CITY0IMEDIAORDINANCENOjqZAYRDINANCEpresdPibingcertainuniformregulationsfortheuseifCystreetsbypublicutilities2requiringfraffchisestherespecifyinguniformconditionsofSuchfrgnohtSesgrantedbytheCityofMedinaprescribingpenaltiesTOITYCOUNCILOFTHECITYOFMEDINADOORDAINASisOrdtnanceapublicasanypersonfirmoreerporati0nsupplyingelectricitywaterorgasordistributingthesameorsupplyingtelephonetelegraphorsewerservicebytheuseofpipespoteslinescableor5thorfixedequipmentunderuponalongoraboveltytreetrightsofwayintheCityofMedinaandforthepurposesofallordinancesoftheCityofMedtnaanypublicutilityshallbedeemedtOiclndeanyemployeenomineeorindependentcontractorthereofefcrmingworkuponsuchfacilitiesinthestreetsorinpublicplacesoftheCitywhetherundercontractdirectionrequestcrauthcrityofsaidpublicutilitySection2FranchiseNecessaryForUseofStreetsbyebliCUtilityFromandafterninety90daysfollowingthefeetiredateofthisordinanceitshallbeunlawfulforanypublicutilitytousethecitystreetrightsofwayoftheCityofMedinwithoutavalidandeffectivefranshisegrantedbytheCityofMedinaortheStateofWashingtonandapplicabletocitystreetrightsofwayofNedinsSeCtion3MacofFacilitiesRequiredAttherequestofhetreetSuperintendentorothepersontowhomhisresponsibilitymaybedelegatedaryublicutilityusingstreetrightsofwaywithintheOityofMedinashallsupplyamapormapstoauniformscaleifsuchbespecifiedshowingasnearasmaybethethenatursandlocationOfitsfacilitieswithinthecitystreetightsofwayorpublicplacesandifsuchfacilitiesbeundergroundthedepththereofAnypublicutilityshallwithorwithoutanyrsquesthereforkeepatitsOfficelocalofficeifanyIsuchanupodatemapShoWingitsfacilitieswithinhecitystreetsorpublicplacesilleeAnyworkaffectinghelocationoitspolespipesconduitsinuponoralongcitystreetsbyoatheinstanceofspublicutilityasheroindefineSshallbedoneonlyuponpermitIlshowingapprovalbytheStreetSuperintendentOrotherpersontowhomhieauthoritymaybedelegatedandaccordingtoanyapplicablejordinancesorresolutionsoftheCityofMedinaSuchapplicationsshallbeacompaniedbyatleasttwomapstothesamesealsasthemaprequiredundersection3hereofjlifsuchberequestedbytheCityandsuchpermitshallbeinadditiOntothatrequiredwherecuttingintothesurfaceoforalteringcitystreetsbeinvolvedSeetionThePublicUtilitytoMoveFacilitiescOommodateCityWorkonihtsofWayWheneverftisdeemednecessarytoaccommodatecityworkincludingWithoutlimitationthechangeofOrimprovementtogradeofanycitystreetitsvadationorrelocationorinthabsenceofcityworkifitbedeemednecessarytosatisfythepublicneedasdeterminedLbytheCityCouncilanypublicutilityshallmoveitsequipmentandfacilitieswithinthestreetrightsofwayorotherpublicplacestoconformtosuchworkorpublicneed 6UniformConditionsofFranchiSeFan0hisesEthelCityoMedinafortheusencitystreetsshallluniformallyconditlonedasFollowsIISestion601AllFranchisestoInclUdeHoldHarmlessPr0vlalenaAnyfranchisegrantedapublicutilityforthelUseefMedtnacitystreetsshallincludeaprovisioneinItgranCeehSldsthecityharmlessfromanyliabilitybyreasonofhesonerectionoperationormaintenanceofit8facilitiesderUponalonorovercitystreetrightsofwayorotherptlplaceslkeoion602lFranchi8esToIncludeAaClonofalsionyfranchisegrantedapuhlietiltyf8eofMadinaettystreetshatlincludeaprovisionWhereinhgrnteeassumestheriskofinjurytoitsfacilitieswithincttysreetriftsofway0rotherpublicplacesbythecityjSeCtion603RightsConferredhyFranchisesToBeSubjectoPOlicePowerAfrchtsegrantedapublicutilityheretePfortheuseoNedinacitystreetsshallincludeaprovisionwhereinthegranteeyitsacceptancethereofacknowledgesthatlritscomerrederebyaresubjectothepolicepowerofthecitytoadoptandenforcegeneralordinancesnecessaryforthesafetyandwelfareofthepeopleofMediasandhatthegranteeagreestocomplywithallsuchgeneralordinancesinsolafasapplicableuoSeetlon604AllFranchisestobeAcceptedWithisAnyfranchisegrantedapublicutilityorthatuseofMedinaCitysreetsshallincludeaprovisionthatifwithintxy60daysafterhegrantingofsuchfreehissthegranueesEallhafailedtofileitswrittenaccepbancethereofwithhe01erkoftheCitythensuchfanchiseShallbenullandVoidecion605AllFanchisestoReqUireConsentoAnYfaehiagrtedapubliCutilitywhichisnobalsoamiclpaZcorporarichfoptheuseofMedinacitystreetssllincludeaprovisionrequiringtheconsentofthecityofMslnnoanytransferthereGfandshellprovidethatanyransfesbeequallybodbythetermshereofSection66AllrAnehisesForfeitableUonBreachyranChisegredapublicutilityforheuseMedinacitysteessblincludeaprOvtsiensrebysuchfranchisemybytheCityCocilbdeclaedforfeitedwhenaftesixtynotlostothelocalmanagerthereofthegranteehallnothavecuredadeficiencyinitsdischargeofheobligationcreatedbyhefranoseandallotherapplicablelawsofheGAryofMedinaSection67oFchiseRitofCondonationAfrachisetedapublictllitywhichisnoualsoammpalorporationfotheuseofMedinacitystreetswillincludeaprovisionatsuchfranchiseinnowaylimitstheoiyintsexerciseofherightofeminendomainandthatinanypurchasorcOndemationofanyofthegranteelspropertyduringtheteofhefranchisetheadditionothesumofelietherelementsofvaleofsuchproperbyreasonoftheclementwhiistherightoocapthepubliensevidencedbysuchfranchiseshallbenogeaterthantheactualoosofobtainingsuchfrchiseasrelatedtosHchpropertyeetion7PenaltiesWlolatidnoofthepovlsionshiaordinateShallbetaSdemeanorandsllbepishableafinenottoexceed300orbyimpriSoentnontS
