CITYOFiEDINAORDINANCENOANORDINANCEamendingOrdinanceNo186incertainofitsprovisionsrelatingtothelicensingandcontrolofanimalsTHECITYCOUNCILOFTHECITYOFIIEDINADOORDAINASFOLLOWSSection1Section31OrdinanceNO186amendedSection3olofOrdinanceNo186isherebyamendedtoreadasfollowsSection31ViolationItshallbeunlawfultokeeporharboradogoverfour4monthsofagewithintheCityunlessalicenseshallbeprocuredfortheanimalfromtheCitySection2Section33OrdinanceNo186amendedSection33ofOrdinancejD186isherebyamendedtoreadasfollowsexpireeachyearEthdyofDecemberfollowingtheissueacethereofThefeethereforshallmbepaidonorbeforeJanuary31stofeachyearexceptastosuchanimalsashavenotpreviouslybeenlicensedorreachedtheageoffour4monthsforwhoselicensesthefeesshallbepaidwithinthirty30daysofacquisitionofownershiporcustodyoruponreachingtheageoffour4monthsThefailuretosotimelypayalicensefeeshallbesubjecttoalatechargeof400foreachanimaltobeaddedtotheregularlicensefeeIntheenforcementofthisprovis5ontheCityofMedinamayrequirereascnableevidencefromwhichthedateofacquisitionorcustodyorattainmentoftheageoffour4monthsmaybedeterminedSection3Section34Ordinance186AmendedSection34ofOrdinanceN016isherebyamendedtoreadasfollowssecticn34FgeTheannuallicensefeeforeachmaleandspayedfemaledogshallbe500foreachunspayedfemaledog750Section4Section37OrdinanceNo186AmendedSection37OfOrdinanceNo18isherebyamendedtoreadasfollowsSection37LostTagaAnyonerorkeeperofalicensedanimalwhosecurrentlicensehasbeenlostmayobtainareplacementtagpriortotheimpoundingofsuchanimalbypaymentofafeeof100totheCitybAnyanimallicensedforthecurrentyearwhichmaybeimpoundedwhilerunningatlargewithoutatagmayberedeemedbypaymentofimpoundingcareandinnocuationfeesasprovidedinSection531 Section5Section42OrdinanceNo186Amendedsection42ofOrdinanceNO186isherebyamendedtoreadasfollowsSection42TopermitananimalwhetherlicensedornottofrequentandrunatlargeOnpublicschoolgroundsduringschoolhoursorledinaCityHallParkatanytimeSection6Section46bOrdinanceNO186AmendedSection46bOfOrdinanceNo186isherebyamendedtoreadasfollowsbyownerorkeeperaggrievedattheclassificationofhisanimalasviciousdepredatoryordestructivemayrequest1Thatthebasesinfactforclassificationbesetforthtohiminwritingandwithparticularityorthathebefurnishedcopiesofthecomplaintsorreportssupportingsuchclassificationandor2ahearingbeforetheedinaMunicipalCourttodeterminethejustificationofsuchclassificationorthemeritofthecomplaintsIntheeventoftheaffirmanceofsuchclassificationtheownerorkeeperappealingshallpaythecostsofsuchhearingincludinga400filingfeeandthefeestootherwitnessescalledbythePoliceChiefinsupportoftheclassificationSection7Section53aandcAmendedSection53relatingtofeesisherebyamend3dtoteainitsSectionaandcasfollowsaAnimpoundingfeeof500uponthefirstimpounding800uponthesecondand1000uponthethirdwithinanytwelve12monthperiodcThecostoffeedingandcareofsuchanimalat200perdaySection8Section56OrdinanceNo186AmendedSection56OrdinanceNo186isherebyamendedtoreadas011owsSection56ImpoundinganddispositionofuncontrolledorviciousanimalAnyfiercedangerousorviciousanimalatlargeintheityeitheruponprivatepremisesofanypersonotherthantheownerorthepublicwaysorpublicplacesoftheCityoranyanimalwhichmaydisturbthequietofanypersonorneighborhoodduringthenormalsleepinghoursorwhichmaysoconductitselfonprivatepremisesastocauseharmtheretoorsubstantialannoyancetotheownerthereofbeingoneofnormalsensitivityorwhichshallbiteapersonorsoinkjureapersonastocauseanabrasionoftheskinisherebydeclaredtobeapublicnuisanceandsuchanimalshallimmediatelybetakenupandimpoundedinthemannerprovidedforinthisordinanceTOtheextentthattheactionsofsuchanimalaspermittedbyitsownerorkeeperconstitutesaviolationoftheotherprovisionsofthisordinanceacitationshallbeissuedbythePoliceDepartmentrequiringintheabsenceofreleaseofsuchownerorkeeperuponpersonalrecognizancethepostingofbailattherateof1000forthefirstoffense2500forthesecondand5000forthethirdastoaparticularanimalwithinanytwo2year2 periodAnanimaldeclaredtobeanuisancehereinmayberedeemedsubjecttotheprovisionsofChapter8butonlybyapersonundertakingtocontrolsuchanimalsoastopreventitscontinuingtobesuchanuisanceandifanyanimalshallbesoimpoundedthree3timesinanytwo2yearperiodundertheprovisionsofthissectionsuchanimalshallbedisposedofasanunredeemedanimalunlesstheownershallundertaketoandactuallykeepsuchanimaloutsidetheCitySection9CodeReferenceThesectionshereofrelatetosectionsofMedinaCodeasfollows171003271003371003471003571004671004771005871005Section10EffectiveDateThisOrdinanceshalltakeeffectonthejrdayOft1972PASSEDthisPdayoff1972andsignedinauthenticationofitspassagethesamedayApprovedastoformCityAttorneyAttestBerniceSowden3
