CITYOFMEDINAORDINANCENO192ANORDINANCEestablishingaNeighborhoodAutoServicingNAzoningfortheCityofMedinaadoptingstandardsandregulationsfortheuseoflandthereinsupplementingthecomprehensiveplanforthephysicaldevelopmentoftheCityforthatpurposeassigningreferencenuanbersintheMedinaCodeandprescribingpenaltiesTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1PurposeThepurposeofthisordinanceistoestablishazoningfortheCityofMedinawhereinautomobilerepairandservicingcanbeprovidedandtoregulatethesameasthehealthsafetyandwelfareofthepublicmaybeaffectedincludingwithoutlimitationresidentsofnearbylandandusersofnearbystreetstheCityCounCilhavingconsideredtherecommendationsofthePlanningCommissionandheldapublichearingthereonatitsregularpublicmeetingofMay91966Section2NeighborhoodAutoServicingNAThereisherebyestablishedfortheCityofMedinaaNeighborhoodAutoServicingNAlandusedistrictwhereinaallusesallowedinR16singlefamilyresidencezonesbautomobileservicestationsandcautomobilemechanicalrepairgaragesuponthesamesitetherewitharepermittedtogetherwithparkingofvehiclesandstoragewhollywithinbuildingsorundergroundofmaterialsincidentaltoserviceandrepairNobuildingorstructureshallbeerectednorshallanyexistingbuildingorstructurebemovedalteredaddedtoorenlargednorshallanylandbuildingstructureorpremisesbeusedforanypurposeotherthantheaboveonlanddesignatedNeighborhoodAutoServicingNANobuildingorstructureshallbeerectedconstructedormovedontolandzonedNAexceptinconformitywithregulationsapplicabletheretonorshallanyexistingbuildingorstructurebeenlargedalteredrepairedmovedorconvertedwiththeeffectofencroachinguponorreducingtheopenspacessurroundingsuchbuildingorstructureinviolationofthesetbackorheightregulationsorregulationsrelatingtothepercentageofareaoccupiedoranyotherlanduseregulationsapplicabletheretosection3RequlationofNALandseNAlanduseshallbelimitedtoareassozonedandgovernedasfollowsLotareaandwidthminima16500squarefeetand135feetrespectivelyBuildinsetbackminima30feetfrontandrearwith15feetsideyardsexceptwherethesiteabutsonanRzoneoradjacenttoanystreetthennotlessthan30feetCBuildinqhelqhtAmaximumOf30feet OffstreetparkinqDefinedas250squarefeetperspacedrainedandsurfacedwithasphalticorportlandcementconcreteSpacesshallbeprovidedasfollowsOneforeachemployeeondutyatanytimeAnadditionaluncoveredspaceforeach1000feetOfbuildingfloorareasix6additionalspacesforaUtoobilestoragewhichmaybecoveredoruncoveredAnaddedspaceforloadingforeachseparatebuildingSuchspacesshallbemarkedandsoarrangedasnottOimpedeaccesstothesiteEScreeninqandlandscapingrequirementsEithera6foothighfenceora4footminimumhedgewhereverRzonedpropertyabutsinformapprovedbythebuildinginspectoroftheCityaseffectivelysightobscuringandharmoniouswithrelatedimprovementsandtopographyandPlantingsalongatleastthirtypercent30OfpropertylinesabuttingpublicstreetsmaintainedatheightsbelowthewindowsofcontemporaryautomobilesAccessrestrictedtomarkeddrivewaysonedrivewaynotexceeding35feetinwidthtobeallowedforeach60feetofstreetfrontagethelocationofwhichissubjecttoapprovaloftheCityEngineerasappropriatetosafeandefficienttrafficmovementAnyplantingshereundershallbemaintainedinahealthystateandtopresentanattractiveaspecttothestreetandneighborhoodpropertiesFOutdoorsiqnsandsgnstructuresMovingsignsandsignstructuresanimatedsignswhirligigspennantsflashinglightsandflagsotherthantwo2governmentflagsareprohibited2onlyonesignidentifyingeachbuildingshallbepermitted3Sizelocationanilluminationarelimitedasfollowsabnomorethan36squareinchesofsignareaforeachlinealfootmeasuredalongthefrontpropertylinesetbackfromthepropertylineasrequiredOfbuildingscnotexceeding25feetinheightanddilluminatedonlybyasteadylightsourceofonecolorandduringhourswhenserviceisofferedanyilluminationincludingthatofbuildingstobesuchastopresentnoglaringlightsourcetopassingvehiculartrafficorneighboringpropertyzonedforresidentialuse Aphotographofanysuchsignshallbefiledtogetherwithadescriptionofanyartificialilluminationwithin10daysofitserectionOneportablesignnotexceeding4feetinheightfromthegroundand3feetinwidthshallbepermittedforeachstreetfrontedAutomobilestoraqeshallbelimitedasfollowsNomorecarsshallbeparkedonthepropertythancanbeaccommodatedundercoverorinmarkedoffstreetparkingorloadingspacesNovehicleshallbeparkedexposedinapartlydisasseaDledorsignificantlydamagedconditionnorformorethan30daysunlessinterruptedbyatleast10NOvehicleortrailershallbeparkeddisplayedforsalerentorforaprizeHOperationanddisplavsAlloperationanddisplaysincludingthoseofmerchandiseshallbewithinanapprovedstructureexceptthosedirectlyrequiredtodispensegasolinewaterairandmotoroilNoaccumulationoftiresorotherautomotivematerialsoutsideapprovedstructuresshallbepermittedTradeinducingprizesshallbedeemedmerchandisesection4PenaltiesViolationofanyoftheprovisionsofthisordinanceshallbeamisdeamnorandanypersonfoundguiltythereofshallbepunishedbyafineofnottoexceedThreeHundredDollars30000orbyimprisonmentfornottoexceedninety90daysorbothEachdaybywhichsuchaviolationshallcontinueafternoticethereoftoanyviolatorfromtheBuildingSuperintendentoftheCityorotherpersonoragencytowhomhisauthoritymaybedelegateduntilsucherectionmovingalterationrepairconversionoraddingtoorenlargingofabuildingorstructureorprohibiteduseormannerofuseisdiscontinuedandanapplicationforbuildingpermitifrequiredfiledshallconstituteaseparateoffenseSection5CodereferenceSections23and4hereofshallconstitutesections55045508and5512inanewchapteroftheMedinaCodenumbered55andentitledNeighborhoodAutoServiceFacilitiesandallothersectionshereofshallbeconsideredoftemporaryorspecialeffectSection6EffectivedateThisordinanceshalltakeeffectMay161966PASSEDBYTHECITYCOUNCILonthe9thdayofMay1966andsignedinauthenticationofitspassagethesamedateApprovedastoformSTEPHENFCHADWICKJRCityAttorneyATTESTBERNICESOWDENCityClerkMyOR
