0228CITYOFMEDINAORDINANCENOQANORDINANCErelatingtotheoperationofwatercraftonLakeWashingtonwithinthejurisdictionoftheCityofMedinaandprescribingpenaltiesTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINFOLLOWSSection1PuroseThepurposeofthisOrdinanceistosecurethesafetrsonsandpropertywithinthejurisdictionoftheCityincludingthattothecenterofLakeWashingtonandMeydenbauerandFairweatherBaysoppositetheCitySection2NegligentOerationProhibitedAnypersonwhoshalloperateanywatercraftinamannersoastoendangerorbelikelytoendangeranypersonorpropertyoratarateofspeedgreaterthanwillpermithimintheexerciseOfreasonablecaretobringthewatercrafttoastopwithintheassureddistanceaheadshallbeguiltyofnegligentoperationandviolationofthisOrdinancesection3RecklessOperationProhibitedAnypersonwhoshalloperateanywatercraftorvesselinarecklessmannersoastoendangerthelifeorlimbordamagethepropertyofanypersonshallbeguiltyofthecrimeofrecklessoperationandaviolationofthisOrdinanceSection4SpeedLimitSpeedsinaccessof7nauticalmilesperhourwithin200feetofanyshorelinepierrestrictedareaorshoreinstallationorwithin100feetofanywatercraftdiversflagorswimmersorwithinthatpartofFairweatherBaywithinthejurisdictionoftheCityofMedlnaareprohibitedprovidedhoweverthatwheregreaterspeedisnecessarytotowwaterskiersagreaterspeedmaybeusedforthelimitedpurposeoftowingthewaterskierdirectlyfromthepointofpickuporthepointofdroptoorfromareastowhichthisspeedlimitdoesnotapplySection5InterferencewithNavigationNopersonshalloperateanywatercraftorvesselinamannerwhichshallunreasonablyorunnecessarilyinterferewithothercraftorvesselsorwiththefreeandpropernavigationofthewaterwaysoftheCityAnchoringOrmooringunderbridgesorinheavilytravelledchannlsshallconstitutesuchinterferenceifunreasonableundertheprevailingcircumstancesSection6ObstructionsandtheMovingofSameaNOmasterorpersonhavingchargeofanyvesselwatercraftorobstructionshallmoororanchorthesameinawaytounreonablyhinderuseofnavigablewatersbyothersormakethesamefasttoanybuoypierorotherstructureownedbyorundertheauthorityandcontroloftheCitywithoutobtainingpermissionthereforfromtheChiefofPoliceorhisdelegatebNomasterownerorotherpersoninchargeofanytowboatshallwhiletowinganyvesselwatercraftorobstructicnunreasonablyobstructnavigablewaterscTheChiefofPoieorotherofficoftheCitytowhomhisauthorityisdelegatedshallhavethepowertoordersuchhindrance obstructionorillegallymadefastvesselremovedanditshallbeunlawfultofailneglectorrefusetopromptlydosoSection7SunkenGroundedorDerelictVesselsWhenanyvesselorwatercraftorobstructionhasbeensunkorgroundedorhasbeenelayednsuchmannerastostoporseriouslyinterferewithorendangernavigationtheChiefofPoliceorhisdelegatemayorderthesaeil2ediatelyremovedandiftheownerorotherpersoninchargethereofafterbeingsoordereddoesnotproceediediatelywithsuchremovaltheCitymaytakeinuediatepossessionthereofandremovethesameusingSuchmethodsasinitsjudgmentwillprev6ntunnecessarydamagetosuchvesselorwatercraftorobstructionandtheexpenseincurredbytheCityinsuchremovalshallbepaidbysuchvesselorwatercraftorobstructionortheownerorothrpersoninchargethereofandincaseoffailuretoDaytheametheCitymaymaintainanactionfortherecoverythereofandreasonableattorneysfeesSection8wAoatingCFDjectsAllvesselswatercraftlogspilingbuildingaaterialscoshouseboatsoranyotherarticleofvaluefoundamriftinthatportionofLakeWashingtonsubjecttotheCitysjurisdictionmaybetakeninchargebytheCityandshallbesubjecttorelamationbytheOwnerthereofonpaymentbyhimtotheCityofanyexpensesincurredbytheCityandincaseoffituretoreclaimmaybesoldordisposedofaccordingtolawSection9IntoxicationaitshallbeunlawfulforanypersonhoisundertheinfluenceoforaffectedbintoxicatingliquorornarcoticdrugstooperateorbeinactualphysicalcontrolofanyvesselorwatercraftonavigableuatersbItshallbeunlafulfortheownerofanyvesselorwatercraftoranpersonhavingsuchinchargeorincontroltoauthorizeorknowinglypermitthesametobeoperatedbyanypersonwhoisundertheinfluenceoforaffectedbyintoxicatingliquororna32coticdrugscjheneveritappearsreasonablycertaintoanypoliceorharboroftleerthatanypersonundertheinfluenceoforaffectedbytheuseofintoxicatingliquororofanynarcoticdrugisabouttooperateawatercraftorvesselinviolationofsubdivisionaofthissectionsaidOfficermaytakereasonablemeasurestopreventanysuchpersonfromsodoingeitherbytakingfrDmhimthekeysofsuchwatercraftorvesselandlockingthesameorbysomeotherappropriatemeansInanysuchcasesaidofficershlliaediatelyreportthefactstot3ChiefofPoliceandshallassoonaspossibledepositsaidkeysorotherarticlesifanytakenfromsaidwatercraftorvesselorpersonwiththeChicofPoliceSuchkeysorOtherarticlesmaybereturnedtoanypersonuponhisdemandandproperidentificationofhimselfwhenitappearsthatheisnolongerundertheinfluenceofintoxicatingliquorornarcoticdrugSectionj0IncapacityofOperatorItshallbeunlawfulfortheownerofayvesselorwatercraftoranypersonhavingsuchinchargeorincontroltoauthorizeorknowinglypermitthesametobeoperatedbyanypersonwhobyreasonofphysicalormentaldisabilityisunabletooperatethesameinaprudentandeffectivemannerSectionAccidentsTheoperatorofanywatercraftinvolvedinanaccidentresultingininjurycrdeathtoanypersonorindamagetopropertyshallinkedlatelystopsuchwatercraftatthesceneofsuchaccidentandshallgivehisnameaddressthenareandornlberofhiswatercraftandthenameandaddressoftheojnertothepersonstruckortheoperatororoccupantsofthevesselorwatercraftcollidedwithorpropertydamagedandshallrendertoanypersoninjuredinsuchanaccidentreasonebleassistance Section12AccidentReportAllaccidentsarisingoutoftheoperationofwatercraftandinvolvingpropertydamageinexcessof10000orinjuriestopersonsmustbereportedtothePoliceDepartmentbycompletionofformsprovidedbytheDepartmentforthatpurposeassoonaspracticablebutinanyeventnolaterthantwentyfourhoursaftersuchaccidentSuchreportshallnotbeadmissibleinevidenceandshallbefortheconfidentialuseoftheChiefofPoliceandCityAttorneySection13OverloadingorExcessivePoweraNOwatercraftshallbeloadedwithpassengersorcargobeyonditssafecarryingcapacitynorcarrypassengersinanunsafemannertakingintoconsiderationweatherandotherexistingOperatingconditionsbNowatercraftshallbeequippedwithanymotororOtherpropulsionmachinerybeyonditssafepowercapacitytakingintoconsiderationthetypeandconstructionofsuchwatercraftandotherexistingoperatingconditionscWheneveritappearsreasonablycertaintoanypoliceorharborofficerthatanypersonisoperatingawatercraftorvesseleitheroverloadedorwithamotororpropulsionmachinerywhichisbeyondsafepowercapacitysaidofficermaytakereasonablemeasurestopreventanysuchpersonfromsooperatingthecrafteitherbyaklngfromhimthekeysofsuchcraftandlockingthesameorbyotherappropriatemeansInanysuchcasesaidOfficershallimmediatelyreportthefactstokheChiefofPoliceandshallassoonaspossibledepositsaidkeysorotherarticlesifanytakenfromsaidwatercraftorvesselorpersonwiththeChiefSuchkeysorotherarticlesmaybereturnedtoanypersonuponhisdemandandproperidentificationofhimselfwhenitappearsthatheistheownerofthewatercraftandtheconditionsunderwhichtheofficertookpreventivemeasuresnolongerexistSection14RestrictedAreasIntheinterestofsafenavigationlifesafetyandtheprotectionofpropertytheChiefofPoliceshalldesignaterestrictedareasandthepurposeforwhichsameshallbeusedNopersonshalloperateavesselorwatercraftwithinarestrictedareaPROVIDEDthatthissectionshallnotapplytovesselsorwatercraftengagedinoraccompanyingtheactivitytowhichtheareaisrestrictednortopatrolorrescuecraftinthedischargeofofficialdutySection15SwimmingSwimminginOpenwaershallbeconfinedtoarestrictedswimmingareasorbtowithinadistanceofonehundredfeetfromtheshoreorapierunlesstheswimmerisaccompaniedbyawatercraftSection16SkinDivingSkindivingisprohibitedawithin300feetofanypublicdockorboatramporpatrolledpublicbeachdesignatedasaswimmingareaexceptpursuanttopermitthereforissuedbythePoliceDepartmentandexceptforcommercialdivingorbinanyotherareaunlessthedivershallbeaccompaniedbyawatercraftortheareainwhichheisdivingshallbemarkedbyanadequatelydisplayeddiversflag Section17WaterSkiingNopersonshalloperateanywatercrafttowingorotherwiseassistingapersononwaterskisaquaplanesurfboardorsimilarcontrivanceaWherevisibilityissignificantlylimitedbyreasonofdarknessorotherwisebUnlesssuchwatercraftshallbeoccupiedbyatleasttwocompetentpersonsorcIneitheranegligentorrecklessmannerhavingregardtotheparticulardangersanddifficultieswhichaccompanysuchactivityNopersonshallwaterskiundersuchcircumstancesorinsuchwaynorinunreasonablycloseproximitytothepersonsorpropertyofothersSection18MufflersItshallbeunlawfultouseoroperateanyengineinoronwaterswithinthejurisdictioncftheCityofMedinaunlesssaidengineisoperatedwithandconnectedtoamufflerOrsilencerofsufficientsizeandcapacityeffectuallytomuffleandpreventexcessiveandOrunusualnoisefromtheexhaustofsaidengineSection19WhistlesandLightsItshallbeunlawfulforthemasterowneroranyotherpersoninchargeofanywateroraftorvesselwhilelyingatanypierorwhilenavigatinginLedinawatersunnecessarilytocauseanywhistleorsirentobeblowncrsoundednorshallanypersonflashtheraysofasearchlightorotherblindinglightontothebridgeorintothepilothouseofanyvesselorwatercraftunderwayforanypurposeotherthanthoseauthorizedbylawSection20EquipmentNumberingandLightsAllwatercraftshallcarrytheequipmentrequiredbyapplicablelawsoftheStateorUnitedStatesincludingwithoutlimitationadequateandapprovedlifepreserversandshallbenumberedordesignatedinaccordancewithFederalandStatelawsanwhenoperatingbetweenthehourscfsunsetandsunriseshallbeequippedwithanhavelittherunninglightsrequiredtherebySection21AircraftAircraftonornearthewatershallkeepclearofallvesselsandwatercraftandavoiimpedingtheirmavigationSection22RulescftheRoadExceptashereinotherwisespecifiedvesselsorwatercraftshallbesubjecttotheRulestoPreventCollisionsofVesselsandPilotRulesforCertainInlandWatersoftheAtlanticandPacificCoastsandoftheCoastoftheGulfofMexicoCF236479promulgatedbytheUnitedStatesCoastGuardpursuanttoActofCongressassuchrulesarenowormayhereafterfromtimetotimebeadoptedSection23PropellersNcmasterownerorotherpersoninchargeofanyvesselcrwatercraftshallwhilethesameislyinginanysliporatanypiereithercauseorallowthepropellerorwheelofsuchvesselorwatercrafttobeworkedinsuchamannerastoendangeranyothervesselwatercraftcrstructureorswimmerordiverSection24DriftItshallbeunlawfulfortheowneragentorlesseeinchargeofanyboatbargefloatorpiertoallowthewholeoranypartthereoftoremainadriftintheavigablewatersortcdriftawaySuchdriftandanybrokendecayeorloosefenderpilingshallberemovedbysuchowneragentorlesseeanduponfailuresotodothesamemayberemovedbytheCityandtheexpensetherefshallbepaidbyandrecoverablefromtheowneragentorlesseecfsuchpierSuchexpenseshallbedeemedtoincludereasonableattorneysfeesifsuitbenecessarytoreeverthesame Section25OilNcownermasteroretherpersoninchargeofanyvesselorwatercraftandnoengineercrotherpersoninchargeofanyengineroomormachineryofanyvesselcrwatercraftandncengineerorotherpersoninchargeofanyengineroomormachinerycfanyvesselorwatercraftandnoownerlesseeagentemployeecrotherpersoninchargeoforemployedinoraboutanypierorotherstructuredandnopersonalongorupontheshoreofsuchlwasehallspillthrowpumporotherWisecauseoilofanydescrlpiontobeorfloatuponanystreampondorlakeAnyperscncausingoiltcbeuponthewatersasaforesaidshallremovethesameanduponhisfailuresctcdothesamemayberemovedbytheCityandtheexpensethereofincludingreasonableattorneysfeesifsuitbenecessaryshallbepaidbyandrecoverablefromthepersoncausingsaidoiltobeuponthewaterThepaymentofsuchsumorthemaintenancecfanactionthereforshallnotbedeemedtcexemptsuchpersonfromprosecutionforcausingsuchoilspillageSection26NuisancesSunkenvesselscrwatercraftrefuseofallkindsstructuresorpiecesofanystructuredocksweepingsdeadfishorpartsthereofdeadanimalsorpartsthereoftimberlogspilesboomstickslumberboxesemptycontainersandoilofanykindfloatinguncontrolledcnthewaterendallothersubstancescrarticlesofasimilarnatureareherebydeclaredtcbepublicnuisancesanditshallbeunalwfulforanypersontothroworplaceincrcauseorpermittcbethrownorplacedanyoftheabovenamedarticlescrsubstancesinLakeWashingtonorupontheshoresthereoforinsuchpositionthatthesamemayorcanbewashedintosaidLakeeitherbystormsfloodsorotherwiseAnypersoncausingcrpermittingsaidnuisancestcbeplacedasaforesaidshallremovethesameanduponhisfailuresotodethesamemayberemovedbytheChiefofPoliceandtheexpensethereofincludingreasonableattorneysfeesifsuitbenecessaryshallbepaidbyandrecoverablefromthepersoncreatingsaidnuisanceInallcasessuchnuisancesmabeabetedinthemannerprovideabylawTheabatementofanysuchpublicnuisancesshallnotexcusethepersonresponsiblethereforfromprosecutionhereunderSection27UseefFloatsorPiersCityfloatsorpiersmaybeusedbywatercraftfordockagepurposesotherthanthehandlingoffreightfreeofchargebutwatercraftshallnotliethereinexcessof30minutesatatimeor45minutesinany24hourperiodAftersuchtimetheuseofsuchfacilitiesbyawatercraftshallbeonlywiththewrittenpermissioncftheChiefofPoliceSection28ObstructinVTrafficThedeterminationoftheChiefofPoliceshallbelnalandconclusiveastoallquestionsrelatingtothepositionofanyvesselorwatercraftatanypierorotherstructurebelongingtotheCityandallpersonshandlingcrinchargeofvesselsorwatercraftshallhandlethesameexpeditiouslyandwithoutinterferencewithorblockinggeneraltrafficandwithoutinterferingwithcommerceandnavigationSection29HealthRegulationsAllwatercraftandvesselsinthewatersohainashallcomplywiththeapplicablepublichealthlawsandregulationscftheUnitedStatestheStateofWashingtonanditspoliticalsubdivisionsSection30EnforcementTheChiefofPoliceandanyofhisauthorizeddeputiesremployeesandauthorizedpersonnelofthegovernmentsoftheUnitedStatestheStateofWashingtonoritspcliticalsubdivisicnsbyvirtuecftheirelectionorappointmentshallhaveauthoritytoenteruponandinspectanyvesselinthewatersofedinaandareherebychargedwiththeenforcementoftheprovisionsofthiscrdinanceexceptastheenforcementthereofishereinotherwisespecifiedItshallbethedutyoftheChiefofPolicetomakecomplaintsforany violationofthesamecranyparthereofinthenameoftheCityProvidedThatthisprovisionshallnotoperatetcprecludethemakingofsuchcomplaintbyanyotherpersonlegallyauthorizedsotodoSecticn31ReleasecnNoticetoAppearWheneveranypersonisarrestedforanyviolaticnofthsOrdinancethearrestingofficermayserveuponhimacitationandnoticetoappearincourtThearrestedpersoninordertosecurereleaseandwhenpermittedbythearrestingofficerfmustgivehiswrittentationandnoticebysigningintheappropriateplaceiencitationandnoticeservedbytharrestingofficerUponthearrestedpersonsfailingorrefusingtcsignsuchwrittenpromisehemaybetakenintothecustodycfsucharrestingofficerandscremainorbeplacedinconfinementSection32ExemptiontoAuthorizeEmergencyVesselsandWatercraftTheprovisionsofthisOrdinanceshallbeapplicabletotheoperationcfanyandallwatercraftbyallpersonsexceptoperatorsofauthorizedemergencyequipmentactuallyrespondingtoanemergencycallorinimmediatepursuitcfanactualorsuspectedviolatorOfthelaandexercisingduecaretotheextentpermittedbyandappropriatetothecircumstancesforthesafetyofpersonsandpropertySection33AidingandettingViolationsItisunlawfultocounselaidcrabettheviolationelorfailuretocomplywithanyoftheprovisionsofthisordinanceSection34DirectioncfTrafficTheCityspoliceofficersandfiremenintheeventoffirenearbyareherebyauthorizedtodirectallwaterbornetrafficeitheripersonorbymeansofvisibleoraudiblesignalinconformancewiththeprovisionsofthisordinanceandassafetyandmovementcftrafficreasonablyrequiresNooperatorofanywatercraftshalldisobeysuchlawfuldirectionSection35PenaltiesAnyviolationofthisordinanceshallbepunishablebyafineofnottcexceed30000orbyimprisonmentnottoexceed90daysorbothsuchfineandimprisonmentSection36PreservationcfActionsThisordinanceshallnotaffectpendingacticonscrproceedingscivilcrcriminalordefensestheretobutthesamemaybeprosecutedordefendedwiththesameeffectasthoughthisordinancehadnetbeepassedorordinancesrepealedtherebySection37RepealOrdinanceNo95asamendedbyOrdinanceNo227isherebyrepealedorprovisihor1beheldinvalicrcfnoeffectsuchdecisionshallnotaffectthevalidityofanyothersectionorprovisionthereofSection39CodeReferenceSections1through35hereofshallconstituteSections8120281204etcthrough81270aswellas8116281164etcthrough811670cftheMedinaCodeandSection36shallbedeemedtheequivalentofSection811241AllotherporticnsshallbeconsideredcftemporaryandspecialeffectForpurposesoftheMedinaCodereferencetoordinancemaybechangedtochapterorthelikeasappropriate
