015511764CITYOFMEDINAORDINANCENOJANORDINANCErelatingtosubdivisionandplattingoflandamendingSection8ofOrdinanceNo16andSections24512and15ofOrdinanceNo52andaddingnewplattingprovisionsastolanddivisibleintomorethantwentyorlessthanelevenbuildingsitesandbuildingbeforefinalapprovalofatentativelyapprovedplatTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSsection1Section8OrdinanceNo16AmendedSection8ofOrdinanceNo16aspreviouslyamendedbySection1ofOrdinanceNo71isfurtheramendedherebytoreadasfollowsSection8EnforcementAstolandinanydistricttwosetsofbuildingplansandtwoplotplansdraWntoscaleshowingtheentiresitedimensionsofthelotdimensionsofthebuildingandlocationoftheseptictankanddrainfieldorsidesewerlineandanyotherinformationrequiredtoshowcompliancewiththeregulationsofthisordinanceshallbefiledintheCityOfficeswhenapplicationforabuildingpermitismadeNobuildingpermitshallbeissueduponplanswhichdonotshowcompliancewiththeregulationsofthisordinanceandotherordinancesapplicabletobuildingandsubdivisionoflandNobuildingpermitshallbeissueduponabuildingsitecreatedinwholeorinpartbydivisionoforbyaconveyancemadeaftertheeffectivedateofthisordinanceofaportionofanyparcelofrealpropertyimprovedbyabuildingandthelandofwhichitisapartwouldnotsatisfytheregulationsofthelandusedistrictwhereitislocatedweresuchlandandbuildingitselfthesubjectofanapplicationforanoriginalbuildingpermitThisdisqualificationshallapplytotheentiretyoftheparcelimmediatelyanduntiltheinadequacyoftheimprovedparcelshallhavebeenremediedUoncompletionofabuildingorstructureuponwhichabuildingpermitwasissueditshallbeunlawfultooccupythesameuntilacertificateofoccupancyhasbeenobtainedfromtheBuildingInspectororotherpersonauthorizedtodischargehisdutiesNocertificateofoccupancyshallbeissuedunlesstheBuildingInspectororotherpersonauthorizedtodischargehisdutiesshallhaveascertainedthatthebuildingorstructureineverrespectcomplieswiththeregulationsofthisordinanceandeveryotherordinanceapplicabletobuildingItshallbethedutyoftheCityManageroftheCityofMedinaorsuchcityofficialsasarehisauthorizedrepresentativestoenforcetheprovisionsofthisordinance Section2Section2OrdinanceNo52AmendedSection2OrdinanceNo52isherebyamendedtoreadasfollowsSection2PlattinqRequiredAnysubdivisionoflandnoworhereafterinsingleownershiptdveemeeeepeeeTeeeeTwhicheither1containsthededicationofpartthereofasapublicstreetorhighwayor2isoflanddivisibleunderapplicabledensityrequlationsofthecityintofiveormorebuildinqsitesunlesstheCityEnqineershallfiathavedeterminedthatonlyfourorlessthereofbesuitableforbuildinqshallbebyplatandaccordingtotheregulationsoftheCityofMedinarelatingtoplattingNopersonfirmorcorpcationproposingtomakeorhavingmadesuchasubdivisionshallenterintoanycontractforthesaleoforshalloffertosellsaidsubdivisionoranypartthereoforshallproceedwithanyconstructionworkthereonoranyimprovementthereofincludinggradingandexcavationwithouthavingfirstobtaineditsapprovalasaplatashereinprescribedEachtransactionoffertoselloractofconstructionorimprovementwithoutsuchpriorapprovalofthesubdivisionasaplatshallbeconsideredaseparateviolationSection3Section4OrdinanceNo52AmendedSection4OrdinanceNo52isherebyamendedtoreadasfollowsSection4DelegationofAuthorityTheauthorityofthecitycouncilastoapprovalordisapprovalofplatssubdivisionsordedicationsisherebydelegatedtotheCityPlanningCommissionsubjecttothestandardsandregulationsforitsexercisehereinprescribedandotherordinancesoftheCityrelatinqtobuildinqandtheuseoflandSection4Section5OrdinanceNo52AmendedSection5OrdinanceNo5isherebyamendedtoreadasfollowsSection5DefinitionsForthepurposeshereofthefollowingtermsshallhavethefollowingmeaningsunlessthecontextclearlyindicatesthecontraryCOMPREHENSIVEPLANistheofficialplanforthecitysphysicaldevelopmentbeingthesumoftheordinancesandtheofficialplansandmapsadoptedtherebygoverningfunctionalpartsofsuchdevelopmentincludingbutnotbywayoflimitationplansandrequirementsrelatingtotypeofusebyzonedensityofbuildingcirculationofpedestrianandvehiculartrafficdrainageofstormwaterlocationandextentofpublicandeemipublicareasoflanduseschoolsparkschurchesetcandsubdivisionoflandOFFICIALMAPSarethemapsorcombinationthereofadoptedbyordinanceasrepresentationsofpartsofthecomprehensiveplanONisheanydivisionoflandintosmallerparcelssuchdivisionbeforagriculturalpurposesandinsuchmannerthateachparcelsocreatedequalsorexceeds10acresinareaorbefortherimaryurDoseofenhancinqconformitywithCitydensityzoninqregulationsutilityservicesorDublic DEDICATIONisthedeliberateappropriationoflandbyitsownerforgenelandpublicusesreservingtohimselfnootherrightsthansuchasarecompatiblewiththefullexerciseandenjoymentofsuchpublicuseSection5Section12OrdinanceNo52AmendedSection12OrdinanceNo52passedJuly81957andfinallyadoptedSeptember91957isherebyamendedtoredasfollowssection12MinimumImprovementsTentativeapprovalshallbeeffectiveforaperiodofweyeesoneVearaftertransferofthefourthparceloutoflandsubiecttoplattinhereunderunlessextendedbythePlanningCommissionforaperiodnottoexceedtwoadditionalyearsduringwhichtimetheapplicantshallexecutetheminimumimprovementsashereinafterrequiredAftertentativeapprovaltheapplicantshalladvisetheCityEngineerbywhichorwhatcombinationofthefollowingmethodshewillcarryouttherequiredminimumimprovementsabygivingtheCityofMedinaabondwithsufficientsuretiesandinanamountdeterminedbytheCityEngineertobesufficientassuringinstallationoftheminimumimprovementsandanyadditionalimprovementsinaccordancewiththestandardshereinaftersetforthtothedecidedsatisfactionoftheCityEngineerbbyactuallyinstallingsuchimprovementseitherasprescribedbythelocalimprovementdistrictlawsoftheStateofWashingtonandCityofMedinaorotherwisePROVIDEDthattheapplicantmayifhechoosesamendsuchelectionofmethodbywhichimprovementsarecarriedoutbywrittennoticetothecityEngineerandtheprovisionorsubstitutionoftherequiredbondAfterthecompletionofsuchimprovementsorprovisionofnecessarybondsandcontractsifanyassuringcompletiontheCityEngineershallprovidehiscertificateinduplicatetothePlanningCommissionthatallimprovementshaveeitherbeencompletedaccordingtothestandardshereinaftersetforthandtheCityscostspaidorsufficientsecuritygivantoassuresuchcompletionwithintheeffectiveperiodoftentativeapprovalandpaymentofsuchcostsThePlanningCommissionshallthereuponforwardacopyofsuchcertificatetotheapplicanttogetherwithnoticeadvisinghimtoprepareafinalplatastothatpartoftheproposedplatforwhichthecertificateisgivenSection6NewCertainParcelsofLandDivisibleintoLessthanElevenBuildinSitesWhereunderapplicabledensityzoningreguaparceloflandnoworhereafterinseparateownershipcouldprovidenotmorethantenbuildingsitesandthedepthofsuchparcelexceedsitsfrontageonalladjoiningstreetsbythree3ormoretimesthenthesamemaybeplattedwithdedicationandimprovementofstreetsinstallationofotherimprovementsasfollowsRightofwaythirtytwo32feetinwidthgradedpavedanddainedbystormsewersalltoestablishedcitystandardssuch sitestobeservedtherebyorfive5iftherebenine9orten10suchsitesandtohaveatitsextremeifthesamedoesnotconnectwithastreetateachendaturnaroundasotherwiserequiredbyplattingregulationscfthecityTherequiredutilitiesmaybeseparatelylocatedinutilityeasementswhenapprovedbytheCityEngineersucheasementstoserveallbuildingsitesandbeinformtoassurereadyaccessbyresponsiblepublicandutilityauthoritiesforinspectionandmaintenancePROVIDEDhoweverthatsaidsubdivisionshallconformwithallotherwiseapplicableplattingandzoningregulationsandproceduresofthecitySection7NwBuildingbeforeaDDroYaloffinalOlatafterinitialtransfersConstructionofnewbuildingsonuptofourbuildingsitescreatedbysubdivisionofparticularlandsubjecttoplattinghereunderpriortofinalapprovaloftheplatthereofmaybeundertakenifthefollowingconditionsfirstbemetaaplatoftheentireowneFshipofwhichthebuildingsitewasaparthasbeententativelyapprovedhereunderbeasementsinformapprovedbytheCityshallhavebeencreatedassuringpreservationoftherightofwayandotherpublicusesprovidedinsaidtenativelyapprovedplatcinallinstrumentsoftransferofparcelscreatedbysubdivisionofsuchlandandsufficientunderregulationsoftheCityastominimumlotareaforbuildingthereshallbeanundertakinginformapprovedbytheCityexpressedasacovenantrunningwiththeremaininglandofthegrantorassuringthetransfereeandhissuccessorsandtheCitythattherequisitesforfinalapprovaloftheplatwillbetimelymetanddthereiscompliancewithallotherapplicableregulationsoftheCitygoverningtheuseandimprovementofthelandSection8NewSuccessiveseparateplatswhenauthorizedWheresubdivisionoflanddivisibleunderapplicabledensityregulationsintotwentyormoreresidentialbuildingsitesisinvolvedandwherethePlanningcommissiondeterminesthattherealizationofanintegratedandusefulstreetwalkwaysewerstormdrainageorotherpublicfacilitysystemwillnotbeprejudicedtherebysaidlandmaybesubdividedbysuccessiveseparateplatsprovided1thatanylanddividedintoparcelsequaltoorlessinareathanfivesufficientresidentialsitesbewithintheimmediateplatand2thatthelandremainingunplattedbeofsufficientsizetobedivisibleintotenormoresuchsitesSection9CodeReferenceSections1234and5hereofrelatetoSections5116520025200652008and52022oftheMedCoderespectivelywhileSections67and8shallconstituteSection52013052023and520125respectivelythereofAllothersectionsofthisordinanceshallbeconsideredofspecialortemporaryeffectSection10PurposeThepurposeoftheamendmentssupplementationsmodificationsembracedinthisordinsnceistoencourageharmoniousdevelopmentoflandunderstandardsheretoforeadoptedbytheCityafterareportofthePlanningCommissionrelatingtosubdivisiongenerallyand
