CITYOFMEDINAORDINANCENO429ANORDINANCEFORTHEPURPOSEOFREGULATINGTHETYPESIZELOCATIONCONSTRUCTIONANDPLACEMENTOFSIGNSINTHECITYOFMEDINAWHEREAStheCityofMedinaisalmostexclusivelyasinglefamilyresidentialcommunityandWHEREASthecityisnearlyfullydevelopedunderapplicablezoningandlanduseordinancesandregulationsandWHEREASthequietsuburbancharacteroftheCityisoneofthechiefattractionstoresidentsandWHERKAStheaestheticappearanceoftheCityaffectsitssuburbanresidentialcharacterandWHEREASthetypesizelocationconstructionandplacementofsignsmayhavesignificantvisualimpactontheaestheticappearanceoftheCityamawholethereforeTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWHSection1GeneralNosignorsignsofanykindshallbeerectedandordisplayedormaintainedwithintheCityofMedinaexceptasheroinafterprovidedinthisordinanceSection2DefinitionsForthepurposeofinterpretingandapplyingthisordinancethefollowingdefinitionsshallapply21SiqnAnymediumvisibletothepublicincludingitsstructureandcomponentpartswhichisusedorintendedtobeusedoutofdoorstoconveyamessagetothepublicorotherwiseattractattentiontoitssubjectmatterforadvertisingoranyotherpurposes22PermanentSianAnysignwhichisaffixeddirectlyorindirectlytothegroundortoanypermanentstructureorbuildingincludingfencesinsuchamannerthatitcannotbemovedortransportedwitheaseandwhichieintendedtoremaininonelocationandpositionforanextendedperiodoftime23TemporarySiGnAnysignwhichisnotpermanentlyaffixeddirectlyorindirectlytothegroundoranypermanantstructureorbufldingandwhichiscapableofbeingmovedortransportedWitheaseSection3SubdivisionandNeiGhborhoodSfansInasubdividedareaorneighborhoodinvolvingeight8ormorehomesoneifreestandingpermanentsignmaybeerectedforthepurposeofidentifyingthesubdivisionorneighborhoodTemporarysubdivisionorneighborhoodsignsareprohibited31Subdivisionandorneighborhoodsignsshallcontainthenameoftheplatsubdivisionorneighborhoodonly32Subdivisionandorneighborhoodsignsshallbeplacedonlyonprivatepropertyatornearthemainpointofentryforvehiclestothesubdivisionorneighborhoodexceptthati suchasignmaybeplacedintheunpavedportionofCityrightofwaypursuanttoarevocablelicenseobtainedfromtheCityonsuchtermsandconditionsastheCityCouncildeesappropriate33Subdivisionandorneighborhoodsignsshallbeconstructedofwoodornaturalstoneoracombinationthereofexclusiveoffasteningspipesetcusedtoattachsaidsigntothegroundoritsbaseandshallhaveanareanotexceedingtwelve12squarefeetHeightofthesignshallnotexceedfour4feetmeasuredatthehighestpointofthesignfromthelowestpointofthenaturalexistinggradedirectlybelowthesignoranypartthereof34SubdivisionorneighborhoodsignsshallbemaintainedingoodconditionandrepairatalltimesIfsuchsignsarenotproperlymaintainedtheCitymayuponthirty30dayswrittennotificationbytheCityoritsauthorizedrepresentativecremployeetotheownerofthepropertyunderlyingthesignortotheomeroftheadjacentpropertyifthesignIslocatedinacityrightofwayrepairorremovethesignattheexpenseofsaidownerIfthecostsincurredbytheCitytorepairorremovethesignarenotpaidwithinthirty30daysofpresentationofaninvoicetothepropertyownerorresidentofthesubjectpropertytheCitymayfilealienonthepropertywhichmaybeforeclosedasamortgagetorecoversuchcostspluscourtcostsandattorneyefees35Subdivisionandneighborhoodsignsshallnotcontainanyadvertisingphonenumbernameofdeveloperarchitectorotherpersonorentity36Subdivisionorneighborhoodsignsmaynotbeaffixedtoanybuildinggaragefenceorotherstructureincidentaltoaresidentialdwelling37Subdivisionorneighborhoodsignsshallnotbeplacedcloserthanfive5feettoanypavedportionofapublicrtghtofwmyasmeasuredattheclosestpoint38Illuminatedsubdivisionorneighborhoodsignsareprohibitedwhetherilluminatedinternallyorotherwise39NosignpermittedunderthissectionshallbeerectedwithoutfirstobtainingapermitasprovidedinSection10ofthisordinanceSection4PoliticalSigns41PoliticalsignsmaybeplacedonprivatepropertyorinthestreetrightofwaywithpermissionoftheabuttingpropertyownerTheownerthereofshallberesponsibleforremovalofsaidsignswithinfortyeight48hoursfollowingtheelectiontowhichtheypertain42Politicalsignsmaynotbeerectedmorethanfortyfive45dayspriortotheelectiontowhichtheypertain43PoliticalsignsmustpertaintoaspecificelectionIssueorcandidateandmustcomplywiththeprovisionsofRCW4217510andanyotherstatestatutesorregulationsregulatingcampaignadvertisingastheymaybeenactedoramendedfromtimetotime2 63videdhoweverthatsuchsignsshallnotexceedtwo2squarefeetCommercialRealEstateStns631NopermanentcommercialrealestatesignsarepermittedwithintheCity632OnetemporarysignshallbeallowedoneachparceltractlotsiteorhometheboundariesOfwhichhavepreviouslybeenestablishedasamatterofrecordintheofficeoftheKingCountyAuditoreitherbythefilingofanapprovedplatorbyanymethodofrealpropertyconveyancefromonepartytoanotherasauthorizedbythelawsoftheStateofWashingtonforthepurposeofadvertisingitforsaleorrent633Saidsignsshallbeofdimensionsnolargerthansix6squarefeetandshallbeforthesolepurposeofadvertisingsaidparceltractlotsiteorhomeforrentorsale634Signsmustberemovedwithinthree3daysoftherentalortheclosingofthesaleofsaidproperty638Thetopofsaidsignsincludinganystructureandcomponentpartsshallbenomorethansix6feetaboveground636Inthecaseofwaterfrontpropertyasecondconformingsignwillbeallowedeitherattheendofthedockoratthelakefront637Portabletemporarytypesignsmaynotbeutilizedinconnectionwithopenhousesalescampaignsorforanyotherpurpose638NonconformingstnsmayberemovedbytheCityofMedtnaoritsauthorizedrepresentativeoremployeeattheexpenseoftheowneroftheunderlyingpropertyorhisagentThisshallbeinadditiontoanypenaltyforerectinganonconformingsignasprovidedbythisordinance639NopermitisrequiredfortemporarycommercialrealestatesignsotherwisecomplyingwiththisSectionSection7StartsforSchoolsChurchesandClubs71Schoolschurchesandclubsmayerectone1freestandingpermanentsignlocatedontheirpropertywhichshallconformtotheconstructionsizeheightandmaintenancerequirementsforsubdivisionsandneighborhoodsignssetforthinSection3ofthisordinance72InadditionclubsshallbeallowedonepermanentoffsitesignfordirectionalpurposesandcontainingonlythenameoftheclubSuchsignshallnotexceedeightsquarefeetinareashallnotbelightedandmaybeerectedonlyonprivatepropertywiththeconsentoftheownerorthepublicrightofwaypursuanttoarevocablelicenseobtainedfromtheCityonsuchtermsandconditionsastheCityCouncildeemsappropriate 73NosignpermittedunderthissectionshallbeerectedwithoutfirstobtainingapermitasprovidedinSeCtionlOofthisordinanceSection8MunicialSiena81NothinginthisordinanceshallrestrictthepostingofsignsbytheCityofMadinsoritsauthorizedrepresentativesforthesafetyconvenienceorinformationofitscitizensSection9NiscellaneousProvisions91NosignsshallbeerectedormaintainedonparksotherpublicpropertyorrightsofwayexceptasspecificallypermittedinthisordinanceNosignshallbeerectedormaintatnedonprivatepropertywithouttheconsentoftheownerthereof92Nosignsofanykindshallbepostedontrafficorsafetysignposts93Nosignsanybeplacedinoronvehiclesvisiblefromanypublicpropertyorrightofwayexceptonesignpervehiclenotexceedingone1squarefootadvertisingsuchvehicleforsale94TemporarysignsforcommunityreligiousoreducationalpurposesmaybeerectedwiththepermissionoftheCityNsnagerforaperiodnottoexceedfifteen15daysSuchsignsmaynotexceedtwelve12squarefeetinareaandfive5innumberThepermissionoftheCityNunsgetunderthisSectionmustbeinwritingNopermitfeeisrequiredforsuchsignsSection10ConditionalUsePermitsFees101ConditionalUsePermitReGutredAnypermanentsignrequiringapermitshallbeerectedandmaintainedonlyafterissuanceofavalidpermitthereforspprovedbytheMadinsPlanningCommissionafterafindingbythatCommissionthatitcomplieswithallapplicableregulationsandisofsuchanaturethatitwillnotpresentasignificantsafetyhazardForsuchpurposestheCommissionmayattachreasonableandappropriateconditionswhichshallbeendorseduponthepermitfortheproposedsignAcommercialenterprisemaycombinerequestsformorethanonesigninasingleconditionalusepermitapplication102ConditionalUsePermitFeesApermltfeeofoneHundredDollars10000shallbepaidtotheCitybytheapplicantforeachpermanentsigntobeerectedoralteredrequiringspermitThepermitfeeisnonrefundable103PhotoGraphReauiredAphotographofeachpermanentsignerectedpursuanttosuchpermitshallbefliedwiththeCitywithinten10daysfollowingItserectionSection11ExistingSicmsThisordinanceshallnotapplytopermanentsignsinplaceonorbeforeJuneI1989anderectedinconformitywiththenapplicableordinancesandregulationsunlesstheuserofsaidsignwishestochangethelocationshapedimensionsorcontentofsaidsignorfallstokeepitingoodrepairinsuchcasesthesignaschangedmustcomplywiththeapplicableprovisionsofthisordinanceIncluding6
