RE: Bulk Code Update
At the joint Planning Commission/Council meeting on September 22"d, Council was provided an
update on the discussions that have taken place regarding bulk over the past many months. They
have asked for a progress report on bulk at their November 9th meeting and a recommendation to
be presented to them in January. In addition, the work plan has been amended to remove the tree
canopy assessment for the time being and instead review the tree retention and replacement
requirements for new construction, which are outlined in sections 20.52.110 and 20.52.130 of
Medina's Municipal Code. In order to have enough time to talk about both topics and take a step
forward in the bulk conversation, Planning Commission will be meeting twice in October.
During the last meeting it was asked if the residential survey results from the summer could be
further refined. It was hypothesized that it is the more established residents who are resistant to
changes that would increase height. Chair Preston has provided a comprehensive summary of the
comments and each individual's response has been separated out. The Comprehensive Plan's land
use element is also included to inform the discussion.

Providing the recommendation is accepted, it should be noted that there is still a public
participation and legal noticing element for the bulk code change that will take place after January.
The tentative adoption of the new bulk regulations could be in April 2021.
The options that have been discussed are below.
Option 1: Structural Coverage Adjustment
Summary: This option would adjust the structural coverage allowed on lots that exceed 16,000
square feet to match those of similar sized lots in the R-20 and R-30 zoning districts. Or, this option
could do away with the zoning aspect and just limit structural coverage to lot size.

Option 2: Incentives (TBD)
Summary: This could be a layered approach. Perhaps if Option I is pursued and the structural
coverage for all lots are reduced, the following could be written as incentives for property owners
to recapture some of that lost coverage
It's been difficult to come up with ways to incentivize development (e.g. pitched roofs) because
many of the traditional methods are just not applicable. Things like expedited permit processing,
affordable housing density bonuses, or reduced permit fees are just not realistic to offer in this
moment. Additional height is contentious and granting more coverage under the current code
doesn't make a lot of sense. A reduction in building capacity is one tool cities are utilizing to
combat excessively large, out of scale houses. If it is determined that the entire structural coverage
needs to be reevaluated and reduced, one way to allow homeowners to recapture some of that lost
square footage (percentage to be determined) could be by requiring a few of the following options,
some of which were discussed briefly last year:

Daylight Plane
Vertically extending to a point (12' or 15' above grade), then an inward sloping line at 45 degrees
Plane Break
All portions of a building that have a side wall exceeding 14 ft. in height and a continuous length
greater than 45 feet shall have an offset/plan break that is a minimum depth of five feet beyond the
required side yard setback and a minimum length of 10 ft.
Second -Story Reduction
This would require reduction coverage in any floor above the first.

Planting Area
At least 50% of the side yard and rear setback shall have a planting area with a minimum width of
5-feet adjoining the side and rear parcel lines (actual percentage and size to be determined).
Option 3: Pitched Roof — Additional Height Bonus
Summary: This option would grant an additional five feet on top of the maximum zoning height
(25 ft./28 ft). if a pitched roof is used and the second floor structural coverage is reduced to 80%
of the first floor
In the Medina Municipal Code (MMC), lots in the R-20 and R-30 zoning district are eligible for
an additional height bonus of 30 feet from the high point of original grade or 36 feet from the low
point of original grade if the structural coverage is reduced to 13% of the lot. Typically with
development regulation incentives, there's a tradeoff as demonstrated by the above example. When
we talk about the possibility of granting an additional five feet, yes that might encourage more
pitched roofs, however it will also negatively contribute to both the perception and actual bulk of
new construction, which is something Council wants to avoid.
In order to maximize the building envelope, it is often the case that one floor is placed directly on
top of another floor, thereby creating a sense of volume and bulk that too often overwhelms
adjacent structures. To offset an increase in additional height but not perpetuate more boxes, it is
proposed that the second floor be reduced to 80% of the first floor. Requiring different coverages
based upon the style of house (single -story vs. two-story) as well as smaller coverages above a
first floor is something that some cities' have done to mitigate the oppressive feeling large box -
style houses can have on a neighborhood.
Option 4: Pitched Roof — Different Height Requirements
Summary: This option would impose different height restrictions depending on the roof -type used:
20 feet for a flat -roof and 25 feet for a pitched roof

gargantuan houses that have no yard and are stacked on top of one another. We are losing our
neighborhoods charm and character

This happened to us 25 years ago.
• Tired of Bellevue allowing mega -mansions that cost millions of dollars, drive up the
prices/affordability of homes, and are larger than 2,500 sq. feet. If you want less traffic on roads,
want less homeless and more housed, don't want this to turn into a concrete city and want to
retain nature and everything that makes the area amazing and worth living in, please reconsider
how many large companies (1000+ employee companies) are being allowed to stack themselves
on top of each other in a tiny space where only multimillion dollar houses exist. PLEASE start
taking future generations into account!!! Thank you for your time.

Too large of homes are allowed on small lots. Evergreen Point Road is not treated as a
residential street like the rest of Medina. It needs protection from speeding and misuse by
cyclists and pedestrians. This too impacts quality of life

ridiculous. What I like may not be what others like and to dictate to residents what they can and
cannot design a house to look like is going to severely impact everyone's property

• Have a citizen architect review board like a very many communities do
• Better home design review with city review board

• I don't want to see a design review committee, so while I may not like a "box" type house,
others may so I don't want to restrict what it looks like.
• If you intend to put restrictions on the architectural styles of home available in Medina then you
are asking for a lawsuit. This is not a CCR community and to impose those upon the residents
present and future is absolutely not in line with the property rights of individuals. I should be
able to build what I want architecturally as long as my structural follows coverage and height
restrictions. If I like Modern, Farmhouse, Craftsman, etc is no business of anyone else's. What is
next colors of paint? Grass maintenance? What if I don't like my neighbor's shade of green on
his house??? Being "impacted" has to be quantified. You can't because it is emotional, This is
purely emotional. I hate the style of Hogwarts on Evergreen Point Road. But I am not going to
say the owners can't build it. They have to live there. Not me. They probably hate my craftsman.
So what?? If you want continuity of style by a track house somewhere else.

fall over but it's expensive to have yearly inspection and expensive to follow the code. Medina
should stop being a busy body strict homeowner's association. Medina is too small to save the
planet even if the entire city were converted to a tree plantation.
• Extremely tall trees are a hazard. They should be banned.
• Please stop neighbors and especially developers from planting Leland Cyprus along property
lines. They are cheap and grow fast, but quickly become a giant cost and nuisance to neighbors
living on the other side. I would encourage you to prohibit the planting of this tree in our
neighborhood. Especially along property lines. It seems unreasonable to me that the adjoining
neighbor should have to spend thousands of dollars a year to maintain someone else trees when
they are growing over the fence. I have personal experience with this problem. Two sides of my
lot have Leland Cyprus trees along the property lien and we spend thousands of dollars every
year to maintain something we didn't plant or want in our yard.
• Legacy Trees should be kept or mandate replant on lot
• Landscape buffers look nice, however in my experience they do not provide noise buffers
• The tree code is still too onerous and requires too many trees on a lot which can reduce access
to light. The shoreline code is very restrictive —the previous building manager told me I couldn't
put up a kids swing set on my property by the lake, which seems anti -family and children
• The waterfront properties that plant big trees should not be permitted
• I don't understand questions #5 — Please do NOT allow Leland Cypress hedge plantings
• 1 am disappointed that major trees can be illegally trimmed or killed to create a view (not

If you intend to put restrictions on the architectural styles of home available in Medina then
you are asking for a lawsuit. This is not a CCR community and to impose those upon the
residents present and future is absolutely not in line with the property rights of individuals. I
should be able to build what I want architecturally as long as my structural follows coverage
and height restrictions. If I like Modern, Farmhouse, Craftsman, etc is no business of anyone
else's. What is next colors of paint? Grass maintenance? What if I don't like my neighbor's
shade of green on his house??? Being "impacted" has to be quantified. You can't because it is
emotional, This is purely emotional. I hate the style of Hogwarts on Evergreen Point Road. But I
am not going to say the owners can't build it. They have to live there. Not me. They probably
hate my craftsman. So what?? If you want continuity of style by a track house somewhere else.

Medina Comprehensive Plan
LAND USE PLAN
Medina has developed and matured into the type of community envisioned at the time of its
incorporation. Old and new residents alike have invested substantially in their homes on the premise
that Medina will continue to maintain its residential quality and character. Development ordinances
and regulations have been adopted over time to assure that these expectations are met. As the above
discussions indicate, there are no compelling reasons for Medina to institute fundamental changes to
its basic land use pattern.
It is important to the community that uses such as the post office and the Medina grocery store, and
facilities such as the City Hall, clock tower, and water tower are retained because of their functional,
historic and cultural contribution to the City. The historical character of these buildings and structures,
and appropriate uses should be retained for future generations. In line with this policy, in 2013 the City
Council amended its zoning regulations and map (Ordinance No. 900) to better reflect existing uses.
St. Thomas Church/School and the Post Office were both rezoned under the Park and Public Places
zoning designation. The amendment also created more uniform zoning boundaries, and eliminated split
zoning on individual parcels.
In the absence of any substantial future growth, it is the basic policy of the City to retain and promote
the high -quality residential setting that has become the hallmark of the Medina community. Medina
will continue to consider ways in which to restrict the size of homes so that individual lots do not
become over -developed and adversely impact the character of the community or the environment.
Future Land Use Desiunations
The Future Land Use Map adopted in this plan establishes the future distribution, extent, and location
of generalized land uses within the City (see Figure 3). The land use categories on the Future Land Use
Map include Single Family Residential, Local Business, Public Facility, School/Institution, Utility,

POLICIES
LU-PI The City shall minimize changes to existing zoning and land use patterns except as to

LU-P2 The City shall consider ways to restrict the size of homes in order to retain the character
of the community and lessen impacts associated with construction.
LU-P3 Residential uses shall not be considered for conversion to non-residential use except
when clearly supported by the community and when impacts to the surrounding area
can be fully mitigated.
LU-P4 The City shall develop a program to preserve community treasures, including, but not
limited to, those historical structures that reflect the City's heritage and history.
LU-P5 Existing non-residential uses are encouraged to be maintained. Existing nonresidential
uses include:
• City Hall
• Medina Grocery Store
• Post Office
• Bellevue Christian School
• Wells Medina Nursery
• Overlake Golf and Country Club
• St. Thomas Church
• St. Thomas School
• Gas Station
• Medina Elementary School
• City facilities and parks
• Utilities
LU-P6 Existing non-residential uses within a residential zone may be converted to residential
use, or may be redeveloped with a new non-residential use in a manner compatible with
surrounding properties when allowed through the conditional use process.
LU-P7 The City shall work with WSDOT and City residents to develop mitigation measures
that it seeks to be implemented as part of regional facilities development or
improvement projects, such as SR 520 and related structures and improvements.
LU-P8 The City shall encourage and facilitate public participation in all land use planning
processes.
LU-P9 The City shall afford due consideration to all stakeholders prior to any land use
decision.
LU-P10 Development of Special Planning Areas and essential public facilities shall require
review of a Master Plan that addresses mitigation of impacts on surrounding uses and
the City as a whole.
LU-P11 If a proposed essential public facility is not located in an existing Special Planning
Area, the proposed site of the essential public facility shall be designated as a Special
Planning Area.
LU-P12 The City shall not preclude the siting of essential public facilities.

LU-P13 The process to site proposed new or expansions to existing essential public facilities
should consist of the following:
a. An inventory of similar existing essential public facilities, including their locations
and capacities;
b. A forecast of the future needs for the essential public facility;
c. An analysis of the potential social and economic impacts and benefits to jurisdictions
receiving or surrounding the facilities;
d. An analysis of the proposal's consistency with County and City policies;
e. An analysis of alternatives to the facility, including decentralization, conservation,
demand management and other strategies;
f. An analysis of alternative sites based on siting criteria developed through an inter -
jurisdictional process;
g. An analysis of environmental impacts and mitigation; and
h. Extensive public involvement.
