negotiations, or grievance or mediation proceedings, or reviewing the proposals made

RCW 42.30.110(1)(g)
To evaluate the qualifications of an applicant for public employment or to review the
performance of a public employee. However, subject to RCW 42.30.140(4), discussion
by a governing body of salaries, wages, and other conditions of employment to be
generally applied within the agency shall occur in a meeting open to the public, and
when a governing body elects to take final action hiring, setting the salary of an
individual employee or class of employees, or discharging or disciplining an employee,
that action shall be taken in a meeting open to the public.
The full Council reconvened into the regular meeting at 4:45 p.m.
ACTION: Motion Frey to adopt the 2020 Medina City Manager review with attachments one
and two as circulated to Council via email by City Attorney Scott Missall on Friday,
December 11. This was seconded by Zook and carried by a 7:0 vote.
ACTION: Motion Frey to increase the City Manager’s pay by 3% in addition to the 1% cola for
a total increase of 4% to be reflected in an adjustment to the upper end of the City
Manager’s salary range. This was seconded by Adkins and carried by a 7:0 vote.
4. PUBLIC COMMENT PERIOD
Mayor Rossman opened the public comment period at 4:49 p.m. The following individual
addressed the Council:
• Brian Pao spoke in regard to a safety issue along Lake Washington Blvd NE
curve and requested that Council look into traffic calming along the curve.
Mayor Rossman closed the public comment period at 4:54 p.m.
5. PRESENTATIONS
5.1 Presentation by City Manager Michael Sauerwein of the City's Top 10 Accomplishments
and Milestones in 2020.
City Manager Michael Sauerwein gave a presentation on City staff’s top 10
accomplishments and milestones of 2020.
5.2 Annual Employee Recognition and Pickle Award Presentation.
Mayor Rossman thanked all staff and City volunteers for managing through the duress
that COVID-19 has brought on. She gave special recognition to Police Office Manager
Barbara Marxer, Police Chief Steve Burns, and Development Services Permit
Technician Amber Taylor who received the most nominations amongst their peers for
the pickle award. Mayor Rossman also recognized the Public Works staff as a whole
and read comments from peer nominations. Finally, Mayor Rossman gave one honorary
pickle award to Deputy Mayor Cynthia Adkins who originated the pickle award.

5.3 Reports and announcements from Park Board, Planning Commission, Emergency
Preparedness, and City Council.
Park Board Sarah Gray gave a brief update from discussions from the last Park Board
meeting. Discussions continue around replacing the play structure at Medina Park.
Chief Burns reported that Emergency Preparedness meeting has been rescheduled to
January. A notice will go out to the community in the coming weeks.

Summary:
Medina has been working under the 2015 Washington State Building Code since July 1, 2016.
Within the building code are regulations intended to protect the health and safety of building
occupants. Our building code covers topics including structural integrity, fire safety,
administration of permits, energy conservation, mechanical systems, plumbing, gas piping, and
much more. The Washington State Building Code is updated every three-years following an
extensive public review process. Following two COVID-19 related delays the 2018 edition of
the State Code is now mandated to be implemented by all Washington counties, cities and
towns on February 1, 2021.

AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON,
AMENDING MEDINA MUNICIPAL CODE CHAPTER 20.40 – BUILDING
CODES; ADOPTING BY REFERENCE THE 2018 EDITIONS OF THE
INTERNATIONAL BUILDING CODE, THE INTERNATIONAL
RESIDENTIAL CODE, THE INTERNATIONAL FIRE CODE; THE
INTERNATIONAL MECHANICAL CODE, THE UNIFORM PLUMBING
CODE, THE WASHINGTON STATE ENERGY CODE, THE
INTERNATIONAL SWIMMING POOL AND SPA CODE, NFPA 58, NFPA
54 ALL TOGETHER WITH LOCAL AMENDMENTS THERETO;
PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN
EFFECTIVE DATE
WHEREAS, the City regulates local construction activity and related matters through the
standards and procedures set forth in the state building code, as defined in Chapter 19.27 RCW
and as adopted locally in Chapter 20.40 MMC; and
WHEREAS, the City Council desires to update the international and uniform codes
adopted by reference in Chapter 20.40 MMC to reflect the most current (2018) state-adopted
standards, together with appropriate local amendments thereto; and
WHEREAS, the updated and/or new regulations adopted under this ordinance will serve
and protect the public health, safety and welfare by ensuring that the City’s local regulatory
framework is current, cohesive and reflects modern standards and procedures for application,
review, administration and enforcement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
Section 1. Amendment of Chapter 20.40 MMC. Chapter 20.40 MMC Building
Codes is hereby amended as follows:
All construction activity and construction materials in the city shall be governed by the
State Building Code as adopted in Chapter 96, Laws of 1974, as updated by the State
Building Code Council to include the 2018 editions of the following codes with
amendments:
Section 2. Severability. Should any section, paragraph, sentence, clause or
phrase of this ordinance, or its application to any person or circumstance, be declared
unconstitutional or otherwise invalid for any reason, or should any portion of this
ordinance be pre-empted by State or federal law or regulation, such decision or pre-

Summary: November 9, 2020 the City Council approved Resolution No. 413, adopting the
2021 property tax levy for the City of Medina and setting forth the estimated levy amount of
$3,986,413. A copy of the resolution, along with supporting documents was submitted to the
King County Assessor’s Office the following week, almost two weeks in advance of the due
date.
December 30, 2020, the King County Assessor requested a clarification setting forth the
increase in dollar amount of the 2021 regular levy identified in City of Medina Resolution No.
413, revising the language only. This will make no impact on the amount of property tax
collected or any taxpayer’s assessment.
The 2021 property tax levy, as presented in Resolution No. 413, was calculated as a 5%
increase to the 2020 levy lid lift amount as approved by the voters. The remainder of the
$99,894 increase was caused by adjustments due to new construction.. The City was able to
meet its 2021 budget without increasing the remaining portion of the 2020 property tax levy.
The King County Assessor has requested the City to revise its resolution to state both the dollar
amount of the overall increase, which was previously only listed in the supporting
documentation, as well as its percentage of increase to the total 2020 amount, not just the lid lift
segment. A red-line version of the resolution is attached.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON,
CERTIFYING TO THE GOVERNING AUTHORITY OF KING COUNTY THE ESTIMATES OF
THE AMOUNT TO BE LEVIED ON THE ASSESSED VALUATION OF THE PROPERTY
WITHIN THE CITY FOR THE YEAR 2021
WHEREAS, the City Council of the City of Medina attest that the population of the City is
less than ten thousand; and
WHEREAS, the City Council has properly given notice of the public hearing held
November 9, 2020 to consider revenue sources for the City’s current expense budget for the
2021 calendar year, pursuant to RCW 84.55.120; and
WHEREAS, the voters approved Proposition 1 on November 5, 2019, to increase
Medina’s regular property tax levy above the limit factor by $0.20/$1000 assessed value to a
maximum rate of $0.83712/$1000 assessed valuation for collection in 2020, set a 5% limit
factor for each year 2021-2025, use the 2025 levy amount as the base to compute
subsequent levy limits, and exempt low income seniors and disabled; as set forth in Ordinance
No. 970; and
WHEREAS, the King County Assessor requested a clarification setting forth the increase
in dollar amount of the 2021 regular levy identified in City of Medina Resolution No. 413
(adopted November 9, 2020), which clarification is set forth in the following Whereas clause;
and
WHEREAS, the City Council, after hearing, and after duly considering all relevant
evidence and testimony presented, has determined that the City of Medina requires a regular
levy in the amount of $3,986,413, for an increase of $99,894, representing a 2.6% increase
which includes a 0% increase in property tax revenue from the previous year, and additional
amounts from including the levy lid lift, as well as amounts resulting from the addition of new
construction and improvements to property, and any possible increase in the value of state-
assessed property, and amounts authorized by law as a result of any annexations that have
occurred and refunds made, in order to discharge the expected expenses and obligations of the
City and in its best interest.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON,
RESOLVES AS FOLLOWS:
Effective Date. This Resolution shall be effective as of December 31, 2020 upon its
adoption by the City Council.

Summary:
The Construction Activity Permit (CAP) is an ordinance and process which regulates development
project impacts on neighboring properties through application of prescriptive mitigation.
Construction parking, work hours, garbage, visual barriers, dust and other impacts are regulated
by the CAP. The CAP replaced the former Construction Mitigation Plan process in July 2019
through adoption of Ordinance 972.
Through use of the CAP it was discovered that updates were needed for the benefit of all users
including permit applicants and city staff. City staff listened to Council input and then worked with
the City Attorney to produce the new proposal. Proposed Ordinance No. 995 addresses those
areas of the CAP Ordinance that through experience were found to need updating. The direct
result of proposed Ordinance 995 is greater time for permit applicants and city staff to perform
mandated actions. A by-product of the proposed updates is the possibility of longer public
comment periods.

15.20.75.010 Purpose.
The purpose of the construction activity permit is to provide a method for citizens to participate in reducing the
impacts of neighboring construction projects while applying a standardized mitigation policy so as to not
unreasonably interfere with permit applicants’ development rights. Additional purposes of this chapter include:
A. Minimizinge potential adverse visual and aesthetic impacts of construction.
B. Establishing objective standards for the mitigation of construction projects.
C. Encouraginge public participation in the mitigation evaluation process.
15.20.75.020 Applicability.
A. Any applicant seeking a building permit from the city is subject to the provisions of this chapter; provided, that:
1. Proposed projects with a combined permit value at or below $499,999 are exempt from the requirements of
MMC 15.20.75.070 and 15.20.75.080.
2. Proposed projects with combined permit value at or above $500,000 shall comply with the additional
requirements in MMC 15.20.75.070.
3. Proposed projects with a combined permit value at or below $499,999 having construction access on a
private lane or joint-use driveway shall comply with the additional requirements in MMC 15.20.75.080.
15.20.75.030 Definitions.
For the purpose of this chapter, the following terms, phrases, words, and abbreviations shall have the meanings
given herein, unless otherwise expressly stated. Words not otherwise defined shall have their common and ordinary
meaning:
A. “Applicant” means the person, persons, or entity who owns the property where the construction under the
building permit is located, or the agent of the person, person, or entity who owns the property where the construction
under the building permit is located.
B. “Building permit” means formal authorization by the city allowing construction activity to occur and includes any
construction activity regulated under permit by the Washington State Building Code as amended by the city of
Medina.
C. “City” means the city of Medina, Washington.
D. “Combined permit value” means the city approved value of all work to be performed.

E. “Construction access” means the entrance and exit points for construction vehicles to reach the project site.
F. “Construction activity” means work performed in association with private development projects performed under
a building permit including but not limited to construction, deliveries to the site, employee arrivals and departures,
and heavy trucking.
G. “Construction activity permit” means the permit issued by the city pursuant to this chapter.
H. “Construction activity site plan” means a site plan which identifies all construction activity associated with the
building permits through standard graphics and notation.
I. “Construction best management practice (BMPs)” means best management practices used in the control of silt
runoff and dust control to help achieve water and air quality goals. Construction BMPs include both measures to
prevent pollution and measures to mitigate pollution.
J. “Construction limits” means an area with established boundaries typically defined by a border consisting of
temporary construction fencing which is installed for the purpose of defining the location of critical areas,
shorelines, tree protection, and low impact development in addition to any other area where construction activity is
prohibited.
K. “Construction parking” means the stopping of any vehicle associated with construction activity on private or
public rights-of-way for a period of greater than 15 minutes; provided, that those vehicles owned by city staff, city
consultants, public utility vehicles, or private property owners are exempt from this definition.
L. “Crane – fixed” means a tower crane which is affixed to the ground and is certified and regulated by the
Washington State Department of Labor and Industries.
M. “Crane – mobile” means a mobile construction crane which is typically affixed to a vehicle and that is certified
and regulated by the Washington State Department of Labor and Industries.
N. “Director” means the city of Medina development services director or designee.
O. “Joint use driveway” means a privately or publicly owned access road without city assigned street designation
used for vehicle access and for use by more than one property.
P. “Heavy truck” means vehicles having a gross vehicle weight of 26,000 pounds or greater, and truck-trailer
combinations having a length over 30 feet.
Q. “Permit holder” means a person or entity that has been issued a construction activity permit.
R. “Private lane” means a privately owned access road with city assigned street designation that provides primary
access to properties and the premises identification.
S. “Public right-of-way” means all public streets and property granted or reserved for, or dedicated to, public use for
streets and all public utilities therein, including easements in favor of the city, together with public property granted
or reserved for, or dedicated to, public use for curbs, gutters and walkways or sidewalks, whether improved or
unimproved, including the air rights, subsurface rights and all easements in favor of the city related thereto.
T. “Road” means any thoroughfare or route used by vehicles including but not limited to public rights-of-way, joint-
use driveways, and private lanes.
U. “Visual barrier” means a temporary fence, landscaping, or other structure or feature that is opaque, six feet high,
and reduces the sight line between the construction and neighboring properties.
V. “Work hours” means the hours within which construction activity is permitted pursuant to Chapter 8.06 MMC.

15.20.75.040 Permit commencement and conclusion.
A. Construction activity may not begin until a construction activity permit is issued, and the permit holder has
attended a preconstruction meeting with the city.
B. Construction activity must cease when the permit holder receives the final inspection approval by city staff.
15.20.75.050 Application requirements.
A. A completed construction activity permit application shall be submitted to the director at the intake meeting
pursuant to MMC 20.80.070(B).
B. A complete construction activity permit application is required and shall contain the following:
1. Construction activity permit application.
2. Legal description of the property.
3. Proof of ownership in the form of one of the following documents:
a. Current purpose and sale agreement;
b. Title;
c. Deed; or
d. Bill of sale.
4. Declaration of agent form.
5. Applications shall include the actual costs incurred by the city in reviewing and processing the construction
activity permit as required by Chapter 20.14 MMC.
6. A sworn statement by the property owner(s), agent and the general contractor acknowledging responsibility
for compliance with the construction activity permit.
7. A right-of-way use permit application pursuant to MMC 12.08.010, if applicable.
C. In addition to the requirements outlined above, the director may require a cConstruction aActivity site plan is
required, drawn at 1" = 10'-0 or 1/8" = 1'-0, or another legible scale as approved by the director, and identifying the
following as applicable:
1. Property boundaries and significant land, and other features including but not limited to bodies of water.
2. Location and dimension to the property boundary of minimum required zoning setbacks.
3. Location of all proposed structures and structures to remain.
4. Adjacent public rights-of-way, private lanes, and joint use drives.
5. Location of construction entrance.
6. Location and swing radius of crane.
7. The estimated duration of crane use.
8. Location of vehicle off-site staging including but not limited to material and equipment deliveries and other
uses of the public rights-of-way.
9. Location of portable toilet a minimum of 10 feet from property boundaries.

10. Location of covered trash container a minimum of 10 feet from property boundaries.
11. Location of construction limits through the location of all critical areas, tree protection, shorelines, and low

15.20.75.060 Permit conditions.
The construction activity permit site plan cover sheet shall contain the following conditions:
A. Work Hours.
1. Permitted pursuant to the MMC 8.06.160.
2. Construction activity is prohibited prior to, or after, the allowed work hours subject to MMC 8.06.160(B),
Exceptions.
B. Construction Parking.
1. Construction parking is prohibited outside of the project’s property boundary, unless specifically permitted
including but not limited to where signed along NE 12th Street.
2. Construction entrance to property and on-site construction parking areas shall be stabilized as a construction
BMP.
C. Site Maintenance.
1. Permit holder shall install or maintain a visual barrier along the project’s property boundary adjacent to other
properties.
2. Project site shall contain an appropriately sized covered trash container.
3. Project site shall be kept clean of trash including but not limited to construction debris and food wrappers.
4. Construction materials shall be stored in a safe, secure, and orderly manner.
D. Noise.
1. Noise shall not exceed the permitted limits identified in Chapter 8.06 MMC.
2. Site workers shall endeavor to limit the sound of radios and voices from traveling across property
boundaries.
3. Idling vehicles are prohibited.
E. Utility Disruption.

1. If the proposed project will disrupt utility service for any neighboring properties, the permit holder shall
provide at least seven days’ written notice to all affected neighbors by delivering a city issued door-hanging
flyer at each affected home that includes the following information:
a. Contact information of the owner or agent for the permitted project which is causing the disruption.
b. The emergency contact information including name, phone number and email address for the utility
contractor doing the work.
c. The date and duration that the service will be affected.
F. Road Closure. Complete closure of roads is prohibited except in an emergency.
G. Road Obstruction. Obstruction of roads is prohibited unless the applicant receives a right-of-way use permit
pursuant to MMC 10.72.040.
H. Director Discretion. The director or designee may modify the construction permit conditions meeting the
requirements within this chapter at any time if additional construction impacts are identified or conditions change.
15.20.75.070 Notice and informational meetingopen house requirements for projects at or above $500,000.
A. Projects with a combined permit value at or above $500,000 shall comply with the requirements of this section.
B. Projects subject to provisions of this section are required to:
1. Provide Post a notice of application; and
2. Hold an informational meetingopen house.
C. Within 14 days of a determination of a complete application, the applicant shall provide a notice of application,
pursuant to this section.The city shall provide a notice of application within 21 days after the determination of a
complete application. The content of the notice of application shall include the following information:
1. The file number assigned to the project permit.
2. The date of the determination of a complete application, and the date the notice of application was mailed.
3. A description of the proposal.
4. A list of the requested and necessary approvals and actions required for the proposal.
5. The location where the application can be reviewed.
6. A statement that the public comments shall be accepted period shall be 14 days from the date of the notice of
application.through the date of the open house.
7. The date, time, and place of the informational meetingopen house.
8. A statement of the rights of any person to comment on the application, receive notice of and participate in
any hearings, and request a copy of the decision once made and any appeal rights..
9. Any other information determined appropriate by the citydirector.
D. The applicant shall be responsible for the notice distribution as required by this section. No later than 1421 days
from the date of the determination of complete application, the applicant shall provide to the director an affidavit
attesting that each required method of notification was carried out in conformance with the regulations in this
chapter. For required mail notice, the applicant shall submit anThis affidavit confirmingshall include verification
that the mailing was sent by first class mailapplicant provided notice to the intended recipients consistent with the
notice requirements of this section. If the affidavit of mailing is not filed as required, any scheduled date by which

the public may comment on an application shall be postponed, if necessary, in order to allow compliance with the
notice requirements of this and other applicable chapters.
E. The notice of application shall be distributed in the following methods:
1. Mailed.
a. Mailed to all property owners within 500 feet of the property boundary line, in all cardinal directions.
b. Notice mailed to persons at their known address shall be judged to have been received by those persons
if those persons and their addresses are named in a declaration of mailing. The failure of any person to
actually receive the notice shall not invalidate any permit or approval.
c. Notice postcard forms shall be provided by the city.
2. Posted.
a. Notice boards shall be placed by the applicant in the following manner:
i. At the midpoint of each abutting street frontage of the site;
ii. No more than five feet inside the street property line;
iii. With the top of the notice board between four and five feet above grade; and
iv. Completely visible and accessible to both drivers and pedestrians.; and
v. In place at least 14 days prior to the date of the informational meeting.
b. Notice boards shall be provided by the city, maintained in clean and readable condition by the permit
holder.
c. Notice boards shall be , and removed by the permit holder within 147 days after the date of the
informational meetingopen house.
F. The open houseinformational meeting shall:
1. Be held no earlier than after the required 14 -days after the notice of application is issued comment period
but no later than but within 3060 days after the date of the notice of application is issueddetermination of
complete application;.
2. Be heldlocated at Medina City Hall between the hours of 5:00 p.m. to 8:00 p.m.;
3. Be moderated, or in an electronic format as determined by the director; and.
3. Be led by the project applicant or assigned agent, and include participation by the general contractor.
4. Provide an opportunity for citizens to offer public input on the applicant’s proposed construction mitigation.
15.20.75.080 Notice requirements for projects with construction access via a private lane or joint-use
driveway.
A. Projects at or below $499,999 that require a building permit and require construction access via a private lane or
joint-use driveway shall comply with the requirements of this section.
B. Projects subject to provisions of this section are required to provide notice of application to all neighbors whose
primary access is via a private lane or joint-use driveway.

C. Within 1421 days of a determination of a complete application, the applicant shall provide a notice of application,
pursuant to this section. The content of the notice of application shall include the following information:
1. The file number assigned to the project permit and the contact information for the property owner or agent.
2. The date of the determination of a complete application, and the date of the notice of application.
3. A description of the proposal.
4. A list of the requested and necessary approvals and actions required for the proposal.
5. The location where the application can be reviewed.
6. A statement that any comments or questions shall be directed exclusively to the property owner or agent on
file.
7. Any other information determined appropriate by the citydirector.
D. The applicant shall be responsible for all notice distribution as required by this section. No later than 1421 days
from the date of the determination of complete application, the applicant shall provide to the director an affidavit
attesting that the required method of notification was carried out in conformance with the regulations in this section.
This affidavit shall include verification that the applicant provided notice to the intended recipients consistent with
the notice requirements of this section. The construction activity permit shall not be issued until the affidavit is filed
with the city pursuant to this section.
E. The notice of application shall be distributed via hand delivery, or a door-hanger, hung or an equivalent method
as approved by the director on theeach front door, or other primary entrance as appropriate, of all properties whose
primary access is via the private lane or joint-use driveway shared by the project site.
F. The notice of application templateforms will shall be provided by the city.
15.20.75.090 Review and approval procedure.
A. Construction activities permits shall be processed as a Type 1 decision. The director’s decision is appealed
pursuant to MMC 20.80.220.
B. The director shall review the application for compliance with this provision of this chapter and other applicable
ordinances and regulations as they currently exist or are hereafter amended, and shall approve or deny the permit
application in conformance with this chapter.
15.20.75.100 Enforcement.
Violations of any provisions of this chapter shall be subject to the enforcement provisions and penalties set forth in
Chapters 1.15 and 20.16 MMC.

AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON, AMENDING
MEDINA MUNICIPAL CODE TITLE 20 (UNIFIED DEVELOPMENT CODE) TO
ESTABLISH A NEW CHAPTER MMC 20.75 RELATED TO CONSTRUCTION
MITIGATION; REPEALING CHAPTER MMC 15.20 (MITIGATION PLANS FOR
MAJOR CONSTRUCTION ACTIVITIES); PROVIDING FOR SEVERABILITY;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the Medina Municipal Code (“MMC” or “Code”) Chapter 15.20 established
construction activity mitigation requirements for the City of Medina (“City”); and
WHEREAS, certain provisions and requirements of MMC Chapter 15.20 have been
updated to reflect revised processes and procedures; and
WHEREAS, the City established the Medina Unified Development Code in Title 20 of the
MMC; and
WHEREAS, the City staff recommend relocating revised MMC Chapter 15.20 to MMC
Title 20 in order to consolidate all building and construction related regulations into one title of the
Code; and
WHEREAS, the City’s SEPA responsible official issued a determination of non-
significance on September 3, 2020 which was not appealed and thus is final; and
WHEREAS, pursuant to MMC 20.81.070, the City Council held a public hearing on
November 9th, 2020, which was noticed in the Seattle Times, to solicit and receive public
testimony regarding the amendments proposed herein; and
WHEREAS, upon review of the proposed amendments, staff’s presentation, and
consideration of public testimony, City Council finds that the proposed amendments as set forth
in Exhibit A, attached and incorporated herein serve the public health, safety, and welfare; and
WHEREAS, the City Council desires to amend the existing MMC as set forth in Exhibit
A.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
Section 1. Recitals Adopted. The foregoing recitals are hereby adopted in support of
this Ordinance.
Section 2. MMC Chapter 15.20 Repealed. Chapter 15.20 of the Medina Municipal Code
is here by repealed in its entirety.
Section 3. MMC Title 20 Amended. Title 20 of the Medina Municipal Code is hereby
amended by the addition of a new Chapter 20.75 – Construction Activity Permit as set forth in
Exhibit A, attached and incorporated herein.

Section 4. Corrections. The City Clerk and codifiers of the ordinance are authorized to
make necessary corrections to this Ordinance including, but not limited to, the correction of
scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any
references thereto.
Section 5. Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this Ordinance is declared unconstitutional or invalid for any reason, such invalidity shall
not affect the validity or effectiveness of the remaining portions of this Ordinance.
Section 6. Effective Date. This ordinance or a summary thereof consisting of the title
shall be published in the official newspaper of the City and shall take effect and be in full force
five (5) days after publication.

15.20.75.010 Purpose.
The purpose of the construction activity permit is to provide a method for citizens to participate in reducing the
impacts of neighboring construction projects while applying a standardized mitigation policy so as to not
unreasonably interfere with permit applicants’ development rights. Additional purposes of this chapter include:
A. Minimizinge potential adverse visual and aesthetic impacts of construction.
B. Establishing objective standards for the mitigation of construction projects.
C. Encouraginge public participation in the mitigation evaluation process.
15.20.75.020 Applicability.
A. Any applicant seeking a building permit from the city is subject to the provisions of this chapter; provided, that:
1. Proposed projects with a combined permit value at or below $499,999 are exempt from the requirements of
MMC 15.20.75.070 and 15.20.75.080.
2. Proposed projects with combined permit value at or above $500,000 shall comply with the additional
requirements in MMC 15.20.75.070.
3. Proposed projects with a combined permit value at or below $499,999 having construction access on a
private lane or joint-use driveway shall comply with the additional requirements in MMC 15.20.75.080.
15.20.75.030 Definitions.
For the purpose of this chapter, the following terms, phrases, words, and abbreviations shall have the meanings
given herein, unless otherwise expressly stated. Words not otherwise defined shall have their common and ordinary
meaning:
A. “Applicant” means the person, persons, or entity who owns the property where the construction under the
building permit is located, or the agent of the person, person, or entity who owns the property where the construction
under the building permit is located.
B. “Building permit” means formal authorization by the city allowing construction activity to occur and includes any
construction activity regulated under permit by the Washington State Building Code as amended by the city of
Medina.
C. “City” means the city of Medina, Washington.
D. “Combined permit value” means the city approved value of all work to be performed.

E. “Construction access” means the entrance and exit points for construction vehicles to reach the project site.
F. “Construction activity” means work performed in association with private development projects performed under
a building permit including but not limited to construction, deliveries to the site, employee arrivals and departures,
and heavy trucking.
G. “Construction activity permit” means the permit issued by the city pursuant to this chapter.
H. “Construction activity site plan” means a site plan which identifies all construction activity associated with the
building permits through standard graphics and notation.
I. “Construction best management practice (BMPs)” means best management practices used in the control of silt
runoff and dust control to help achieve water and air quality goals. Construction BMPs include both measures to
prevent pollution and measures to mitigate pollution.
J. “Construction limits” means an area with established boundaries typically defined by a border consisting of
temporary construction fencing which is installed for the purpose of defining the location of critical areas,
shorelines, tree protection, and low impact development in addition to any other area where construction activity is
prohibited.
K. “Construction parking” means the stopping of any vehicle associated with construction activity on private or
public rights-of-way for a period of greater than 15 minutes; provided, that those vehicles owned by city staff, city
consultants, public utility vehicles, or private property owners are exempt from this definition.
L. “Crane – fixed” means a tower crane which is affixed to the ground and is certified and regulated by the
Washington State Department of Labor and Industries.
M. “Crane – mobile” means a mobile construction crane which is typically affixed to a vehicle and that is certified
and regulated by the Washington State Department of Labor and Industries.
N. “Director” means the city of Medina development services director or designee.
O. “Joint use driveway” means a privately or publicly owned access road without city assigned street designation
used for vehicle access and for use by more than one property.
P. “Heavy truck” means vehicles having a gross vehicle weight of 26,000 pounds or greater, and truck-trailer
combinations having a length over 30 feet.
Q. “Permit holder” means a person or entity that has been issued a construction activity permit.
R. “Private lane” means a privately owned access road with city assigned street designation that provides primary
access to properties and the premises identification.
S. “Public right-of-way” means all public streets and property granted or reserved for, or dedicated to, public use for
streets and all public utilities therein, including easements in favor of the city, together with public property granted
or reserved for, or dedicated to, public use for curbs, gutters and walkways or sidewalks, whether improved or
unimproved, including the air rights, subsurface rights and all easements in favor of the city related thereto.
T. “Road” means any thoroughfare or route used by vehicles including but not limited to public rights-of-way, joint-
use driveways, and private lanes.
U. “Visual barrier” means a temporary fence, landscaping, or other structure or feature that is opaque, six feet high,
and reduces the sight line between the construction and neighboring properties.
V. “Work hours” means the hours within which construction activity is permitted pursuant to Chapter 8.06 MMC.

15.20.75.040 Permit commencement and conclusion.
A. Construction activity may not begin until a construction activity permit is issued, and the permit holder has
attended a preconstruction meeting with the city.
B. Construction activity must cease when the permit holder receives the final inspection approval by city staff.
15.20.75.050 Application requirements.
A. A completed construction activity permit application shall be submitted to the director at the intake meeting
pursuant to MMC 20.80.070(B).
B. A complete construction activity permit application is required and shall contain the following:
1. Construction activity permit application.
2. Legal description of the property.
3. Proof of ownership in the form of one of the following documents:
a. Current purpose and sale agreement;
b. Title;
c. Deed; or
d. Bill of sale.
4. Declaration of agent form.
5. Applications shall include the actual costs incurred by the city in reviewing and processing the construction
activity permit as required by Chapter 20.14 MMC.
6. A sworn statement by the property owner(s), agent and the general contractor acknowledging responsibility
for compliance with the construction activity permit.
7. A right-of-way use permit application pursuant to MMC 12.08.010, if applicable.
C. In addition to the requirements outlined above, the director may require a cConstruction aActivity site plan is
required, drawn at 1" = 10'-0 or 1/8" = 1'-0, or another legible scale as approved by the director, and identifying the
following as applicable:
1. Property boundaries and significant land, and other features including but not limited to bodies of water.
2. Location and dimension to the property boundary of minimum required zoning setbacks.
3. Location of all proposed structures and structures to remain.
4. Adjacent public rights-of-way, private lanes, and joint use drives.
5. Location of construction entrance.
6. Location and swing radius of crane.
7. The estimated duration of crane use.
8. Location of vehicle off-site staging including but not limited to material and equipment deliveries and other
uses of the public rights-of-way.
9. Location of portable toilet a minimum of 10 feet from property boundaries.

10. Location of covered trash container a minimum of 10 feet from property boundaries.
11. Location of construction limits through the location of all critical areas, tree protection, shorelines, and low

13. The estimated duration of outdoor tile cutting.
14. Location of barge.
15. The estimated duration of barge use.
16. Any proposed utility service disruptions to neighboring properties.
17. The estimated duration of disrupted utility service.
15.20.75.060 Permit conditions.
The construction activity permit site plan cover sheet shall contain the following conditions:
A. Work Hours.
1. Permitted pursuant to the MMC 8.06.160.
2. Construction activity is prohibited prior to, or after, the allowed work hours subject to MMC 8.06.160(B),
Exceptions.
B. Construction Parking.
1. Construction parking is prohibited outside of the project’s property boundary, unless specifically permitted
including but not limited to where signed along NE 12th Street.
2. Construction entrance to property and on-site construction parking areas shall be stabilized as a construction
BMP.
C. Site Maintenance.
1. Permit holder shall install or maintain a visual barrier along the project’s property boundary adjacent to other
properties.
2. Project site shall contain an appropriately sized covered trash container.
3. Project site shall be kept clean of trash including but not limited to construction debris and food wrappers.
4. Construction materials shall be stored in a safe, secure, and orderly manner.
D. Noise.
1. Noise shall not exceed the permitted limits identified in Chapter 8.06 MMC.
2. Site workers shall endeavor to limit the sound of radios and voices from traveling across property
boundaries.
3. Idling vehicles are prohibited.
E. Utility Disruption.

1. If the proposed project will disrupt utility service for any neighboring properties, the permit holder shall
provide at least seven days’ written notice to all affected neighbors by delivering a city issued door-hanging
flyer at each affected home that includes the following information:
a. Contact information of the owner or agent for the permitted project which is causing the disruption.
b. The emergency contact information including name, phone number and email address for the utility
contractor doing the work.
c. The date and duration that the service will be affected.
F. Road Closure. Complete closure of roads is prohibited except in an emergency.
G. Road Obstruction. Obstruction of roads is prohibited unless the applicant receives a right-of-way use permit
pursuant to MMC 10.72.040.
H. Director Discretion. The director or designee may modify the construction permit conditions meeting the
requirements within this chapter at any time if additional construction impacts are identified or conditions change.
15.20.75.070 Notice and informational meetingopen house requirements for projects at or above $500,000.
A. Projects with a combined permit value at or above $500,000 shall comply with the requirements of this section.
B. Projects subject to provisions of this section are required to:
1. Provide Post a notice of application; and
2. Hold an informational meetingopen house.
C. Within 14 days of a determination of a complete application, the applicant shall provide a notice of application,
pursuant to this section.The city shall provide a notice of application within 21 days after the determination of a
complete application. The content of the notice of application shall include the following information:
1. The file number assigned to the project permit.
2. The date of the determination of a complete application, and the date the notice of application was mailed.
3. A description of the proposal.
4. A list of the requested and necessary approvals and actions required for the proposal.
5. The location where the application can be reviewed.
6. A statement that the public comments shall be accepted period shall be 14 days from the date of the notice of
application.through the date of the open house.
7. The date, time, and place of the informational meetingopen house.
8. A statement of the rights of any person to comment on the application, receive notice of and participate in
any hearings, and request a copy of the decision once made and any appeal rights..
9. Any other information determined appropriate by the citydirector.
D. The applicant shall be responsible for the notice distribution as required by this section. No later than 1421 days
from the date of the determination of complete application, the applicant shall provide to the director an affidavit
attesting that each required method of notification was carried out in conformance with the regulations in this
chapter. For required mail notice, the applicant shall submit anThis affidavit confirmingshall include verification
that the mailing was sent by first class mailapplicant provided notice to the intended recipients consistent with the
notice requirements of this section. If the affidavit of mailing is not filed as required, any scheduled date by which

the public may comment on an application shall be postponed, if necessary, in order to allow compliance with the
notice requirements of this and other applicable chapters.
E. The notice of application shall be distributed in the following methods:
1. Mailed.
a. Mailed to all property owners within 500 feet of the property boundary line, in all cardinal directions.
b. Notice mailed to persons at their known address shall be judged to have been received by those persons
if those persons and their addresses are named in a declaration of mailing. The failure of any person to
actually receive the notice shall not invalidate any permit or approval.
c. Notice postcard forms shall be provided by the city.
2. Posted.
a. Notice boards shall be placed by the applicant in the following manner:
i. At the midpoint of each abutting street frontage of the site;
ii. No more than five feet inside the street property line;
iii. With the top of the notice board between four and five feet above grade; and
iv. Completely visible and accessible to both drivers and pedestrians.; and
v. In place at least 14 days prior to the date of the informational meeting.
b. Notice boards shall be provided by the city, maintained in clean and readable condition by the permit
holder.
c. Notice boards shall be , and removed by the permit holder within 147 days after the date of the
informational meetingopen house.
F. The open houseinformational meeting shall:
1. Be held no earlier than after the required 14 -days after the notice of application is issued comment period
but no later than but within 3060 days after the date of the notice of application is issueddetermination of
complete application;.
2. Be heldlocated at Medina City Hall between the hours of 5:00 p.m. to 8:00 p.m.;
3. Be moderated, or in an electronic format as determined by the director; and.
3. Be led by the project applicant or assigned agent and include participation by the general contractor.
4. Provide an opportunity for citizens to offer public input on the applicant’s proposed construction mitigation.
15.20.75.080 Notice requirements for projects with construction access via a private lane or joint-use
driveway.
A. Projects at or below $499,999 that require a building permit and require construction access via a private lane or
joint-use driveway shall comply with the requirements of this section.
B. Projects subject to provisions of this section are required to provide notice of application to all neighbors whose
primary access is via a private lane or joint-use driveway.

C. Within 1421 days of a determination of a complete application, the applicant shall provide a notice of application,
pursuant to this section. The content of the notice of application shall include the following information:

4. A list of the requested and necessary approvals and actions required for the proposal.
5. The location where the application can be reviewed.
6. A statement that any comments or questions shall be directed exclusively to the property owner or agent on
file.
7. Any other information determined appropriate by the citydirector.
D. The applicant shall be responsible for all notice distribution as required by this section. No later than 1421 days
from the date of the determination of complete application, the applicant shall provide to the director an affidavit
attesting that the required method of notification was carried out in conformance with the regulations in this section.
This affidavit shall include verification that the applicant provided notice to the intended recipients consistent with
the notice requirements of this section. The construction activity permit shall not be issued until the affidavit is filed
with the city pursuant to this section.
E. The notice of application shall be distributed via hand delivery, or a door-hanger, hung or an equivalent method
as approved by the director on theeach front door, or other primary entrance as appropriate, of all properties whose
primary access is via the private lane or joint-use driveway shared by the project site.
F. The notice of application templateforms will shall be provided by the city.
15.20.75.090 Review and approval procedure.
A. Construction activities permits shall be processed as a Type 1 decision. The director’s decision is appealed
pursuant to MMC 20.80.220.
B. The director shall review the application for compliance with this provision of this chapter and other applicable
ordinances and regulations as they currently exist or are hereafter amended, and shall approve or deny the permit
application in conformance with this chapter.
15.20.75.100 Enforcement.
Violations of any provisions of this chapter shall be subject to the enforcement provisions and penalties set forth in
Chapters 1.15 and 20.16 MMC.

o SR 520 Expansion-Joint – Continue to aggressively manage SR 520 expansion-joint
noise issue to achieve an agreeable resolution.
• Maintain regular and consistent communication with Washington State
Legislators, WSDOT, and consultants.
• Continue to work with Legislators, WSDOT, and consultants to include Phase 2
of the University of Washington Engineering Department’s Sound Mitigation
Study in the State’s Supplemental Budget.
• Have the University of Washington Engineering Department to present the results
of Phase 2 of their Sound Mitigation Study to the City Council. (2022).
o Community Survey – In 2019 and 2020 the Development Services Department
conducted three surveys to ascertain citizen’s attitudes regarding construction and
development in their neighborhoods. Results of the surveys were discussed at the
September 22, 2020 Joint City Council Planning Commission Meeting.
In 2021 we will conduct a Community Survey including city services, community
priorities, and quality of life in Medina.
o Bi-Monthly Online Open House with the City Manager and Police Chief – This is a
temporary COVID replacement for “Coffee with the City Manager and Mayor” and
“Coffee with a Cop”.
• City Staff will hold on-line Community Forums on the following topics:
o Emergency Preparedness and other Community Public Safety Concerns.

appropriate traffic calming techniques.
o Leaf Blowers and Gas-Powered Lawn Equipment – Work with neighboring cities, to
regulate use of this equipment. (2020 Performance Review)
o Employee Training Programs – The following programs are offered at no-cost though
our insurance carrier; Washington Cities Insurance Authority (WCIA).
• Implicit Bias and Unlearning Racism – I recently attended this excellent two-
day program. While our Police Officers receive similar training on a regular basis
as part of the Department’s accreditation process …I would like to provide it to
all City employees this year.
• Preventing Harassment and Discrimination in the Workplace – This ½ day
program is regularly provided to all employees. One session for employees. One
for supervisors. We will also include lifeguards and seasonal employees if
scheduling allows.
o Service Level Agreement – Develop a Service Level Agreement specifying how City
Staff responds to questions and complaints. Promote and encourage the use of our on-
line Citizen Helpdesk. (2020 Performance Review)
o Annual Review Process – Work with the Personnel Committee to develop an annual
review process for all City Staff. (2020 Performance Review)

o Washington Association of Sheriffs and Police Chiefs (WASPC) Accreditation –
Medina Police Department is up for WASPC re-accreditation in 2021. Department
successfully passed re-accreditation in May 2017. The purpose of law enforcement

agency accreditation is to professionalize the law enforcement industry by providing a
review process for agencies to be certified as operating under industry best practices and
standards.
o Training – Fulfilling the expanded training requirement for the Law Enforcement
Training and Community Safety Act (LETCSA), passed in 2018. This will be the first
year we will be required to fulfill higher training hours and requirements. In November
2018, voters passed Initiative 940 (I-940) in an effort to establish higher training
requirements and police accountability standards so we will need to work to complete the
new level of training.
o Emphasis on Traffic Safety – Continue to focus on all traffic safety – vehicular, bicycle,
and pedestrian – throughout the community through education, engineering (where
possible and cost effective), social media, and enforcement to reduce collisions, improve
awareness, and improve safety.
o Support and promote Medina Emergency Preparedness Committee including
Schools Sub-Committee.
Development Services
o Public Portal – Continue development of our new Public Portal with the goal of fully
independent use by outside users.
o Staff Cross-Training – This regular and primarily internal training program will assure
continuity of services, service maintenance, and workload balancing.
o State Building Codes – Adopt the 2018 Washington State Building Code.
o Right of Way Permit – Create a new Development Services Right of Way Use permit.
This will consolidate all work associated with development projects into Development
Services and reduce the Public Works Directors involvement in volumes of small
projects.

Police Department Update – December 2020
The following is a summary highlighting some of the Medina Police Department activity in December
2020.
Year End Review 2020: The City of Medina and Town of Hunts Point had a slight increase in
property crime in 2020 compared to 2019. In 2020, Medina Police officers handled a combined 14
burglaries in Medina and Hunts Point which was the same number as 2019. Officers investigated 22
car prowls which was an increase from the 18 car prowls that occurred in 2019. Most of the property
crimes were committed by suspects entering a car or building through an unlocked door or window.
Medina and Hunts Point had an increase in malicious mischief cases in 2020 from 2019 investigating
16, up from the 11 investigations in 2019. Theft investigations had a slight increase in 2020 with 18
investigations compared to 17 in 2019. Identity theft saw the largest increase – 41 investigations in
2020 compared to the 9 that occurred in 2019. Overall, total crimes investigated increased from 75 in
2019 to 113 in 2020.
Police Officers responded to noticeably more domestic disturbances, trespass, harassment, mental
health, and suicide calls for service in 2020 – 134 calls in 2020 more than doubling the 62 calls in
2019.
There were 11 traffic collisions in 2020, down from 19 in 2019.
The Medina Police Department continues to work with local law enforcement communities to
Identify trends and apprehend suspects. The use of technology, including police and residential
surveillance cameras, has assisted Medina PD with identifying potential suspects.
Calls for service, crime prevention and outreach continued to be a focus in 2020:
Officers performed 177 House Watch checks,
59 E-Lert notifications were sent out in 2020,
Increased social media tools (Twitter, Facebook, Nextdoor Medina) utilized,
Officers responded to over 1300 calls for service,
One virtual “Community Forum with the City Manager and Police Chief” was held. COVID-19
restrictions caused the cancelation of Coffee-with-a-Cop and Shredder/E-recycle/Drug-Take-
Back Days.
Proactive involvement from the citizens has been and will continue to be important in reducing
crime in the community. Citizens should continue calling 911 when observing suspicious
activity and utilizing the House Watch Program to assist in protecting homes when away.

Sauerwein and Police Chief Steve Burns held a virtual “Community Forum with the City Manager and
Police Chief.” The forum was very successful as there were over 45 attendees. There was a
presentation by Chief Burns covering the following topics:

Captain Dave Scherf Retires from Law Enforcement: After 31+ years in law enforcement, Captain
Dave Scherf will be retiring from law enforcement. Dave spent 25 years with the Washington State
Patrol before coming to Medina as a police officer in March 2015. In August 2016 he was promoted
to Captain. Dave has been a valuable member of the Medina Police Department and community.
His friendly demeanor and positive attitude have been greatly appreciated by all that meet him.

InGov. Jay Inslee today announced “Healthy Washington — Roadmap to Recovery,” a COVID‐19 phased recovery
plan. Beginning on January 11, 2021, the state will follow a regional recovery approach with every region beginning
in Phase 1.
“No one was untouched by the effects of the pandemic in 2020; many have and continue to suffer through no fault
of their own,” Inslee said during a press conference Tuesday. “We aren’t out of this yet, but we are close to turning
the corner on COVID‐19 and this third wave of infection.”
Washington has avoided overwhelming the state’s health care systems throughout this pandemic so far through
rigorous safety measures, such as physical distancing and masking, as well as social and economic restrictions. This
new recovery system aims to safely ease some restrictions while also maintaining crucial hospital capacity,
ensuring care for Washingtonians that need it and paving the way for economic recovery.
Governor Inslee had announced temporary restrictions to be in effect statewide initially from November 17 until
December 14, extended until January 4th and subsequently to January 11th.

Gov. Jay Inslee announced the state will provide funding for almost 100,000 Washingtonians who will lose federal
Pandemic Unemployment Assistance (PUA) benefits.
This emergency payment will be issued by the Washington State Employment Security Department (ESD) to all
PUA claimants who were in active status the week ending November 21st, and will total $550 per claimant, which
equates to roughly two weeks of benefits for most PUA recipients. If signed, the federal relief package would
extend federal PUA benefits through March 14, 2021.

Permit Activity
The “Monthly Issued Permit Report” dated 2020 provided with this report shows a
2020 vs. 2019 comparison. 2019 was an extraordinarily busy year for Development
Services. January and February of 2020 were even busier than 2019, but in March
that ended.
Total (permit) value of work in 2020 was $24,492.00 vs. $118,126,260 in 2019. A
typical year is approximately $35,000,000 in permit valuation.
Pre-application meetings have been regular meaning that future permit applications
will be coming.
The adoption the 2018 Washington State Building Code in February 2021 does have
some impact on our current pre-application activity as applicants often try to get their
projects vested prior to the code change.
Planning Commission
On March 27, 2020, the Governor signed into law SB 6617 which requires all cities
remove the on-site parking requirement for accessory dwelling units (ADU’s) within
¼ mile of a major transit stop. In Medina, a major transit stop includes the park-n-
ride on Evergreen Point Road as well as the bus stops on 84th Avenue NE and NE
12th Street. The legislation does allow a city to continue to require on-site parking if
it has determined that those impacted areas do not have the adequate street parking
capacity, have physical space impediments, or there are other reasons supported
by evidence that would make on-street parking infeasible. In January, our planning
consultants will begin a parking study to determine whether or not the city’s streets
will be able to accommodate this increased parking. The planning consultant line
item in Development Services 2021 budget will fund the study. If it is determined the
city does have adequate space to support the additional parking, an amendment will
be required by July 1, 2021. If the study determines there is not adequate parking
available, no code change will be required. Once it is determined whether or not
Medina will need to adopt the off-street parking requirements of SB 6617, staff will
bring to Council minor code amendments in the first half of 2021. These

amendments are intended to clean up the code by repealing expired sections,
providing clarification, and include minor updates required by HB 2343.
Planning Commission’s December 8th meeting update was included in Council’s
December 14th packet. They will meet next on January 26th.
Code Enforcement
Code enforcement was light in December. One warning was issued for construction
parking.
With limited staff availability at City Hall, COVID is having a significant effect on our
ability to proactively provide Construction Activity Permit code enforcement.
2018 Washington State Building Code Adoption – Ordinance No. 994
For adoption on your consent agenda is the 2018 Washington State Building Code.
The 2018 State Code replaces the 2015 edition. Medina is required to adopt the
new 2018 edition as are all jurisdictions in our state. The “Building Code” is actually
several volumes of various technical and administrative books covering subjects
including building construction, mechanical, plumbing, energy, ventilation and many
other topics. The building code further references thousands of other documents
which are then all adopted together.
Medina does have the option to make some administrative amendments, but we are
not proposing any changes within this adoption cycle.
Construction Activity Permit Amendments – Ordinance No. 995
The Construction Activity Permit (CAP) is an ordinance and process which regulates
development project impacts on neighboring properties through application of
prescriptive mitigation. Construction parking, work hours, garbage, visual barriers,
dust and other impacts are regulated by the CAP. The CAP replaced the former
Construction Mitigation Plan process in July 2019 through adoption of Ordinance
972.
Through use of the CAP for several months it was discovered that updates were
needed for the benefit of all users including permit applicants and city staff. City
staff listened to Council input and then worked with the City Attorney to produce the
new proposal. Proposed Ordinance No. 995 addresses those areas of the CAP
Ordinance that through experience were found to need updating. The direct result
of proposed Ordinance 995 is greater time for permit applicants and city staff to
perform mandated actions.
2021 Development Services Goals
Again this year we have some very important goals to achieve. These goals are of
course in addition to our regular work processing and work with development
projects. Council will need to be involved and approve of some of what we are doing
in Development Services this year. The City Manager is providing the 2021 goals

to you. Here is a highlight of a few goals we are working on that you may be
interested in:
• Right of Way Permit. We would like to create a “Development Services Right
of Way Use permit. This would consolidate various right of way permits for a
development project into a single permit. This will reduce our Public Works
Directors work on these small projects, reduce administrative staff time, give
a simpler approach to permitting for contractors and staff, and allow us to
better evaluate our costs and assure that our fees match our expenses.
Additionally, we will have better control of the right of way landscaping. This
will additionally create a revenue source to cover actual costs of permitting.
• Development Code and Process Complexity Reduction. We will be working
to reduce complexities of our Unified Development Code and our processes
where possible. Staff will be reviewing our code sections and will bring code
amendments to Council during the year. Processes and procedures are also
being evaluated. Goal is simplicity and efficiency where possible.
• Cost vs. Service Analysis.
We are looking at our costs of service both internal and external. This is a
deep look at Development Services that has not happened in some time. The
goal is to understand all costs of service vs. all revenue. This will ultimately
come back to Council as fees and fee structures will likely require
modifications. During the process I will ask Council to be involved. This effort
is also considering a 2022 proposal for Development Services to have its own
enterprise fund where we will in essence be similar to a non-profit business.
• Professional Services Contracts
We have already begun the review of contracts and have begun talking with
our professional services consultants regarding their contracts and billing
methods. This is part of the “Cost vs. Service Analysis”, and effort towards
what will be a proposed 2022 separate Development Services fund
(‘Enterprise Fund”). We will be working with our consultants towards assuring
their costs are better accounted for and that their costs are fully covered in
our fees. Setting a structure for analysis will allow for annual review and
adjustments that we do not currently have.
• Advance Deposit
We will be simplifying this existing process and modifying for better accuracy.
This is also a part of the “Cost vs. Service Analysis”. We have traditionally
collected deposits from applicants regarding certain building permit
applications. These additional funds are collected above the permit fees paid
and are used to offset additional costs incurred during the permit life. Unused
funds are returned at the end of a project. Additional funds are often needed
to re-build the deposit. The deposits pay for consultant and city staff costs for
permitted development project costs which are outside of the intent of the
permit fees. Typically, these costs are for revisions and additional requests
for inspections beyond the permit fee intent.

• Code Enforcement
Our code enforcement chapter in our Medina Municipal Code requires
updating and simplifications. This is a very large project that we will work
on over the next several months and bring to Council a draft later in 2021.

The City of Medina operates on a modified accrual year which allows us to have a “13th month” each year in
order to process expenses into a prior year. December & 2020 will not close until January 20, 2020. Final
reports will be submitted in your February meeting packet.
GENERAL FINANCE UPDATES
The Finance Committee met on December 7th. During that meeting the 2021 Committee Goals were created:
• Continue developing community-friendly, accessible financial information as started in 2020 with
2021’s budget-in-brief. The committee wishes to serve as a first-round feedback during
development.
• Have the Finance Director create a report on 2020’s year-end General Fund carryover balance,
reflecting the significant budget variances that caused it. The Committee would like to review it
as part of the process of determining a recommendation to Council as to what to do with it.
Reserves? Special project? Combination?
• Continue with meeting on even months and as needed. The meetings will include quarterly “deep
dives” into the financial statements, preferably before they are published in a regular Council
meeting packet. This schedule does not preclude off-cycle communications from the Finance
Director to the Committee if something big changes that an alert could help forestall surprises.
The State Auditor published their recently completed 2019 audit of the City. As previously mentioned, the City

SNEAK-PEAK OF 2020’S CLOSING FINANCIAL STATEMENTS
Sales tax receipts are already completed for the year. The original 2020 budget projected the City to receive
$1,277,688 which was later amended to $1,477,688. Actual receipts were $1,587,383, making 2020 the largest
sales tax year in Medina’s history!
December is usually a pretty slow month for real estate sales, which drive REET receipts. In 2019, three
properties were sold, totaling $8.3M and generating $41K of real estate excise tax for the City. As I have been
reporting all year, 2020 has been extremely robust for Medina’s real estate market and December 2020 was no
different. Seven properties were sold, totaling $41M and generating $202K of REET for the City. At least a third
of all homes sold during 2020 are being purchased to tear down and replace with a much larger structure---
keeping the pace of development, and associated sales tax pouring through Medina for another few years at
least. December actually only had 1 tear down listed but it will be impactful: $7.55M purchase price for 0.89
acres of lakefront on Evergreen Point Road.

1. 2021 PUBLIC WORKS CAPITAL PROJECTS – Every year the Public Works Department develops
a list of capital projects for the upcoming budget year. Maintenance projects or mandated updates
to infrastructure is typically priority. However, there are many other elements that are considered
during the process to balance the city’s long-term goals.

2. HEAVY RAIN EVENTS & LOCAL FLOODING – Over the last month, the Puget Sound Region has
experienced extremely wet weather with 24-hour rainfall totals near 3 inches. These heavy rain
events along with the residual fall leaves have overwhelmed the city’s current storm system. The
city was seeing localized flooding especially in the basin areas. As stated in last month’s report,
Gray & Osborne is contracted to update and evaluate the city’s storm system and develop a list of
future projects.

3. PRIVATE STORM INSPECTION PROGRAM – After the second round of letters were mailed to
homeowners, the city received an additional 18 completed inspections. For 2020, the city received
48 completed inspections out of the updated list of 98 properties that have private storm facilities.
Per the NPDES permit requirements the Department of Ecology requires 80% compliance. Even
though the city is still non-compliant, these numbers show our commitment to achieving the 80%
goal for 2021.

4. MAINTENANCE UPDATES – During the month of December the Public Works crew responded
to numerous stormwater related maintenance calls. There were also several fallen tree incidents
caused by a combination of saturated ground and windy conditions. Over the holidays, the stair
railings at Medina Park were hit by a vehicle which destroyed both handrails. Public Works was
able to straighten one rail and temporarily reinstall it to provide support until a permanent fix can
be done.

5. PROJECT UPDATES –
2015 Medina Park Stormwater Pond Imp. – Bravo Environmental has proposed a vactoring
procedure to dredge the pond. However, we are currently researching a method that will lessen
the impact to the pond wildlife. In addition, recent estimates for material disposal is around
$900,000.00.
2017 Medina Beach Park Tree Replanting – Currently waiting for phase III tree planting.
TIB 84th Ave NE Overlay – NE 12th St to Overlake Drive – Contract has been awarded to Icon
Materials. This project is a partnership with King County Roads and will be postponed until
Summer 2021 due to Bellevue’s AC Watermain Project.
2021 Overlay Program – 86th Ave NE Overlay is in review.
Medina Park Playground Improvements – Kompan is designing structures that will fit the city’s
budget and the parkboards ideas.
