ORDINANCENOxmOrdinanceDefiningandProhibitingUnfairHousingPracticesinSalekandintheRentalandOfferingforRentandintheFinancingofHousingAccrmunodationsandDefiningOffensesandPrescribingPenaltiesforViolationsThereofTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1DefinitionsDefinitionsasusedinthisOrdinanceunlessadditionalmeaningclearlyappearsfromthecontextshallhavethemeaningssubscribed1HousingAccommodationsshallincludeanydwellingordwellingunitroomingunitroominghouselotorparceloflandintheCityofMedinawhichisusedintendedtobeusedorasimprovedwitharesidentialstructureforoneormorehumanbeings2Dwellingincludesanybuildingcontainingoneormoredwellingunits3DWellingUnitincludesasuiteofroomsforOccupancybyonefamilycontainingspaceforlivingsleepingandpreparationoffoodandcontainingtoiletandbathingfacilities4RoomingUnitincludesoneOrmoreroomswithinadwellingunitorroominghousecontainingspaceforlivingandsleeping5Personincludesoneormoreindividualspartnershipsorotherorganizationstradeorprofessionalassociationscorporationslegalrepresentativestrusteestrusteesinbankruptcyandreceivers6ownersincludepersonswhoownleasesubleaserentoperatemanagehavechargeofcontrolorhavetherightofownershippossessionmanagementchargeorcontrolofthehousingaccommodationontheirOwnbehalforonbehalfofanother7Occupantincludesanypersonwhohasestablishedresidenceorhastherighttooccupancyinahousingaccommodation8ProspectiveOccupantincludesanypersonwhoseekstopurchaseleasesubleaseorrentahousingaccommodation9RealEstateBrokerincludesanypersonwhoforafeeccemissionorothervaluableconsiderationlistsforsalesellspurchasesexchangesleasesorsubleasesrentsornegotiatesoroffersorattemptstonegotiatethesalepurchaseexchangeleasesubleaseOrrentalofahousingaccommodationofanotherorholdshimselfoutasengagedinthebusinessofsellingpurchasingexchanginglistingleasingsubleasingorrentingahousingaccommodationofanotherorcollectstherentalfortheuseofahousingaccommodationofanother10RealEstateAgentSalesmenorEmployeeincludesanypersonemployedbyorassociatedwitharealestatebrokertoperformorassistintheperformanceOfanyorallofthefunctionsofarealestatebroker1 11Lenderincludesanybankinsurancecompanysavingsorbuildingandloanassociationcredituniontrustcompanymortgagecompanyorotherpersonengagedwhollyorpsrtlyinthebusinessoflendingmoneyforthefinancingoracquisitionconstructionrepairormaintenanceofahousingaccommodation12ProspectiveBorrowerincludesanypersonwhoseekstoborrowmoneytofinancetheacquisitionconstructionrepairormaintenanceofahousingaccommodation13UnfairHousingPracticemeansanyactprohibitedbythisordinaace14PersonAggrievedmeansanypersonagainstwhomanyallegedunfairhousingpracticehasbeencommitted15RespondentmeansanypersonwhoisallegedtohavecommittedanunfairhousingpracticeeaintherentalandofferingforrentofhousingaccommodationsarecontrarytothepublicpeacehealthsafetyandgeneralwelfareandareherebyprohibitedbytheCityofMedinaintheexerciseofitspolicepowerSection3UnfairHousingPracticesForbidden1NOownerlesseesublesseeassigneerealestatebrokerrealestatesalesmanmanagingagentoforotherpersonhavingtherighttosellrentleasesubleaseassigntransferorotherwisedisposeofahousingaccommodationshallrefusetosellrentleasesubleaseassigntransferorotherwisedenytoorwithholdfromanypersonorgroupofpersonssuchhousingaccommodationsorotherwisedenytoorwithholdfromanypersonorgroupofpersonssuchhousingaccommodationsorsegregatetheusethereoforrepresentthatsuchhousingaccommodationsarenotavailableforinspectionwheninfacttheyaresoavailableorexpelorevictanoccupantfromahousingaccommodationbecauseoftheracecolorreligionancestryornationaloriginofsuchpersonOrpersonsOra4criminateagainstorsegregateanypersonbecauseofhisracecolorreligionancestryornationalorigininthetermsconditionsorprivilegesofthesalerentalleasesubleaseassignmenttransferorotherdispositionofanysuchhousingaccommodationsorinthefurnishingoffacilitiesorservicesinconnectiontherewith2ArealestatebrokeragentsalesmanoremployeeshallnotbecauseofracecolorreligiontancestryornationaloriginofanoccupantpurchaserprospectiveoccupantorprospectivepurchaseraRefuseorintentionallyfailtolistordiscriminateinlistingahousingaccomodationforsalerentleaseorsubleasebcRefuseorintentionallyfailtoshowtoaprospectiveoccupantthehousingaccommodationlistedforsalerentalleaseorsubleaseRefuseOrintentionallyfailtoacceptandortransmittoanowneranyreasonableoffertopurchaseleaserentorsubleaseahousingaccommodation2 dOtherwisediscriminateagainstanoccupantprospectiveoccupantpurchaserorprospectivepurchaserofahousingaccommodation3NOpersonbankbankingorganizationmortgagecompanyinsurancecompanyorotherfinancialinstitutionorlenderoranyagentoremployeethereoftowhomapplicationismadeforfinancialassistanceforthepurchaseleaseacquisitionconstructionrehabilitationrepairOrmaintenanceofanyhousingaccommodationshallaDiscriminateagainstanypersonorgroupofpersonsbecauseofracecolorreligionancestryornationaloriginofsuchpersonorgroupofpersonsoroftheprospectiveoccupantsortenantsofsuchrealpropertyinthegrantingwithholdingextendingmodifyingorrenewingorintheratestermsconditionsorprivilegesofanysuchfinancialassistanceorintheextensionofservicesinconnectiontherewithorbUseanyformofapplicationforsuchfinancialassistanceormakeanyrecordofinquiryinconnectionwithapplicationsforsuchfinancialassistancewhichexpressesdirectlyorindirectlyanylimitationspecificationordiscriminationonthegroundofracecolorreligionancestryornationaloriginSection4ExclusionsNothinginthisOrdinanceshall1ApplytotherentingsubrentingleasingorsubleasingOfsinglefamilydwellingswhereintheownerorpersonentitledtopossessionthereofnormallymaintainsorintendstomaintainhisresidencehomeorabode2BeinterpretedtoprohibitanypersonfrommakingachoicefromamongprospectivepurchasersortenantsofpropertyonthebasisoffactorsotherthanracecolorreligionancestryornationaloriginSection5EnforcementProcedures1AstatementallegingaviolationofthisordinancemaybemadebyanaggrievedpersonSuchstatementshallbeinwritingandsignedbythechargingpartyshallbefiledwiththeCityCouncilwithinninety90daysaftertheallegeddiscriminatoryactandshallcontainsuchparticularsastheCouncilbyregulationmayrequireTheCouncilshallpromptlyfurnishacopyofsuchstatementtothepartycharged2TheCouncilshallcausetobemadeaninvestigationOfallchargesfiledwithitproceedingineachcaseinsuchmannerasitdeemsappropriateIfaftersuchinquiryandhearingsastheCouncilconsiderspropertheCouncileerminesthatnoprobablecauseexiststobelievethatanunfairhousinpracticehasoccurredthechargeshallbedismissed3IftheCouncildeterminesaftersuchinvestigationthatprobableuseexiststobelievethatanunfairhousingpracticehasoccurreditshallendeavortoeliminateorremedysuchviolationbymeansofconciliationandpersuasion3 4IfuponalltheevidencetheCouncilfindsthattherespondenthasengagedinanyunfairpracticeitshallforwarditsfiletotheCityAttorneyforappropriateenforcementacticnincludingprosecutionforaviolationofthisordinance5TheCouncilintheperformanceofitsfunctionsmayenlisttheaidoftheCityManagerwhoisherebydirectedtorendersuchaid6TheCouncilmayadoptsuchrulesandregulationsasitshalldeemnecessarynotinconsistentwiththeprovisionsofthisordinanceSection6SeverabilityTheprovisionsofthisordinanceareseverableandifanyprovisionsentenceclausesectionorpartthereofisheldillegalinvalidorunconstitutionalorinapplicabletoanypersonorcircumstanceillegalityinvalidityunconstitutionalityorinapplicabilityshallnotaffectorimpairanyoftheremainingprovisionssentencesclausessectionsorpartsofthisordinanceortheirapplicationtootherpersonsorcircumstancesItisherebydeclaredtobetheintentoftheCitCouncilthatthisordinancewouldhavebeenadoptedifsuchillegalinvalidorunconstitutionalprovisionsentenceclausesectionorparthadnotbeenincludedthereinandifthepersonorcircumstancestowhichtheordinanceoranypartthereofisinapplicablehadbeenspecificallyexemptedtherefromsection7PenaltyUponconvictionofviolationofthisordinancetheguiltypartyorpartiesshallbesubjecttoafineofnotmorethan30000orimprisonmentfornotmorethanninety90daysorbothsuchfineandimprisonmentSection8CceReferenceSectionl1through7hereofshallconstituteSections1080210804etcthrough10814oftheMedinaCodeandallothersectionshereofshallbeconsideredoftemporaryorspecialeffectThetermChaptermaybesubstitutedforordinanceasappropriatetotheCodesuchChaptertobeentitledOpenHousing1968PASSEDbytheCouncilatitsreguladayof1968ATTESTMayorBernce7owdeneityClerkepenFChadwcCttoreytLAL
