0306CITYOFMEDINAOiNANCEANORDINCestablishingproceduresfortheabatementarremovalofpublicnuisancesofabandonedvehiclesorvehiclehulksorpartsthereoffromprivatepropertynotiacludinghighwaysCITYCOUNCILOFTHCITYOFMDINADOORDATNASPOLLOW8t8action1PUblicBenefitTheMedinaCitycouncilfindsanddeclaresthatitisnecessaryfortheprotectionandwelfareofthegeneralpublicinregardtovehiclehulksandabandonedvehiclesthatcertainproceduresbeestablishedSection2AbandonedVehiclesPrivatePropertyNoparsonshallabandonanyvehicleorvehiclehulkwithintheCitofMadinsTheChiefofPoliceofthecityOfMedinaisherebyauthorizedtodeclareapublicnuisanceanyabandonedvehlcleorvehiclehulkorparttherefromonprivatepropertywithintheCityofMedinaSubjecttoacontrarydeterminationatapublichearingsuchvehicleorhulkshallberemovedandimoundedatthedirectionofthechiefofPoliceoftheCityofNedinsRemovalshallbeexecutedbyaregistereddisposerthatqualifiespursuanttoRCW4652108ThisOrdinanceshallnotapplytoaAvehicleorpartthereofwhichiscompletelyenclosedwithinanybuildingorotherenclosureinalawfulmannerorwhereitisnototherwisevisiblefromthestreetorotherpublicorprivatepropertyor0AvehicleorpartthereofwhichissoredorparkedinalawfulmanneruponprivatepropertyinconnectionwithabusinessofalicenseddismantlerorvehicledealerfencedaccordingtotheprovisionsofRCW4680130Section3DefinitionsThefollowingdefinitionsshallapplyintheinterpretationandenforcementofthisOrdinancezaAbandonedvehicleshallmeananyvehicleleftuponthepropertyofapersonotherthantheregisteredorlegalownerofthevehiclewithouttheconsentoftheOwnerofsuchpropertyforaperiodoftwentyfour24hoursorlongerexceptavehicleshallnotbeconsideredabandonedifitsowneroroperatorisunabletoremoveitfromtheplacewhereitislocatedandsonotifieslawenforcementofficialsandrequestsassistancebVehiclehulkshallmeantheremnantorremainsofanautomobiletruckorothermotorvehiclewhichiswreckeddismantledorinoperativeandcannotbemademechanicallyoperativewithouttheadditionofvitalpartsormechanismandtheapplicationofasubstantialanountoflabortoeffectrepair Section4NoticePublicHearingProvidedBeforeabatementandremovalofanysuchvehicleorhulkorpartthereoffromprivatepropertythechiefofPoliceofthecityofMedinashallgivenoticetothelastregisteredownerofrecordandthepropertyownerofrecordthatapublichearingmayberequestedbeforethecityCouncilandthatifnohearingisrequestedwithintwenty20daysfromthedateofreceiptofsuchnoticethevehicleorhulkorpartthereofdescribedinsaidnoticewillbesbetedandremovedbythecityandthecostsOfsuchabatementandremovalcollectedfromthelastregisteredownerofsuchvehicleorvehiclehulkiftheidentityofsuchownercanbedeterminedunlesssuchownerinthetransferofownershipofsuchvehicleorvehlclehulkhascompliedwithRCW4652104orthecostsmaybeassessedagainsttheownerofthepropertyonwhiohthevehicleisstoredUonreceiptofanysuchrequestforpublichearingtheCityCouncilshallbyresolutionsetadateforublichearingonthequestionofabatementandreovalofthevehicleorhulkorpartthereofasapublicnuisanceandshallcausetobegiventwenty2daysjnoticeofthetimelocationauddateofsuchhearingThenoticesprovidedforinthissectionshallbemailedbycertifiedOrregisteredmailwithafivedayreturnrequestedtotheownerofthepropertyonwhichsuchvehicleorhulkorpartthereofislocatedasshownonthelastequalizedassessmentrollandifldentificatimnumbersareavailabletodetermineownershiptothelastregisteredandlegalownerofrecordofsuchvehicleorhulkorpartthereofSection5PublicHearingTheownerofthepropertyuponwhichanysuchvehicleorhulkOrpartthereofislocatedmayappearatsuchhearinginpersonormaytimelypresentawrittenstatementforconsiderationatsuchhearingandmaydenyresponsibilityforthepresenceofsuchvehicleorhulkorpartthereofonsuchpropertygivingreasonsforsuchdenialIfitisdeterminedatsuchhearingthatsaidvehicleorhulkorpartthereofwasplacedonsuchpropertywithouttheconsentofthepropertyownerandthathehasnotsubsequentlyacquiescedinitspresencethentheCityshallnotassesscostsofadministrationorremovalofthevehicleagainstthepropertyupunwhichthevehicleislocatedorotherwiseattempttocollectsuchcostsfromtheownerSection6DispositionofAbandonedVehiclesAftertweety2dayselapseafterreceiptofthenoticeOftheCitysintenttoabateandremoveanysuchnuisanceorafterapublichearingifsuchisrequestedatwhichtheChiefofPoliceoftheCityofMedinaJsdeterminationofnuisancehasbeenafirmedtheChiefofPoliceshallcausesuchvehicleorhulkorpartthereoftoberemovedanddisposedoftoalicensedautowreckerandshallgivenoticetotheWashingtonStatePatrolandtheWashingtonStateDepartmentfMotorVehiclesthatsuchvehicleorhulkorpartthereofhasbeenwreckedandtheproceedsofsuchdispositionshallbeusedtodefraythecostofabatementandremovalofanysuchvehiclehulkorpartthereofincludingthecostsofadministration
