CITYOFMEDINAORDINANCENO378AnordinancerepealingOrdinanceNo282andMedinacodeChapter97andestablishingregulationsgoverningremovalandtrimmingoftreesgrowinginthepublicrightsofwayTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1PurposeandPolicyDeclaredThisordinanceisenactedasanexerciseofthepolicepowerOftheCityofMedinatoprotectandpreservethepublicpeacehealthsafetyandwelfareItsprovisionsshallbeliberallyconstruedfortheaccomplishmentOfthesepurposesItisinthepublicinterestofthecitizensofMedinatoregulateremovalandtrimmingoftreeswithinthepublicrightsofwayinordertopreventtheneedlessremovaloftreeswhichformanimportantpartofthebeautificationofthepublicstreetsandadjoiningpropertiesandtoallowremovalOrtrimmingoftreesinthepublicrightsofwaywhichblockviewsorlightimpairsightdistancesfordriverscreatepotentialhazardstousersOfthepublicrightsofwayandownersofadjoiningpropertyorwhichmycausesimilarnuisancesorhazardsThisordinanceisintendedtobealawofgeneralapplicationforthepublicatlargeitisnotintendedfortheparticularbenefitofanyindividualpersonorroupofpersonsOtherthanthegeneralpublicanditisnotintendedtoimposeliabilityontheCityofMedinaoritsofficersoritsemployeesrunningtoindividualmembersofthepublicNothingcontainedinthisordinanceisintendedtobenorshallbeconstruedtocreateorformthebasisforanyliabilityonthepartoftheCityofMedinaoritsofficersemployeesoragentsforanyinjuryOrdeanageresultingfromanypersonsfailuretocomplywiththeprovisionsofthisordinanceorbyreasonoforinconsequenceofanyactorommissioninconnectionwiththeimplementationorenforcementofthisordinanceSection2PermitRequiredNotreelocatedinaCityrightofwaywhichisgreaterthanfourinches4indiametermaasuredtwentyfourinches24fromthegroundatthebaseofsaidtreeshallbetrimmedorremovedwithoutfirstobtainingapermitwhichmustbeapprovedbytheMedinaPlanningCommissionorbyasubcommitteethereofconsistingofnotlessthanthree3membersappointedbythechairmanofthePlanningCommissionassetforthhereinSection3ApplicantsAnypersonmaysubmitanapplicationtoremoveortrimtreesorothersightobscuringshrubberywhichisgreaterthantenfeet10inheightgrowinginthepublicrightsofwaywhichblocktheapplicantsviewobstructsunlightimpairsightdistancesatdrivewaysorintersectionsorcreatepotentialhazardstolifeorpropertyAnypersonwhoownsrealpropertywhichbordersuponthepublicrightofwaymaysubmitanapplicationtotrimorremovetreesorshrubberyintherightofwaycontiguoustotheapplicantspropertyforanyreason Section4ConsiderationofApplicationAllapplicationsforpermitsfortreeremovalortrimmingshallbeconsideredbytheMedinaPlanningCommissionorbyasubconnitteeofthePlanningCgmmissionconsistingofnotlessthanthree3membersOfthePlanningCommissionchosenbythechairmanoractingchairmanatanyregularmeetingofthePlanningCommissionAllapplicationsshallbeconsideredatapublichearingtobeheldimmediatelyfollowingtheregularlyscheduledmonthlymeetingsofthePlanningCommissionSection5FormofApplicationsAllapplicationsshallbesubmittedtotheCityClerkonformsprovidedbytheCityandshallcontainthefollowinginformationaStreetaddressorlocationdescriptionofpropertyadjoiningtherightofwaybNameandaddressofpersonrequestingthepermitcAreamapshowingtheapplicantspropertytheareaofrightofwaycontainingthetreeortreesunderconsiderationandanyproprtiesadjacenttosaidrightofwaydTopographicmapatascaleofnotlessthanoneinchlequalsonehundredfeet100showingthelocationofthetreeortreesunderconsiderationandthelocationofbuildingsOrstructuresOnallpropertiesadjacenttotherightofwayeThenumberlocationdiameteratapproximatelytwentyfourinches24fromthegroundlevelapproximateheightconditionandtypeoftreeortreesunderconsiderationfAwrittenstatementfromtheapplicantdescribingthebasisforthereliefrequestedgUponrequesttheapplicantshallsubmitsuchfurtherinformationasmaybedeemednecessaryorusefulbythePlanningComissionAllapplicationsforpermitsunderthisordinanceshallbefiledwiththeCityClerkatleastthirty30dayspriortothehearingatwhichitistobeconsideredAfeeoftmltydollars2000shallbepaidatthetimetheapplicationisfiledprovidedthatnofeeshallberequiredforapplicationsinwhichreliefisrequestedsolelyforpurposesofpublicsafetySection6RequirementsforApprovalNoapplicationfiledunderthisordinanceshallbeapprovedunlessamajorityoftheplanningcommissionorofanysubcommitteeappointedtherefromdeterminethattheapplicationmeetsthefollowingminimumrequirementsaTheapplicationiscompatiblewiththeintentoftheComprehensivePlanofMedinabTheapplicationisconsistentwiththepublicinterestinmaintaininganattractiveandsafeenvironmentcTheapplicationhasnomateriallydetrimental
