CITYOFDINAORDINANCENOCANORDINANCEdefiningcertainactsconductoromissionsconkstitutingmisdemeanorsandprescribingpenaltiesthereforallinthenatureofaPenalCodefortheCityofMedinaTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSCHAPTERIGENERALPROVISIONSSection11ViolationofOrdinanceRMisdemeanorTheviolationofanyordinanceoftheCityshallbedeemedamisdemeanorandmayberosecuredbytheauthoritiesoftheCityinthenameoftepeopleoftheStateofWashingtonormayberedressedbycivilactionattheoptionofsaidauthoritiesorbothSection12PenaltiesWhereNoneSpecifiedAmisdemeanorisacrimeandwherenootherpenaltyisrescribedbytheordinancesthereforconvictionthereofshalbepunishablebyafineofnotmorethanThreeHundred30000Dollarsorbyimprisonmentinthecityjailfornotmore0thanninety9daysorbothSection13CostsofProsecutionWheneveranyoneisconvictedofamisdemeanorundertheordinancesoftheCityInadditiontothefineimposedhemustpaythecostsofprosecutionIndefaultofsuchpaymentheshallbeImprisoneduntilsuchfineispaidorworkedoutonabasisofFive500DollarsperdaySection14PersonandubltcOfficedefinedUnlessotherwisespecifiedforthepurposesofaparticularordinancethewordpersonwhenfoundinthisandotherordinancesoftheCityshallbeheldtoincludeanynaturalpersonandassociationscopartnershipsandcorporationswhetheractingbythemselvesorbyservantsaGentsoremployeesUnlessotherwisespecifiedforthepurposesofaparticularordinancethetermpublicofficerwhenusedintheordinancesoftheCityshallbedeemedtoincludepoliceofficerstheCityManagertheCityClerktheCityAttorneytheMayororanyotherCityCouncilmantheCityHealthOfficertheCityManagertheCityStreetSuperintendenttheJudgeoftheMunicipalCourtanyParkCommissionerandanyassistantsdeputiesclerksandemployeeshavingauthoritytoexerciseanyofthepowersofthesameCHAPTERIIOFFENSFSACINSTTHEPERSONSection21AssaultEverypersonwhowithintenttoinflictbodilyharmortocreateanapprehensionthereofshallattemptorofferwithforceandviolencetodoacotorealhurttoanothershallbeguiltyOfanassaultandshalbepunishedforamisdemeanorunlesssuchassaultoruseofforceisexcusedundertheprovisionsofRevisedCodeofWashingtonSection911040 CSection22AssaultandBatteryAssaultandbatteryistheunlawfulbeatingofanotheroraconsummatedattempttounlawfullytouchstrikebeatorwoundanotherpersonEverypersonconvictedofanassaultandbatteryshallbeguiltyofamisdemeanorSection23ProvokingAssaultEverypersonwhoshallbywordsignorgesturewillfullyprovokeorattempttoprovokeanotherpersontocommitanassaultorbreachofthepeaceshallbeguiltyofamisdemeanorSection24IndecentLibertiesEverypersonwhotakesanyindecentlibertieswithoronthepersonoranyfemaleofchastecharacterwithoutherconsentshallbeguiltyofamisdemeanorCHAPTERIIIOFFENSESAGAINSTPROPERTYSection31iar3Everypersonwhowithintenttodepriveordefraudtheownerthereof1shalltakeleadordriveawaythepropertyofanotheror2shallobtaintomtheowneroranotherthepossessionofortitletOanypropertyrealorpersonalbycolororaidofanyorderforthepaymentordeliveryofpropertyormoneyoranycheckordraftknowingthatthemakerordrawerofsuchordercheckordraftwasnotauthorizedorentitledtomakeordrawthesameorbycolororaidofanyfraudulentorfalserepresentationpresentationorpretenseorbyanyfalsetokenorwritingorbyanytrickdevisebuncogameorfortunetellingor3havinganypropertyinhispossessioncustodyorcontroliasbaileefactorpledgeeservantattorneyaantemployeetrusteeexecutoradministratorguardianorofficerofanypersonestateassociationorcorporationorbycompetentauthoritytotakeorholdsuchpossessioncustodyorcontrolorasafinderthereofshallsecretewithholdorappropriatethesametohisownuseortotheuseofanypersonotherthanthetrueownerorpersonentitledtheretoor4havingreceivedanypropertybyreasonofmistakeshallwithknowledgeofsuchmistakesecretewithholdorappropriatethesametohisownuseortotheuseofanypersonoterthanpriatedsbringintothiscityorbuysellreceiveoraidinconcealingorwithholdinganypropertywrongfullyproprierdwhetherwithinoroutsideoftheCityinsuchmannerastoconstitutelarcenyundertheprovisionsofthisordinancestealssuchpropertyandshallbeguiltyoflarcenyoevercoitslarcenyisguiltyofamisdemeanorSection32IntUrytoPropertyGenerallyEverypersonwhowtlfullyllL1GutsdowndestooinjuresanyodimbertiramsorcpstandingorgwfnorwhichhasbeencutV0andislyinguponthelandsoanotheroofthestateor2CutsdowngirdlesoroherwfseLnJuesafruitshadeornamentaleestandingonthelandofanotheoofthestateorinanyroadorstreetor3Digstakesorcarriesawaywithoutlawfulauthorityor peaceprovokedisorderorendangerthesafetyofothersshallbeunlawfulandanypersonguiltyofaviolationofthisSectionshallbeguiltyofamisdemeanorCHAPTERVIOFFENSESAGAINSTPUBLICHEALTHANDSAFETYSection61CarryingPistolorLoadedRiflewithoutLicenseNopersonshallcarryapistolorloadedrifleinanyvehicleorconcealedonorabouthispersonexceptinhisplaceofabodeorfixedplaceofbusinesswithoutalicenseasprovidedbyordinancehoweverthatthisprovisionshallnotapplytolawenforcementofficersarmembersofthearmedservicesoftheUnitedStatesortomembersoftheNationalGuardwhenondutySection62LicensetoCarryPistolorLoadedRifleOualificationszExceptionsTheChiefofPoliceorotherpublicofficialtowhomhisresponsibilitymaybedelegatedshallyapplicationofanypersonwhohasnotbeenconvictedinstateorelsewhereofanycrimeofviolenceissuealicensetosuchpersontocarryapistolorloadedrifleinavehicleorconcealedonorabouthispersonwithinthisstatefornotmorethanoneyearfromdateofissueifitappearsthattheapplicanthasgoodreasontofearanyinjurytohispersonorpropertyorhasetherproperreasonforcarryingapistolandthatheisasuitablepersontobesolicensedThelicenseshallbeintriplicateinformtobeprescribedbythestatedirectoroflicensesandshallbearthenameaddressdescriptionandsignatureofthelicenseeandthereasongivenfordesiringalicenseTheoriginalthereofshallbedeliveredtothelicenseetheduplicateshallwithin7daysbesentbregisteredmailtothedirectoroflicensesandthetripicateshallbepreservedfor6yearsbytheauthorityissuingsaidlicenseThefeeforsuchlicenseshallbe200ofwhichthesumof100shallbepaidintothestatetreasurySection63DischargingFirearmsinCityAnypersonwhoshallwithinthelimitsoftheCityfireoffordischargeanygunpistolorfirearmofanykindwithoutlawfulauthorityshallbeguiltyofamisdemeanorSection64OtherDangerousWeaponsEverypersonwhoshallmanufacturesellordisposeoforhaveinhispossessionanyinstrumentorweaponofthekindusuallyknownasslungshotsandclubormetalknucklesshallfurtivelycarryorconcealanydaggerdirkknifeorotherdangerousweaponorwhoshalluseanycontrivanceordeviceforsuppressingthenoiseofanyfirearmshallbeguiltyofamisdemeanorSection65KeepingExplosivesEverypersonwhoshallmakeorkeepanyexplosiveorcombustiblesubstanceintheCityorcarryitthroughthestreetsthereofinaquantityormannerprohibitedbylaworbyCityordinanceandeverypersonwhobycarelessnegligentorunauthorizeduseormanagementofanysuchexplosiveorcombustiblesubstanceshallinjureorcauseinjurytothepersonorpropertyofanothershallbeguiltyofamisdemeanorSection66AllowingViciousAnimalsatLargeEverypersonhavingthecareTorcustodyofanyanimalknowntopossessanyviciousordangeroustendencieswhoshallallowthesametoescapeorrunatlargeinanyplaceormannerliabletoendangerthesafetyofanypersonshallbeguiltyofa
