HomeMy WebLinkAboutOrdinance No. 0373CITYOFMEDINAORDINANCENO373AnordinanceammendingOrdinanceNO367andMedinaCodeSections5165through5168requiringfencingaroundpoolsTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSOrdinancenumber376andCodeSections5165through5168areamendedtoreadasfollowsSection1PurposeandPolicyDeclaredThisOrdinanceisenactedasanexerciseOfthepolicepoweroftheCityofMedinatoprotectandpreservethepublicpeacehealthsafetyandwelfareItsprovisionsshallbeliberallyconstruedfortheaccomplishmentofthesepurposesThisordinanceisintendedtobealawofgeneralapplicationforthepublicatlargeitisnotintendedfortheparticularbenefitofanyindividualpersonOrgroupofpersonsotherthanthegeneralpublicanditisnotintendedtoimposeliabilityontheCityofMedinaoritsofficersOritsemployeesrunningtoindividualmembersOfthepublicNothingcontainedinthisordinanceisintendedtobenorshallbeconstruedtocreateorformthebasisforanyliabilityOnthepartOftheCityOfMedinaOritsofficerseployeesoragentsforanyinjuryordamageresultingfromthefailureoftheownerofapooltocomplywiththeprovisionsofthisordinanceorbyreasonorinconsequenceofanyactorommissioninconnectionwithimplementationOrenforcementofthisOrdinanceSection2PoolDefinedThetermpoolasusedinthisordinanceisdefinedasanyartificallyconstructedwaterholdingdevicedesignedusedormaintainedforrecreationalpurposesbyanindividualforusebyhisorherhouseholdandguestsandlocatedonalotasanaccessoryusetoaresidenceSection3FencingaFromandafterSeptember11981allpoolswhetherthenexistingorthereafterbuiltwhicharewhollyorinpartOutsideanyresidentialstructureshallbeenclosedbyasubstantialfencenotlessthanfourfeetinheightandwhichshallalsobeinaccordancewiththeprovisionsrelatingtofencesundertherelevantsectionsoftheordinancesoftheCityOfMedinaSuchfencingshallbeconstructedandmaintainedastopreventwithinreasonanypersonfromgainingaccessbeneathoverOrthroughsaidfenceandwhichshallhavesimilarlysubstantialgatesordoorsofthesameheightasthefencewithdevicesforlockingsaidgatesordoorsatalltimeswhenthepoolisunguardedunattendedornotinactualuseAllsuchgatesordoorsshallbeequippedandmaintainedwithselfclosingandselflatchingdevicesatalltimesandalllatchesshallbeplacedatleastfour4feetabovethegroundorshallbemadeinaccessibletosmallchildrenfromtheOutside bWhenapoolislocatedwithinayardenclosedbyafencewhichsatisfiestherequirementsofthiscodenofenceimmediatelysurroundingsaidpoolshallberequiredcFencingshallnotberequiredalongtheshorelineofLakeWashingtonprovidingthatthefencingotherwiserequiredisextendedtothemeanhighwaterlineatsaidshorelineOrtotheedgeOfanybulkheadorotherconstructionwhichextendsbeyondthemeanhighwaterlinedTheCityOfMedinaBoardOfAdjustmentpursuanttonormalvarianceproceduresmaydeclarethatfencingisnotrequiredOnoneOrmoresidesofanypoolwhentheyfindthataccesstosaidpoolbypersonswouldbeimpossiblewithinreasonbecausesteepbanksmaintaineddensevegationorotherbarrierswouldpreventsuchaccessSection4ViolationPenaltyViolationofanyoftheprovisionsofthisordinanceshallbeamisdemeanorandanypersonfoundguiltythereofmaybepunishedbyafinenottoexceed30000orbyimprisonmentnottoexceed90daysorbothEachdaywhensuchaviolationshallcontinuetoexistafternoticethereoffromthebuildingofficialoranypersonOragencytowhomhisauthoritymaybedelegatedshallconstituteaseparateoffenseSection5CodeReferencesSectionIthrough4hereofshallconstituteSection5165through5168oftheMedinaCodeandallothersectionshereofshallbeconsideredOfspecialOrtemporaryeffectSection6EffectiveDateThisordinanceshalltakeeffectonthefirstdayofSeptember1981PASSEDbytheCityCouncilonthethirteenthdayofJuly1981andsignedinauthenticationofsuchpassagethesamedayMayorAttestApprovedastoformKirkRWinesCityAttorney3EAE2
