CITYOFNHEDINAORDINANCENOjANORDINANCErelatingtotheplattinandsubdividingoflandintofiveormorelotsortractsorcontainingadedisationofanypartthereofasapublicstreetorhighwayandprescribingpenaltiesTHECITYCOUNCILOFTHECITYOFDINADOORDAINASFOLLOWSIGENERALPROVISIONSSection1PutoseThepurEoseofthisordinanceistodischargethedutycreChapter16oftheRevisedCodeofWashingtontoestablishreasonableregulationsforthecontrolofplattingandsubdividingoflandandtodosoinamannertendingtoenhancethehealthsafetyandwelfareoftheresidentsoftheCityofedinatheCityCouncilhavingconsideredtherecommendationsofthePlanningCormisslonafteritsdeliberationsonthesubjectitspublichearingofJune27197onitsproposedrecommendationsanditsreporttotheCityCouncilbasedthereonSection2PlattinRequiredAnysubdivisionoflandnoworhereafterinsingleownershipintofiveormorelotsplotsortractsorwhichcontslnsthededicationofanypartthereofasapublicstreetorhighwayshallbebyplatandaccordingtotheregulationsoftheCityofedlnarelatingtoplattingNopersonfirmorcoreorationproposingtomakeorhavingmadesuchasubdivisionshallenterintoanycontractforthesaleoforshalloffertosellsaidsubdivisionoranypartthereoforshallproceedwithanyconstructionworkthereonoranyimprovementthereofincludinggradingandexcavationwithouthavingfirstobtaineditsapprovalasaplatashereinprescribedEachtransactionoffertoselloractofconstructionorimprovementwithoutsnchpriorapprovalofthesubdivisionasaplatshallbeconsideredaseparateviolationSection3PenaltiesEachviolationoftheprovisionsofthisordinanceshallbepunishablebyafineofnottoexceed300orbyimprisonmentnottoexceed90daysorbybothection4DelegationofAuthorityTheauthorityoftheCityCouncilastoapprovalordisapprovalofplatssubdivisionsordedicationisherebydelegatedtotheCityPlanningCommissionsubjecttothestandardsandregulationsforitsexercisehereinprescribedSectionDefinitionsForthepurposeshereofthefollowingtermsshallhavetherollowingmeaningsunlessthecontextclearlyindicatesthecontraryCONPREHENSIVEPLiNistheofficialplanforthecitysphysicaldeveIopmentbeingthesumoftheordinancesandtheofficialplansandmapsadoptedtherebygoverningfunctionalpartsofsuchdevelopmentincludingbutnotbywayoflimitationplansandrequirementsrelatingtotypeofusebyzonedensityofbuildingscirculationofpedestrianandvehiculartrafficdrainageofstormwaterlocationandextentofpublicandsemipublicareasoflanduseschoolsparkschurchesetcandsubdivisionofland OFFICIALMAPSarethemapsorcombinationthereofadoptedbyordinanceasrepresentationsofpartsofthecomprehensiveplanSUBDIVISIONisthedivisionoflandintosmallerparcelsunlesssuchdivisionbeforagriculturalpurposesandinsuchmannerthattheparcelssocrestedequalorexceed10acresinareaDEDICATIONisthedeliberateappropriationoflandbyitsownerforgeneralandpublicusesreservingtohimselfnootherrightsthansuchasarecompatiblewiththefullexerciseandenjoymentofsuchpublicuseSection6LandDesignatedforPublicUseSuchareaswithinaproposedsubdivisionorplatashavebeendesignatedinthecomprehensiveplanforparksplaygroundsorotherpublicuseshallbemadeavailableforpublicacquisitionbyprovisionofareasonabletimewithinwhichtheownerandthecityorotherpublicagencyaffectedmaynegotiateastotermsofpurchaseandareasonabletimeinadditionifitappearsthatsuchtermscannotbeagreedupontocommencecondemnationproceedingsIIPROCEDURESection7FilingtheProposedPlatAnyproposedplattogetherwithanapplicationfortentativeapprovalandafeeintheamountof00perbuildingsiteplustheanticipatedcostsofthecityincludingengineeringandcheckingshellbefiledatleasttwoweekspriortothemeetingofthePlanningCormmissionatwhichitmaybereviewedandinsufficientcopiesfordistributiontotheCityManagerCityEngineerHealthOfficerWaterSewerFireandSchoolDistrictsorauthoritiesandgasorelectricpublicutilitycompaniesandfortheuseofthePlanningCommissionitselfSection8FormofProposedPlatAproposedplatshallshowconformitywiththedesignstandardshereinaftersetforthandbepreparedbyaregisteredprofessionalengineerorlandsurveyorItshallcontainthefollowingelementsinreadilycomprehensibleformcombinedinamapormapswhenpossiblealldocumentsassembledandindexedifnecessaryandbearingthenameoftheproposedplattheownerandsurveyororengineerandifmapsshowingthedatescaleandnorthpointaalegaldescriptionofthelandproposedforplattingbavicinitysketchtothescaleofnotmorethan400feettotheinchshowingalladjacentsubdivisionsstreetsandacreageparcelsandthenamesoftheirownersandhowthestreetsandpedestrianwaysrelatetotheirexistingandproposedcounterpartsinneighboringsubdivisionsorbunplattedlandtoproducemostadvantageouscirculationoftrafficandneighborhooddevelopmentctheproposedlayoutoflotsblocksstreetsandpedestrianwaysutilityandstemwatereasementstheirproposeddimensionsnamesandnumbersalltoascaleof200feetorlesstotheinch2 dthelocationofexistingstreetsorpedestrianwaysorothereasementstheirdimensionsandnameswithinoradjacenttotheproposedplattogetherwithanyotherimportantfeaturessuchaspermanentbuildingswatercoursespowerandtelephonesablesrailroadrightsofwayorlinesmunicipalorwaterschoolsewerorfiredistrictbobundariestownshipandsectionlinesandcornersandthelocationofexistingmonumentsetheboundarylinesofthetractproposedforplattinganditstopographyshowingcontoursatintervalsof5feetorlessfthelocationofexistingwatermainssewersgaslinesculvertselectricpowerortelephoneconduitsandanyotherundergroundinstallationswithinorimmediatelyadjacenttotheproposedplattogetherwithpipesizesandgradesgthelayoutoftheproposedwaterdistributionsstempipesizesandtheirgradesandthelocafandfirehydrantsvalveshtheplansandprofilestothescaleof20feettotheinchorlessgradesandsizesofOroposedsanitarysewersifrequireditheplanofstreetlightingifanyJtheplanofstreettreeplantingifanyktheprofiletothescaleof20feettotheinchorlessandproposedgradesofallstreetstheircrosssectionsincludingwidthofpavementlocationofstormsewersutilitymainsendcurbsandsidewalksifanythelocationandsizesofcatchbasinsculvertsandotherdrainagestructuresofforthezonesinvolvedmallparcelsoflandintendedtobededicatedortemporarilyreservedforpublicuseortobereservedinthedeedsforthecommonuseofpropertyownersofthesubdivisionwiththepurposeconditionsorlimitationsofsuchreservationsclearlyindicatedncertificatesfromtheCountyTreasurerandAssessorthatalltaxesonthepropertyhavebeenpaidothenamesandaddressesoftheownersofpropertycontiguoustoorwithin300feetoftheproposedsubdivisionSection9ReviewSufficientcopiesforconsiderationbythePlanningCommissoCityEngineeranBuildingInspectorthewatersewerfireandschooldistrictsorauthoritiesandgasorelectricpublicutilitycompaniesaffectedshallbedistributedtothemAndacompletenumberedfileshallbemaintainedforallcorrespondenceandfilingsrelatingtotheproposedplat WithintendaysoffilingtheCityEngineerHealthOfficerandBuildingInspectorshallwithinthescopeoftheirmunicipalfunctionsmakewrittenreportsonthesufficiencyoftheproposedplatwhichtogetherwithanyrecommendationsofthewatersewerfireandschooldistrictsorauthoritiesandgasorelectricpublicutilitycompaniesaffectedshallbeforwardedtothePlanningCommissionwhichshallconsidersuchreportsandrecommendationsandexaminetheproposedplatforconformitytotherequirementsofthecomprehensiveplanincludingthedesignstandardshereinaftersetforthSection10PublicHearingWhenitappearsthattheplatasproposedsatisfietherequirementsofthisordinanceendthecomprehensiveplanasawholethePlanningCommissionshallsetatimeforhearingastotheadvisabilityofgrantingitstentativeapprovalNoticeofsuchpublichearingnamingtheapplicantandgenerallydescribingthelandproposedtobeplattedandclearlyindicatingthetimeandplaceofhearingshallbepostedinatleastthreeconspicuousplacesonoradjacenttothelandshallbeforwardedbyregisteredmailtotheownersofallpropertycontiguoustoorwithln300feetofthelandandshallinadditionbegiveninaccordancewithChapter216Lawsof1953RCW232010SectionllTentativeApprovalAftersuchhearingandwithin60daysofthetimeofitsrilingthePlanningCommissionshalleitherdisapprovetheplatasproposedorgiveitstentativeapprovalIfitdisapprovesacopyoftheproposedplatwithalistofdeficienciesorsuggestedmodificationsshallbereturnedtotheapplicantacopyofsuchllstbeingretainedinthePlanningCommissionfileWhetheritapprovesordisapprovesnoticeofitsactionshallbegiventheapplicantandthemunicipalofficerswatersewerfireandschooldistrictsorauthoritiesandgasorelectricpublicutilitycompaniestowhomtheproposedplatwasearliersubmittedforreviewSection12MinimumImprovementsTentativeapprovalshallbeeffectiveforaperiodoftwoyearsunlessextendedbythePlanningCommissionforaperiodofnottoexceedtwoadditionalyearsdttringwhichtimetheapplicantshallexecutetheminimumimprovementsashereinafterrequiredWithinfivedaysoftentativeapprovaltheapplicantshalladvisetheCityEngineerbywhichorwhatcombinationofthefollowingmethodshewillcarryouttherequiredminimumimprovementsabygivingtheCityofMedinaabondwithsufficientsuretiesandinanamountdeterminedbytheCityEngineertobesufficientassuringinstallationoftheminimumimprovementsandanyadditionalimprovementsinaccordancewiththestandardshereinaftersetforthtothedecidedsatisfactionoftheCityEngineerbbyactuallyinstallingsuchimprovementseitherasprescribedbythelocalimprovementdistrictlawsoftheStateofWashingtonandtheCityofMedinaorotherwiseAfterthecompletionofsuchimprovementsorprovisionofnecessarybondsandcontractsiranyassuringcompletiontheCityEngineershallprovidehiscertificateinduplicatetothePlanningCormmissionthatallimprovementshaveeitherbeencompletedaccordingto thestandardshereinaftersetforthandtheCityscostspaidorsufficientsecuritygiventoassuresuchcompletionwithintheeffectiveperiodoftentativeapprovalandpaymentofsuchcostsThePlanningCommissionshallthereuponforwardacopyofsuchcertificatetotheapplicanttogetherwithnoticeadvisinghimtoprepareafinalplatastothatpartoftheproposedplatforwhichthecertlfieateisgivensubmittedinatleastspncgtheoriginalAlldocumentsmapssurveynotesshallcontainthenameofthesubdivisionandthenamesandaddressesoftheapplicantandhissurveyorsorengineersCompletefieldandcomputationnotesshallbesuppliedshowingoriginalorreestablishedcornerswithdescriptionofthesameandtruebearingsanddistancestoestablishedstreetlinesandmonumentsturninganglespointsofcurvaturelengthoftangentsandtheactualtraversewitherrorofclosureandmethodofbalancingwithsketchesshowingalldistancesanglesandcalculationsrequiredtodeterminecornersanddistancesoftheplatTheerrorofclosureofanyandalltraversesshallnotexceedonefootinfourthousandfeetThemapshallclearlyreflectthefollowingelementsandconformitywiththeproposedplatastentativelyapprovedathenorthpointscaleanddatebtheboundarylineswithaccuratedistancesandbearingslocationandwidthofallexistingpublichighwaysapproachingandintersectingtheboundariesofthesubdivisioncthelocationanddimensionsoftherightsofwayofallstreetsorpedestrianwaysutilityorstormwatereasementsparksplaygroundsorotherdedicationstopublicusetogetherwithasuitablyinscribedstatementofdedicationsignedandacknowledgedbytheownersofthelanddthelengthofallarcsandradiiallturninganglespointsofcurvatureandlengthoftangentsandthelocationofallmonumentsandtheircharacteristicsereferenceoftheplattotheUnitedStatesCoastandGeodeticSurveydatumortheplanecoordinatesystemoftheStateofWashingtonfthenumbersorotherdesignationoflotsandblocksandtheirdimensionsganinscriptionforexecutioninbehalfoftheCityofMedinainformasfollowsThePlanningCommissionoftheCityofMedinatheauthorityoftheoiCitysapprovalmeetinginregularsessiondatedidfindthatnameofplataplatoflandwithintheCityofMadinsservesthepublicuseandinterest andhasauthorizeditschairmanandsecretarytoexecuteitswrittenapprovalhereonSectionlFinalPlatApprovalIfthefinalplatassubmittedisfoundtocomplywiththeforegoingrequirementsthenthePlanningCommissionshallapprovethesameIfnotthenitshallbereturnedtoeapplicantformodificationorcorretionSuchactionshallbetakenatapublicmeetingheldincompliancewithChapter216Lawsof193RCW232010andwithin60daysorthefilingofsaidfinalplatunlesstheapplicantshallhavefiledwrittenconsenttoalongerperiodUponapprovalallcopiesshallbesuitablyendorsedinbehalfoftheCitybyChairmanandSecretaryofthePlanningCommissionanddistributedasfollowsatheoriginaltotheCountyAuditortwocopiestotheCountyAssessorconecopytoeachtheCityEngineerandtheHealthOfficerdonecopytoberetainedbytheCommissionAfterrecordingofthefinalplatasapprovedplattingiscompletetotheextentoftheauthorityoftheCityofMedinaIIDESIGNANDIMPROVEENTSTANDARDSSection15LotsLotsshallconformtotheminimumsizeandfrontagerequirementsofthelandusezoneAstofrontageonlywhentheOveralloptimumarrangementoflotsrequireslesserfrontageitmaybepermittedifnotsignificantlybelowtheminimumstandardShapeandorientationshallbeappropriateforthelocationExcessivelengthinrelationtowidthfrontageontwostreetsandsidelinesatotherthanapproximaterightanglestothefrontlinearetobeavoidedCornerlotsshallbewidertopermitfrontyardsetbackfrombothstreetsandthecornerattheintersectionshallbeanarcofl0feetminimumradiusavcwSection16BlocksBlocksshallnotexceed1320feetInlengthunlesstopographyorothercharacteristicsofthelandreqdireandsuchlongerblockwillnotimpedetrafficflowWhereablockisover660feetlongsl0rootpedestrianwayshallbededicatedLayoutofblocksshallbesuchastoaffordadequatelotsforthetypeoflanduseandadequatestreetsforaccesscirculationcontrolandsafetyandtomakethebestofthelimitationsandopportunitiesofthetopographySection17StreetsandPedestrianWaysarightofwayminimumrightofwaywidthsshallbeasfollowsfeederstreets60feetresidentialstreets50feetturnaroundsan80footdiametercircleorPlanningCommissionapyprovedTorifnecessarypedestrianwaysl0feetblayoutstreetsshallbelaidout1ToconformwiththeOfficialCirculationPlanandbeproperlyrelatedtoexisting andplannedstreetsandpedestrianwaysandtoconditionsoftopographyconvenienceandsafetyandtotheuseofthelandservedprovidedthatofficiallyplannedstreetsmaybereallgnedwhereconducivetoabetterarrangementoflotsandpublicfacilitiesandimprovedcirculationoftrafficTogenerallyfollowcontourlinescontinuingtotheboundariesoftheplatsoastoprovidecontinuityofstreetsandpedestrianwaysTointersectatrightanglesorapproximatelysoTominimizeaccesstomajorstreetsbyprovisionofmarginalaccessstreetsreversefrontagewithscreenplantinginanonaccessreservationalongtherearpropertylineorothermeanstoseparatethroughandlocaltrafficandTogiveaminimumradiusofcurvatureatthestreetcenterlineoflO0feetandalO0foottangentbetweenreversecurvescimprovementgradingThemaximumgradeofstreetsshallbe7andtheminimum025themaximumgradeofpedestrianwaysshallbe10ChangesingradeshallbeconnectedbyapprovedverticalcurvesStreetsandpedestrianwaysshallbegradedtofullwidthaccordingtoapprovedcrosssectionundercitystandardsforprivateworkoncitystreetrightsofwaypavingStreetsshallbehardsurfacedaccordingtothespecificationsoftheSamestandardsintermsofthetypeofpavingelectedbytheapplicantSidewalksifanyshallsatisfytheminimumsofthesamestandardsdlightingandtreesIftheapplicantelectstoprovidelightingortreesinstallationorplantingshallconformwiththeOfficialStreetLightingorTreeplansenamesandsignsNamesshallbethoseofthestreetsdlextendedorasaprovedbytheplanningCommissionoSection18UtilitiesGVnZawaterAcompletewatersystemwithfirehydrantsshallbeprovideddesignedlocatedandinstalledaccordingtoadardsprescribedbytheCityEngineer7 bsanitarysewersIfthereisapublicsewermainlyingwithin800feetoftheproposedplatorifsuchisplannedforinstallationbythesewerauthoritywithinoneyearoffilingoftheapplicationacompletesanitarysewersystemtoconnectshallbeprovideddesignedlocatedandinstalledtostandardsprescribedbytheCityEngineercutilitieseasementsEasementsforutilltieeshallbeprovidedwherenecessarytosupplementstreetorpedestrianrightsofwaycenteredonrearorsidelotlinesifpracticaldstormsewersProvisionofstormsewerswillbenecessaryasanincidentofpavingThelocationandtypeofcatchbasinsculvertsandotherstructuresshallbeaccordingtothoseestablishedbytheCityEngineerandtheOfficialDrainagePlanWheresuchplanindicatesstormwatereasementsshallbeprovidedSection19InappropriateAreasandSlopesover10AreasdeterminedtobeinappropriateforsubdivisionforexamplewherepoordrainageorslideconditionsexistmaybesubdividedonlyifextraordinarymeasuresapprovedbytheCityEngineerandPlanningCommissionareassuredtoremedytheirdefectsSlopesof10ormoremaybesubjecttosuchadditionalrequirementsasthePlanningCommissionwiththeadviceoftheCityEngineermayprescribeSection20VariationsandExemptionsIftheapplicantshallapplythereforatthetimeoffilinghispropseedplattheCityCouncilmayvarytheapplicationoftherequirementsoftheComprehensivePlanincludingtheregulationsrelatingtoplattingitselfwhereitfindsunnecessaryhardshiptoexistWheresuchvariationisaskedthenoticeofpublichearingprescribedinSectionlOhereofshallbeamplifiedtoshowthatavarianceisaskedwhatregulationsaresoughttobevariedandonwhatbasisunnecesmaryhardshipisallegedtoexistWithin30daysaftersuchhearingthePlanningCommissionshallsubmititsreportincludinganengineeringstatementpreparedbytheCityEngineerandrecommendationastotheproprietyofgrantingavariancetotheCityCouncilwhichshallatitsnextregularmeetinggrantordenythesameThetimefortentativeapprovalordisapprovaloftheapplicantsproposedplatmaybeextendedbythePlanningCommissionbythetimenecessarytosecureadeterminationoftheapplicationforavarianceincludingreviewinthecourtsoftheStateofWashingtonForpurposesofreviewtheCityCouncilsdecisionshallbetreatedlikeoneoftheBoardofAdjustmentSection21CodeReferenceSections2through20hereofshallconstituteSections5200252004etcthrough52038oftheRedinsCodeandallothersectionshereofshallbeconsideredofspecialortemporaryeffectSection22EffectiveDateThisordinanceshallbecomeeffectiveuponSeptember91957iffinallyadoptedthenApplicationstoplatmaybereceivedandotherwiseconsideredbutnotentativeapprovalofaproposedplatgivenbeforethatdate8
