents were present to speak regarding this issue: Ted Tanase, 3611 Evergreen Point Rd. Mike Mandel, 3224 78th Margie Danz, 2420 77th Ave. NE Charles Swoope, 7319 NE 18th Marianne Denman, 1851 Evergreen Point Rd. John and Gail Swihart, 3615 Evergreen Point Rd. Loren Cole, 8226 Overlake Dr. W. Martha Woodman, 401 Upland Rd. City Planning Consultant Don Largen was present to speak to some of the concerns he has relative to enforcement, specific means of measurement and the areas of the ordinance that need more definition. Discussion followed. Cory moved to continue the public hearing to the next meeting on November 14, 1994. Scholl seconded the motion, passed unanimously. ORDINANCES/RESOLUTIONS Resolution No. 227 - A Resolution fixing the time for a hearing on a petition to vacate the northerly portion, approximately 45 feet, of 73rd Ave. NE. Scholl moved that the hearing be scheduled for the next City Council meeting on November 14, 1994. Potts seconded the motion, passed unanimously. REPORTS/DISCUSSION Financial Reports & Claims Scholl moved to approve the September claim warrants #7730-7825 totalling $141,318.89 and payroll warrants #13694-13746 totalling $66,707.78. Cory seconded the motion, passed unanimously. Police Retort Accepted as submitted. Public Works Report Accepted as submitted. OTHER BUSINESS Success 8K Run Discussion on some concerns relating to the Wheels of Fire/Success Run that was held on 9/27/94. There was City Council Minutes October 10, 1994 Page Three discussion on ways to improve public awareness, so that next year residents won't be caught so off -guard. Timely notification would allow residents the opportunity to plan accordingly, which would alleviate most of the problems. SR 520 Expansion City Manager Papke and Mayor Taylor met with the Mayors from the other Points Communities to discuss the SR 520 expansion. They reported that the City of Medina is in the process of coordinating with the other Points Communities to compile a joint list of concerns that will be sent to the WSDOT. To be a viable part of the contract negotiation process, it was mutually agreed that appropriate timing is critical. It was decided that the final list will not be sent to the WSDOT until the conclusion of the public hearings the Washington Transportation Project (WTP) has scheduled for November. ORDINANCES/RESOLUTIONS (CONTINUED) Resolution No. 228 - A Resolution of the City Council of the City of Medina accepting the sculpture entitled "Summer" from artist Peter Skinner. City Manager Papke reviewed that Medina resident Peter Skinner has made an offer to donate a sculpture, entitled "Summer", for placement in Medina Park. If the offer is accepted, Papke stated that Mr. Skinner has agreed to cover the cost of the moving and installation of the piece, but the city would be responsible for providing the slab poured foundation. She noted that the Park Board has reviewed the offer and recommends approval. Discussion followed. It was the consensus of the Council, on behalf of the City, to accept the sculpture donation for placement in Medina Park. Scholl moved to approve Resolution No. 228. Cory seconded the motion, passed unanimously. Executive Session - Litigation The regular meeting was adjourned to executive session at 10:00 PM.
