CITYOFMEDINAORDINANCENOANORDCEprovidingforplannedlandusedevelopmentwithvariationofotherwiseapplicablezoningrequirementsuponspecialundertakingsoftheownerTHECITYCOUNCILOFTIlECITYOFEDINADOORDAINASFOLLOWSSection1PurposeTheFUrposeftheprovisionsOfthischapteristopermitdevel6pmentoflandaccordingtosubmittedplanswithvariationofotherwiseapplicablezoningreguirementswheresuchdevelopmentwillfurtherthegeneralobjectivesoftheCityscomprehensivelanduseplanandthespecialundertakingsofthedeveloperincertainrespectsexceedtheminimumrequirementsofsuchzoninglawsTheordinanceisadoptedafterfavorablereportofthePlanningCommissionandapublichearinguponsuchreportandrecommendationbeforetheCityCouncilatitsregularmeetingMarch131967Section2VariationofzoningreguirementsauthorizedforplannedlandusedevelopmentsNotwithstandingtheotherrequirementsoftheMedinaZoningCodetheregulationsOfsuchcodemaybevariedtopermitthedevelopmentofcertainparcelsoflandaccordingtodistinctplansthereforpreviouslysubmittedandapprovedundertheproceduresofthisordinanceandanyordinancesamendatorytheretoofanapplicationpursuanttoMedinaisnotauthorizedundertherequirementsofthatsectiontheBoardOfAdjustmentmayifitfindsthatarequestedactiontogetherwithotherplansoftheownerwillfurthertheobjectivesofthecomprehensiveplanincludingthezoningcoderefertheproposaltothePlanningCommissionforfurtheractionashereinafterstatedIndoingsotheboardshalltransmititswrittenfindingsandrulingontheapplicationtothePlanningCommissionandsuchfindingsshallbesufficientlydetailedtoshowthebasisoftheboardsconclusionthattheproposalwouldresultinadevelopmentmoreconsistentwiththegeneralobjectivesOftheCityscomprehensiveplanthancouldbehadfromstrictcompliancetherewithSection4PlanninqCommissionfurtherinformationandhearingThePlanningCommissionmayrequiretheapplicahttosubmitadditionalinformationinsupportofhisapplicationincludingbutnotlimitedtodetailedplansandspecificationswhichshallbesufficientlyschematicandgraphicastoclearlydescribetheprojectIfthePlanningCommissionthendeterminesthattheproposalmeritsfullconsiderationitshallcausenoticetobegiventoadjoininglandownersandapublichearingtobeheldthereonAtsuchhearingandinitsstudyoftheproposalthePlanningCommissionshallconsiderthecomprehensiveplanf2eCitysdevelopmentasawholetheextenttowhichrequirementsnotsoughttobevariedaveexceededtheaveraeeffectoftheproposalcomaredtothestandadsofthecomprehensiveplanotherundertakingswichsubservethepurposesoftheplanbutarenotrequiredbyitandanyotherconsiderationofCitylanduseplanningbywhichutilityandappearanceoftheproposalmaybejudgedUpontheconclusionofsuchhearingandstudythePlanningConunissionshallmakewrittenfindingsoffactandconclusionscopiesofwhichshallbetransmittedtotheBoardAdjustmentandtheCityCouncilSection5SpocialconditionsInmakingitsfindingsandconclusionsinrespecttoaproposalforplannedlandusedevelopmentthePlanningCommissionmayimposespecialconditionsandrestrictionstoinsurecompletionofdevelopmentinaformacceptabletotheCityandwithinareasonabletimeSuchspecialconditionsmayincludebutshallnotbelimitedtoatimelimitfortheeffectivenessofany permitabondorbondsaprescribedorderofdevelopmentwhereseveralimprovementsareinvolvedandstrictcompliancewithapprovedplansSection6CouncildisaproyalIfthePlanningCommissionhasapprovedaplannedlandusedevelopmentproposalandtransmittedfindingsandconclusionstotheeffectitspermissionshallbesubjecttocontraryactionbytheCityCouncilatorbeforeitssecondregularmeetingfollowingreceiptthereofInoucentrationbetakenthepermissionofthecommissionshallthereuponba0meeffectiveuponthetermsexpressedthereinSection7CodereferenceSections1through6hereofshallconstiuteSections55045508etcthrough5524andallothersectionshereofshallbeconsideredoftemporaryorspecialeffectSection8EffectivedateThisordinanceshallbecomeeffectiveuponthedayof1967PASSEDbytheCityCouncilonthedayof1967andsignedinauthentieationofitspassagethesamedayLYORApprovedastoform9
