CITYOFMEDINAORDINANCEN0ANORDINANCEpermittingproportionatesetbabkswhereundersizedlotsarepermittedbecauseofpriorseparateownershipordevelopmentTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSsetbackrionhesizeofthebuildingsitewherebecauseOftheapplicabilityofanexceptiontotheminimumlotsizerequirementssmallerbuildingsitesarepermittedduetoseparateownershiporpriordevelopmentintheblockorannexedneighborhoodprecedingtheapplicabilityoftheCitysminimumrequirementsThisordinanceisadoptedafterareportoftheCityPlanningCommissiononthesubjectandapublichearingthereonheldpursuanttoduepublishednotxcebeforetheCityCounciluponthe8thdayofMay1967Section2ProportionedSetbacksforLotsQualifyingUndervariousMinimumLotsizeDensityExceptionsWherebyvirtueofseparateownershiporpriordevelopmentasinthiscodeprovidedlandmaybeimprovedwithlessthantheotherwiserequiredminimumlotsizerequirementsinordertoencourageappropriatedevelopmentbuildingsOrstructuresneedbesetbackfromthefrontbackandsidelinesaportionofthedistanceotherwiserequiredbearingtothelatterthesameproportionaterelationshipasthepermittedbuildingsitebearsto20000squarefeetPROVIDEDthatsuchsetbacksshallinnoeventbelessthanthegreaterof120feetastofront15feetastorearor5feetastosidelinesunlessappropriatelyvariedbytheBoardofAdjustmentor2ApplicablerestrictionsasimposedbyplatSection3codeReferenceSection2hereofshallconstituteSection51154oftheMedinaCodeandallothersectionshereofshallbeconsideredoften3raryOrspecialeffectSection4EffectiveDateThisordinanceshalltakeeffectuponthe15tbdayOfMay1967PASSEDbytheCityCouncilOnthe8thdayofMay1967andsignedinauthenticationofsuchpassagethMAYORApprovedastoformCityAttorneyATTESTEerniceSowdecityClerk
