CITYOFiEDINAORDINANCENO248ANORDINANCEprovidingforamunicipalcourtinandfortheityofMedinarepealingSection1ofOrdinanceNO128THECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1MunicipalcourtestablishedThereisherebyestablishedamunicipalcourtentitledTheMunicipalCourtoftheCityofiledinaasalsoestablishedbyresolutionundertheauthorityofRCW350060adoptedconcurrentlyherewithallasappropriatetoChapter350RCWprovidingfortheestablishmentOfmunicipalcourtsincitieswithapopulationoflessthan20000asistilecasewiththecityofMedinaSection2JurisdictionSuchmunicipalcourtshallhaveexclusiveoriginalcriminaljurisdictionOfallviolationsofcityordinancesdulyadoptedbythecityandshallhaveoriginaljurisdictionofallotheractionsbroughttoenforceorrecoverlicensepenaltiesorforfeituresdeclaredorgivenbysuchOrdinancesOrbystatestatutesSaidcourtisempoweredtoforfeitcashbailorbailbondsandissueexecutionthereontohearanddetermineallcausescivilorcriminalarisingundersuchordinancesandnotrequiringremedyinanothercourtandpronouncejudgmentinaccordancetherewithProvidedthatfortheviolationofacriminalordinancenogreaterpunishmentshallbeimposedthanafineof300orimprisonmentnottoexceed90daysorbothsuchfineandimprisonmentInalltrialsforoffensesinmunicipalcourtajurytrialshallbeallowedonlyinoffencesinvolvingtherevocationorsuspensionofadriverslicenseorothergrossmisdemeanorNochangeofvenueshallbetakenfromthemunicipalcourtandthedefendantshallnotbeentitledtofileanaffidavitofprejudiceagainstanyjudgeofthemunicipalurallasinRCW350280providedSection3AppointmentThemunicipalcourtofthecityofMedinashallbepresidedoverbyamunicipaljudgeandsuchjudgesprotemasmaybedeemednecessarytoactintheabsenceordisabilityoferegularjudgeTheyshallbeappointedbythemayorwiththeconcurrenceofaraajorityofthecitycouncilsuchjudgesshallbeattorneysdulyadmittedtopracticelawbeforethecourtsorecordoftheStateofWashingtonwhoshallhavepracticedlawinKingCountyThesalaryoftheregularmunicipaljudgeshallbepaidmonthlyaccordingtotheappropriationthereforinthecitysbudgetandsuchsalaryshallnotbewithheldexceptuponafailureofsaidjudgetodeterminemattersalreadypresentedtohimhisfailuretocontinuetoqualifytoholdtheofficeorhisfailuretodischargethedutiesofsuchofficeasinthisordinanceandthegenerallawsofthestateofWashingtonprovidedSuchregularjudgeshallonlyberemovedbythemayorwiththeapprovalOfamajorityOfthecouncilforsuchcauseasthemayordeemssufficientwhichshallbesetforthinalettertosuchjudgeProvidedthatshouldthejudgerequestapublichearingthereonthecouncilshallholdthesamepriortohisrenDvalSection4DocketThemunicipaljudgeshallkeepadocketuponwhichmustbeenteredallcasesarisingunderordinancesofthecityofMedinaandshallmakesuchchargesasfeesasareprescribedbythelawsofthestateofWashingtonrelatingtolikeproceedingsbeforejusticesofthepeacesaidfebshallbetaxedascostsinthecaseandallfeesshallbeturnedOvertothecitytreasurer Section5CourtmeetingWherecasesarereadytobeheardthecourtshallmeetatleastonceeachmonthatareasonableandregulartimetohearsuchcasesWherethenumberandqualityofcasesreadytobeheardinanymonthexceedsthenumberwhichmayreadilybeheardinathreehourcourtsessionthenthecourtshallholdasecondandseparatesessiontowhichcasesshallbeassignedallwithaviewofavoidingforwitnessesincludingpoliceandpartiesthenecessityinsofarastlesamemaybereadilyforseenofbeinginattendanceuponthecourtformorethanthreehoursbeforethematterinwhichtheyareinterestedcommencestobeheardIfdeterminedtobeinthepublicinterestasforthegreaterconvenienceofwitnessesincludingpoliceandpartiesatleastOnemeetingofthecourteachmonthshallbeaneveningmeetingSection6PracticePeadingspracticeandprocedurebeforetheEedinaMunicipalCourtshallbegovernedbythestatutesandgeneralla7ofthestateofWashingtonincludingTitle3oftheRevisedCodeofWashingtonandtheRulesofCourtparticularlytherulesforcourtsoflimitedjurisdictionwhereverappropriateSection7ViolationsbureauaccountsTheViolationsBureauofthcityofMedinaasheretoforestablishedbyOrdinanceNo2DshallremaininfullforceandeffectThemunicipaljudgeshallkeepproperaccountsofallfinescostsorothermoniesreceivedbyhimwhenactingbyorunderauthorityOfthecityandpaytothecityreasurermonthlyallsuchmoniesandtakeaduplicatereceiptthereforoneofwhichshallbefiledwithth3cityclerkSectionBondhemunicipaljudgebeforeenteringuponthedutiesofhisofficeshalltakeanoathofofficeandgiveabondtothecityinth3sumof500conditionedonthefaithfulperformanceofhisdutiesaccordingtolawSection9CityclerkordeputytoactasclerkofcourtTheCityClerkoftheCityofMedinashallbeexofficioclerkofthemunicipalcourtandpersonallyorbyhisauthorizeddeputyperformsuchservicesofaclericalnatureasarerequiredfromrimstotim3intheconductofthebusinessofthecourtSection10Section1Ordinance128repealedSection1ofOrdinance128beandthesameisherebyrepealedSection11CodereferenceSections1through9hereofshallconstituteSectiom1151through11509OftheMedinaCodeandallothersectionshereofshallbeconsideredofspecialortemporaryeffectSection12EffectivedateThisordinanceshalltakeeffectonDecember311969PASSEDbythecitycouncilonthe24thdayofDecember1969whichtimaregularcouncilmeetingOfDecember8thhadbeenadjournedandsignedinauthenticationofitspassageuponsuchcontinueddateApprovedastoform3TDeFrielJrMayorStephenFChadwickCityAttorneyBerniceSowdnCityClerk
