ANORDINANCEregulatingtheharboringandrunningatlargeofcertainanimalsprovidingforthelicensingseizureiquarantineimpoundingsaleendotherdispositionthereofdeclaringcertainactionstobepublicnuisancesdescribingpenaltiesforviolationsendrepealingordinanceNo94THECITYCOUNCILOFTHECITYOFMEDINADOORDATNASSeCtion1PurposeDeclaredThisordinanceisenactediriforthepurposeofregulatingthekeepingofdogwithintheCityThefeschargesendpenaltiescollectedhereundershallbebudgetedtodefrayinwholeorinparttheexpenseofsuchregulationSection2DefinitionsandTermsAsusedinthisordinanceUnlessthecontextotherwiseindicatesthefollowingwordsandtermsshallmeanaAnimalshellincludeorfemalnaturalorsterilizedbDogshallincludebothmaleandfemalenaturalOrsterilizedViciousanimalshallincludethosewhosetemperamsntorhabitscreatedangerofinjurytopersonsorotheranimalsorcreatesareasonableapprehensionofinjurytopersonsorotheranimalsdPredatoryanimalshallincludeanydogofeithersexwhoseactionorhabitscustomarilydefilesdespoilsordamagespropertyofotherseOwnerorkeepershallincludeanypersonassociationorcorporationowningkeepingorharboringananimalfAtlargemeanstobeoffthepremisesoftheownerandnotunderthecontroloftheownerorofanauthorizedpersonovertwelveyearsofageeitherbyleashorotherwisebutananimalwithinanautomobileorothervehicleofitsownershallbedeemedtobeupontheownerspremisesBarkingdogmeansanydogwhichbyfrequentorhabitualhowlingyelpingorbarkingannoysordisturbsotherpersonsinthevicinityothepremisesoftheowneroruponthepublicstreethLeashshallincludeacordthongorchainnotmorethan10feetinlengthbywhichananimaliscCntrolledbythepersonaccompanyingitiHarboringTheoccupantofanpremisesonwhichananimalremainsortowhichtcuatomarilyreturnsdailyforfoodandcareforaperiodof10daysispresumedtobeharboringorkeepingtheanimalwithinthemeaningofthisordinance JOfficerorOfficialanypolicemanoranyofficerofficialpersonorpersonsdesignatedbytheCityManagerorbyordinanceofthisCitytoissuelicensespickuprestrainimpoundaelidlspoaegivenoticeforanyotheractsdutiesorfunctionsprescribedbythisorotherordinancesrelatingtotheanimalsheroinregulatedkLicenseshallmeanthedoglicenseissuedbytheiCityofMealinsunderthisordinance1KennelshallincludeanyplaceotherthanaiveterinaryhospitalwherethreeormoredogsarekeptforbreedingandtheoffspringsthereofareoldforprofitorwheresuchanimalsarereceivedforcareandhoardingmPublicemergencyshallincludeanysituationresultingfromconditionsofwarinsurrectioncontagiousdiseasesorothercircumstancewhichintheopinionoftheChiefofPolicewarrantstherestraintandconfinementofanimalswithinthepremisesoftheownerorkeepernPoundAplacewithinorwithouttheCityprovidedandoperatedbytheCityemployeesorbyanindependentagencyundertheauthorityoftheCityactingaloneorinconcertwithotherKingCountyandormunicipalltiesfortherestraintandcareofanimalsoPetSheshallincludeanyplacedulylicensedlfWherelivPeentmlabirdsorfisharekeptndjofferedforsaleopVeterinaryHospitalshellincludeanyestablishmentmaintainedandoperatedbyalicensedveterinarianforthediagnosistreatmentandcareofdiseasedorinjuredanimalsandfortheircareandtrainingqSpayedFemaleshallincludeafemaledogwhichhasbeensterilizedbyalicensedveterinariantoavoidorpreventconceptionProofofsuchsterilizationmustbeevidencedbythecertificateofalicensedveterinarianrsheattaintAnanimalshallbedeemedtobeunderrestraintifitisconfinedwithinthepropertylimitsofitsownerorkeeperbyasuitablefenceorsecurelyrestrainedwithinthepremisesbyaleashaffixedtoapostorothersecurelyfixedobjectSeCtion31ttuntokeeporharboradogovertmonthsofagewithintheCityiunlessananimallicenseshallbeprocuredfortheanimalfromtheCityIfjLIoenseshallbemadeuponformsprovidedbytheCityTheiiSectiOn32LicenseApplicationApplicationforsuchlilapplicationshalllistthenameaddressandphonenumberoftheownerthenamebreedcolorageandsexofeachanimalownedorharboredbyhimandsuchothermedicalandvaccinationinformationanddataasmayberequiredinSection81hereof SuchinformaionshallbekeptconvenentlyindexedbythelicensingofficialtogetherwiththenumberofthelicenseissuedEc15ection33TermThelicenseshallexpireeachyearOnthe31stdayofDecberfollowinthedateofissuancethereofISection34FeeTheannuallicensefeeforeachmaleBogandspayedfemaledogshallbe200ThermallicensefeeforeachfemaledogshallbeISection35DisplayEachlicenseddogshallbeprovidedbytheownerorkeeperwithasuitablecollerorharnesswhichshallbewornbytheanimalatalltimeswhenrunningatlargeTosuchcollarorharnessshallbeaffixedatagprovidedbythecityofficialforeachyearforwhichalicensehasbeenprocuredSuchlicensetagshallbesoaffixedastoharandbediscernibletoapersonofnormalvisionatnotlessthen10feetThelicensetagshallbestampedwiththenumberandyeaforwhichitisissuedTheshapeordesignofsuchtagshallbechangedfromyeartoyearItshallbeunlawfulforanypersonetherthantheousthieagentoracityofficialtoremovethelicensetagfromthedogSection36TransferWhenevertheownershipofananimalshallchanethenewownershallnotifythelioensinofficialandpaytotheofficialasumequalto50oftheannualfeewhereuponthelicensingofficialshellchanetherecordeccordinglyforsuchanimalandthepreviouslyissucdlicenseforsuchenimelshellremainvalidfortheremainderoftheFearSection37LostTaRaAnyownerorkeeperofalicensedanimalwhosecurrentlicensetaghasbeenlostmayobtainareplacementtagpriortoimpoundingofsuchanimalbypaymentofafeeof50tOthelicensingofficialbAnyanimallicensedforthecurrentyearwhichmaybeimpoundedwhilerunningatlargewithoutatagmayberedeemeduponpeymentofimpoundingcareandinnoculationfeesaaprovidedinSection53SectionkControlofAnimalsItshallbeunlawfulfortheownerorkeeperztheCityatanytimewithoutaodordinanceSectionh2TopermitnanimalwhetherlicensedoTnottofrequentandrunatlargeonpublicschoolgoundsduringschoolhoursSection43TopermitadotentcrepublicpiecewhrefoodisstoredpeparedservedorsoldtothepublicSection44TopermitafemaledogtorunatlargewhileinheatSeotio45TOpermit2dogtorunatlrgeduringprohibitedhoursortimesWhiChmaybesethereafterbythe CityCounciltheCityManagerthe0bierofPoliceortheiCityHealthOfficerduringapublicemergencymadefinedinSection2mSection46TopermitaviciousdepredatorydestructiveordiseasedanimaltorunatlargeaftertheownerorkeeperhasbeennotifiedbytheCityOfficialthatmuchanimalhasbeensoclassifiedorthatreportsorcomplaintsoftwoormoreneighborsorotherresidentshavebeenfiledorregisteredwiththeChiefofPolicewhichwouldputtheownerorkeeperonnoticeofadispositionortendencytoconditionorconductofsuchanimalthatcreatesathreatofinjurytoanypersonoranimalorpropertyofothersaInthlarespectanypersonreasonablyapprehensiveoverthesafetyofhispersonhisfamilyorhispropertybecauseofthethreateningviciousordepredatoryactionsofanydogmaymakewrittencomplaintgivingsuchinformationasmayberequiredbytheChiefofPolicebAnyownerorkeeperagrievedattheclassificationofhisanimalasviciousdepredatoryordestructivemayrequestahearingbeforetheBellevueDistrictCourttodeterminetheJustificationofsuchclaeeificatlonorthemeritofthecomplaintsIntheeventoftheaffirmanceofsuchclassificationtheownerorkeeperappealingshallpaythecoatsofsuchhearingincludinga500filingfeeandthefeestootherwitnessescalledbythePoliceChiefinmupportoftheclassificationSection47TopermitsuchviciousanimalofftheownermpremisesunlesssecurelymuzzledorleashedinthecustodyandcontrolofapersonoverlyearsofageandphysicallyabletorestrainandcontrolsuchanimalSection48ToharborcrpermitabarkingdonwhosebarkingissofrequentloudorconunontothehoursofreposeastoannoypersonsonadjacentpropertyISection5IMPOLrNDINGOFOFFENDINGANIFLArSection51DutyItshallbethedutyofmuchcityemployeesasshallbedesignatedforthatpurposebytheCityManagerortheemployeesOfanyauthorizedagencydesignatedbytheCityManagerwiththeapprovaloftheCityCounciltotakeupandimpoundanyanimalfoundintheCityinviolationofanyoftheprovisionsofthisordinanceSection52HeistryThepoundkeeperorhisdulyappointedagentshalimmediatelyuponimpoundingofanyanimalmakeacompleteregistryenteringthebreedcolorndsexofsuchanimalandwhetherlicensedifknownandiflicensedheshallenterthenameandaddressoftheownerandnumberofthelicensetaifknownandifbearinaninnoculationtaghenberofsuchtagshallberecordedaWhenanylicensedanimalshallbeimpoundedtheChiefofPoliceshallforthwithgivenoticebymailandbytelephoneiftheownerbewithinthecitylimitstotheownerofmuchlicenseddoginformingsuchowneroftheimpoundingofhisdogendthereasontherefor biWhenanydognotbearln6acollsorharnesstowhichisettachedalicenseShallbeimpoundedtheChiefofPoliceorpoundmastershallgivenoticewithin24hoursofsuchimpoundingbypostingnoticeofsuchimpoundinggivingthebreedcolorsexendotheridentifyingcharacteristicsofsuchimpoundedanimaltogetherwiththedateandIplaceofapprehensionthereofSuchnoticeshallbepostedstPolicelleadquartersandatsuchotherpublicplaceasshallbeprovidedforsuchnotice53FeesForeveryanimaltakenupandimpoundedsprovidedintsordinancethereshallbepaidtothedesignatedofficialfortheuseoftheCitybyanypersondesiringtoredeemsuchanimalthetotalofthefollowingfeesaAnimpoundingfeeof50bzrlheehadbeenisedthecurrentyeartheannuallicensefeerequiredbySection34oriftagislostthereplacementfeeasprovidedbySection37alorifredeemedbyotherthanpriorownerthecostoftransferringregistrationasprovidedbySection36cThecostoffeedingandcareofsuchanimalat100perdayforanimalsweighingunder90poundsand150perdayforanimalsweighing91poundsormoreCostoftnnoculatingsaidanimalagainstrabiesat20unlessownerpresentsacertificateasprovidedbySection81providedhoweverthatthepoundmasterinhisdiscretionimaywaivecollectionofthefeesprovidedinaandoaboveineventofsaleoftheanimaltosomepersonotherthanpriorOWnerorkeeperProvidedfurtherthatpaymentofthefeesprovidedinithissectionshallbeexclusiveofanyfinesorpenaltiesimposedupontheowneruponconvictionofviolationofanyprovisionofthisordinance54tedemptionfirstthreedaysAnyanimalwhichhasbeenimpoundedmayberedeemedduringthefirstthreedaysafterbeingimpoundedbyanypersonclaimingtoownoractfortheownerofsuchanimalandaftersuchthreedaysbyanypersononpaymentofthefeesandcostssssetforthinSection53aboveIfanysuchanimalbenotredeemedwithinsixdaysafterbeingimpoundedsuchanimalshallbesubjectatobeingdestroyedbytheorderoftheChiefofPoliceortheauthorizedpoundmasterprovidedthataftersuchsixdaysonorderofthepoundmasterbsuchanimalmaybekeptandofferedforsaleatapricefixedbythepoundmasterorcreleasedbythepoundmastertoanypersonwhoshallpaythefeesrequiredbySection53orsuchportionincludinginnoculationandlicenseaspoundmastermayrequireor dsdchpoundmastermayreleasesuchanimaltoanyotherorganizationforsuchotherdispositionashemayseefitprovidedthatnoanimalshallbegivenorsoldtoanypersonorassociationforviviseotionpurposesSection55DispositionofProceedsFromSaleofImpoundedAnimalsTheproceedsoftheauctionorothersaleofanyimpoundedanimalaftertheexpirationoftheperiodofredemptionaboveprovidedshallbeappliedfirsttothecostofapprehensionlicenseandthecareoftheanimalattheratssetinparagraphir53aboveandthebalanceofsuchproceedsshallbedepositedIwiththeCityClerktobeheldforaperiodofsixmonthsduringwhichtimeanypersonwhoshallpresentsufficientIcredibleevidenceofownershipofsaidanimalmaybeentitledtoredeemtheremainderofsuchproceedsIftherehasbeenlLnoredemptionofthebalanceofsuchproceedswithinsixmonthsofthedateofsaletheClerkshalldepositsaidfundswiththegeneralfundsoftheCitySection56ImpoundinganddispositionofviciousanimalsAnyfiercedangerousorviciousanimalatlargeinthepublicwaysorpublicplacesoftheCityoruponprivatepremisesofanypersonotherthantheownerandanyanimalwhichmayiLLdisturbthequietofanypersonorneighborhoodorwhichmayIaoconductitselfonprivatepremisesastocauseharmtheretoorannoyancetotheownerthereoforwhichshallbiteapersonorsoinjureapersonastocauseanabrasionoftheskinisherebydeclaredtobeapublicnuisanceandsuchsnivelsshallIimmediatelybetakenupendimpoundedinthemannerprovidedforinthisordinanceAnysuchanimalSmayberedeemedsubjecttoheprovisionsofChapter8onlybyapersonundertakingtocontrolsuchanimaleoastopreventitsbeinganuisanceasheroinabovedefinedsndifanyanimalshallbesoimpoundedthreetimesinanytwoyearperiodundertheprovisionsofthissectionsuchanlmalshallbedisposedofasanunredeemedanimalunlesstheownershallundertakeandactuallykeepsuchanimaljIoutsidetheCityIISection57ProtectionofmailmanetcAnyanimalofiIfiercedangerousOrvicioustendenciesshallnotbeirmittedItorunatlargewithintheCityandshallbekeptsecurelyConfinedwhenontheownerspremisessothatsuchanimalannotreachmailmendeliveryboysorotherswhomayhaveioccasiontoentertheownerspremisesinthecourseoftheirlawfulworkvSectionBitingdoRAnydogwhichshallbiteattack7LOrattempttobiteoneormorepersonstwoormoretimeswithiniiEfiveyearperiodisherebydeclaredtobeanuisanceandshallnotbekeptwithinheCityIfanysuchanimalhallbefoundwithintheCityitshallbeimpoundedanddisposedofasanunredeemeddogandtheownershallhavenorighttoedeemsuchdogSeCtionS9DestrUctionIfanyfiercedangerousviciousdepredatOryanimalcannotbeoafelytakenpandimpoundedNuchdogmaybeslainbyanypoliceofficerorauthorizedagentortheCityPoundjSecion51oCostsinveterinaryhospitalAllcostsImaintaininganysuchanimalinaveterinaryhospitalshallbytheowner 11ContionsOnreleaseWhenananimalshallbeimpoundedpursuanttotheprovisionsofthisordinancethepoundmastermayimposesuchconditionsuponthereleaseOfsuchanimalasmaybenecessaryordesirableinordertoavoidforestallorpreventrecurrenceoftheviolationleadingtotheimpoundingofsuchanimalantinoanimalshallberedeemedbvtheownerorotherpersonexceptincompliancewithConditionswhichmayincludeundertakingtokeepsuchanimalousldetheCityundertakinglmaiMalngtocontrolsuchanimalwithinspecifiedlimitsoranyohercomiitionswhichmaybeappropriateandreasonabletoavoidrecurrenceoftheconditionsleadingtosuchimpoundingSection6INJURINGKILLINGABANDONINGORNISTREATINGANIMALSI61CrueltYgaccidentsNopersonshallwilfullyanUeasonablyinjureheatorabuseananimalorrundonanyanimalwithavehicleAnypersonwhokillsorinjuresananimalwhiledrivingavehicleshallstopatthesceneoftheaccidentandrendersuchassistanceaspracticableshallmakereasonableefforttolocateandtoidentifyhimselftotheownerortoanypersonhavingcustodyoftheanimalandshallreporttheaccidentimmediatelytocitypolicy62CareItshallbeunlawfulforanypersontokeeporharborananimalwithintheCitywithouprovidingasuitabledryplaceforthehousingthereofortofailtoprovideasuitableamountofwholesomefoodandcleanwaterforthenutritionandcomforthereofortoleavethepremisesuponwhichsuchanimalisconfinedortowhichitcustomarilyreturnsformorethan2hourswithoutprovidingforthefeedingandcareofsuchanimalintheabsenceofsuchperson63poisonItshallbeunlawfulforanypersontopoisonortowilfullyplaceorleavepoisonfondanywherewithintheCitywhereitmaybeeatenbydomesticanimalsortoleavepoisonorunpoisoneafoodoutsidetheCitywiththeintentionandinsuchproximityastopoisonaoatordogwithintheCityofedinaUponconvictionofviolationofthissectionsuchpersonshallbesubjecttoafinenfupto300or30daysimprisonmentorbothSection7ARRESTOFANIRL71ArrestcircumstancesofTheCitybyitsproperlyconstitutedofficersshallarrestanyanimalsaFoundtobeatlargeorharboredundercircumstancesconstitutingaviolationofthisordinanceorbDamagingpropertyofapersonotherthantheownerofsuchdogexceptindaleneeofthepropertyoformembersoftheownershouseholdoroCausingbodilyharmtoanypersonOrdActingInsuchmannerastocausereasonableapprehensionofsuchharmtopersonsoranimalsnotwithinoruponthepremlsesofsuchdogsowner7 SuchanimalmyalsobetakenintocustodybyanypersonwhoobservessuchviolationSUChpersonshallpromptlycalltheCitypoliceorotherofficialorreporttheCircumstancesleadlgtosuchseizureanddeliverortenderpossessionofsuchanimaltotheCityforimpoundig72InterferenceAnypersonincludingtheownerormemberofhisfamilywhoshallgiverefugetoorwhoshallfailorrefusetodeliverpossessionofamanimaltoanofficerwhosinpursuitofananimalseenvolatinganyprovisionofthisoraluanceshalluponconvictionthereofbeguiltyofamisdemeanorandbesubjecttoafinenottoexceed1000073EntrvAnofficerinhotpursuitofananimalknowntobeviciousorreasonablysuspectedofbeingdangeroustopersonsotherthanwrongfultrespassersuponhisownerspremisesmayenterthepremisesoftheoueranddemandpossessionofsuchanimalandifafterrequesttherefortheownerorkeeperoftheanimalover16yearsofageshallrefusetodelivertheanimaltotheofficerandtheofficercannotwithreasonablesafetycatchtheanimalhemaycauseittobekilledProvidedsuchofficershallnotentertheabodeofthecnerwithoutawarranttherefor74HOldiuzandcareoflmnouudedanimalsAllanimalsarrestedandimpoundedshallbegivenhumanecareandproperlyfedduringsuchdetentionReasonableeffortshallbeexertedtosegregatesuchanimalsastosiexaconditionandtemperamentsothatthetimidsickweakorinjuredanimalswillnotsufferfromtheactionsofothers75RetentiontimeEx0eptinthosecasesinwhichtheanimalisbeingredeemedorreturnedtotheownerorpersonhavingthelawfulrighttheretoallimpoundedanimalsshallberetainedfornotlessthan72hoursafterthetimeofgivingnoticeofsuchimpoundingunlesstheanimalissickorinjuredandasoonerdisposalisdeemedbythepoundmastertohethepropercoursetobetakenThepoundmastershallretainimpoundedanimalsbeyondthe72hourminimumrequirementinhisopiniontheanimalisofsufficientValueandattractionthattheoanticuedcareandexpenseiswarrantedpendingthesaleordisposalofsuchanimalSection8RABIES81QuarautineobservatlouauivaccinationNolionessshallbeissuedforanydogwhichhasnotbeeninnooulatedagainstrabieswithinaperiodOf12monthspriortotheappucatioforsuchlicenseTheveterinarianinnooulatinganyanimalshallprovidetheOwnerwithacertificateevidencingsuchfacttogetherwiththedatethereofandtheagebreedsexcolorandotheridentifyingcharacteristicsofsuchdogThelicensingofficialshallentersuchinformationintotheregisterprovidedinthisordinance82ConfinementandretentionbyownerItshallbeunlawfulfortheownerofanyanimalwhennotifiedthatsuchanimalhasbittenanypersonorhassoinjuredanypersonastocauseanabrasionoftheskintosellorgiveawaysuchanlmalortopermitorallowsuchanimaltobetakenbeyondthellmitsoftheCityexcepttveterlmaryhospitalanditshall dutyofsuchowneruponreoeiviunoticeofthecharacteraforesaidtoimmediatelyplacesuchanimalinadulylicensedveterinaryhospitalwhichsuchanimalshallbeconfinedforaperiodofatleast15daysortodeliversuchanimaltoanypolicemanforsuchplacementProvideduponauthorizationofalicensedveterinarianwiththeconsentoftheCityHealthofficersuchanimalmaybereleasedtothecustodyofitsownerupontheownersundertakingtokeepthesamesecurelyChainedandnonfinedtothepremisesoftheownerandsegregatedfromanyotheranimalsduringsuchobservationperiod83ConfinementbyCityUpontakingpossessionofananimalknowntohavebittenorhavingdisplayedsymptomsofrabiesanypolicemanorotherauthorizedcityemployeeorauthorizedagentshallforthwithconveysuchanimaltothenearestveterinaryhospitalwheresuchanimalshallbesecurelychainedcrConfinedforaperiodofatleast15daysIncasesuchanimalisdeliveredtoaveterinaryhospitalnoticeofthenameandlocationofsuchhospitalshallbeimmediatelyfurnishedtheChiefofPolicebytheownerofsuchanimalanduponthereceiptofsuchanimaltheveterinaryhospitalshallsubmittotheChiefofPoliceacertificatestatingthatsuchanimaleithershowsnosymptomsofrabiesordoesshowsymptomsofrabiesAttheexpirationOf15daysofconfinementanduponreleaseofsuchanimaltheveterinaryhospitalshallsubmittotheChiefofPoliceasecondCertificatestatingthattheanimaldoesnothaverabiesandhasbeenreleasedThecostofmaintainingsuchanimalintheveterinaryhospitalshallbebornebytheownerthereofexceptwheretheownerofsuchanimalcannotbeascertainedtheCityshallthenpayforsuchobservationandcare8ExaminationmlainsuecentInallcaseswhereanyanimalwhichhasbittenapersonorcausedanabrasionoftheskinisslainbyanypolicemanorotherauthorizedrepresentativewhetherbyorderofthecourtorotherwiseandaperiodof15dayshasnotelapsedsincethedayonwhichsuchdogbitanypersonorcausedanabrasionoftheskinofanypersonitshallbethedutyoftheofficerslayingsuchanimaltoforthwithdeliverintactthebrainofsuchanimaltothelaboratoryoftheStateDepartmentofHealthoradulyauthorizedveterinaryhospitalforexaminationSectio9POUNDSTOBEMAINTAINEDBYTHECITYTheCityManagershallprovidesomesuitableplacewithinorwithouttheCityforhousinganimalspickedupasstrayedinjuredorinviolationofthetermsofthisordinanceandprovisionshallbemadeforthecaretreatmentsaleorotherdispositionofanimalsnotredeemedasprovidedaboveSuchhouseshallbesodesignedandconstructedastokeeptheanimalsincleandryandwellventilatedpensorcagespermitanimalstogetsunshineandexerciseandprovidesegregationofanimalsbefireproofprovideisolationcagesforsickorbitecasesprovideofficeorherroomsforattendantstobeonthepremises24hoursperdayprovidealethalroomandamorgueCareforsaidanimalsshallbeprovidedasapprovedbyalicensedeterinarianDeadanimalssklbeorematedburiedorremovedtoarnderingplantwithin48hoursofdeathexceptthatincaseofthedeathordestructioncfsuchanimalresultingfromitshavingacommunicablediseasethebodythereofshallberemovedandcrematedorburiedasseenasfeasibleafterdeath9
