CItYOFMEDINAORDINANCENOORDINANCEcreatingaBoardofAdjustmentandrescribingitsdutiesauthorityandprocedureTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSecttoniMembershipAppointmentTermsofIcrIQiThereisherebycreatedaBoardofAdjustmehthereinafterdesignatedtheBoardITheBoardshallconsistoffivemembersallofwhomshallerve21withoutsalarywhoshallbeappointedbytheMayorwiththeadviceoftheCityManagerandconsenoftheCouncilandshallbecitizenshavinganunderstandLIinnofthebenefitsofzoningothemunicipalityThetermofDfficeofeachmemberoftheBDardShallbefouryearsexcepzastotheinitialmemberLshipwhichshallconsistofonememberappointedforlOneyearnefortwoyearsoneforthreeyearsandtwoforfouryearsAllermsshallexpireontheLsecondTuesdayofMarchintheappropriateyearIncaseanyvacancyshouldoccurinthememberLshipoftheBoardforanycausetheMayorshallfillsuchvacancybymakinganappointmentNiththeconetsentofheCouncilMembersoftheBoardmayDeremovedbyheMayoIwiththeapprovaloftheCouncilforsuchcausesastheCouncilshalldeemsufficientwhichshallbesetforthinaletterothememberormembersaffectedmroviddnnamshouldthememberormembersaffectedrequestpublichearingthereontherebesuchabearingbeforeremovalSection2InitiationofActionUontheirreceipinproperformtheBoardshallearanddecideallapplicationsforspecialproperyusesforvariancesorforreviewofanydeterminationofStheBuildingInspectorInadditiontheBoardmayonitsDwnmotioninitiateareviewftheBuildingInspectorsinterpretationoftheprovisionsofthezoningordinancesSection3SpecialProperyUsesAuthorityTheBoardshallhaveandexerciseoriginaljurisdictionlinreceivinggrantingordenyinallrequestsforspecialproperyueesasdefinedInthezoningcoJordinancesIfafterapublichearingtheBoardffindsthattheconditionsoftheordinancesuponwhichthesespecialusesarepermittedhvebeenfulfilledanduponareportoftheBuildingInspectothattherovisionsofallotherordinanceSwithwhichcomplianceisrequiredhavebeenfulliliaditjsallgrantsuchapplicationotherwiseitshalldenythesameSection4eviewofDecisionof8pildingcoin32AuthorityTheBoardmayreviewanyinterpetationoftheprovisionsofthezqningordinancemadebytheBuildingInspectorandanyorderrequiremeritdecisionordeterminationrelatin9theretointheapplicationofthespecificprovislonsofthezoningordinancetoanyparcelof1andandorstructureheBoardmayafterpublichearingconfirmorreversetheinterpretationmadebytheInspectorandanyorderrequirementdecisionordeterminationrelatingtheretoandtheobrdsdecisionshallbeLbasedupontherecordandthefindingsineachcaseandtothatenditshallhaveallofthepowersofth lSection5VarianceSAuthoritvWhereunnecessaryjhardshipsandpracticaldifficultiesarecreatedforLthelandownerintheapplicationoftheprovisionsofthezoningordinancestheBoardshallhavepowerinpassinguponapplicationstherefortograntavarianceinharmonywiththegeneralpurposeandintentofsaidzoningordinancesandsuchvariancesmayvaryanyrulesregulationsorprovisionsofsaidzoningordinancesrelatingtotheuseoflandaneorstructuressothatthespiritoftheOrdinancewillibeobservedpublicsafetysecuredandsubstantialjusticedoneHowevertheBeardshallnotvaryanyrioftherulesregulationsorprovisionsoftheizoningordinancesunlessitshallfindafterpublichearingthatallofthefollowingconditionsexistineachcaseofanapplicationforavariance1Thatthelandaneorstructureinquestioncannotbereasonablyuseddcannotyieldareasonablereturnifused6nlyforthepurposespermittedandinaccordancewithDtherrequirementsinthelandusedistrictinwhichznelandandorstructureislocated2hatthegpltheowreruhquecircumtancehlarotthegralcoC6ZFfTtheneighborhoodandarenottheresultoftheownerrsaction3ThattheusereuestedbylneapplicantifestablishedwillnobeofageneralhclassificationdifferingfromtheessentialuseprovisionsDfthelandusedistrictinwhichthelandaneorstructureislccatedSection6VariancesFindingsofFactTheBoardsfindingsshallincludeareportpreparedbythePlanningCoiQ3GwhichacomparislonismaappicantsrequestforvarianceandofthepresentlandutilizationpatternwithinneneighborhoodareaoftheapplicantslandandsuchreportmaycontainotherpertinentinformationregardinganyexistingorpreexlstingconditionsrelatingtbtopographygeologytrafficutilitiescondiionsseforthbynoofficialplansdavelogjmntplansandhecomprehensiveplansasmayproperlybeincludedTheBoardsfindingsshallincludealloftherelevemfactsoftheapplicantsapplicationandsuchlacswhichsupporandopposethecontentionoftheapplicationasmaybedeterminedouofthehearingthereonornepetitionsoletterssubmittedinconnectiontherewithSection7ProcedureypersonorpersonsaggrievedjointlyorseverallyandanypersonofficerorofficialofanydepartmenlboardorcommissionoftheCitymaysupportoropposebypetitionofletterortestimonyattheheaingLnereonanyZapplicantsrequestforaspecialpropertyuseortforreviewofadecisionoftheBuildingInSpectorrloforavarianceThepetitionrlettershallspecifythereasonsforsupportingoropposingtheapplicationandshallcontainthesignatureanddescriptionofthelandofeachpopertyownersigningitLikewiseanywitnessappearingatthehearingthereonhallspecifyhisreasonsforsupportingoropposingtheapplicationandidentifyhimselfanddescribehisblandifitbeclaimedthatitiseftactedgypetitiongarlettershallbesubmittedtotheBoardatthetimedesinatedinitsrulesofprocedureApplicationsforspecialpropertyusesfor VrevlewofadecisionoftheBuildingInspectorororvarian6esmaybemadetotheBoardwithinsuchtimeasshallbeprescribedinitsrulesofprocedureZcptesfapplicationsshallbefiledwiththeBuildingInspectorPlanningCommissionandtheBoardContainingthedecisionoftheBuildingInspectorifanyandthereasonswhytheappticahtisaggrievedifnebeaggrievedspecifyingthegroundsthereforandwitheachapplicationthereshallbepaidafeeof1000nocovertheCityscostofhandlingthesameTheBuitdinInspectorshallbethesecretaryoftheBoardandshallreceivefortheBoardallapplicationsf6rspecialesforreviewoftheBuildingInspectorsdecisionsorforvariancesandshallmaintainandbecustodianfallrecordsoftheBoardihcludingtheminutesofitsmeetingsitsfindingsanddecisionsAllrecordsshallbeopentothepublicUponthefilingofsuchapplicationtheBuildininspectorshallforthwithtransmittotheBoardallpapersconstitutingtherecordanddecisionoftheBuildingInspectorrelatintheretoTheBoardshallconcurDyatwothirdsvoteofthememberspresenttoreverseadecisionoftheBuildingInspectorIftherebenodecisionoftheBuildingInSpectorrelatingotheapplicationtheIBoardshallactbymajorityvoeTheBoardsdispoSitiOnDfanyapplicationshallbeintheformofanDrderapplicantTheBoardShalladoprulesofprocedurekeepminutesofitsproceedingsincludingthevoteofeachmemberDneachquestionconsideredbyitandkeeprecordofitsfindingsandactionineachcaseThepresenceofthreemembersshallbenecessarytoconstituLeaquorumdetermineThereshallbefixedlaceofmeetingandallmeetingsshallbeopentotilepublicTheBoardshallcauseobepostedatleastten10dayspriorzothehearinginconspicuousplaceswithin300feetofsuchtndassthesubjectofanyaplicationtobethereconsideredaminimumofto2placardseachcontaininganoticeadvisingthepublicofthefollowingnformationtheproposedspecialuseorvarzanceordecisionatheBuildingInspectorzobereviewedandthetimeandplaceofhearingWrittennoticeshalllikewisebegiventOtheownerinquestionifhbeotherthanthethelandSection8TimeDecisio5ffectiVeAnydecisionoftheBoardshallnotbecomefinaluntiltheexpiratioffivedaysfromtheentryofsuchdaciSionintheofficialrecordsoftheBoardunlesstheBoardshallfindthainemakingofthedecisioneffectiveimmediatelyisnecessaryforznepreservationofpropertyorpersonalrightsandshallsocertifyontherecordoftheapplicationifaspecialuseorvariancebegrantedandtheapplicantnotavaithimselfoftherightsconferredtherebywithinoneyearfromthedateoftheboardsdecisionthensuchdecisionwillceaseobeeffectiveandanewapplicationforbuildingpermitan0rcertificateofoccupancyortheBoardshallefinalsubjecttoThedecisionofreviewbytheSuperiorCourtoftheStateofWaShingtoninandforKingCountySection9ieetihgsandNotideeeinofthedBoarshellbeheldatlbastonCeeachmonthandatsuchothertimesastheChairmanofheBoardmay Section10StayAnapplicationotheBoardforanyspecialuseforreviewofadecisionoftheBuildingInspectororforvarianceshallsayallproceedinggsinfurtheranceoftheactionfromwhichtheapplicationwastakenunlesstheBuildingInspectorcertifiestotheBoardafteracopyoftheapplicationshallhavebeenfiledwithhimthatkyreasonoffactsstatedinhiscertificazeastaywouldcauseimminentperiltolifeorproperywhichcasesuchactionshallnotbestayedthantytheSuperior3ourIntheabsencesuchcertificatetheBoardshalldecidewhetherroceedingsshallbesayedifitbenotableearanddecidetheissueraisedbyneapplicationaitsfirstmeetingSection11CodeReferenceSections1through10hereofshallconstitutesections12101through12110correspondinglyoftheMedinaCodeandellonersectionshereofshalloeconsideredoftemporaIyorspecialeffectSection12BffectiveDateThisordinanceshalltkeeffectLLofipassagethesamedayApprovedastoformtyAttorneyAttestActingCizyClerk
