ORDINANCEN0jrYFiORDINCErepealingOrdinanceNedregulatinglduseWithintheCityofMedicaltabliehtnglandusedistrietsjadeptingstanQardsanregulationsfortheuseoflanathereinandneeofbuildingsprecribingpenaltleaFOOWSTECITYCOUNCZLOFTMECITYOFMEDINADOORDAINASPSection1PurposeTheputmossofthisordinanceis7lUtoregulatelanduseasitaffectshhealthsafetyandwelfarerLrlOftheresidentsofthCityofMadinntheCityCouncilhavingconsideredtherecommendationsofthePlatosingCommissionoftheOttyofMadinnafteritsdeliberationsonthesubjectitspublichearingofNovember91955onitsproposedrecommendationsanditsreporttotheCityCouncilbaseduponsuchdeliberationsandpublichearingSection2LandUseDistrictsEstablishedThereareherebyestablishedfortheCityofMedinathreeresidentiallanduseclassificationstobeknownaslandusedistrictsasfollowsM16Districtwith16000sqftminimlotsizeR20Districtwith20O00sqftminilotsizeH30Districtwith30000sqftminimmlotsizeNobuildingorstructureshallbeerectednorshallanyexistingbuildingorstructurebemovedalteredaddedtoorenlargednorshallanylandbuildingstructureorpremisesbeusedforypurposeotherthantheuseslistedinthisordinanceforthelandusedistrictinwhichsuchlandbuildingstructureorpremisesarelocatedNobulldinEorstructureshallbeerectedconstructedormovedontolandexceptinconformitywiththeregulationsapplicabtothelandusedistrictwheresuchlandislocatednorshallanyexistingbuildingorstructurebeenlargedalteredrepairedmovedorconvertedwiththeeffectofencroachinuponorreducingtheopenspacessurroundingsuchbuildingorstructureinviolationofthesetbackorheightregulationsorregulationsrelatingtothepercentaeofareaOccupiedOfteldusedistrictwhereitislocatedSection3ReulstlonofR16LandUseDistrictsThenimumlotareaforeachdwellinginthisdistrictshallbe1000squarefeetThemlnimsetbackofanypartofanybuildingorstructureshallbe30feetfromthefrontpropertylineand30feetfromthebackpropertylineandshallbe10feetfromeachsidelineBuildingsorstructurescomprisingadwellinganditsaccessorystructuresshalltogetheroccupynomorethan30percentofeareaofanylotTheheightofanybuildingorstructureshallbelimitedto30feetmeasuredfromthehighestpointofthefinishedgradeatthebuildingswalltothehighestpointoftheroofproperThereshallbeaminimof70feetoffrontageonadedicatedandimprovedstreetAndusesllbelimitedtosinglefilydwellingsSection4RadiationofR20LandUseDistrictsTHenimumlotareaforeachdwellingintnisdistrictshallbe20O0squarefeetTheminimumsetbackofanypartofanyObuildingorstructureshallbe30feetfromthefrontpropertylineand30feetfromthebackpropertyllneandshallbe10feetfromeachsidelineBuildimpsorstructurescomprisingadwellinganditssccessorystructuresshalltogetheroccupynomorethan30percentoftheareaofylotTheheightofybuildingorstructureshallbelimitedto30feetmeasuredfrom jCateofthisordinanceandlawfulpriortosuchdatemaycontinueprovidedthatitisnotexpandedorenlargedandthatifsuchnonconforminguseisabandonedanyfutureuseofthelandandanystructureorbuildingonthelandwheresuchnonconformingusewaslocatedshallconformtotheregulationsofthedistrictinwhichitIislocatedDiscontinuanceofanonconforminguseforaperiodofEi30daysshallbeprimafacieevidenceofintentiontoabandonAbuildingtheuseofwhichisanonconforminguseasheroindefinedcannotbeenlargedorexpandedorreconstructedlunlessitbemadetoconformtothelanduseandotherregulationsofthisordinanceandtotheotherordinancesoftheCityofMedinarelatingtoZonlngandbuildingSection8EnforcementAstolendinanydistricttwosetsofbuildingplansandtwoplotplansdrawntoscaleshowingtheentiresitedimensionsofthelotdimensionsofthebuildingandloctionoftheseptictankanddrainfieldorsidesewerlineandanyotherinformationrequiredtoshowcompliancewiththeregulationsofthisordinanceshallbefiledintheCity0ffiseewhenapplicationforabuildingpermitismadeNobuildingpermitshallbeissueduponplansWhichdonotshowcompliancewiththeregulationsofthisordinanceandotherordinancesapplicabletobildtngNobuildingpermitshallbeissueduponabuildingsitecreatedinwholeorinpartbydivisionoforbyaconveyancemadeaftertheeffectivedateofthisordinanceofaportionofanyparcelofrealpropertyimprovedbyabuildingwiththeeffectthatsuchexistingbuildingandthelandofwhichitisapartwouldnotsatisfytheregulationsofthelandusedistrictwhereitislocatedweresuchlandandbuildingitselfthesubjectofanapplicationforanoriginalbuildingpermitUponcompletionofabuildingorstructureuponwhichabuildingpermitwasissueditshallbeunlawfultooccupythesamuntilacertificateofoccupancyhasbeenobtainedfromtheBuildingInspectororotherpersonauthorizedtodischargehisdutiesNocertificateofoccupancyshallbeissuedunlesstheBuildingInspectororotherpersonauthorizedtodischargehisdutiesshallhaveascertainedthatthebuildingorstructureineveryrespectcomplieswiththeregulationsofthisordinanceandeveryotherordinanceaplicabletobuildingItshallbethedutyoftheCityManageroftheCityofMedinaorsuchcityofficialsasarehisauthorizedrepresentativestoenforcetheprovisionsofthisordinanceSection9PenaltViolationofanyoftheprovisionsOfthisordinanceshamisdemeanorandanypersonfoundguiltythereofshallbepunishedbyafineofnottoexceed30000crbyimprisonmentfornottoexceed90daysorbothEachdaybywhichsuchaviolationshallcontinueafternoticethereoftoanyviolatorfromtheBuildingSuperintendentorotherpersonoragencytowhomhisauthoritymaybedelegateduntilsucherectionmovingalterationrepairconversionoraddingtoorenlargingofabuildingorstructureorprohibiteduseisdiscontinuedandanapplicationforabuildingpermitifrequiredfiledshallconstituteaseparateoffenseSection10CodeReferenceSections1through9hereofshallconstitutesections51025104510651085110511251145116and5118respectivelyoftheMedinaCodeandallothersectionshereofshallbeconsideredoftemporaryorspecialeffect
