CITYOFMEDINAORDINANCENO37ANORDINANCErelatingtomovingbuildingsTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1PermitRequiredNopersoncorporationfirmororganizationshallmoveanybuildingoveralongoracrossahighwaystreetoralleyintheCitywithoutfirstobtainingapermitfromtheadministratorSection2AdministratorAdministratorshallmeanaCityemployeeoragentdesignatedbytheCityManagerastheofficialresponsiblefortheadministrationofthischapterSection3ApplicationApplicationforsuchpermitshallbemadetotheadministratoronformstobeprovidedbytheCityandshallbeaccompaniedbyapermitfeeof5000Section4DeositforExpenseofCityUponreceiptofanapplicationtheainistratorshallestimatetheexpensethatwillhaincurredinremovingandreplacinganypropertyoftheCitytheremovalandreplacementofwhichwillberequiredbyreasonofthemovingofthebuildingthroughtheCitytogetherwiththecostofmaterialsnecessarytobeusedinmakingsuchremovalsandreplacementsPriortotheissuanceofthepermittheadministratorshallrequireoftheapplicanttodepositasumofmoneyequaltotwicetheamountoftheestimatedexpenseSection5GeneralDepositAnapplicationhereundershallbeaccompaniedaByacashdepositorcorporatesuretybondinthestunof200000asindemnityforanydamagewhichteCitymaysustainbyreasonofdamageorinjurytoanyhighwaystreetoralleysidewalkorotherpropertyoftheCitywhichmybecausedbyorbeincidentaltothemovingofanybuildingoveralongoracrossanystreetintheCityandbByapublicliabilityinsurancepolicynamingtheCityofMedinaasanadditionalinsuredproviding10000000tosatisfyanyclaimbyprivateindividualsfirmscorporationsOrotherentitiesarisingoutofcausedbyorincidentaltothemovingofanybuildingoveralongoracrossanystreetintheCityandcByacashdepositorcorporatesuretyperformancebondinthesumof200000conditioneduponthepermitteewithinsixmonthsfromthedateoftheissuanceofsuchpermit1Completingtheconstructionpaintingandfinishingoftheexteriorofthebuildingand1 FaithfullycomplyingwithallrequirementsofthischapterthebuildingcodeandtheotherordinancesthenineffectwithintheCityincludingbutnotlimitedtopermitteecompletingsuchworkwithinsixmonthsfromthedateoftheissuanceofsuchpermitIntheeventtheprovisionsOfsubsectlonchereofarenotcompliedwithwithinthetimespecifiedthesumOf200000shallbeforfeitedtothecityasapenaltyforthedefaultandthisshallbeinadditiontoanyotherpenaltiesprovidedforfailuretocomplywiththetermsofthischapterSection6ConditionsforSecuringPermitAsaconditionofsecuringthepermitaThepermitteeshallfurnishtheCitywithesetofplansandspecificationsforthecompletedbuildingandbThepermitteeshallpriortomakinganyapplicationforsuchpermitorwithintendaysaftermaingsuchapplicationcausealloftheinteriororexteriorwallsceilingsorflooringtoberemovedtosuchextentasmaybenecessarytopermittheCitybuildinginspectortoexaminethematerialsandtypeOfconstructionofsuchbuildingtoascertainwhetheritdoesorcanberehabilitatedtocomplywithallexistingbuildingcodesandordinancesoftheCitywhenlocatedonanewsitewithintheCitySaidinspectionshallbeatthepermitteesexpensecThepermitteeshallafterreceivingapermittomovethestructureonCitystreetsnotifytheaminlstratoroftheproposeddateandtimeofsuchmoveSuchproposeddateandtimemustbeapprovedbytheCitybeforeanystructureismovedonanyCityhighwaystreetoralleySection7InspectionbyAdministratorTheadministratorshallinspectthebuildingandtheapplicantsequipmenttodeterminewhetherthestandardsforissuanceofapermitaremetSection8StandardsforIssuanceTheadministratorshallrefusetoissueapermitifitisfoundaThatanyapplicantionrequirementoranyfeeordepositrequirementhasnotbeencompliedwithbThatthebuildingistoolargetomovewithoutendangeringpersonsorpropertyintheCitycThatthebuildingisinsuchastateofdeteriorationOrdisrepairorisOtherwisesostructurallyunsafethatitcouldnotbemovedwithoutendangeringpersonsorpropertyintheCitydThatthebuildingisstructurallyunsafeorunfitforthepurposeforwhichmovedifthebuildingistobelocatedintheCity2 eThattheapplicantsequipmentisunsafeandthatpersonsandpropertywouldbeendangeredbyitsusefThatzoningorotherordinanceswouldbeviolatedbythebuildinginitsnewlocationgThatforanyotherreasonpersonsorpropertyintheCitywouldbeendangeredbythemovingofbuildingsSection9AppealAnypersonaggrievedbytheactionoftheadministratorinrefusingtoissueapermitunderthischaptershallhavetherighttoappealsuchactiontotheBoardOfAdjustmentbyfilingaNoticeofAppealwiththeCityclerkwithintendaysOfreceivingnoticeoftheactionfromwhichappealistakenAtthehearingbeforetheBoardofAJustmenttheappellantmayappearandbeheardsubjecttotherulesandregulationsoftheboardSection10FeesandDepositsAReturnUponNonIssuanceUpontherefusaloftheadministratortoissueapermittheadministratorshallreturntotheapplicantallfeesdepositsandbondsBReturnUponAllowanceforExpenseAfterthebuildinghasbeenmovedtheadministratorshallprepareawrittenstatementofallexpensesincurredinremovingandreplacingallpropertybelongingtotheCityandallmaterialusedinthemakingOftheremovalandreplacementtogetherwithastatementofalldamagecausedtoorinflicteduponpropertybelongingtotheCityTheadministratorshallreturntotheapplicantalldepositsafterdeductionofasumsufficienttopayforallofthecostandexpensesandforalldamagedonetopropertyOftheCitybyreasonofthebuildingSection11AdministratortoDesignateStreetforMovingTheadministratorshalldesignatethestreeetsoverwhichthebuildingmaybemovedTheadministratorshallhavethedesignationapprovebythePoliceDepartmentInmakingtheirdeterminationstheadministratorandthePoliceDepartmentshallacttoassuremaxunumsafetytopersonsandpropertyintheCityandtominimizecongestionandtraffichazardsonpublicstreetsSection12DutiesofPermitteeEverypermitteeunderthischaptershallaUsedesignatedstreetsMoveabuildingonlyoverstreetsdesignatedforsuchuseinthewrittenpermithNotifyofrevisedmovingtimeNotifytheadministratorinwritingofadesiredohangeinmovingdateandhoursasproposedintheapplicationcNotifyofdamageNotifytheadministratorinwritingofanyandalldamagedonetopropertybelongingtoorlocatedwithintheCitywithintwentyfourhoursafterthedamageorinjuryhasoccurred3 deDisplaylightsCauseredlightstobedisplayedduringthenighttimeoneverysideofthebuildingwhilestandingonastreetinsuchmannerastowarnthepublicoftheobstructionandshallatalltimeserectandmaintainbarricadesacrossthestreetsinsuchmannerastoprotectthepublicfromdangerorinjulbyreasonOfthemovingofthebuildingStreetoccupancyperiodRemovethebuildingfromtheCitystreetsaftertwelvehoursofsuchoccupancyunlessanextensionisgrantedbytheadministratorfgComplywithgoverninglawWithinsixmonthsfromthedateofissuanceofthepermitcomplywithallCityBuildingFireandZoningOrdinancesandallotherapplicableordinancesandlawsuponrelocatingthebuildingintheCitySafeguardinstallationsiteProvideadequatebarriersandwarningsatanysitewithintheCitywhereabuildingistobelocatedsufficienttopreventaccesstoanyconstructionorexcavationsitebychildrenoradultsduringallphasesofconstructionhPayexpenseofofficerPaytheexpensesofatrafficofficerorderedbytheadministratortoaccompanythemovementofthebuildingtoprotectthepublicfrominjuryiClearpremisesRemoveallrubbishandmaterialsandfillallexcavationstoexistinggradeattheoriginalbuildingsiteandatthesiteatwhichthebuildingisrelocatedsothatthepremisesareleftinasafeandsanitaryconditionSectiont3EnforcementAEnforcingOfficersTheadministratorandthePoliceDepartmentshallenforceandcarryouttherequirementaofthischapterBPerntteeLiableforExpenseAboveDepositThepermitteeshallbeliableforanyexpensedamagesorcostsinexcessofdepositedamountsorsecuritiesandtheCityAttorneymayprosecuteanactionagainstthepermitteeinacourtofcorpetentjurisdictionfortherecoveryofsuchexcessiveamountsCPremisesLeftUnsafeTheCitymayproceedtodoanyworknecessarytoputtheoriginalpremisesorthesiteatwhichthebuildingisrelocatedinasafeandsanitaryconditionwherepermitteedoesnotcomplywiththerequirementsofthischapterandthecostthereofshallbechargedagainsttheGeneralDepositDCostofEnforcementTheapplicantshallberesponsibleforallcostsincludingreasonableattorneysfeesincurredbytheCityinenforcingtherequirementsofthischapter4
