CALL TO ORDER: The regular meeting of the Medina City Council was called to order at 7:05 PM by Mayor Taylor. The meeting was tape recorded. ROLL CALL: Present: Councilmembers Ray Cory, Sigrid Guyton, Kay Koelemay, Susan Potts, Grahame Ross, Dennis Scholl and Mayor Dewey Taylor MINUTES OF PREVIOUS MEETING: Councilmember Scholl moved to approve the minutes of the October 9, 1995 meeting. Councilmember Cory seconded the motion. It was passed unanimously. ANNOUNCEMENTS Staff Request by City Manager Papke that Council and staff use microphones. AUDIENCE PARTICIPATION Walter Scott, 2022 77th Ave NE, presented a petition of residents along NE 77th Street between NE 16th and NE 22nd Streets in Medina requesting the installation of speed bumps, speed limit and children -at -play signs. The petition also included a request for installation of "local access only" signs. The petition notes the concern of residents for safety of children due to excessive speed and non -local traffic on the street. The following also spoke in favor of some kind of traffic control measures: Karen Scott, 2022 77th Ave. NE; Lori Brustkern, 2012 77th Ave. NE; Larry Gill, 2045 77th Ave. NE; Roger Barbee, 1687 77th Ave. NE After some Council discussion, City Manager Papke indicated that City staff will review the issue and alternatives and get back to the citizens. Steven Guyton, 7408 NE 18th Street, addressed the City Council to provide notice of a public health concern within the City. Mr. Guyton described some of the physical symptoms of illness that he attributes to an adjacent construction project. He noted the existence of local studies indicating that people respond to lower levels of pollution, particularly over long periods of time, than are now mandated for clean air by the federal government. He requested that the Council take legislative action to prevent future occurrences in the City of Medina. Councilmember Guyton described her personal experience with the situation. Medina City Council Minutes November 13, 1995 Page 2 DISCUSSION Draft Washinaton Administrative Code IWAC1 Rule A staff report was presented by City Manager Papke. The rule will establish guidelines for the advisory vote to be taken on the public/private partnership project for SR520. Council may submit comments to the Washington State Department of Transportation up until the rule is actually adopted, which is currently anticipated in February 1996. Mayor Taylor commented that it might be better to take advantage of the upcoming meeting with the other Points Communities on November 20, 1995 to establish a common approach among the communities. The action was approved by common consent. Plannina Commission Appointment Mayor Taylor presented the name of David J. Krull as a replacement for the vacancy on the Planning Commission. Maryel Duzan, 2227 Evergreen Point Road, voiced her support for the recommendation of Mr. Krull as a planning commissioner. Councilmember Cory made a motion to approve the appointment of David Krull as a planning commissioner. Councilmember Potts seconded the motion. It was approved unanimously. ORDINANCES/RESOLUTIONS ORDINANCE NO. 604 - AN ORDINANCE ALLOWING ACCESSORY DWELLING UNITS IN RESIDENTIAL ZONES, ESTABLISHING DEVELOPMENT, DESIGN AND OWNER -OCCUPANCY REQUIREMENTS, ADDING A NEW DEFINITION TO CHAPTER 17.12 AND ADDING A NEW CHAPTER TO THE MEDINA MUNICIPAL CODE. Maryel Duzan, 2227 Evergreen Point Road, recommended that the Council take action at this meeting rather than delaying to further study the issue. She provided comments on the draft ordinance as revised from the last Council meeting. Councilmembers discussed the provisions of the ordinance. Susan Marglin, 2617 Evergreen Point Road, questioned whether or not multiple addresses could be assigned to one property. Council discussion continued. Daniel Becker, 8005 NE 28th Ave. NE, discussed perceived loopholes in the draft ordinance. Councilmember Koelemay made a motion to delete the provision for a separate address for accessory dwelling units. Councilmember Potts seconded the motion. The motion passed with Councilmember Ross in opposition. Councilmember Koelemay moved that the requirement for a separate entry to an accessory dwelling unit be deleted from the draft ordinance. The motion was seconded by Councilmember Potts. The motion was approved with Councilmembers Guyton and Ross in opposition. Councilmember Potts made a motion to remove from Section 2.17._.030, E. - " _ terminate by reason of extended absence...", and to replace it with "a resident gone for a period of longer than 12 months will terminate the legal use. Councilmember Koelemay seconded the motion. The motion was approved with Councilmembers Cory, Ross, and Scholl dissenting. In preparation for adoption of the draft ordinance, City Attorney Wines presented the following substitute language and deletions: Section 2.17._.030, E. - "Legal residency shall terminate after absence in excess of one year." Medina City Council Minutes November 13, 1995 Page 3 Section 2.17._.030, J and L(3) are deleted. Councilmember Cory moved to adopt Ordinance No. 604 as amended. Councilmember Scholl seconded the motion. The motion passed with Councilmember Ross in opposition. Resolution No. 232 - Amendments to Solid Waste Interlocal Agreements City Manager Papke gave a brief staff report. The proposed amendments address the new governing structure for the solid waste agency. Councilmember Cory moved — approval. Councilmember Potts seconded the motion. Passed unanimously. Resolution No. 233 - Interlocal Aareement with Eastside Transportation Proaram City Manager Papke gave a brief staff report and history of the organization. The proposed interlocal agreement included a contribution of $1,000 from the City of Medina. After some discussion, Councilmember Cory made a motion to table until the meeting of December 11, giving the City Council opportunity to talk to the other Points Communities about the issue. Councilmember Potts seconded the motion. Passed unanimously. Resolution No. 234 - Agreement with Eastside Public Safety Communications Agency Police Chief Race reported on the 800 Mhz system and its implementation through participation in the Eastside Public Safety Communications Agency. Funding for the hardware in the police department was financed through a County -wide tax levy approximately three years ago. There is an ongoing cost to help fund the agency of $200/mo. The City will be responsible for maintenance costs of its equipment. The 800 Mhz system will greatly upgrade police and emergency communications. Councilmember Scholl moved to grant the Mayor authority to sign the agreement upon its finalization. Councilmember Koelemay seconded the motion. Passed unanimously. REPORTS Financial Reports & Claims Councilmember Cory moved to approve October warrants #8821 - #8908 totaling $187,721.30 and October payroll warrants #14374 - #14421 totaling $71,083.31. Councilmember Scholl seconded the motion. The motion was passed unanimously. Councilmember Potts asked if the City's consultant's have improved their billing practices. City Manager Papke responded that the consultant's still lag in their billings. Staff will continue to work with the consultants. Police Report - October 1995 Police Chief Race reported an unusual amount of unrelated thefts and burglaries during the past month. Councilmember Cory requested further information concerning communication provided the Council regarding a chase that involved a Medina police officer. Police Chief Race provided further details. City Manager Papke added that staff is still investigating involvement in the incident by Medina personnel. Councilmember Ross questioned the use of leaf blowers on Sundays. Police Chief -- Race responded that when a complaint is received the Police Department generally asks gardeners and homeowners to readjust their hours to a more reasonable time, such as Mon. - Fri. Medina City Council Minutes November 13, 1995 Page 4 AUDIENCE PARTICIPATION Wilma Edmonds, 7721 NE 24th Street, having missed the opportunity at the beginning of the meeting, requested permission to address the Council. She commented to the City Council that she had had several reports of increased insurance rates to residents resulting from the change of zip code for Medina. City Manager Papke responded that she had received only one complaint at City Hall, to which she had responded. OTHER BUSINESS Fee Addressing Designation of Open Space City Manager Papke asked the City Council to waive the 45 day rule for notification of establishing a new fee. She related that the City had been approached about the possibility of a property owner applying to have a portion of their property be designated as open space. She wanted the City to be in a position to recover its expenses for staff time and all administrative costs of the process. The fee will be set at full reimbursement of actual costs to the City associated with processing an application for Designation of Open Space. After Council discussion, Councilmember Cory moved to waive the 45 day rule. Councilmember Scholl seconded the motion. The motion passed unanimously. EXECUTIVE SESSION Councilmember Potts moved to adjourn to executive session to discuss property acquisition with an anticipated return to open session at 10:00 PM. Councilmember Scholl seconded the motion. Approved unanimously The Council adjourned to executive session at 9:40 PM., and returned to open session at 10:20 PM.
