HomeMy WebLinkAboutOrdinance No. 0510CITYOFMEDINAORDINANCENO510ANORDINANCEprohibitingtheplacementofresidentialyardwasteinsolidwasteorrecyclingcontainersforcollectionbycityliaenseddisposalcompanyWHEREASChapter7095RCWasamendedbytheWasteNotWashingtonActSHB1671requiresthattheCountyComprehensiveSolidWasteManagementPlanincludestrateEiesandproceduresforreductionofsolidwasteandforthecollectionofsourceseparatedrecyclablematerialsformresidencesintheurbanareaandWHEREAStheCityhasagreedtocooperatewithKingCountyinimplementingsolidwastereductionandrecyclingprogramsthroughimplementationoftheComprehensiveSolidWasteManagementPlanandWHEREAStheCountyhasestablishedagoalofa65percentreductionofthewastestreambytheyear2000witha35percentreductionby1992andWHEREASoneofthemethodsproposedtoachievewastestreamreductiongoalsistorequireseparationofyardwastefromsolidwasteandtoseparatelycollectyardwasteandsolidwasteNOWTHEREFORETHECITYCOUNCILOFTHECITYOFMEDINAWASHINGTONDOORDAINASFOLLOWSSection1DefinitionsForpurposesofthisordinancethefollowingwordsshallhavethemeaninghereinafterprovidedISolidwasteasusedhereinshallmeanandincludeallgarbagerubbishtrashrefusedebrisscrapwastematerialsanddtsaardedmaterialsofalltypeswhatsoeverexceptthefollowlng1hazardouswastes2reeyelablematerialsend3yardwaste2YardwasteasusedhereinshallmeanandIncludematerialssuchassodErassweedsflowersaswellasbranchesandpruningslessthan3inchesindiameterItexaludesfoodwasteplasticsandsyntheticfiberslumberanywoodortreelimbsoverthreeinchesindiameterorthreefeetinlengthandsoilcontaminatedwithhazardouswasteSection2zThedepositofyardwasteinsolidwastecontainersorracyosTinEcontainersforeolleetionbylicensedcollectionserviceisprohibitedNosolidwastenorreeycleblematerialthataremixedwithyardwastewillbecollectedbylicensedsoilactionserviceYardwastewillonlybecollectedbysalientionserviceiftheyardwasteisseparatedandcontainedinapprovedcontainersorbundledinanapprovedmannerandtheresidentisparticipatingintheCitysyardwastecollectionprogramSection3ViolationofSection2ofthisordinanceshallnonstituteaninfractionpunishablebyafinenottoexceed10000SectiontTheCityManagerofhisdesigneeisauthorizedanddirectedtotakeallsetionnecessarytoimplementtheprovisionsofthisordinanceincludingtheamendmentofanysolidwasterecyclingoryardwasteagreementnecessarytoachievethepurposesofthisordinanceandtomodifyorestablishnewrulesforthecollectionofsolidwasterecyolablematerialsoryardwaste Section5EffectiveDateThisordinanceshallnottakeeffectuntilfive5daysafteritspublicationorthepublicationofasummaryofitsintentandcontentnoruntilq5daysafternoticehasbeenpublishedintheCitysofficialnewspaperthatayardwastecollectionprogramisavailabletotheresidentsoftheCityPASSEDBYAFFIRMATIVEVOTESOFAMAJORITYOFTHECITYCOUNCILONTHE14thDAYOFMay1990ANDSIGNEDINAUTHEITIONOFSUCHPASSAGETHE14thDAYOFMay1990ApprovedastoformAttest
