HomeMy WebLinkAboutOrdinance No. 0261CITYOFLEDINAocoAORDINANCErelatingtosignsinNAandSR30LandUseDistrictsspecifyingregulationsforsuchsignsinSR30DistrictsanddutiesOftheMedinaDesignCommissioninrespecttotheenforcementthereofprovidingpenaltiesTHECITYCOUNCILOFTHECITYOFIEDINADOORDAINASFOLLOWSSection1SR30outdoorsisandsignstructuresSignsinSR30landusezonesshallelimitedasfollows1Movingsignsandsignstructuresanimatedsignswhirligigspennantsflashinglightsandflagsotherthantwo2governmentflagsareprohibited2OnlyOnesignidentifyingeachbuildingshallbepermitted3Sizelocationandilluminationarelimitedasfollowsanomorethan36squareinchesofsignareaforeachlinealfootmeasuredalongthefrontpropertylinebsetbackfromthepropertylineasrequiredofbuildingscnotexceeding12feetinheightanddilluminatedonlybyasteadylightsourceOfonecoloduringorhenSurviVeisofferedanyilluminationincludingthatofbuildingstobesuchastopresentnoglaringlightsourcetopassingvehiculartrafficorneighboringpropertyzonedforresidentialuse4Aphotographofanysuchsignshallbefiledtogetherwithaitserectiondescritionofanyartificialilluminationwithintend5Oneportablesignnotexceeding4feetinheightfromthegroundand3feetinwidthshallbepermittedforeachstreetfrontedbutthesameshallberemovedduringallnonbusinesshoursSection2SignpermitinSR30andNAlandusedistrictsunyn6FrtablesignexceptsuchasarepermittedinalllandusedistrictsshallbeerectedandmaintainedonlyuponpermitthereforapprovedbytheedinaDesignCommissionafterafindingbythatCommissionthatitcomplieswithallapplicableregulationsandisofsuchanatureasnottopresentasignificantdistractionandsohazardintermsofthespeedandvolumeoftrafficOnfrontingstreetsfortheavoidanceofwhichtheCommissionmayattachreasonableandappropriateconditionswhichshallbeendorseduponthepermitthereforSection3pesignCommissionparticularauhorEinsTheMedinaDesignramissionshaYiapromptly1 determineallapplicationsforsignsnotgenerallypermittedinallresidentialzonesandspeciallydeterminewhetherthesamewillsatisfytheparticularregulationsofthecityapplicabletheretoandwillpresentnosignificantdistractionandsohazardintermsofthespeedandvolumeoftrafficonfrontingstreetsfortheavoidanceofwhichtheCommissionmayattachappropriateconditionsanditshallbeunlawfultomaintainerectormoveonlandinthecityanysignnotgenerallypermittedorfailinginanywaytocomplywithsuchregulationsandreasonableconditionsaswellasapplicableprovisionsoftheUniformBuildingCodeasadoptedbythecitySection4PenaltyViolationsofanyoftheprovisionsofthisordinanceshallbeamisdemeanouandanypersonfoundguiltythereofshallbepunishedbyafineofnottoexceed30000Orbyimprisonmentnottoexeeed90daysorbothEachdaybywhichsuchaviolationshallcontinueafternoticethereoftoanyviolatorfromanybuildingsuperintendentorotherpersonoragencytowhomhisauthoritymaybedelegateduntilsucherectionmovingalterationrepairconversionoraddingtoorenlargingofsuchastructureisdiscontinuedandanapplicationforbuildingpermitifrequiredfiledshallconstituteaseparateoffenseSection5CodeReferenceSection1hereofshallconstitutesection516ItheedinaCodesection2sections51494and5510andsection3section124032whilesection4shallbedeemedtheequivalentofsections5118and5512thereofSection6EffectivedateThisordinanceshalltakeeffectonthe21stdayofDecember1970PASSEDbytheCityCouncilonthe14thdayofDecember1970andsignedinauthenticationofitspassagethesamedayeyhadwickJrArttCityClerk
