The City did not have its own policy in place – followed RCW 35.79

New Chapter 12.44 – Street Vacations
Intended to be consistent with, implement and supplement RCW Chapter 35.79
Proposed Ordinance – Applicability
Petitioner applies to the City Clerk
Application fee and appraisal deposit
If appraisal is more than deposit, petitioner will be invoiced
The petition for vacation is placed on the next Council agenda
Council will adopt a resolution for the public hearing no greater than 60 days and no less than 20 days out

Public Hearing will be noticed as follows:
Posted on site
Posted in 3 areas around the city (outside city hall, post office, Medina park community boards by NE 12th)
Posted on the website and sent out through GovDelivery
Published in the newspaper
Mailed to property owners within 300 ft. of subject property
Proposed Ordinance – Staff Report
A staff report will be prepared that addresses the chapter and approval criteria
Other departments (Public Works and Police) as well as utility companies will be solicited for comments
Five days prior to the hearing, the staff report will be sent to the applicant, council and any other person of record
Proposed Ordinance – Vacation Criteria
Council shall consider but not be limited to seven vacation criteria
ROW that abuts a body of fresh or salt water shall not be vacated unless:
The vacation will result in one of the following: port; beach or waterfront access purposes; moorage or launching sites; park, recreation, or other public uses
The city declares the property isn’t being used as a street, alley or easement and is not suitable for any of the following: port; beach or waterfront access purposes; moorage or launching sites; park, recreation, or other public uses
The vacation will enable the city to implement a plan adopted by resolution or ordinance

Up to one-half of the appraised value of the vacated portion of the property
Up to the full appraised value if
The subject property has been part of a dedicated ROW for 25 years or more
The subject property was acquired at public expense
The subject property abuts a body of water subject to MMC 12.44.160 (waterfront streets)
Council may approve property in lieu of monetary compensation
