ANonConformingUseAnyuseoflandwithintheCitynotpermittedunderthecurrentordinancesinforceinthelandUsedistrictwheresuchuseislocatedBNonConformingStructureAnybuildingorstructurewithintheCitynotwhollyconformingtothecurrentzoningandlanduseregulationsinforceinthelandusedistrictinwhichthebuildingorstructureislocatedwhetherornotsuchnonconformxtywaspermittedbyavarianceCTrueValueofBuildingorStructureTheassesedvaluefortaxpurl3osesofthebuildingorstructureintheconditionexistingatthetimeofmakingapplicationforabuildingpermitDCostofConstructionincludingmaintenanceandrepairsThetruevalueintheopenmarketofallworkrequiredtoaccomplishtheproposedconstructionasdefinedbytheUniformBuildingCodeforthepurposeofcomputingbuildingpermitfeesThetruevalueshallincludereasonabletruemarketvalueformaterialsandlaborandincludefifteenpercent15additionalfornormalcontractorprofitandoverheadbutexcludeWashingtonStateandlocalsalestaxesEReconstructionMaintenancerepairalterationsadditionsimprovementsandassociatedworktheaggregatevalueofwhichexceedssixtypercent60ofthetruevalueoftheexistingbuildingorstructure1760020RegulationofNonConformingUsesAAnonconformingusewhichlawfullyexistedpriortotheeffectivedateoftheordinanceregulatingsuchuseisherebypermittedtocontinueandbemaintainedandoperatedinaccordancewiththissectionBAnonconformingusethathasbeendiscontinuedforaperiodofthirty30daysormoreisherebydeclaredtobeabandonedandtheabandonednonconforminguseshallnotsubseguentlybepermittedwithoutapprovalgrantedthroughthespecialuseorconditionalusepermitprocessoftheCityofMedinaCAbuildingorstructurecontainingorusedinsupportofanonconformingusemaybeordinarilymaintainedandrepairedto itsoriginalconditionandforthepermittedusewithlikematerialsandconstructionmethodsbutmaynotbealteredimprovedenlargedexpandedorreconstructedwithoutapprovalgrantedthroughthespecialuseorconditionalusepermitprocessoftheCityofMedinaDOrdinarymaintenanceandrepairshallnotexceedtwentyfivepercent25ofthetruevalueofthebuildingorstructureinanyonecalendaryearEWheneverabuildingorstructurecontainingorusedinsuportofanonconforminguseisbyrulingofthebuildingoffYcialdestroyeddamagedorthedeterioratedtopointwhererepairswouldcostinexcessofsixtypercent60ofitstruevalueanysubsequentuseofthebuildingorstructuretocontainorsupportthenonconforminguseisnotpermittedwithoutaprovalgrantedthroughthespecialusepermitprocessoftheCYtyofMedinaFAnonconformingusemaynotbeincreasedenlargedorexpandedwithoutapprovalgrantedthroughthespecialuseorconditionalusepermitprocessoftheCityofMedina1760030RegulationofNonConformingStructuresAAnynonconformingstructurewhichcompliedwithzoningandlanduseregulationspriortotheeffectivedateoftheordinancewithwhichitdoesnotconformisherebypermittedtocontinueandbemaintainedinaccordancewiththissectionBAnonconformingstructuremaybemaintainedrepairedalteredimprovedremodeledexpandedenlargedorreconstructedifthenonconformingconditioniseliminatedaspartoftheworktobeperformedCAnonconformingstructuemaintainingtheconditionofnonconformityshallnotbereconstructedwithoutavarianceDAnonconformingstructuremaintainingtheconditionOfnonconformitymaybeexpandedorenlargedwithoutthenecessityofavarianceonlyunderthefollowingconditions1Anyadditiontotheexistingstructureconformsinallrespectstothecurrentlanduseregulationsofthelandusedistrictincludingbutnotlimitedtosetbacksheightandlotcoverageanddoesnotincreaseany existingnonconformity2TheexistingstructuretoremainiflocatedonabuildingsiteintheR16orR20districtsandqualifyingforproportionalsetbacksmaynothavesetbacksoflessthantwenty20feetastofrontfifteen15feetastorearandfive5feetastosidemeasuredfromtheestablishedpropertylinestothefurtherestextentoftheexistingstructure3Theexistingstructuretoremainmaynotexceedeitherthirty30feetinheightmeasuredfromthehighpointoforiginalgradeatpointofcontactwiththebuildingwallorthirtysix36feetinheightmeasuredfromthelowpointoforiginalgradeatpointofcontactwiththebuildingwalltothehighestpointoftheroofproperorparapetwallexclusiveofchimneysorantennae4Thetotalproposedlotcoverageofallstructuresonthesitedoesnotexceedthecoverageallowableundercurrentregulationsforthelandusedistrictinwhichthesiteislocated5TheCityPlanningConsultantdeterminesthatthecombinationoftheexistingnonconformingstructureandtheproposedexpansionandorenlargementdoesnotcreateaconditionwhichwillhaveanadverseeffectonadjacentpropertiesorcreateaprecedentdetrimentaltotheMedinacommunityBeforemakinganysuchdecisionthePlanningConsultantshallcausethepropertytobepostedinaconspicuouslocationforatleastseven7daysdescribingtheproposalandadvisingthatdetailedplansareavailableatCityHallThedecisionofthePlanningConsultantmaybeappealedtotheMedinaBoardofAdjustmentwithinten10daysfromthedateofthedecisionbyanyaggrievedpartyAnypersonmayfileawrittenreuestatCityHallforacopyofthePlanningConsultantTsdecisionETheadministrativereviewfeemaybeappliedtowardthefeeforavarianceiftheCityPlanningConsultantdeniestheapplicationandtheapplicantseeksavarianceSection2EffectiveDateThisordinanceshalltakeeffectfive5daysafteritspublicationorthepublicationofasummaryofitsintentandcontent
