0004CIfOFEDINAORDINANCENOANORDINANCeregulatingtheerectionconstructionenlargementalterationrepairdemolishingconiversionormovingandmantenanceofbuildingsandstructuresintheCityofMadinsWashingtonprovidingfortheissuanceofpermiteandcollectionoffeesthereofprovidingfortheissuanceofpermitsendcollectionoffeesthereofprovidingfortheadoptionofconstructioncodessuchasBuildingCodeandFireZonePlumbingElectricalHealthSafetyprovidingforpenaltiesforviolationthereofandamendmentsTHECITYCOUNCILOFTHECItYOFMEDINADOORDAINASFELLOWSSectionlThepurposeofthisodinanceistoregulatebuildingasitaffectsthehealthsafetyandwelfareoftheresidentsoftheCityofMadinsuntilsuchtimeastheappointmentoftheCityanagerandcreationofaplanningcommissionpermittheconsiderationoftheircommendationswithrespecttheretoSection2BuildingCodeTheUniformBuildingCode1952EditionVolumelandincludingapendicesthereinaspartthereofpublishedbytePacificCoastBuildingOfficialsConferenceisherebyadoptedandincorporatedheroinbythiaferenceasiffullysetforthendshallcontrolallbuildingintheCityofMadinsinallparticularswhereitbeconsistentwiththeotherprovisionsofthisordinanceSection3FireZoneAllareaszonedasresidentialdistrictsunderlanduseordinancesaredeclaredaFireZone3forthepurposesoftheUniformBuildingCodeasadoptedheroinSection4eesRecordsDoubledFeeasThatSection302oftheUniformBuildingCodeisamendedbyaddingthefollowingtobeknownillas302BPlumbingRatesFeesi1Forthefirstsixfixtures100EcForeachadditionalfixture035eachbeexemptWhereworkforwhichapermitisrequiredbythecodesincorporatedhereinisstartedpriortoobtainingapermitthereforthefeesshallbedoubledbutthepaymentotsuchdoubledfeesshellnotrelieveanypersonsfromfullycomplyingwithallbuildingrequirementsintheexecutionoftheworknorfromanyotherpenaltiesprescribedhereinThepersonorpersonschargedwiththeperormanceofthedutiesofBuildingInspectorhereundershallkeepapermanentandaccuraterecordofall 2Cont4OrdinanceNoSection4issuedendshallsimultaneouslwiththeusnceofanysuchpermitdeliveroopihereoftheCityTreasurerandsuchcountyofficialsasnecessaryIntheeventapermitisrefusedbythe8uildin9ectororsuchpersonorpersonschargedwiththeerformanceofhisdutieshereundersuchfactshallcertifiedtotheCityTreasurerandtheappliCsntshallbeentitledtothereturnofhislicensefeespaidthereforSection5PlumbingCedeTheReortofthelinainommttteeforaNationalPumbinCodeJune1951DomesticCommerceSeriesNo28ssuedJointlybyUSDepartmentofCommerceNationalProductionAuthorityandHousingandHomeFinanceAgencyWashington25DCandthelatestamendmentstheretoorrevisionsthereofisherebyadoptedEandincorporatedhereinbythisreferenceasiffullysetforthandshallcontrolallbuildingastoplumbTjingintheCityofedinaSection6ElectricalCodeTheNationalElectrideNBFUpamphletNo701951StandardcfCoNationalBoardofFireUnderwritersandthelatestamendmentstheretoorrevisionthereofisherebysdoptedandincorporatedhereinbythisreferenceasiffullysetforthandshallcontrolallbuildingastofacilitiesfortheuseanddistributionofelectricityasrelatedtobuildingsSection7HealthReulationsThetlgulesandulationsoftheStateBoardofHealthBookVlatestamendmentstheretoorrevisionsthereofJlreherebyadoptedandincorporatedhereinbythisreferenceasiffullysetforthandwhereverappliableshallcontrolallbuildingintheCityoflMedineSection8SafetyCodeFSafetyStandardSforWorkoftheDepartmentofLsborendndustriesof1951endlatestamendmentstheretorevisionthereofisherebyadoptedandincorporatedhereinbythisreferenceasiffullysetforthandwhereverapplicableshallcontrolallbuildingintheCityofMadinnSection9BuildinginspectorandHealthOfficerNhenanyofthesecodesrefertoBuildingInspectorthisshellbetheappointeeoftheCityCounciluntiltheCityansgerisemployedwhenitshellbecometheCityanagerorhisappointeeWheretheCountyHealthDepartmentismentioneditshallmeanCityHealthufficerSectionlORighofEntryTheBuildin9InspecfororotherpersonauthorizedtodischargehisdutiesiSherebyeuthorizedndempoweredtoenteranybuildorpremiseswithintheCityofMedinaforpurposesofinspectionortopreventaviolationofthiscodeuponpresentationofproperoredentialsheneverin 3ContdOrdinanceNOSection10htsl0ptnionanyprovisionsofthiscodearebeingviolatedbytheworkhemaordersuchworktoforthwithceaseeneverntheopinionoftheBuildingInspectororotherpersonauthorizedtodischargehisdutiesanybuildingorportionthereofisdangerousorunsafetopersonsorpropertyhemaydondamnthesameandorderitsreairorremovalWrittennoticeofsuchconditionshalbeservedupontheownerreputedovnerorpersoninchargeofsuchbuildingandnobuildingsocondemnedshallthereafterbeusedoroccupiedforanypurposeafterWrittennoticeasaboveprovidedhasbeenserveduntilthesameshallhavebeenrepairedandapprovedbytheBuildingInspectororotherpersonauthorizedtodischargehisdutiesSection11ElalViolationofanyoftheprovisionsofthisOrdinanceshallbeamisdemeanorandanpersonfoundguiltythereofshallbepunishedbyafneofnottoexceed30000orbyimprisonmentfornottoexceed90daysorbothItshallbeaseparateoffenseforeachandeverydayorportionthereofduringwhichanyviolationofanyoftheprovisionsofthisOrdinanceiscommittedcontinuedorpermittedSection12PartialInvaltdltyIntheeventanyportionofthisOrdinancebefoundandheldbythecourtstobeinvalidtheremainingportionsthereofshallnotbetherebyaffectedSection13CodeReferanceSections1through12hereofshallconstitutesections51001through51012correspondinglyoftheMadinsCodeandallothersectionshereofshellbeconsideredofspecialortemporaryeffectSection14EffectiveDateThisodinanceshalltakeeffecteoteLrlq2qPASSEDDytheCityCouncilontheldayoflguac195andsignedinauthenticationofitspassagethesamedayA4oprovedastoformteDhenFChsdickActingCitAttorneyAttestCFiZlyAYORProTemJroetyPndretnHothsnhtdCityClerk
