HomeMy WebLinkAboutOrdinance No. 0066CITYOFMEDINAORDINANCENOANORDINANCEestablishingasuburbanresidentialSR30lazMiusedistrictintheCityofMadinsadoptingstandardsandregulationsfortheUseoflandthereinandprescribingpenaltiesTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1PUrposeThepurposeofthisordinanceistoestablishalandusedistrictfortheCityofMedtnawhereincommercialhorticulturetruckgrdeningagrioultbbPeotherthantheraisingofanimalsmaybepursuedandtoregulatethesameasthehealthsafetyandwelfareoftheresidentsoftheCityofMedlnamaybeaffectedtheCityCouncilhavingconsideredtherecommendationsofthePlanningCommissionafteritshearingonthesubjectheldMarch251958andhavingitselfheardthematteratitsregularpublicmeetingofApril141958Section2SuburbanResidentlalSR30LandUseDistrictEstablishedThereisherebyestablishedfortheCityofMedinaasuburbanresidentialss30XlandUsedistrictwhereinthefollowinguseoflandshallbepermittedaallusespermittedinaR30landusedistrictandbcommercialhorticulturetruckgardeninSandagricultureotherthantheraisingofanimalstogetherwithallstructuresnormallyincidenttoallsuchusesincludingbutnotbywayoflimitationhothousesgreenhousesstorageshedsheatingplantsandthelikeNobuildingorstructureshallbeerectednorshallanyexistingbuildingorstructurebemovedalteredaddedtoorenlargednorshallanylandbuildingstructureorpremisesbeusedforanypurposeotnerthantheaboveonlanddesignatedsuburbanresidentialSR30oNobuildingorstructureshallbeerectedconstructedormovedontosuchlandexceptwithconformitytoregulationsapplicablethertonorshallanyexistingbuildingorstructurebeenlargedalteredrepaldmovedorconvertedwiththeeffectofencroachinguponorreducingtheopenspacesurroundingsuchbuildingorstructureinviolationofthesetbackorheightregulationsorregulationsrelatingtothepercentageofareaoccupiedoranyotherlanduseregulatlonsapplicabletheretoSection3RegulationofSR30LandUseDistrictSR30landusedistrictshallbesubjecttothesameregulationsapplicabletoR30landusedistrictsintermsofminimumlotareasetbackpercentageofareaoccupiedheightandstreetfrontageexceptthatwhereaparcelinsuchdistrictSrentsonmorethanonestreetallstructuresshallbesetbackatleast30feetfrombothofaidstreetsandthebackpropertylineisforpurposesofsetbackdefinedasthesideoppositethestreetuponwhichtheparcelhastheleastfrontageSection4PenaltyViolationofanyoftheprovisionsofthisordinanceshallbeamisdemeanorandanypersonfounduiltythereofshallbepunishedbyafineofnottoexceed30000orbyimprisonmentfornottoexceed90daysorboth EachdaybywhichsuchaviolationshallcontinueafternoticethereoftoanyviolatorfromtheBuildingSuperintendentorotherpersonoragencytowhomhisauthoritymaybedelegateduntilsucherectionmovingalterationrepairconversionoraddingtoorenlargingofabuildingorstructureorprohibiteduselsdiscontinuedandanapplicationforabuildingpermitifrequiredfilledshallconstituteaseparateoffeueSection5SR30LaUdUseDlstri0tDefinedTheSR30landusedistrictisdefinedasfollowsAllthatportionoftheCityofMediuawithintheNorth330feetoftheEast12oftheSoutheast14oftheSoutheast14ofSection24Township25NorthRangehEastWMSection6CodeReferenosSectionF2through5hereofconstitutesections510551115118and51135respectivelyoftheMedinaCodeandallothersectionshereofshallbeconsideredoftemporaryorspecialefte6tSectionY1EffectiveDateThisOrdinanceshalltakeeffectll6PASSEDbytheCityCouncilonthedayOfdhe1958andsignedinauthentioationofitspassagetheofomentionedApprovedastoformSTEPHENCHADWICKMJRStephenFChadwickJrCityAttorneyAttestxFaryFItzgeraldCityClerkMAYOR
