ORDINANCENO28ANORDINANCEoftheCityofMedinaWashingtonprovidingfortheimprovementofacertainareawithinthecitybytheconstructionandinstallationofstreetimprovementsandbydoingallworknecessaryinconnectiontherewithandincidentaltheretoallpursuanttoResolutionNo76OfthecitycreatingalocalimprovementdistrictthereforprovidingthatpaymentofthecostofsaidimprovementsbemadebyspecialassessmentsonthepropertyinsaiddistrictpayablebythemodeofpaymentbybondsandcreatingLocalImprovementDistrictNo2FundWHEREASonMay81967theCounciloftheCityOfMedinaWashingtonadopteditsResolutionNo76declaringitsintentiontoordertheiTrovementofacertainareawithinthecitybytheconstructionandinstallationofstreetimprovementsandbydoingallworknecessaryinconnectiontherewithandincidentaltheretowhichresolutionfixedthetimeanddateofhearingthereonat800oclockpmonthe12thdayofJune1967attheCityHallinMedinaWashingtonAndWMREASsuchresolutionwasdulypublishedinthemannerprovidedbylawandnoticeofsuchhearingwasalsodulygiventotheownersorreputedownersofalllotstractsandparcelsoflandorotherpropertytobespeciallybenefitedbytheproposedimprovementsasrequiredbylowandEREASsaidhearingwasheldonsaiddateandatsaidtimeandplaceasprovidedinaidresolutionandnoticeandafteradiscussionofsaidimprovementsandafterhearingallprotestsandconsideringthesametheCoancildeterminedtoOrdertheconstructionandinstallationoftheimprovemantsheroinaftermoreparticularlydescribedandtocreatealocalimprovementdistrictthereforandtheCoancilhavingauthorizedbondcounselforthecitytodrawthenecessaryordinancecreatingthelocalimprovementdistrictandorderiugtheconstructionandinstallationofsuchimprovementsNOWTHEREFORETheCityCouncilOftheCityofMedinaWashingtonDOORDANasfollowsSection1ThatNE26thStreetbetween79thand80thAvenuesNWand79thAvenueNEbetweenNE24thand28thStreetsshallbeimprovedbygrading Thecityshallcontribute25percentoftheentirecostandexpenseofsaidimprovementsandappurtenancesincludingalnecessaryexpensesincldentaltheretoThebatanceofsuchcostandexpenseshalbebornebyandassessedagainstthepropertyincludedinthelocalimprovementdistrictheretoforecreatedThenatureoftheimprovementissuchthatthespecificbenefitsconferredonthepropertywillnotbefairlyreflectedbytheuseofthezoneandtermlntmethodIthereforeassessmentshahbemadeagainstthepropertyofthedistricttnaccordancewiththespecialbenefitsitwillderivefromtheimprovementwithoutregardtothezoneandtarmintmethodSection9Bondsofsaidlocalimprovementdistrictbearinginterestatarateofnottoexceed6percentperannumandpayableonorbeforeadatenotexceedingtwelve12yearsfromandafterthedateofissueshallbeissuedinpaymentofthecostandexpensesoftheimprovementsprovidedhereinwhichbondsshallberedeemablebythecollectionofspecialassessmentstobeleviedandassesseduponthepropertywithinthedistrictasaboveprovidedsuchassessmentstobepayableinten10equalinstallmentswithinterestatarateofnottoexceed6percentperannumunderthemodeofpaymentofbondsasdefinedbythestatutesoftheStateofWashingtonandordinancesoftheCityofMedinaAnyassessmentsorinstallmentsthereofwhendelinquentandtheinterestduethereonshallbearapenaltyof6percentofthetotalamountthereoffromthedateofsuchdelinquencySection4ThereisherebycreatedafundofthecitytobeknownasLocalImprovementDistrictNo2FundIintowhichFundthereshallbepaidalloftheassessmentscollectedinsaiddistrictasandwhendirectedbytheordinanceconfirmingsaidassessmentsandtheassessmentrollthereforSaidFundshallbeusedsolelyforthepurposeofpaymentofbondsandorwarrantstobeissuedinpaymentofthecostandexpenseofsaidimprovementsashereinprovidedInterlmwarrantsbearinginterestatarateofnottoexceed6percentperannummaybedrawnonsaidFundbaseduponestimatedofthecttys3 engineersandsoldbythecitytoprovidefundsforthepaymentofthecostofconstructionandinstallationofsaidimprovementsandcostsincidentaltheretoasthesameshallbeincurredThemoneyreceivedfromthesaleofsaidwarrantsshallbeplacedintheLocalImprovementDistrictNO2ConstructionFundofthecitywhichisherebycreatedandwhichshallbeusedtopayallofsaidcostsPASSEDbytheCounciloftheCityofMedinaWashingtonandapprovedbyitsMayorataregularmeetingheldthe10thdayofJulyw1967CITYOFMEDIAWASHINGTONMayorATTESTCCityIerkAPPROVEDASTOFORMCityAttorneyIBERNICESOWDENthedulyelectedqualifiedandactingCityClerkoftheCityofMedinaWashingtonDOHEFaBYCERTIFYthattheforegoingisatrueandcorrectcopyofOrdinanceofsaidcitydulypassedbyitsCouncilandapprovedbyitsMayorataregularmeetingofsaidCouncilheldonthe12thdayofJune1967andregularlycontinuedbyadjournmenttoJune261967
