CIVOFMEDINAORDINANCENOaqANORDINANCEprescribingconditionsforbuildingwhereaccessistobeprovidedbyprivatelanesinlieuofrequiredfrontageonadedicatedandimprovedpublicstreetprescribingpenaltyTHECITYCOUNCILOFTHECITYOFMHDINADOQRDAINASFOLLOWSSection1ThepurposeofthisordinanceIstoregulatelenduseonlonglotswhereallrequirementsofthelandusedistrictcanbemetsavethoserequiringfrontageonadedicatedandimprovedstreettheCityCouncilhavingconsideredtherecommendationsofthePlanningCommissionoftheCityofMedlnaafteritsdeliberationsonthesubjectanditspublichearingofFeb231956anditsreporttotheCityCouncilbaseduponsuchdeliberationsandpublichearingSection2WhenbuildingoermittedonprivatelanesNotwithstandingtheprovisionsofthezoningordinancesofMedinarequiringminimumfrontageonadedicatedandimprovedstreetbadingpermitsmayissuefortheconstructionofadwellingwhereaccessisprovidedbetweenthebuildingsiteandapublicroadorstreetviaaprivatelanesatisfyingtherequirementsheroinafterenumeratedSection3NecessaryEasementforprivatelaneSothatabuildingsitemayqualifybyvirtueofaccessviaaprivatelanesuchlaneshallfollowaneasementinformapprovedbythecityandrecordedintheAuditrsofficeofKingCountyhavingaminimumwidthoffeetextendingfromthepublicroadtothepropertylineofthebuildingsiteorsitesforingressandegressofallvehicularandpedestriantrafficallutilitiesincludingthoseundergroundandforthesettingofpolesandstringingofwireswhicheasementbyLhetermsofitsgrantshallceaseastoanydominanttenementwheneversuchdominanttenementshallabutonapublicroadorstreetSection4PrivatelanesfrontageBuildingsitesshallhaveeminimumwidthatthefrontbldinglinethattsthelineacingtheprivatelaneasfollowsInR16districtInR20districtInR30district70feet70feet90feetSection5privatelanessetbacksplannedstreetsTheminimumsetbackofanypartofanybuildingorstructureshallbetenfeetfromtheeasementlineandthirtyfeetfromeitherpropertylineoppositethepublicroadandsetbackfromanyofficiallyplannedstreetasifitwereinbeingSectlon6PrtatelanesdwellingservedAmaximumoffour4buildingSitesmaybeservedbyanyoneprivatelaneandinordertoreducethenumberofaccessesonapublicroadtheservienttenementnotwithstandingthatttmayabutonsuchpublicroadorstreetshallusetheprivatelaneforitsaccesstosuchpublicroadSection7PrivatelanesoffstreetparkingToqualifyasabuildingsitebyVirtueofaccessviaaprivatelaneeachbuildingsiteservedbysuchlaneshallprovideoffstreetparkingattherateo250sqfeetofgravelledorpavedanddrainedareapercarasfollows ZnZ6lone3carsZnR20lone4carsZnR30lone5carsSuchoffstreetparkingareashallbeseparateanddistinctfromtheeasementoFturnaroundhereinrequiredSection8PrivateladesturnaroundTojelifyasabuildingsitebyvirtueofaccessviaaprivatelaneermlnusofsuchprivatelaneshallbeprovidedwithaturnarounsuitableforrivatecarsandpublicvehiclestheplanofwhichmustbeapprovedytheCityEngineerorotherpersontowhomhisresponsibilitymaybedelegatedhavingaminimumcircleof60feetindiameteroritsequivalentSection9PrivatelanesconstructionstandardsbondToqualifyasabuildingsitebyvirtueofaccessviaaprivatelanethelaneservingsuchbuildingsiteshallbegradedsurfacedanddrainedtothesamestandardsapplyingatthetimeofapplicationforapermittoprivateworkonpublicstreetsintheCityof4edinaandthesestandardsshallapplynotonlytotheeasementroadwaybutitsturnaroundandadjacentparkingaswelltheprivatelaneroadwayshallbesogradedandsurfacedtoaminimumwidthof16feetTheaplicantforabuildingpermionabuildingsiteproposedtoeservedbyaprivatelaneshallpostabondsatisfactorytotheCityofMedinaassuringcompliancewiththeseconstructionstandardsSection10Anyviolationoftheprovisionsofthisordinanceshallbeamisdemeanorandanyparsonfoundguiltythereofshallbepunishedbyafineofnottoexceed300orbyimprisonmentnottexceed90daysorbothSection11CodeReferenceSections2through9hereofshallconstituteSections514o51651etcthrough5138respectivelyandSection10hereofshallconstituteSection5118ftheMedtnaCodandallothersectionshereofshallbeconsideredoftemporaryospecialeffectSection12HffectiveDateThisordinanceshalltakePASSEDbytheCityCouncilonthe7thdayofMay1956andsignedinauthenticationofttapassagethesmedayApprovedastoformSTfiPHFNFCHADWICKSTEPHENFCHADWICKCityAttorneyAttestMARYFITZGFRALDMlryFitlgeraldCityClerkPARKParkMayoroGC
