CALL TO ORDER: The regular meeting of the Medina City Council was called to order at 7:00 PM by Mayor Taylor. The meeting was tape recorded. ROLL CALL: Present: Councilmembers, Cory, Koelemay, Potts, Ross, Scholl and Mayor Taylor Absent: Councilmember Guyton MINUTES OF PREVIOUS MEETING: Scholl moved to approve the minutes of the May 8, 1995 meeting. Cory seconded the motion, passed unanimously. ANNOUNCEMENTS Council Potts publicly thanked Medina residents Bill and Melinda Gates for their recent offer to contribute financially towards the installation of the proposed playground equipment for the new play area in Medina Park. City Manager Papke announced that the discussion with the Port Officials regarding airplane noise has been rescheduled to the next regular council meeting on July 10, 1995. Papke, on behalf of the City Council, Park Board and City Staff, invited everyone to join them at 7:00 PM in Medina Park on the summer solstice, June 21, for the dedication of the new sculpture entitled "Summer" and for a goundbreaking for the new children's play area. DISCUSSION Approval of Public Works Contract No. 1-95 Greg Hill, City Engineer, was present to review the bids for the NE 12th St., Evergreen Point Road Phase 2 Storm and Street Improvements Contract #1-95. He recommended the bid award go to Laser Underground and Earthworks, Inc. for the base bid in the amount of $366,027. Scholl moved that the bid award go to Laser Underground and Earthworks, Inc. Cory seconded the motion, passed unanimously. Request from T R U S T (Tolls Represent Unfair State Taxes) seeking a contribution of 20 200 David Krull, member of T.R.U.S.T., was present to review their request that the City Council give them $20,200 to help pay for a portion of their unpaid debts. He also announced that ESHB 1317, which would require citizen involvement and approval of public -private highway improvements, had recently passed the legislature and is now before the Governor for his approval. Medina City Council Minutes June 12, 1995 Page two Kirk Wines, City Attorney, stated that the real question that needs to be resolved by the City Council is whether there was any commitment for payment of a portion of the expenses that has been incurred by T.R.U.S.T. He stated that the auditor's office and he both agree that if it is decided that there was no advance commitment, then payment would be considered a gift and should not be made. Discussion followed. It was the consensus of the City Council that no prior commitment was made to T.R.U.S.T. for reimbursement of any expenses, so it was agreed that they would deny their request. However, they did recommend that should T.R.U.S.T. foresee any future expenditures, that they come back to the City Council with a request prior to incurring the expense for their review and possible approval. Medina's 40th Anniversary of Incorporation Discussion of Medina's upcoming 40th Anniversary of Incorporation. Thorton Thomas, ex -mayor of Medina and long-time resident, was present to share and reminisce of past anniversary celebrations that have been held. Discussion on Initiative No. 164 Planner Bob Burke was present to review the initiative. He stated that if the initiative does become law that it will require an economic impact analysis of new regulations, as they would affect private property values. He also stated that any zoning or other regulatory change would need to be analyzed by the City to determine whether or not there would be any reduction in private property values as a result of imposing any development regulation as the City would be expected to compensate the affected property owner. Potts moved that the State be notified that the City Council is in opposition of the passage of Initiative No. 164. Koelemay seconded the motion. Discussion followed. Potts and Koelemay voted aye. Cory, Scholl and Ross voted nay, the motion failed. Proposed Zoning Changes Planner Burke reviewed that on April 25, 1995 the Planning Commission held a public hearing on items related to Chapter 17 and Chapter 12 of the Medina Municipal Code. The items were: 17.76.010 Fences and Walls - Height, Accessory Units, 17.40.025 & 17.40.040 Frontage on a Public Street, 17.40.080 Public Street Right -of -Way turnaround and 12.28.050 Replacement of Significant Trees if removed. Discussion followed. It was the consensus of the City Council that the issue pertaining to accessory units be brought back as a discussion item at the next City Council meeting on July 10, 1995. It was also decided that City Attorney Wines be directed to bring back the proposed changes in draft ordinance form for further discussion at that same meeting. Animal Control Regulations Chief Race reviewed the current animal control regulations. It was agreed that the current regulations were sufficient and that, for the time being, no further legislation will be enacted. A000intment of Permanent_ Alternates to the Planning Commission Medina residents Herb Lyon and Mike Zubko were appointed to serve on the Planning Commission on an as -needed basis as alternate members. City Council Minutes June 12, 1995 Page three ORDINANCES/RESOLUTIONS Ordinance No 601 - An Ordinance to prohibit possession of drug paraphernalia. Discussion followed. No action taken. REPORTS Police Report Accepted as submitted. Public Works Report Accepted as submitted. Financial Report & Claims Scholl moved to approve the May claim warrants #8418-8494 totaling $86,947.25 and May payroll warrants #14105-1152 totaling $69,429.12. Seconded by Cory, passed unanimously. Executive Session - Property Acquisition and Personnel The regular session was adjourned to executive session at 9:28 PM. The executive session returned to regular session at 10:16 PM. Scholl moved to enter into a 1995 continued employment contract with City Manager Papke, reflecting the same cost of living increase afforded to all other city employees for 1995 (2.8%), retroactive to January 1, 1995.
