HomeMy WebLinkAboutOrdinance No. 0189CITYOFMEDINAoRDINqcANORDINANCBpermittinglimitedreductionofminimumlotsizerequirementswherethelandissteepuponcertainconditionsTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1PurposeThepurposeofthisordinanceistorecognizetheisolationofbuildingsitesinadthedifficultyofimprovingsteeppropertieswithintheCitytheCityCouncilhavingheldapublichearinguponaproposalforadjustmentoftheminimumlotsizeregulationswheresuchconditionexistsuponthe9hdayofNovember1964afterareportandrecommendationofthePlanningCommissionoftheCityuponthesubjectnoticeofsaidpublichearinghavingbeentheretoforepublishedinthemannerrequiredbylawSection2HighBankDensitvExceDtionPermitfromBoardofAdjustmentWhereaparceloflandinseparateownershipatthetimeoftheadoptionofthisregulationcontainsmorethantherequiredlandareaforonebuildingsiteinthelandusezoneinwhichsuchparcelliestheBoardofAdjustmentmaygrantaconditionalusepermitsothesamemaybedividedintotwoormorebuildingsitesprovidedafterahearingconductedinthemannerofanapplicationforavarianceitfindsaeachbuildingsitewillcontain85percentormoreoftheminimumlotarearequiredbutinanycasenotlessthan16000squarefeetandliesatanelevationOf30feetaboveorbelowtheaverageelevationofthepropertyfromwhenceitistobeseparatedsaiddifferenceinelevationtobemeasuredalongtheirconunoncenterlineasshownbythesketchofasurveyorlicensedintheStateofWashingtonwhichsketchisaccompaniedbythesurveyorscertificatecertifyingtheamountofsaiddifferenceandbanystructureonabuildingsitetheaverageelevationofwhichisgreaterthanthatofthepropertyfromwhenceitislasttobeseparatedshallbepositionedonsaidsiteinsuchamannerthattheelevationofthefoundationofthestructureisnolessthanthatoftheelevationofthehighestpointexistingorpermittedforastructureonthebuildingsitefromwhencethebuildingsiteislastseparatedandcanystructureonasitetheaverageelevationofwhichislowerthanthatofthepropertyfromwhenceitislasttobeseparatedshallbelimitedinheightsothatitshighestpointdoesnotexceedinheighttheexcavationofthefoundationofanystructureproposedexistingorpermittedunderthelanduseregulationapplicabletothepropertyfromwhencesaidbuildingsiteislastseparatedandjnoextraordinaryharmisdonetoorunduehardshipcreatedforadJacenpropertiesandethereistobecompliancewithalloherapplicablelanduseregulations Section3CodeReferenceSection2hereofshallconstituteSection51152oftheMedinaCodeandallothersectionsshallbeconsideredoftemporaryorspecialeffectSection4EffectiveDateThisordinanceshalltakeeffectonthedayofMay1966PASSEDBYTHECITYCOUNCILonthe8whdayOf66andsignedinauthenticationOfitspassagethesamedateMAYORApprovedastoformSTEPHENFCHADWICKJRCityAttorneyATTESTBERNICESOWDENCityClerk
