CITYOFMEDINAORDINANCENO376AnordinanceestablishingtheconditionsrateschargesrequirementsobligationsanddutiesforconstructionmaintenanceandoperationofacableconnunicatlonanddistributionsystemwithintheCityandgrantingtherightprivilegeandauthoritytoafranchisestoconstructoperatemaintainandusepolesconduitscableswiresandotherincidentalequipmentinuponunderoveralongandacrossstreetsavenuesboulevardsalleysandotherpublicplacesoftheCityofMedinaandimposingcriminalpenaltlesforunauthorizedreceiptofCATVsignalsTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1DefinitionsaApplicantshallmeananypersonorentitywhoshallapplytotheCityforafranchisetoconstructandoroperateandmaintainaCATVsystemwithintheCityortoexpandpresentfacilitiesunderanexistingfranchiseoranypersonwhoseeksassignmentofanyexistingCATVfranchisebCATVshallmeanCommunityAntennaTelevisionasdefinedbytheapplicableFCCregulationscFCCshallmeantheFederalCommunicationsCommissionaregulatoryagencyoftheUnitedStatesgovernmentdGranteeshallmeananypersonfirmorcorporationorotherentitygrantedafranchisebytheCityeitherpreviouslyorhereafterandthelawfulsuccessortransfereeorassignofsuchpersonfirmorcorporationasprovidedforinthisordinancewhoshallhavebeengrantedafranchisetoconstructandoroperateandmaintainacablecommunicationanddistributionsystemwithintheCityeBasicServicesshallmeanthetransmissionorretransmissionOfallVFsignalsoriginatingintheSeattleTacomaBellinghamareatwofromCanadaatwentyfour24hoursportschannelatwentyfour24hournewschannelatleasttwosattelitetransmitteddomesticUnitedStatesstationsandamusicchannelallofwhichshallbeavailabletoSubscribersforthebasicfeeMquivalentservicesmaybesubstituteduponapprovalbytheofficefAccessChannelsshallmeanfreecompositechannelstobeusedforeducationalpurposesandbygovernmentandpublicagenciesandortheirrepresentativesgSuretyshallmeananypolicyOfinsuranceorsuretybondrequiredbythisordinance1 hGrossSubscriberRevenueforthepurposeofdeterminingthefranchisefeepayabletotheCityshallbedefinedasallBasicServicespaytvandancilliaryservicesandadvertisingrevenuesreceivedbytheGranteefromoperationswithintheCitybutshallexcludeincomederivedfrominstallationchargesextraoutletsorconvertersiSubscribershallmeananypersonorentitywhoinreturnforafeereceivesservicesofferedbytheGranteeincludingBasicServicesaswellasanyotherservicesofferedbyGranteeJOfficeshallmeantheCityManagerOrtheOtherpersonorentitydesignatedbytheCityManagerasbeingresponsiblefortheadministrationoffranchisesfortheCitykCityshallmeantheCityofMedina1SurroundingCommunitiesshallmeanthosecitieswhoseboundariesarecontiguoustotheCityandthemunicipalitiesandunincorporatedareaswithinathirty30mileradiusthecenterofwhichistheCityhalloftheCitySection2ApplicationforFranchise1EachApplicantshallfileanapplicationwiththeofficeinaformsubstantiallysimilartoExhibitAattachedhereto2TheapplicationshallcontaininadditiontosuchotherthingsastheOfficeshallrequirethefollowingaNameandaddressofApplicantbThenamesaddressesandbusinessbackgroundsofallofficersdirectorspartnersmanagingagentsorotherpersonswhowillberesponsiblefortheexecutiveandoperationalofficesoftheApplicantandeachpersonorentityowningcontrollingorhavingarighttoownOrcontrolmorethanfive5percentofthebeneficialinterestOftheApplicantcThenamesandaddressesofanyandallofficersdirectorsshareholdersorholdersofmorethanfive5percentofthebeneficialinterestintheApplicantandallsubsidiariesOftheApplicantandthoseofanyandallcontrollingparentorganizationswhoOwnOrcontrolorhaveanybeneficialinterestinanyotherorganizationorentitywhoholdsOthercabletvfranchisesfromothermunicipalitiesintheUnitedStatesandtheareasinwhichthosefranchisescoverdIftheApplicantisapubliclytradedcorporationitmustsupplyanannualreportanda10KReportwiththeapplication2 eEachApplicantmustsupplyadetailedfinancialplanincludigaProFormawhichwillprojecttheOperationsoftheApplicantforthefirsttenyearsfollowinganyawardOfthefranchiseThefinancialplanshouldincludebutwillnotbelimitedtothoseitemsdetailedontheapplicationExhibitNAfAllotherdetailedinformationassetforthinSections10131415and25andotherwiserequestedintheapplicationExhibitASection3HearingAftertheapplicationhasbeenreceivedtheCityCouncilorsuchpersonorbodiesasmaybedesignatedbytheCityCouncilshallconductapublichearingtodeterminethefollowingaThatthepublicwillbebenefitedbythegrantingofafranchisetotheApplicantbThattheApplicanthasrequisitefinancialandtechnicalresourcesandcapabilitiestobuildoperateandmaintainacabletelevisionsysteminthefranchiseareacThattheApplicanthasnoconflictinginterestseitherfinancialorcommercialwhichwillbecontrarytotheinterestsofthecitydThattheApplicantwillcomplywithalltermsandconditionsplaceduponthefranchisebythisOrdinanceeThattheApplicantiscapableofcomplyingwithallrelevantfederalstateandlocalregulationspertainingtotheconstructionoperationandmaintenanceofthefacilitiesandsystemsincorporatedinitsapplicationforafranchiseSection4TermsofFranchiseAnyfranchisegrantedpursuanttothisordinanceshallbenonexclusiveandshallnotprecludethecityfromgrantingotherorfurtherorfuturefranchisesorpermitsorprecludetheCityfromusinganyroadsrightofwaystreetsorotherpublicpropertiesoraffectitsJurisdictionoverthemoranypartofthemorlimitthefullpoweroftheCitytomakeallnecessarychangesastheCityinitssolediscretionshalldecideincludingthededicationestablishmentmaintenanceandimprovementofallnewrightsofwayandthroughfaresandotherpublicpropertiesofanytypeTheGranteeshallagreeandcovenanttoprotectsupporttemporarilydisconnectrelocateandremoveatitssolecostandexpensefromanypublicpropertyanyofitsinstallationswhensorequiredbytheCitybyreasonsoftrafficconditionspublicsafetystreetvacationsdedicationsofnewrightsofwayandtheestablishmentofstreetgradeortheconstructionofanyimprovementorstructurebyanygovernmentalagencyactinginagovenmentalcapacityprovidedthattheGranteeshallinallsuchcaseshavetheprivilegetotemporarilybypassonanyauthorizedportionofthesamestreetorrightofwayuponapprovalbytheCityasectionofitscableorappurtenancestobesotemporarilydisconnectedorremoved3 Section5stemDescriptionEachApplicantwillprovideaminimumofftyfour54channelsystemsatpresentandmakeavailablethereonthebasicservicesdescribedhereinandallpremiumservicesofferedbyCATVprovlderetothepreaominentnumberofsurroundingcomunltieswhichservicesshallbespecifiedinthefranchiseapplicationVariancesmaybegrantedfromtheaboverequirementsforreasonsoftechnicalinabilitiesalternateprogramingsourceswhichareacceptabletotheCityandforsuchothereconomicconvenienceortechnicalreasonsasmaybeapprovedbytheCitySuchrequestforvarianceswillbereconsideredanddecidedintheCityssolediscretionVarianceswillnotberequiredforaddingadditionalservicesbutonlyforsubstitutionofservicesforthosedescribedinthisordinananceorinthefranchiseThesystemasitisconstructedandoperatedmusthavethecapabilitytoincorporatenewtechnologieschangesinprogrammingandstateoftheartdesignandimprovementsavailableduringthelifeofthefranchiseAtnotimewillthecapabilitiesofthesystembelessthanthatofferedbyCATVprovideretothepredominatenumberofSurroundingCMunltiesprovidedhoweverGranteemayberelievedfromtheobligationofprovidingnewservicesnotnowavailablewithinthesurroundingcommunitiesuponasatisfactoryshowingthatsuchservicesarenoteconomicallyortechnicallyfeasibleTheCityshallhavetherightthroughoutthetermofanyfranchisegrantedhereundertoreviewthetermsOfsuchfranchiseandthisordinancetoinsurecompliancewiththissectionandGranteeshallprovideallinformationreasonablynecessarytofacilitatesuchreviewTheCityexpectsahighlevelofservicetosubscribersandafranchiseesresponsivenesstosubscriberconcernsandcomplaintswillconstituteanimportantpartofthereviewprocessSection6TwowayAccessTheGranteeshallsetasidefive5channelsfortwowayaccessTheGranteeshallmakereadyatthestartofitsoperationsonesuchdedicatedchannelswithtwowayinteractcapabilitiesfortheoperationofatwentyfour24hourfireburglaryprotectionsystemIftheGranteefailstoprovideserviceuponsuchchannelwithinareasonabletimetheCitymayfollowingsix6monthsnoticeOfitsintentiontodosorequiretheGranteeeithertoprovidesuchserviceortocontractwithotherenetitiestoprovidesuchserviceSection7CommunityAccessGranteewillatitssoleexpensemakereadilyavailabletotheCitysuchfacilitiesasitnowhasorlateracquiresfortheproductionanddistributionofcivicpoliticalculturalandsocialinformationoncommunityaccesschannelsGranteeshallnotberequiredtoprovideaccessfacilitiessolelyfortheuseofthecityifithasexistingfacilitieswhichareavailableonareasonablebasisfortheCitysuseSection8CommunityFacilitiesGranteeshallinstallthesystemcablesinsuchpublicbuildingsprivateandpublicschoolsasmaybedesignatedbytheCityTheBasicServiceswillbeprovidedovertheselineswithoutcharge4 Section9PatesandChargesNoGranteeshallimposeupontheSubscribersratesorchergeeforBasicServicesorincreasesinsuchratesorchargesuntilithasfirstgiventheCityninety90daysnoticeofsuchratesorchargesorincreasesinsuchratesorcharges1AnyApplicantforanewfranchiseorfortherenewalorextensionofafranchiseandanyGranteeproposinganyincreasesinratesandchargesfortheinstallationofcableorBasicServicesshallfirstfilewiththeofficeascheduleoftheproposedratesandchargesortheproposedincreasedratesandchargestogetherwithanaffidavitcertifyingcompliancewithThescheduleshallincludeamongotherthingsthethislsectionfollowingloefforgijk1InstallationofBasicServicePeriodicchargesforBasicServiceInstallationforpremiumsservicePeriodicchargesforpremiumserviceInstallationofFMservicePeriodicchargesforFMserviceincludingratesFMserviceasaprimaryserviceChargesforrelocationandreconnectlonConverterchargesChargesforparentalcontrolkeysInstallationchargesforbulkconunercialservicePeriodicchargesforbulkcommerclalserviceInstallationchargesforadditionaloutletservicemPeriodicchargeforadditionaloutletservicenDiscountsformultiplepremiumservicesetcoInteractiveservicechargespExtendeddopinstallationchargesTeletexttypeserviceandequipmentchargesrAllotherchargesproposed2TheofficeshallexamineandinvestigatetheschedulessubmittedbytheApplicantorGranteeandmakerecomuendationstotheCityCouncilwithrespecttheretowithinthirty30daysafterreceiptthereofTheCityCouncilshallhavetherightinitsdiscretiontoreviewsuchratesIftheCityCouncilelectstoreviewsuchratesitshallnotifythe5 applicantorgranteepriortotheexpirationoftheninety90daynoticeperiodofitsintentiontodosoandshallschedulewithinfortyfive45daysthereafterapublichearingtoconsiderthereasonablenessoftheratesandifsuchratesarefoundtobeunreasonabletoestablishmaximumratesandchargesTheCitywillusethefollowingcriteriafordeterminingthereasonablenessoftheratesThefeeschargedtoSubscribersbyCATVproviderstopersonsintheSurroundingCommunitiesthecostandexpensetotheGranteeoftheservicesprovidedtheextentofcapitalinvestmentintheCitybytheGranteethestateofartandthetechnologicalstatusofthesystemintheCityoftheGranteewandafairrateofreturnOninvestmentbytheSrsnteeIftheCityCouncildoesnotnotifytheGranteeofitsintentiontoreviewproposedratesandchargeswithinninety90daysafterreceivingnoticeoftheproposedratesandchargessaidratesandchargesshallbedeemedapproved3NoGranteeshallmakeorgrantanyundueinfluenceoradvantagetoanySubscriberoruserexceptasspecificallyauthorizedhereinnorunlawfullydiscriminateagainstanypersonorgroupprovidedthissubsectionshallnotbeconstruedtoprohibittradepromotionscustomaryintheindustryprovidedsuchtradepromotionsarenototherwiseprohibitedbylawSection10SystemConstructionEachApplicantwillprovideamapindicatingplantcoverageofallCityareasatthetlmeofapplicationforfranchiseorforabuildingpermitinthecaseofanexistingfrachiseholderThegenerallayoutofnetworkswillbeprovidedincludingundergroundplantheadendhubssattelitesubstationsantennasmicrowaveandorsupertrunklinktrunksandfeedersThismapwillhereviewedforconleteneesandpractlcalconsiderationsbytheOfficeinitsevaluationOftheapplication1ApplicantshouldstatethemeanseloyedtoverifythestabilityandsuitabilityoftheproposedheadendsiteandtheearthstationsiteincludingbutnotlimitedtofieldtestlngorothermeanstoinsurethatsufficientsignalstrengthandqualityareavailableAllcablesfromheadendtotapoffswillberunundergroundexceptwhereelectricutilitylinesareoverheadIncaseswhereeectriclutilitylinesareoverheadexistingutilitypolesmaybeusedprovidediftheelectricutilityservicedropisundergroundthecableservicedropshallalsobeundergroundInanyareawhichshs11hereinafterbedesignatedbyordinanceasanareainwhichelectricutilitylinesshallbelaidundergroundtheGranteeswiresandcablesincludingdropcablesshallalsobeplacedundergroundSuchfutureundergroundincausedbysuchdesignationshallbeattheGranteeesoleexpense2AllfacilitiesconstructedunderthisordinanceshallbeplacedandmaintainedatsuchplacesandpositionsinoruponsuchstreetsavenuesalleysandpublicplacesasshallnotinterferewiththefreepassageoftrafficendthefreeuseofadjoiningpropertyandshallconformtotheNationalElectricCodeStateofWashingtonandcityregulationspertainingtosuchconstruction3WheneveritshallbenecessaryintheinstallationrepairorsubstitutionofanyfacilityorOtherapparatustomake6 anyexcavationinorthealterationofanystreetavenuealleyOrpublicplacesaidGranteeshallsecurepermitfromtheCityandconductsuchworkincompliancewithanyordinanceinforceintheCityrelatingtosuchactionsSection11BuildingMovingWheneveranypersonshallhaveobtainedpermissionfromtheCitytouseanystreetforthepurposeOfmovinganybuildingaGranteeuponseven7dayswrittennoticefromtheCityClerkshallraiseorremoveattheexpenseofthatpersondesiringtomovethebuildinganyofitswireswhichmayobstructtheremovalofsuchbuildingprovidedthatthemovingofsuchbuildingshallbedoneinaccordancewithregulationsandgeneralordinancesoftheCityatsuchreasonablehoursandinsuchreasonablemannerasshallcausetheleastinterferencewiththebusinessofsaidGranteeWheremorethanonestreetisavailableforthemovingofsuchbuildingthebuildingshallbemovedonsuchstreetasshallcausetheleastinterferencewiththelinesofGranteeandotherfranchiseholdersItisfurtherprovidedthatthepersonorpersonsmovingsuchbuildingshallindemnifyandsaveharmlesssaidGranteeofandfromanyandalldamagesorclaimsofwhatsoeverkindornaturecauseddirectlyorindirectlyforsuchtemporaryarrangementofthelinesandpolesoftheGranteeSection12TechnicalStandardsGranteelscableconunicationssystemshallmeetalltechnicalperformancerequirementsimposedbyFCCrulesandregulationsatthepresenttimeGranteeshallnotberelievedoftheobligationtoconformtosuchrulesandregulationsbyanyfuturereductionsinoreliminationoftechnicalrequirementsbytheFCCTheresidentialreversesystemshallbecapableofprovidingareversetrasmissionwithminimumsignalstrengthandqualitynotlessthanrequiredbytheFCCstandardsforClassIsignalsSection13SystemComponentsandMaintenanceEachApplicantshallprovidethefollowing1DescriptionOfmajorcomponentsproposedforuseinthesystemincludingantennasearthstationequipmentheadendequipmentmicrowaveequipmentcableplantequipmenthomeSubscriberequipmentinstitutionalSubscriberterminalequipmentandinteractiveservicesequipment2ProceduresforsystemmaintenancepreventiveandcorreotiveincludingtypeandfrequencyforinspectionandtestingThisshouldincludeproofofperformancetestinginitialandannual3AdetaileddescriptionoftheproposedprogramforrespondingtoSubscribercomplaintsincludingastatementofpolicyastothecreditorothermeansofcompensationtotheSubscriberforlossofserviceforeach12hoursegmentwhichisattributabletooperatorerrororlackoftimelyresponseSection14SubscriberAgreementsEachApplicantshallprovideacopyoftheformofanyagreementundertakingorotherinstrumentproposedtobeenteredintobetweentheApplicantandanySubscriberSection15TradeAgreementsEachApplicantshall7 providedetailedstatementssettingforthinsubstanceanyandallagreementsandorundertakingswhetherormalorinformalwrittenoralorimpliedexistingorproposedtoexistbetweentheApplicantandanypersonfirmorcorporationorotherentitywhichariseoutoforrelatedrrectlytoanyapplicationorthegrantingofafranchiseSection16ModificationsIfanyportionofthisordinanceShouldbeinconsistantwithanyruleorregulationnoworhereinafteradoptedbytheFCCthentotheextentoftheinconsistancytheruleorregulationoftheFCCshallcontrolforsolongbutonlyforsolongassuchruleorregulationshallremeinineffectbuttheremainingprovisionsOfthisordinanceshallnottherebybeaffectedSection17InsuranceEachApplicantshallprovideevidenceofbothliabilityandpropertydamageinsuranceofonemilliondollars1000000AcopyofsuchinsuranceshowingtheCityasadditionalinsuredwillbedeliveredattheOfficenolaterthantwenty20daysafterawardingofthefranchiseThisinsuranceistoremaininfullforceandeffectforthedurationofthefranchiseandcopiesoftheannualrenewalswillbegiventoheofficeSection18TimelinessandCoverageEachApplicantshallagreethatthecompleteproposedsystemaslistedinitsapplicationwillbeinstalledandoperationalwithoutexceptionwithintwelve12monthsoftheawardingofthefranchiseandshallhavecompletedistributionlinescapableofprovidingservicetoeveryresidencelocatedintheCitywithinsuchperiodAllhomeconnectionsrequestedshallbeinstalledwithinsixty60daysaftertherequestforconnectionisreceivedandthedistriubtionlineshavebeeninstalledSection19PenaltiesAGranteeshallbeassessedthesumOfonethousanddoll000perdayascompensatoryliquidateddamagesforeachdaytheinstallationisnotfullycompletedandoperationalaftertheexpirationofthetwelve12monthperiodfollowingtheawardingofthefranchiseTheCityshallhavetherightsolelyandexclusivelywithinitsdiscretiontowaivesuchpenaltiesAnysuchwaivershalinotconstitutewaiveroffuturerightstoenforcethispenaltySection20FranchiseFeeAGranteeshallpaytheCityquarterlyOnorbeforethetenth10thdayOfeachJanuaryAprilJulyandOctoberasumequaltofour4percentoftheGrossSubscriberrevenueschargedbytheGranteeTheCityshallhavetherightatanyreasonabletimetoinspectthebooksandrecordsoftheGranteeforthepurposeofascertainingtheactualSubscriberchargesandGranteeshallfurnishpromptlywitheachpaymentastatementoutliningSubscriberchargesuponwhichpaymentwasbasedAllfranchisefeesmaybeCreditedagainstanybusinessandoccupationorutilitytaxnoworhereafterassessedbytheCityTheimpositionofthisfranchisefeeshallnotlimittheCitysrighttoimposeadditionalbusinessandoccupationutilityorothertaxesonafranchiseSection21LengthofFranchise8 1AfranchisegrantedbytheCityunderthisordinancemaybeforatermofnolongerthanfifteen15years2TheCitymayterminatethefranchiseuponthirty30dayswrittennoticeintheeventofthewillfulfailurerefusalOrneglectbytheGranteetodoorcomplywithanymaterialreuirementsofthisordinanceortherulesandregulationsadoptedpursuanttothisordinancethefranchiseagreementbetweentheCityandtheGranteeandanyrepresentationsmadebyGranteeinitsapplicationinanypublichearingOrinwritingsignedbytheapplicantIntheeventofterminationinadditiontoallotherremediesallowedbylawtheCitymaydirectGranteetoremoveallofitsfacilitieslocatedwithintheCityifGranteefailstoremovesuchfacilitieswithinninety90daysfromreceiptOfnoticetodososuchfacilitiesmayberemovedbytheCityatGranteesexpenseormaybepurchasedbytheCitypursuanttoSection33ofthisordinanceSection22PeriodicReportsEachGranteewillfurnishtotheOfficewithinninety90daysoftheconclusionOfitsfiscalyearareportOfitsactivitieeincludingbutnotlimitedtothefollowinga10KReporttotheSCifGranteeisrequiredbytherulesandregulationstofileoneiftheGranteeisnotrequiredtofileoneanauditedfinancialreportbLstingsofthenumberofSubscriberswithintheCitycThenumberofhomespasseddThenumberOfSubscriberswithBasicServiceseThenumberOfSubscriberswithPremiumServicesfThenumberOfSubscribersusingtwowayserviceegThenumberofhookupsinperiodhThenumberofdisconnectsinperiodiThenumberofmilesofcablelaidinperiodJTotalnumberofmilesofcableinCitykCommentsOncitizenrelationssuchasnumberofcomplaintsreceivedandhowthosecomplaintswereresolved1PlansforfuturetechnicalupgradingmPlansforfutureprogramingandorchangesnGeneralconunentsSection23ualOprtunityandAffirmativeActionPlanEachGranteeshalcomplywithallequalemployment9 irmactingonbehalfoftheGranteeduringthelifeofthefranchiseGranteeshallcomplywithallpresentandfutureordinancesandregulationsoftheCityregardingexcavationorconstructionandwheneverdeemednecessarybytheCityshallberequiredtopostaperformancebondinanamounttobedeterminedinthediscretionoftheCityEngineerinfavoroftheCitywarrantingamongotherthingsthatallrestorationworkwillbedonepromptlyandinaWorkmanlikemannerSection31IndemnityandHoldHarmlessandWaiverof1EachGranteeshallindemnifyandholdharmlesstheCityfromanyandallliabilitiesfeescostsanddamageswhethertopersonorpropertyorexpenseofanytpeornaturewhichmayoccurtotheCitybyreasonoftheconstructionoperationmaintenancerepairandalterationsofGranteesfacilitiesInanycaseinwhichsuitOractionisinstitutedagainsttheCitybyreasonofdamageorinjurycausedbyGranteetheCityshallcausewrittennoticethereoftobegiventotheGranteeandGranteethereuponshallhavethedutytoappearanddefendinanysuchsuitoractionwithoutcostOrexpensetotheCity2GranteeshallhavenorecoursewhateveragainstheCityforanylosecostexpenseordamagearisingoutofanyprovisionorrequirementofanyordinanceorfranchiseortheenforcementthereof3NoprivilegenorexemptionshallbegrantedorconferreduponGranteebyanyfranchiseexceptthosespecificallydescribedthereinandanysuchprivilegeclaimedundersuchfranchisebyaGranteeandanyuseofanystreetshallbesubordinatetoanypriorlawfuloccupancyofthestreetoranysubsequentimprovementorinstallationthereinSection32CondemnationIfduringthetermofafranchiseoranextensionthereoftheCityshallacquirebypurchaseorcondemnationanyofaGranteespropertyorassetsmaintainedorusedunderthefranchisetheCityshallpayonlythefairmarketvalueforthepropertyandorphysicalassetsplusthefeespaidtotheCityforobtainingthefranchisesection33PaversionNotwithstandinganysubsequentstateorfederallegislationenactedinthefuturetheCityreservestheunconditionalrighttopurchasetheentireoranyportionofaGranteessystematafairmarketpriceintheeventofnoncompliancewithanyprovisionofthisordinanceThisprovisionisinadditiontoalltheotherrightsandremediesavailabletotheCityunderthisordinanceoranyotherstatutoryorcommonlawandshallnotrequireanexclusiveelectionofsuchremediesSection34PenaltiesforUnauthorizedReceiptofGranteesServicesEverypersonwhoknowinglyandwillfullymakesunauthorizedconnectionwhetherphysicalelectricallyorinductivelyOrattachesanyunauthorizeddeviceordevicestoanycablewireorothercomponentofafranchisecabletelevisionsystemunderthisordinanceortoatelevisionsystemwhichsuchpersonisnotauthorizedtoreceiveshallbeguiltyof
