HomeMy WebLinkAboutOrdinance No. 0063CITYOFMEDINAORDINANCENO3ANORDINANCEdefiningsinglefamilydwellinguseunderthezoningordinancesTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1PurposeThepurposeofthisordinanceistOdefineuseoflandforsinglefamilydwetlingsandvariousincidehtsthereofaSsuchuseaffectsthehealthsafetyandwelfareoftheresidentsoftheCityofMedinatheCityCouncilmvingconsideredtherecommendationsofthePlanningCommissionafteritsdeliberationsonthesubjectitspublichearingofFebruary261957onitsproposedrecommendationsanditsreporttotheCityCouncilbaseduponsuchdeliberationsandpublichearingSection2SinzleFamily0ccuDancyDefinitionsForthepurposesofthisordinancethefollowingtermsshallhavethemeaningheroindicatedunlessthecontextclearlyindicatesadifferentmeaningSINGLEFAMILYDWELLINGadetachedprivatedwellinghousecontainingnotmorethanonefullkitchenfacilityandotherwiselimitedindesigntotheaccommodationofonefamilyitshouseholdservantsandguestsandcontainingnotlessthanninehundredfeetoffirstfloorareaoxclusiveofgarageopenentryporchespatiosandaccessorybuildingswhichmayincludeonebeachorplayhousenotexceeding200squarefeetingroundareaandhavingnomorethanoneroomplusabathroomandotherwisenotdesignedforcontinuingoccupancyHOUSEHOLDSERVANTSindividualswhospendmorethawfiftypercentoftheirworkingtimeemployedasserrantsonthebuildingsiteandinnoeventworklessthantwentyhoursperweekForthepurposesofthischapterhouseholdservantsshallincludethespouseandChildrenofsuchaservantFAMILYtheimmediatekindredmadeupofspersonandspousetheirparentsgrandparentschildrenandthespousesthereofandgrandchildrenandthespousesandchildrenthereofGUESTSthosewhooccupyuponinvitationoftheownerorlesseewithoutChargeorotherconsiderationforsuchoccupancyAsinglefamilydwellingmaybeoccupiedbythemembersofonefamilyaloneitsguestsandhouseholdservantsPROVIDEDhoweverthatitshallnotbeaviolationofthisordinancefortheownerofanydwellingtoprovidelodgingfornotmorethantwopersonsnotattachedtohisfamilyaslongassuchuseisincidentaltotheuseofthedwellingforresidencepurposesbysuchownerSection3AccesscryBulldlnzsConstructionandUseSeparateaccessorybuildingsnotdesignedforoccupancyandwhoseuseisincidentaltothatofasinglefamilydwellingshallbepermittedwithinthesetbackandotherlimitationsapplicabletObuildinginthelandusedistrictwheresuchdwellingislo CaredWherethearea0fthebuildingsiteisSufficienttosupporttwoormoresinglefamilydwellingsinthelandusedistrictwhereitislocatedseparateaccessorybuildingsdesignedforoccupancymaybeerectedandmaintainedasifthesamewerethemselvessinglefamilydwellingsandsubjecttothesameregulationsandusedasguesthousesservantsquartersorforrentalWheretwoororebuildirgsdesignedforoccupancyexistonacitewhichisinadequateinareaforthatnumberofsinglefamilydwellingstheircontinuedueisdeclaredtobenoneconformingbutmaycontinuesubjectotheregulationsrelatingtononconformingusesiScOtion4HomeOccupationsOccupationsinsinglefamilydwellinglandsusedistrictsarelimitedtothosewherehomefacilitiesareusedandnosignsorcommercialnamesareusedorexhibitedandnomerchandiseisdisplayedforadvertisingpurposesSection5SignsNosignsofacommercialnatureshallbepermittedinsinglefamilydwellinglandusedistrictsexceptsignsoftheownerorhisagentsstatingthatthepropertyisforsaleorforrentSection6CodeReferenceSections2through5hereofshallconstituteSections514651485150and5152tortespondinglyoftheRedinsCodeandallothersectionshereofshallbeconsideredoftemporaryorofspecialeffectSection7EffectiveDateThisordinanceshalltakeeffectonthe7dayofJ1958PASSEDbytheCityCouncilonthefosyofVt1958andsignedInauthenticationofitspassagethesamedayApprovedastoformtFyortenhenFChadwickJrStephenFChadwickJrCityAttorneyMaryFitzgeraldMaryFitzgeraldCityClerk
