HomeMy WebLinkAboutOrdinance No. 0396CITYOFMEDINAORDINANCENO396ANORDINANCEESTABLISHINGREGULATIONSUPONTRENCHCUTTINGINCITYSTREETSTHECITYCOUNCILOFMEDINADOORDAINASFOLLOWSSECTION1RegulationsonTrenchCuttinginCityGtreetsAlltrenchcuttingwithinthepavedportionofstreetsoftheCityofMedinashallcomplywiththefollowingrequirementsaMethodofCuttingAlltrenchcutsshallbemadeinasolidstraightlinewithasawNOtrenchshallbecutwithajackhamerpickOrbyanyskipcuttingmethodThisparagraphshallnotapplywhereafullwidthoverlayisrequiredbOverlayRequirementonLongitudinalCutsAnylongitudinaltrenchcutinexcessofonehundred100feetmustbecoveredbyafullwidthoverlayoftheroadwaysurfaceSaidoverlayshallcomplywithallapplicablecitystreetrequirementsandshallextendten10feetbeyondeachendofthelongitudlnalcutcBackfillingAllbackfillmaterialmustbefreedraininggranularmaterialfreeofdebrisandclayAllbackfillmaterialshallbecompactedbyamechanicalcompactortoninetyfive95percentofmaximumdensitytobedeterminedinaccordancewithASTMdesignationD1557inonefootstagestowithinfourinchesoftheexistingroadgradedTackCoatTackcoatshallbeappliedonalledgesofthecutsurfaceeTemporaryPatchAtemporarypatchconsistingoffour4inchesOfClassBasphalticconcreteshallbeplacedinthecutbringingtheexcavatedareabacktothegradeoftheroadfPermanentPatchAftersettlementiscompleteandaminimumOfthree3monthshaselapsedthetemporarypatchshallbereplacedwithapermanentpatchThispermanentpatchshallconsistofClassBaspbalticconcreteThepermanentpatchshallextendatleasttwo2feetbeyondeithersideofthetrenchAllcuttingOfthepermanentpatchperimetersshallmeettherequirementssetforthhereinregardingthemethodofcuttingendtherequirementoftackcoatApatchofatleastOneandOnehalf112inchesofClassBaspbalticconcreteshallbeinstalledrolledandbroughtuptotheexistingroadwaygradegFeeA50nonrefundablefeewillberequiredforeachtrenchcutinadditiontothecostofinspectionandtestingdescribedinMedinaCodeSection9424hBondAllpersonsseekingtoObtainapermitforatrenchcutmustpostabondinthea3untof1000withtheCity ClerkspecifyingthattheroadwaysurfacewillberepairedtothesatisfactionoftheCityEngineerSaidbondswillnotbereleaseduntilatleastthree3monthshaveelapsedfromtheinstallationofthepermanentpatchandsaidpermanentpatchhasbeenapprovedbytheCityEngineerOrtheCityManagerSaidbondshallnotberequiredfromanypublicutilityiTheCityEngineerorCityManagermayapprovevariancesfromtheseregulationsiftheyaresatisfiedthatthealternativesproposedwilladequatelyprotectorrepairtheCitystreetSECTIONIICodeReferenceSectionIhereofshallbecomeSection9426oftheMedinaCityCodeSECTIONIIIEffectiveDateThisordinanceshalltakeeffectfromandafterthe9thdayofJuly1984PASSEDBYTHECITYCOUNCILONTEEllthDAYOFJUNE1984ANDSIGNEDINAUTHENTICATIONiFSUCHPASTMISANEDAYDellaMWyattcityeerkkrkApprovedastoformKirkRWinesCityAttorney
