EXECUTIVE SESSION Time Estimate: 60 minutes RCW 42.30.140(4)(a) Collective bargaining sessions with employee organizations, including contract negotiations, grievance meetings, and discussions relating to the interpretation or application of a labor agreement; or (b) that portion of a meeting during which the governing body is planning or adopting the strategy or position to be taken by the governing body during the course of any collective bargaining, professional negotiations, or grievance or mediation proceedings, or reviewing the proposals made in the negotiations or proceedings while in progress. RCW 42.30.110(1)(i) To discuss with legal counsel representing the agency matters relating to agency enforcement actions, or to discuss with legal counsel representing the agency litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal or financial consequence to the agency. 13. Medina Beach Park - Update on Caution Buoys Sergeant Gidlof gave a brief update that new caution buoys were installed at no charge by Seattle Harbor Patrol. Gray thanked the Police Department for getting these installed. 2. Fairweather Nature Preserve - Discuss the Unapproved Mountain Bike Path Public Works gave update. The ramps and bike trail were dismantled. No extensive damage was done, and plants will grow back. Sergeant Gidlof reported that patrols are done as time is allowed and asked residents to call 911 if they see any suspicious activity. New signage will be added to state this is a Nature Preserve. 3. Medina Park - New Signage Osada gave update that new signage and maps showing the on-leash/off-leash area for dogs will be added to the park. Postcards with the new rules and map will be mailed out to all residents the week of November 27, 2020. 7. PARK REPORTS Fairweather & Lid Looks great. The recommendation includes rebalance structural coverage in R-16, review residential development policy re: second floor step-back and review floor area ratio. Planning commission recommends modifying the structural coverage for lots larger than 16,000 square feet in the R-16 zoning district to match what is allowed for the same sized lots in the R-20/R-30/SR-30 zoning districts. They also recommend that the city does not implement a second-floor step-back. Finally, they recommend that the city does not move to a Floor Area Ratio (FAR) method for calculating lot coverage. Police o Washington Association of Sheriffs and Police Chiefs (WASPC) Accreditation (second half) – Medina Police Department is up for WASPC re-accreditation in 2021. Department successfully passed re-accreditation in May 2017. The purpose of law enforcement agency accreditation is to professionalize the law enforcement industry by providing a review process for agencies to be certified as operating under industry best practices and standards. This will be the first year we will be required to fulfill higher training hours and requirements. In November 2018, voters passed Initiative 940 (I-940) in an effort to establish higher training requirements and police accountability standards so we will need to work to complete the new level of training. o Emphasis on Traffic Safety (on-going) – Continue to focus on all traffic safety – vehicular, bicycle, and pedestrian – throughout the community through education, engineering (where possible and cost effective), social media, and enforcement to reduce collisions, improve awareness, and improve safety. o Speeding and Traffic Calming (second half) – the City will conduct a speed study of traffic on Evergreen Point Road, 84th Avenue NE, and the East/West Streets connecting these two main arterials. We will also study Overlake Drive West/East. Based on the data generated by the study, City Staff will recommend implementation of appropriate traffic calming techniques. o Support and promote Medina Emergency Preparedness Committee including Schools Sub-Committee (on-going). Medina Park Patrols: In 2020, Medina Municipal Code 2.24.025, Rules applying to Medina Park and Fairweather Park and Nature Preserve regarding pets was changed. The new rule made it illegal to have dogs off-leash in the west side of Medina Park – see below. Medina Police Officers have increased patrols in Medina Park to educate dog owners of the change in the law. Attempted Burglary Charges: On February 1st, Medina Police Officers responded to an attempted burglary in the 1200 block of Evergreen Point Road. Officers arrived on-scene to detain two individuals leaving the area. Upon completion of the investigation, felony charges were submitted to the Prosecutor. Planning Commission By Stephanie Keyser Planning Commission continued their discussion of the tree code at their February 23rd meeting. The commissioners have been made aware of Council’s desire to adopt a code amendment by the end of the year and it is staff’s goal to have a draft code available for public review beginning this summer and to have two open houses in the fall. Discussions around the tree code include the actual definition of a significant tree (currently the code identifies a significant tree as being one that is 6” or greater in DBH and listed on Medina’s significant tree list); better protection for legacy trees; whether the significant tree list is still necessary; creating a location requirement for retention and well as supplemental trees; and separating out the retention section (MMC 20.52.110) from the density ratio section of the code (MMC 20.52.130). The current proposal would have residential uses following a retention schedule while keeping non-residential uses following the density ratio section. Please note that there would be no further analysis into non- residential uses as they’re not part of the limited scope of the work plan, however this separation seems to be an easy way to begin to address the conflict within the cod. The reasoning behind this separation is that the code currently creates a situation that prevents someone from having to retain more trees than required by the density ratio section, which essentially nullifies the retention section. Additionally, staff will be bringing two code amendments to Council in June: the first is the small bite at bulk with the amendment to lots larger than 16,000 square feet in R-16 and the second is going to be minor code amendments that will include amendments intended to clean-up the code, streamline process for staff and applicants, and a couple of minor mandatory ADU amendments that staff was unable to bring before Council last year due to COVID. The tree code discussion will continue at the March 23rd meeting. Page 38 of 56 AGENDA ITEM 9.1b 2 Tree Removal There will be several development projects starting over the next few months. Each of these projects will involve tree removal under permits issue by Medina. St. Thomas Rooftop Play Area Phase II of the St. Thomas School project is the construction of the rooftop play area building. Substantial completion was achieved on February 12th by the contractor and Medina issued an occupancy certificate the same day. Phase III of the St. Thomas project involves conversion of existing interior space into classrooms. Code Enforcement With limited staff availability at City Hall, COVID is having a significant effect on our ability to proactively provide Construction Activity Permit code enforcement. Two parking citations were issued this past month. Two violations of our Tree Management code have also caused the need to issue citations that are currently under preparation for issuance. Contractor Email Regarding Noise Testing I had been working with a contractor regarding a failed noise test of an outdoor mechanical heat pump appliance. The contractor contacted you by email. Property Tax normally is deposited during the April/May and October/November fiscal periods. • Sales Tax Revenues are $349K as of February 2021. This continues the 2020 pace, elevated due to COVID impacts causing increased destination-based receipts. In creating the 2021 budget, staff and Council decided to budget this revenue conservatively rather than planning for sporadic windfalls caused by large expensive destination-based purchases. The COVID related impacts are expected to lessen as the year progresses and restrictions are lifted. • Utility Taxes & Franchise Fees are remitted mostly by the quarter. The amount reflected in February, $253K represents receipts of 4th quarter 2020 amounts. • Development fees continue to come in at a stunning pace; associated expenses will take 1-2 years to catch up with receipts. • Hunts Point’s Q1 contract payment for police services is expected to be received in early April. 2021 overall receipts will be $17K below line-item budget due to 2020 PD cost savings Medina is contractually obligated to pass along to Hunts Point in 2021. Expense: • Finance pays the full 2021 annual WCIA Insurance Liability premiums in February, $186K. This single expense accounts for 35% of its overall budget. With ordinary monthly spending expected for the rest of the year the cost center should finish within budget. • Police is slightly above budget pace for the year due to the annual Exemplary Pay in February. The cost center will recover from the one-time expense easily by the end of the year to finish within budget. CAPITAL FUND • There is $154K of REET (real estate excise tax) revenue year-to-date, reflecting December & January’s real estate activity. This is nearly 40% of the receipts we had anticipated for the entire year when drafting the budget. So far the predicted eventual slowing of home sales in Medina has yet to show itself. Page 43 of 56 AGENDA ITEM 9.1c GENERAL FINANCE NOTES: The Finance Committee met on February 24th, A “deep dive” review into 2020’s closing financial statements was completed. The committee also discussed the General Fund’s excess carryover balance caused by one- time revenues and COVID-related cost savings. The committee decided to recommend to Council to transfer the excess, $251,844, to the Contingency Fund to start rebuilding its resources. This recommendation will come before Council in the form of a future 2021 budget amendment. It was difficult to decipher the records it broke, but the City of Medina received nearly 12 inches of snow. The Public Works crew stayed busy from Friday-Sunday, keeping the roads plowed and safe for the residents. After a debrief with the crew, we decided that more safety notifications would need to be sent to the community. These events are infrequent, and often times requires ongoing changes depending on the experiences. Page 53 of 56 AGENDA ITEM 9.1e 3.DOE DUMPSTER LID EVALUATION PROGRAM – The city’s stormwater permit (NPDES) requires a new outreach program every year. Last year the City of Medina piloted a program to educate the local businesses regarding Illicit Discharge. These programs require hands-on and boots-on-the- ground visits to evaluate and discuss the goals that is required by Ecology. This year the city has partnered with other jurisdictions in the Dumpster Lid Program which is a phased approach to awareness and behavioral changes. Page 54 of 56 AGENDA ITEM 9.1e 4.MAINTENANCE UPDATES – The Public Works crew is still responding to stormwater related maintenance issues. In addition, with the recent snowstorm the crew spent many long hours driving plows to clear the roadways. Two of the maintenance workers stayed for the whole weekend, sleeping on cots at the Public Works Shop. After some rest, they were able to get back to the daily tasks such as fixing the flag pole at City Hall and garbage pickup. Page 55 of 56 AGENDA ITEM 9.1e 5. PROJECT UPDATES – 2015 Medina Park Stormwater Pond Imp. – Bravo Environmental has proposed a vactoring procedure to dredge the pond. However, we are currently researching a method that will lessen the impact to the pond wildlife. In addition, recent estimates for material disposal is around $900,000.00. 2017 Medina Beach Park Tree Replanting – Currently waiting for phase III tree planting. TIB 84th Ave NE Overlay – NE 12th St to Overlake Drive – This project is a partnership with King County Roads and will be postponed until Summer 2021 due to Bellevue’s AC Watermain Project. King County is planning to go out for bid in the coming weeks. 2021 Overlay Program – 86th Ave NE Overlay is in review. Medina Park Playground Improvements – Kompan is currently creating 3D renderings and details for the park board to review version 2.
